A federal judge on Monday is set to consider a request from the state of Utah to block gay weddings that have been taking place since Friday when the state's same-sex marriage ban was overturned.

U.S. District Judge Robert J. Shelby ruled Utah's law passed violates gay and lesbian couples' rights under the 14th Amendment.

Lawyers for the state want the ruling put on hold as they appeal the decision that has put Utah in the national spotlight because of its long-standing opposition to gay marriage. Shelby will hold a hearing on the request Monday morning.

On Sunday, a federal appeals court rejected the state's emergency request stay the ruling, saying they couldn't rule on a stay since Shelby hasn't acted on the motion before him.

Following Shelby's surprising ruling Friday afternoon, gay and lesbian couples rushed to a county clerk's office in Salt Lake City to get marriage licenses. More than 100 couples wed as others cheered them on in what became an impromptu celebration an office building about three miles from the headquarters of the Mormon church.

Hundreds of couples are expected to arrive at county clerks offices early Monday morning in hopes of getting marriage licenses before a possible halt if Shelby grants the stay its request. Legal experts say that even if a stay is granted, the licenses that have already been issued will likely still be valid.

For now, a state considered as one of the most conservative in the nation has joined the likes of California and New York to become the 18th state where same-sex couples can legally wed.

Utah is home to The Church of Jesus Christ of Latter-day Saints, which was one of the leading forces behind California's short-lived ban on same-sex marriage, Proposition 8, which voters approved in 2008. The church said Friday that it stands by its support for "traditional marriage" and that it hopes a higher court validates its belief that marriage is between a man and woman.

In Shelby's 53-page ruling, he said the constitutional amendment Utah voters approved in 2004 violates gay and lesbian couples' rights to due process and equal protection under the 14th Amendment. Yeah, after Utah legally said okay to modern polygamy, suddenly the arguments they were making about traditional marriage came across as more irrational than anything. Eventually according to our own legal decisions and precedence and both the state and federal constitutions the judge didn't really have any other choice but to find in favour of the plaintiffs.

The basic jist of both decisions is that if they're adults then their living arrangements are no one else's business. Especially not mewling hand-wringing self-appointed moral guardians.

Though the tax code does legally confine everyone to only ONE reportable partner, but that doesn't affect gay marriage whatsoever. Under the law polygamists will only report one spouse but can now openly be families, and openness with broader society is exactly what those communities need to end abuses that go on.

Anyway it's been a pretty cool month for alternative lifestyles. And a bad month for traditional marriage (and good riddance). The church is showing some hypocrisy here, but even here the church is not all powerful. Social change happens and they will either come to terms with it or be left behind.

“Despite today’s decision, we are hopeful that the lower court’s well-reasoned decision will be upheld in the end and that courts across the country will continue to recognize that all couples should have the freedom to marry," Joshua Block, attorney with the American Civil Liberties Union, said in a statement.

The state argued last week in its high court appeal that "as a result of the district court's injunction, numerous same-sex marriages are now occurring every day in Utah. And each one is an affront... to the interests of the states and its citizens in being able to define marriage through ordinary democratic channels."

The request was presented to Justice Sonia Sotomayor, who asked all her colleagues to weigh in. Monday's order had no noted dissents and can enforced immediately.

More than 900 gay and lesbian couples have married since then.

The high court order will remain in effect until the Denver-based 10th U.S. Circuit Court of Appeals decides whether to uphold Shelby's ruling.

The action now shifts to Denver, where the appeals court will consider arguments from the state against same-sex marriage as well as from the three gay and lesbian couples who challenged the ban in support of Shelby's ruling. The appeals court had twice rebuffed the state's plea to stop gay weddings pending appeal.

Blah blah blah blah hey I know, every time these mormon kids decide they want to get married really young, they should have to pass around a petition to about 100,000 people so it can be included as a proposition in the next voting cycle.

Because who marries who should be decided democratically, and everyone knows highschool romances are valid and forever and everything else isn't.

You can choke on the hypocrisy hereabouts.

I'm assuming you meant "deny", not "deign"... ;o)

And yes, I would imagine that's what it's about...SOME Supremes seem to be willing to look at the legal points rather than following their political agenda, but it's unfortunate it's working out this way, IMO. It will no doubt be reversed, and there's a whole lot of time, money, and bru-ha-ha in between, not to mention those who got married and are now in limbo.
