You're missing a really important word, which I reverse highlighted in white:

UNLESS.

If you learn to read legalese you'll find that little words are important. Worlds of difference exist between 'may', 'shall' and 'must'. It's vital to pay attention to those words, including 'UNLESS'. The law reads: you aren't entitled to this defense if you are committing a felony UNLESS ...

The INTENT is clear: if you attempt to rob, or rape, or kill or otherwise seriously harm someone AND ***YOU*** STOP FIGHTING OR AGGRESSING ***THEY*** aren't entitled to vigilante justice: THEY aren't entitled to track YOU down after you stop being a threat and blow you away.

If you are an intended victim you are allowed deadly force in the face of immediate fear. If you are a perpetrator who has stopped perpetrating, you are allowed deadly force in the face of immediate fear. B/c the law is only meant to address immediate fear for life and health.

That means, as SignyM pointed out, assuming there are no witnesses, the person who's alive at the end is the one who gets to tell their story of THEIR immediate fear and why they used deadly force. The immediate fear the other person had becomes irrelevant.

Which is why this law is flawed, and why the jury needed to consider jury nullification. It defies any sense of justice that an armed person tracks down another person at night, shoots them dead, and claims self defense. As I mentioned elsewhere. But jury nullification didn't happen b/c the jury was too white, too female and too compliant towards 'the man'. And Martin was too black, too male, and too much like everything they considered a threat. Also as I mentioned elsewhere.

ETA: And either Zimmerman was very lucky, or he was, as testified, a VERY good student of the syg law, and exploited every crack in the law to his advantage. Given his father is a judge, I think the latter. Which makes him a cold-blooded killer.

So, how do you feel about letting a person like that go free?

I know how to read Florida statute, do it every day. Again the "unless" is in paragraph 2 which is regarding provoking an attack. The "unless" does not cover a person committing a felony.

You are right that law allows individuals who are committing felonies and stop to be attacked. That is a flaw, but the intent was to ensure the statute does not cover people breaking the law.

Yes, the law is too broad. The bar for self-defense claims in Florida is to low. There have been many worse cases in the state than this one. Zimmerman had more evidence to support his claim than many others. Remember there was an eye witness that saw Martin on top of Zimmerman punching him. With that fact Zimmerman is not likely to have been convicted of murder in any state.

As for Zimmerman I am okay with letting him go in light of the alternative. I don't think he is a monster. I don't think he intended to kill anyone. If you think he did I would ask what evidence you have of this? The answer is very little.

Now sure the jury could have nullified the law and found him guilty. It would have been a short lived victory in this case as the lack of evidence would lead to that conviction overturned on appeal.

The "or" only signifies that 1 and 2 are both situation that are not covered. The "unless" only applies to paragraph 2. It applied to both they would not be separate paragraphs. The section would read.

(1) Is attempting to commit, committing, or escaping after the commission of, a forcible felony or, Initially provokes the use of force against himself or herself, UNLESS

That is how it would be written if (a) and (b) applied to both forcible felonies and provocation. There is a reason those two are separated into two separate paragraphs. This is basic outline stuff.

Subparagraphs (a) and (b) only apply to paragraph 2. Or to put it logiclly, Not X if 1 or (2 unless A or B)


This is backed up by chapter 776.013(3) A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.

Consider this:

Would there have been a fight if GZ stays in the car. Wouldn't the 'dangerous' 17-year-old go home. Why is GZ walking around with a gun with the safety off. Was he expecting something dangerous to happen. If that was GZ's voice on the 911 call yelling for help, then why did he stop yelling as soon as the shot was fired. If, as he claims, that he didn't know Treyvon was dead until the cop told him - wouldn't he keep screaming for help from the life or death struggle.

How did GZ know he was up to no good. How did he know that he was high, was he with him when he smoked marijuana. If GZ was really that scared then why didn't he wait for the cops to arrive. If he spread his arms out away from his body, then why did the cops say that they found Treyvon's arms underneath him. If Treyvon really had bashed GZ's head against the concrete 10-12 times, wouldn't he have more than a couple of scrapes and a few lumps on his pointy head. Wouldn't he have a concussion. Wouldn't he have gone to the ER for treatment..........oh yeah, his attorneys admitted he exaggerated his injuries (exaggerated is a nice way of saying he lied).

Could he have, maybe, twisted the truth a little (another nice way of saying he lied). The moment he got out of the car, he started it.

My theory: GZ snuck up on TM from behind and TM spun and popped him in the nose saying "Get off me." GZ grabbed him and they both fell in a heap with GZ hitting his head against the sidewalk. They scuffled, rolling around changing dominant position at various times. GZ reaches for his gun and aims at TM, noticing the gun TM begins to scream for help because he knows he's about to die; because GZ is pointing it right at his chest, he pulls the trigger - direct hit - TM is struck point blank, right through the heart. GZ stands there and watches him die. The police do their damndest to breathe life into the boy. GZ stands there and watches him die.

I submit that it was GZ who uttered those words - "You're gonna die tonight" IN COLD BLOOD.

Sometime physical evidence requires interpretation, or it just isn't sufficient to make a judgement on its own merit. And I suppose that's one of the weaknesses inherent in self defence laws, you may have physical evidence of being attacked, but if you've been in a fight, how do you determine who started it. Not always easy to work out.

Secondly, does physical attack consititute the only threat in a situation. Take ikiki's example, if you threaten someone verbally "i'm going to rape you and then cut out your liver and eat it' or by cornering someone, and they attack you in self defence, and you kill them, how is that going to pan out when self defence laws are broad enough that police might view the scene, say 'meh, you've got some injuries, obviously self defence - see you later pal'
