Hello,

I just found this story about a young man arrested and sent to jail for a Youtube video. From the context of the story, it does not sound like a copyright violation. Does anyone know the details of this video, the arrest, and the trial?

He apparently filmed a video of himself singing to a first grade class, overdubbed it with sexually explicit lyrics intercut with segments of the children laughing, and posted it on Youtube.

Disturbingly, it is a felony conviction. The article said he video taped a presentation to a first grade class and edited in sexually explicit lyrics.

Oh my God!!!111!!! Someone used teh bad language in connections with de chidrens!!!111!!!

Let's bring that guilty bastard in here and give him a fair trial and right nice hanging!

This is a spoof, a gag... done very well, apparently, ( I've not seen the video, guess I never will ) in which at no time did any minors hear , see or were in any way subjected to vulgar, adult themed lyrics or displays.

Not directly related, but the issue has been brought up on the use of technology and what constitutes actual 'crime'. Such as the use of computer generated images of porn. Pics so life like, but made up of only composites of different 'models' , where no actual individuals were filmed, or recorded, at all.

How can this guy be in trouble when no crime has been committed?

I think youtube does have rules for content. This is groty and not something I think is a good thing, but I don't think he should get arrested since its free speech and the kids didn't really hear those lyrics during the real presentation. I do think though it should be kicked off youtube for content violation. Just because I don't approve of it (which I don't) doesn't mean he should be arrested.

I don't have children, but I would be angry if I saw my child's face in that video.
It would be wise not to mix children with any kind of smut, whether they were subjected to it or not is not the point. Their images were placed with language that was not appropriate to their age.

Hello,

After reviewing the case in more detail, I have come to a personal conclusion about this incident.

What he did was disgusting and morally repugnant, because he misrepresented himself to the people he was filming.

However, the video itself should not be criminal.

I am appalled that this went to trial, and am dismayed that he was found guilty of a crime.

I can imagine people taking a swing at this in civil court, but a criminal conviction shatters much of what remains of my faith in the legal system.

Free Speech means protecting the vile and repugnant speech that inflames your ire and turns your stomach. It is obvious that no one needs to protect universally agreeable speech. The bane of a free society is that you must constantly defend the right to make choices that you personally despise.

If I were a rich man, I might make a career out of challenging this sort of injustice. It would be a righteous hobby.

I think what we're seeing is a pitchfork mob stirred up by a media and fueled by lawyers and policy makers.

This fits an overall pattern of a society intolerant of any independent expression.

A storm is brewing. It may be time to make port elsewhere.
