In a ruling that will constrain future presidents, the court held on a 9-0 vote that the three appointments Obama made to the US National Labor Relations Board (NLRB) in 2012 were unlawful. The decision limits the ability of presidents to make so-called recess appointments without Senate approval.

In the same ruling, on the lesser decision, on 5-4 vote, they said that if the President violates the Constitution by bypassing the Senate in these ways, and if the Senate does not object forcefully enough, that the Constitution is thereby changed.

So, umm, this would be called Atrophy of The Constitution? If a Branch of Government does not exercise it's rights, responsibilities, and duties adequately, The Constitution can be changed by allowing the rights to whither and die?

Have there been other examples of this type of Constitutional change? If enough time expires after being written, without contention, it has become obsolete? I don't recall any other instances of this.

2 bigger points to bring away from the ruling ( ignore the source of the link above ) are that ...

1. Even Obama's hand picked Justices voted against his tyrannical attempt to tell Congress when it is or is not in session

2. The some 1000 rulings the NLRB made with these 3 ILLEGAL appointees may essentially be null and void. We shall see.

I'm sure Obama knew this was coming, and has a back up plan to get around USSC rulings. Don't be surprised if he tries something even more asinine and illegal. Just because he hates being said "NO" to by anyone.

Not sure if this figure is correct.
McConnell capitulated and approved those appointees in his deal, so the rullings between Obama's illegal appointments and McConnell screwing us should be void, but after McConnell screwed us, the rulings may well hold up.

Of course it does not matter that recess appointments have been done this way for many years now and that all the supreme court said was that congress had to be in recess for at least 10 days before a president can make any recess appointments. Also the appointments Obama made that were in question were to the National Labor Relations Board which could not function while the seats Obama filled were empty. Why would the Republicans wish to block them from doing their job? Well we all know the reasons behind that. Many here won't acknowledge it was all an attempt by Republicans to support big business at the expense of the working class.

9 to 0 does suggest those responsible got it wrong. I am not familiar with all twelve times but I will check that out. Justice Roberts was very clear. He wanted this to apply only here for this small company. However the door has been opened and the challenges will be made. Pandora is out of the box. Hobby Lobby is not a religious organization. This ruling in not based on a churches rights to practice its faith. It is based on the man at the top saying in effect, I don’t believe in it so I should not have to do it.

How do you like the fact that the Supreme Court just said if you work for a company the boss, “ who’s faith never mattered before” can now call you into his office and tell you that many of the things in your health insurance policy he does not agree with. You see he believes in sharia law so you can no longer expect coverage for them.

That is what some of you are jumping up and down celebrating. Society gained nothing and the CEO gained a whole new set of ways to challenge regulations put in place for the sake of the general population. Great news right because what we really need in this country are more ways to protect corporations.

Healthcare isn't an actual 'right'. But the Left view that everyone MUST be treated exactly equal, and that the only way to ensure that is the case is for the govt to furnish , or see to it that every 'right' isn't merely available, but offered up to all, for free.

Hobby Lobby offered some 16 of the 20 available contraceptive methods. It didn't DENY anyone who worked for them to have the other four, they just didn't feel it was their duty to supply them. The pill isn't a constitutional RIGHT. You aren't OWED that, by the govt, your employee, or anyone. If you choose to go that route, then fine... you can. But that should be entirely up to you.

It's a bit like claiming the 2nd Amendment is a Right, so all should be offered free guns and ammo. Either by the govt directly, or by the govt forcing your employer to supply them.


This entire issue has been fabricated by Obama, NOT to ensure women get 'reproductive rights ', but as a campaign issue. He had to have known this would not have made it through the USSC. Good for his side if it had, but he was banking on it not, so that he could then fund raise and politic for the next campaign cycle, or more.

The right like to say that is what charities are for. The left say tens of millions fall through the cracks because the money is all tied up in the bank accounts of a few so something must be done. There is no excuse to let people go without health care in a country that has so many resources. Especially when the insurers are immune from the antitrust laws and rig the game. Some women need the pill for other benefits that do not include birth control. It is about those of us who see this differently. I am not a socialist but I do see the need in having social programs to help keep society healthy. Every democracy does. Even with the Supreme Courts ruling the women may still get the coverage. They may extend the provision that they set in place for religious organizations. That, the insurer will cover the cost. They will in fact just raise their rates to cover the cost so hobby lobby will still be paying for the birth control. Ironic isn’t it?

It is not about control but instead what society deems necessary services for their communities or nation to function as a whole.

From there society has every right to tax itself and accumulate funds to provide those services.

Most of what I have suggested about the decision comes from justice Ginsburg who wrote a 35 page decent paper, and constitutional lawyers about what comes next. My point is this. With the blocking of an immigration bill and angry Republican mobs greeting the busses transporting the children illegally flooding the country. With women continually be degraded by the Republican Party, (so much so the women on the Supreme Court are crying foul), and blacks voting predominantly Democratic. Along with 70% of the Asian vote going Democratic the last election. The Republican Party is going to have to deal with Hillary and Bill Clinton in 2016, and with her, the sweeping in of a lot of democrats Into the House and Senate. That’s only two years away.

You may be right about the fall elections. A lot of the country is pretty pissed off.

I don’t have to show myself to be right about the Republicans and women’s issues. It has been the topic of much political analysis and if you are not aware of it, it is because you do not wish to acknowledge it. Fine by me.

2016 is two years off and much can happen. Still I think the people in the middle will control the outcome and it won’t bode well for the Republicans. The only votes they can count on are not enough.
