The Obama administration today announced it will no longer actively seek to deport illegal immigrants who don’t have criminal records and that it will review all existing deportation cases involving non-criminal immigrants on a case-by-case basis.

The news follows months of intense pressure from immigrant advocates who had urged the president to use his administrative authority to refocus the government's limited law enforcement resources while congressional gridlock over a comprehensive immigration system overhaul persists.

The administration has already prioritized the removal of criminal aliens, but today officials took that policy one step further with the promise to review more than 300,000 pending deportations on a case-by-case basis and stay those involving individuals not convicted of crimes.

The Department of Homeland Security said it will also no longer focus its limited resources on apprehending and deporting non-criminals, including young people brought to the country illegally by their parents, military veterans and the spouses of active-duty troops.

“It makes no sense to spend our enforcement resources on these low-priority cases when they could be used with more impact on others, including individuals who have been convicted of serious crimes,” Cecilia Munoz, the administration's director of intergovernmental affairs, wrote in a White House blog post.

“This means more immigration enforcement pressure where it counts the most, and less where it doesn’t," she said. "That’s the smartest way to follow the law while we stay focused on working with the Congress to fix it.”

An administration official said a joint DHS-Justice Department panel will apply a set of criteria to the pending cases, examining a person’s criminal record, his or her contributions to the community, family ties and military service record, all to determine whether or not to put them on hold. Be interested to see what others thing; me, I think it's a good thing. Probably a sop to Hispanic voters, but it makes sense to me.

Freedom is Important because People are Important

Hello,

It is a rather straightforward rule of Triage that when you have too many people to deal with, you prioritize the worst cases that aren't too far gone.

The philosophy works well in virtually any discipline, including the deportation of immigrants.

Which means the 70 year old Mexican granny who is illegally here and illegally babysitting for extra cash gets deported after the rapist, serial killer, gun runner, and gangster.

That we weren't operating this way already is surprising to me.

Until folks get on the ball and pass some sort of comprehensive immigration reform - in whatever shape that finally appears - the current executive rulings are just gonna be a political football...which probably means neither party will want to pass comprehensive immigration reform any time soon.

Plus all governments need a pool of cheap labour as a stick to beat their workers with, which immigrants are ideal for, and a scapegoat when things get hairy, which immigrants are also ideal for.

It makes common sense to go after the worst first, but how often do we see common sense come out of the government? At least this is a step forward...for now.

This is wonderful. Obama and his regime can now be arrested for treason. The punishment for treason is death.

If you are an illegal immigrant and you have not been arrested for committing a crime, the odds that you will ever be deported have now gone way, way down. With the Republicans in control of the House of Representatives, Barack Obama knows that he simply is not going to be able to get amnesty for illegal immigrants passed by Congress. But instead of giving up, Obama has decided to ram amnesty for illegal immigrants down our throats any way that he can. The head of the Department of Homeland Security, Janet Napolitano, has announced that there will now be a case-by-case review of all deportation cases involving illegal immigrants. Those involving "criminals" will be prioritized and almost all the rest will be thrown out. In essence, this is "backdoor amnesty" for illegal immigrants and it also represents a stunning admission by the Obama administration that it is simply going to refuse to enforce our immigration laws.

Yes, deportation cases for criminals should be moved to the top of the list, but openly announcing that almost all other illegal immigrants will not be deported is just going to encourage millions more illegal immigrants to come pouring in to this country.

Government officials have now been given a list of 19 factors to use when deciding whether to use "prosecutorial discretion" in deportation cases.

Essentially, what is going to happen now is that illegal immigrants are going to get to stay in the United States if any of the following apply....

-arrival in the U.S. as a young child

-actively "pursuing an education"

-serving or served in the U.S. military

-spouse of someone in the U.S. military

-18 years old or younger

-"elderly"

-pregnant or nursing

-victim of a "serious crime"

-serious disability or health problem

-caring for a family member with a serious disability or health problem

As you can see, these categories are so broad that almost all illegal immigrants will be able to fit into at least one of them.

Now we are not only going to have "anchor babies", we are also going to have "anchor pregnancies". Millions of women that want to come to this country will soon learn that all they have to do is to somehow get inside our borders and get pregnant and they will be golden. With millions upon millions of promiscuous American men running around, that should not be too hard to do.

Janet Napolitano says that she wants to primarily focus on deporting those that have been convicted of a crime or that pose a "security risk".

But isn't coming into this country illegally a crime?

The funny thing is that many of the elements of this new policy seem to have been lifted almost directly out of the DREAM Act. But the Obama administration knows that passage of the DREAM Act is very unlikely at this point so now it is basically imposing amnesty for illegal immigrants by executive fiat.

Quite a few prominent politicians are already expressing outrage. For example, the following is how Arizona Governor Jan Brewer characterizes this new plan by the Obama administration....

"This plan amounts to backdoor amnesty for hundreds of thousands -- if not millions -- of illegal aliens"

Brewer also feels that Obama needs to be reminded that he is not a king that gets to do whatever he wants.....

"We need to remind President Obama that we elected a president that serves beneath the law and did not anoint a king that is above the law."

Sadly, this is a pattern that we are starting to see with Obama. If there is a law that he does not like, he just declares that he is not going to enforce it and everyone applauds.

People like Obama love to talk about "the rule of law", but whenever it becomes inconvenient for them they quickly discard it.

Dan Stein, the President of the Federation for American Immigration Reform, says that this new policy will essentially open up the floodgates for more illegal immigration....

"In essence, the administration has declared that U.S. immigration is now virtually unlimited to anyone willing to try to enter and only those who commit violent felonies after arrival are subject to enforcement."

Basically, by announcing this policy so openly, the Obama administration has given a huge, flashing green light to millions of potential illegal immigrants.

Obama is also openly pandering for votes in 2012. He is going to need all the help he can get to get re-elected, and this move will definitely get the radical pro-illegal immigration forces on his side.

But refusing to enforce the law in order to get a voting block on your side is no way to run a country.

Now Obama will almost certainly claim that anyone that is for enforcing our immigration laws is against Hispanic people.

But that is complete and utter nonsense. The truth is that God created all of us and we are all equally valuable in His eyes.

That is why the Declaration of Independence says that "all men are created equal".

All people should be loved and all people have great value.

We are a nation of immigrants and we will always need legal immigration.

But what we have now is a system that does not make sense at all. Right now, legal immigrants have to pay outrageous fees and go through months of hell in order to do things legally, and illegal immigrants just have to hop the border and start enjoying the free ride.

Today, far more immigrants move into the United States illegally than come in through the legal process. Now, thanks to Obama, even more people are going to come pouring in illegally.

There is nothing wrong with wanting everyone to come in through the front door.

In fact, it is the only thing that makes sense.

Right now millions upon millions of criminals, drug dealers and gang members are pouring across our poorly guarded border with Mexico. Large numbers of welfare parasites and people with dangerous diseases are also coming across on a regular basis.

Illegal immigration costs our economy billions upon billions of dollars. Illegal immigrants pay next to nothing in taxes, but they have no problem receiving tens of billions of dollars worth of free education benefits, free health care benefits, free housing assistance and free food stamp benefits.

According to a review of U.S. Bureau of Labor Statistics and Census Bureau data, legal and illegal immigrants gained over a million additional jobs between 2008 and 2010 even as millions of American citizens were losing their jobs during that same time period.

The cost of educating the children of illegal immigrants is staggering. It is estimated that U.S. taxpayers spend $12,000,000,000 a year on primary and secondary school education for the children of illegal immigrants.

So is it really unreasonable to ask the federal government to protect our borders, enforce our laws and require that all immigrants come in through the front door?

Well, that may seem like common sense to many of us, but unfortunately the Obama administration has chosen another direction.

So get ready for another huge wave of illegal immigrants.

After word of this new policy gets around, millions of them are going to be headed our way.

Hello,

This may be the first time I've seen Pirate complain about government transparency.

In reading his post, I find that, remarkably, Pirate does not object to prioritizing the deportation of criminals.

Rather, he is upset because this sound and reasonable government policy has been stated openly.

Pirate is afraid that the government transparency on this policy will encourage more immigrants to come over.

Pirate wishes the government was more secretive.

Well, duh. It seems pretty self-evident that some criminals are more criminal than others.

Or are you suggesting that police should stop chasing a serial killer in order to write a ticket for a jaywalker?

I agree that the worst should be deported first, take precidence over the others. The one thing that worries me about this, selfish as it may be, is that if we get too many extra people showing up will we have enough resources for the people who are here legally, whether born here or immigrant. I always hear stories about how in southern California there are too few doctors to see everyone, services are stretched thin, especially medicare, medacal etc. So that's the thing that concerns me. Plus if I go to Ireland and just stay without permission my ass will get kicked to the proverbial curb, why should it be any different here? Now I feel that it is too hard to legally move to Ireland if you're an American, but that's their rules and its their right to make those rules as they see fit and I have to follow them unless I want trouble.

Question: any of you ever actually tried to deal with the process of immigration for real ?

My ex's new husband, you see - immigrated from Canada, he's a friggin Canadian, one of the few countries on the planet we're not currently at odds with, and thus the bullshit involved is kept to a minimum...

That "minimum" being EIGHT three inch thick BOOKS on the subject, and a monstrous MOUNTAIN of non-stop paperwork that borders on, nay, is indeed, downright fucking obscene, for a simple immigration from a friendly country.

Having seen that, I no longer care ONE SINGLE WHIT, if someone is in this country illegally, period.

THAT problem is of OUR making, entire, and honestly I am wholly out of patience with the fuckin INS as it is, up to and including having pulled former rank and clearance* on them when they started some shit over some nitpick of extremely vaguely written paperwork and it was that, let them haul him off, or start deckin people.

*WHY they ain't never revoked it remains, as ever, a mystery to me.
