This just pisses me the hell off - bad enough all the other lies and bullshit, but for fucks sake, if the law does not allow prohibition, abusing the tax code to enforce behavior is just as fuckin illegal.

It's also one of the many reasons I am an Anarchist - the "Rule of Law" doesn't hold an ounce of water when workarounds to violate peoples rights are acknowledged with a nod and a wink, it reduces it all to a fiction, a charade, end of the day, rule of the gun is what it is.

Cigarettes are an unhealthy, stupid habit. It is a product that preys on the weaknesses of mankind.

But so is the use of copious amounts of Butter and Lard.

I think I'll support the right to enjoy a cigarette without being subjected to crippling taxes.

My pancakes and air-chilled fried chicken rely on a free world, absent sin tax prohibition.

Ok, lemme clarify - the reason it ain't been outlawed is cause they'd not ever get the votes for it, so "screw democracy we'll outlaw it anyway with backdoor abuse of the tax code!" - THAT, is bullshit.

And worse, it's asinine puritan first-amendment violatin bullshit cause just like the temperance/teetotaller/prohibition movement it's a tiny minority manipulating THE LAW in an attempt to FORCE THEIR MORALITY down upon others, who may or may not share it.

Tell me, how would YOU feel about say, being charged an excise tax on "secular reading material", hmm ?

Or perhaps a probitive tax on some food or entertainment produce you like, by folks who really want it banned and resort to this kind of chicanery to subvert YOU having any voice at all in the decision within the law ?

Folks go on and on about the supposed "threat" of Sharia Law, without ever realizing that we have our own version right here, both above (Blue Laws) and below the belt - both of which essentially violate both First Amendment Rights, and the basic principles of Life, Liberty, Happiness.

And given how many times, how many EXCUSES about where that money was going to be spent - and then robbed for pork every time the moment your back was turned cause they think you're SO STUPID you'll fall for the same lies over and over again, and that they can squeeze and squeeze indefinately when all that REALLY happens is a booming smuggling industry and much of that so-called windfall going to "enforcement and compliance" in a diminishing returns loss cycle till they wind up with nothing, and then having that bigass hole in their projected budget they come looking for YOU to fill it, oh yeah, brilliant work that...

All cause some assholes think they can manipulate the tax code to enforce THEIR notion of proper behavior.

Well fuck that, I wanna see a $666.00 excise tax on Bibles, given the quanitifiable harm that particular belief inflicts on the mental health of those infected by it, and the disturbance of "second hand preaching" (aka witnessing) being a public nuisance besides, not to mention littering up hotel rooms via the Gideons....

Y'know, my wife quit smoking, finally, about 8 months ago, and she credits the all-natural roll-your-own Ciggy Shack down the road. She went there because they were cheaper - about $15 a carton less - but then found that when she was ready to quit, it was much easier than any time she'd ever tried before. She's certain that it's because of the lack of all the extra chemical additives that Big Tobacco puts in the old-fashioned cigarettes.

So yeah, this kind of backdoor prohibition pisses me off, too, because we've sent several people to such places in hopes that it would enable them to quit smoking eventually as well.


But you'll likely get no support fighting these fuckers. Not until they decide to do the same thing to sodas, french fries, and the Big Mac. *THEN* Americans will shit kittens and gear up for a fight!

I know that no one will like this but I don't mind a bit of taxation on ciggies. I think it should only be done though when people have voted on it, as in the actual populus, not the people in charge. People in my city tend to vote for those things, if the people vote yes then it doesn't bother me, sorry Frem.

Hello,

I think it's easy to empathize with a violated, wounded creature. A bird with a broken wing. A dog with broken ribs that has been kicked by its owner. Even a seated OWS protester who has been maced in the face by the police.

These are living, breathing concepts. We are born and raised to identify with them.

But when people talk about the right to have a drug, or a French fry, or a cigarette, people do not usually imagine a living, breathing concept. They imagine inanimate objects. A scary needle. A greasy spud. A smoking roll of leaves. If they do manage to summon a person to mind, it is always a victim. Someone in the hospital, undergoing surgery with a slim chance of survival. All because of this reprehensible object.

The taking of freedoms is not easily relatable when it takes these forms. This is especially true if these objects have no positive relationships with our lives and our history. Why should anyone want to burn their brains, have a heart attack, or die from lung cancer? My grandpa had a heart attack. My Uncle died of cancer. Outlaw it yesterday! You need me to sign the petition? You need me to punch the ballot? I'm there!

Some freedoms don't seem like they need protecting. They seem to be more trouble than they're worth.

This is all fine and dandy...

Until the freedom in question is ours.

Then we may look around, aghast at what is being done, and wonder why no one is speaking up for us.

But that thing we like to do? We are better off without it.

Six out of ten people agree.

And that's all that matters.

I think Freedom is just a word until you've defended something you don't personally enjoy. Going out on a limb for someone else's rights is particularly difficult when you don't care for the thing in question. Sometimes the thing in question is just other people's favorite route to oblivion.

I defend flag burning, although I've never burned a flag or had the desire to do so. I defend smokers' rights even though I gave it up a few years ago. I defend the rights of people to have access to alcohol, to do drugs if they want to, to have sex with whom they want, provided all involved are consenting adults. Hell, I'll defend a woman's right to wear Spandex™, even though far too often, it's worn by women who really shouldn't be wearing it. I'll defend "gangsta rap" and the Dixie Chicks, because even if I feel much of their music is garbage, I realize that garbage still has the right to be garbage - and I defend my right to change the station!

I'll defend Sarah Palin's right to free speech, and I'll defend the right the rest of us have to ridicule her with gleeful abandon.

As Frem pointed out, this isn't about health or fairness - it's about punishing people for behavior that a vocal few don't approve of. McDonald's kills more people than Phillip Morris or Annheiser Busch. Where is their sin tax?

I wonder if maybe we should start taxing protesters. After all, it's something that the vast majority of people don't do, and don't care if it is taxed. I bet we could erase a chunk of our deficit and help pay for healthcare for the poor if we just taxed every Occupy protester $5000 for a permit to protest.

That's ludicrous, of course, and I'm joking, but it's illustrative of the idea that it's fine to charge outrageous taxes just because most people don't care about a thing. I can't really find in the Constitution where it says that "the Congress shall have the right to tax people whenever they find something the people don't seem to care about."

Hello,

I am personally not approaching this as a conversation about democracy or the United States in particular. I'm sure that the tyranny of the majority is dutifully codified into our laws. I see this more as a general conversation about Freedom.

I think that we should not deprive people of choices just because we don't like their choices. This, I espouse as a philosophy of living with other human beings, and not as a particular quality to any single human government.

I feel it is wrong to force our preferences of behavior onto others. If someone wants to find a lonely place and smoke themselves into an early grave, I will counsel against it. But I won't seek to use any system against them- Even when such systems are available to me. It is every individual's right to abuse themselves in whatever fashion pleases them- according to my philosophy. It is only when they abuse others that I must move to stop them.

No it just says that Congress has the power to tax. Politics says they are going to tax things that the majority of people do not care about. The less people they piss off the more of a chance to get re-elected.
