I do, as well as do many in the legal profession. The evidence coincided with Zimmerman's testimony. Not just his WORD was taken. This was a politically driven witch hunt, and nothing less. The cops initially looked at the evidence, it synced up with the witnesses, the testimony and, as we saw after this meaningless show trial, while tragic, the death was justified.

So would you be okay if a member of your family had been shot and the person who did it was not brought to trial? Would you be satisfied if the police told you it was in self defence even though your relative was unarmed?

I think you'd want some sort of justice played out here. Now even if the evidence was that some sort of self defence was involved, I think a manslaughter charge would have been warranted. But then I am thinking more of system which distinguishes between reasonable force and lethal force, which clearly is not the case - very wrongly - in some states in the US.

To me lethal force is required only if your life is in immediate danger ie someone points a gun at you. Reasonable force (if any self defense was justifiable) might have been hitting Travvon with the gun rather than shooting him.

I have to say I haven't read details of the evidence, so can't argue one way or another, but it seemed to me that if Travvon had lived he might have argued his actions were in self defense as well.

Feeling devastated at the loss of a family member , by what ever means, doesn't justify a lynch mob mentality and skirting the rule of law.

It just doesn't.

The race merchants got exactly what they wanted. An arrest. A trial. A verdict. Hell, 2 out of 3 ain't bad.

You tell me... how many times should George allowed Trayvon to bounce his head off the cement? How long should George have let him rain blows to his face with clinched fists, while lying there, utterly defenseless, before being knocked out ? And then what ? Does Trayvon take George's gun, and kill him right there ? Or does he just leave him in a bloody heap, concussion or worse, for the cops to ( hopefully) find him ?

It was political pressure which got the police chief fired in Sanford. It was political pressure which got GZ arrested in the first place. It was political pressure ( and hubris ) which made the prosecution go for 2nd degree murder, instead of the more realistic charge of manslaughter. I don't disagree that GZ wasn't blameless here. He absolutely did some things which were ill advised, leading up to the confrontation. But his actions didn't warrant being jumped by Trayvon, and then pummeled, while being pinned on the ground.


( And did you see how I made my point w/ out insulting those who want to dismiss the rule of law ? Maybe THAT will sink in to their heads. Maybe )

Half right. Zimmerman had a chance to have the case dismissed based on self-defence but he and his defence team chose to forgo that hearing and go to trial.

In Florida 2nd degree murder come with the less included charge of manslaughter. So the state had no reason just to go for the lesser charge.

You are wrong. Just being approched by someone, even at night, is not enough to claim a reasonable fear for your life. That law is also written in such a way that it does not cover the person who first escalated the encounter. The reason Zimmerman was aquitted however is close to what you are say, he survived to tell his tale. Martin could not refute it.

How the family members feel about a case should have no part in deciding if charges should be filed. Everybody has feelings. The family of Zimmerman has feelings too. Lots of feelings all around and on both sides. The standard for filing charges is not if momma is crying, it is whether or not the state has probable cause to show that a person committed a crime. A prosecutor then has to make the reasoned calculation based upon a full and impartial consideration of the facts if he has the ability to convince a jury (or judge) beyond a reasonable doubt that the defendant committed the offense.

In Zimmerman's case, the basic facts were largely undisputed. There was a fight. Zimmerman was on the bottom getting punched. There were injuries to his head consistant with his statements, he shot and killed Martin during the assault. The ONLY way the prosecutor can prove murder or manslaughter is if Zimmerman in some way started the fight. Following, not illegal. Confronting, not illegal. Zimmerman must have instigated a physical confrontation, if he did not or if you can't prove it, then the case cannot be made. In this case there was no evidence that Zimmerman started the physical confrontation and some evidence that he did not. Given those facts, the case should not have been brought.

Lets say there's no shooting and police arrive to find Martin on top of Zimmerman punching him, who gets charged? Likely Martin, but if police are unsure they refer it to me and I make the call after reviewing the reports and meeting one or both parties (depending on who is pushing for charges and keeping in mind my rule that 'just because your getting your ass kicked does not make you the victim). Lets say police get there sooner still and find Martin and Zimmerman scuffling (still on their feet), who gets charged? Both get may get Disorderly Conducts for mutual combat (very common in bar fight situations and I've gone on to convict both sides in mutual DOCs).

The question in all these case is what can I prove? In this case there was no way to prove any of the charges against Zimmerman because they could never nail down or cast doubt on Zimmerman's assertion of what occured during those four minutes between when the 911 call ended and when the shot was fired. What we do know...all we know is that Martin saw Zimmerman, made a racist comment about him, and then confronted him. This is what Jenteal testified to. Cracker, confrontation, then the call ends. Then nothing until the witnesses start hearing screams and see Martin on top of Zimmerman.

It is not beyond reasonable doubt that Martin saw this "creepy ass cracka" following him, confronted him, then assaulted him. Martin had a history of violence and drug use and even drugs in his system at the time (two key pieces of evidence that were not allowed to the jury).

In the end this is all the product of racial bias. Zimmerman is the victim of the Local, State and Federal govt for prosecuting him for being white...which is ironic because he's hispanic. Martin was a victim of the violent permisive wanna-be gangster culture that has been allowed to corrupt so many of his generation and not confined to his particular race (Hernandez, a former Patriot Tight End, is a good example of this problem).

Its a shame...but not a crying shame.

So you can't kill in self-defense if you are being beaten to death...wow. One thinks of the recent case of the New Jersey woman (white) beaten in her home in front of her 3 year old (on video) by a large black intruder. In your world, she has no right to kill that man to defend herself and her child since...he was unarmed.

As for hitting him with the gun. Bad tactics.

To paraphrase the good captain, if someone is trying to kill you, you can try to kill them right back. I note for the record that likely not one member of the crew would have voted to convict Zimmerman (with the possible exception of the doctor).

Ah...well its nice to know that you can judge someone and make wild 'what if' speculation based on your lack of knowledge of the details of the evidence.

Way to be informed. Good job. Let me note for the record that if Martin lives and gets charged with assault...he pleas guilty and gets probation. If the whole thing is reversed (Zimmerman dies) Martin gets tried as an adult and gets life (or worse) and since he called Zimmerman a cracker he also committed a hate crime (but we don't charge black folks with hate crimes so we'll be satisfied with murder).

Meh, wild speculation is at the basis of all discussions re this case, whether you read the evidence or not.

It's another country, about laws that will never affect me unless I travel to Florida, which is not on my list of places to visit anyway. I was not following the trial outcome with baited breath to see the outcome. I admit this.

So should I not post? Should people only post on issues that they have followed intricately and it great detail. In which case, please go back and delete about 90% of the posts on these boards.

So looking in the from the outside, this case makes no sense. It makes no sense that there was not even some reasonable doubt about Zimmerman's story to not bring it to trial without a bit of fuss being created. I think if you kill someone, even in self defense, the onus is on YOU proving that there was reasonable enough grounds for your actions. That includes you being hit or battered. Plenty of people hit and batter one another and it doesn't end in death. You should have to prove that lethal force was required, and a trial is the fairest way of determining that.

And while victims have no place in determining a trial outcome, they certainly deserve some consideration in legal processes, otherwise why bother?
