County in NM starts allowing same sex marriage.

Yesterday, after reviewing state laws, a local County Clerk decided there was no legal reason not to allow same sex-marriage in New Mexico, and immediately started issuing marriage licenses to same-sex applicants.

Upon review, the state Attorney General has stated that he will not block or overturn these marriages, as he feels to do so would be unconstitutional (note, the NM state constitution does NOT include any stipulation for man and woman, just 2 consenting adults).

The AG did say that the State Supreme Court could still over-turn the marriages, and Gov. Martinez has said she thinks the issue should come to a vote, but given the fairly Liberal nature of the state, and the so-far mute response from the anti-equality folk - this has a solid chance of standing.

Wow, what a great way for it to happen...hope it holds.

On the other hand, I can already see plane tickets rolling off the machines for the anti-gay activists to head there and hassle their legislators...

There are efforts to make same-sex marriage legal in New Mexico, but the mostly focus on a judicial effort. Legislative efforts involving same-sex marriage have mainly gone nowhere on either side of the debate.



Heeeeere we go again? Now that someone's actually DONE something, let's see how New Mexico deals with it...

The issue also involves some interesting cultural divides. Much of the Hispanic population is against gay marriage. But the Native American population tends to generally be completely ok with it.

Supposedly a large group of Republican lawmakers in New Mexico are considering filing suit to block county clerks from issuing same-sex marriage licenses, it seems. But the group is now reconsidering its options after a second county clerk was ordered by a state court to begin issuing same sex licenses. That order, by District Judge Sarah Singleton to Santa Fe County Clerk Geraldine Salazar, was issued on Thursday in a lawsuit brought by a gay couple seeking to get married in the state.

Now lawyers on behalf of Sharer are considering new legal options in response to Singleton's court order. We'll see how it goes...

Not surprising. We'll see if t gets much traction. Farmington is an ultra-conservative corner of a fairly liberal state, so the strongest opposition will come from there.

One thing I'm curious about.

Here (in Australia) our marriage laws are Federal -pretty much. So in the US, if I get married in one state and then move to another which doesn't recognise my marriage, then does that impact in any way.

Also doesn't marital status affect things like taxation, eligibility fo social security? I know they do here. What happens then?

Yes, marital status determines a lot of things, some state, some federal, and no, we have no federal marriage "law", so what's valid in one state might not be valid in another. It's a mess. They went through all this with interracial marriage (which, of course, according to the right is "nothing like the same"), now they're going through it again. In New Mexico, the first (I BELIEVE it was the first) same-sex marriage occurred via a lawsuit, which may be why they're letting others.

Just as a follow-up: NM's State Supreme Court just unanimously decided that it was a violation of the State's constitution to block same-sex marriage, and has tossed out all (Republican) lawsuits trying to block it.

It's now the law of the land in New Mexico.
