My SCARY day!

I near killed a man.

My 5 yr old son had been pestering me to take him for a drive in our new 4WD so we went for a drive on a dirt road. We were approaching a left hand bend so I slowed down to 40kph and was way to the left(my side) of the road when a dirtbike rider came screaming towards me cutting the corner leaving himself nowhere to go except straight into the bullbar and under my front wheel. My son was crying and I was mortified about having to go back with him to see this rider who I was sure was dead.

The guy was very lucky to only have what appears to be a broken femur(thigh bone). We had to wait half an hour for the ambulance with this guy in agony then another hour for the police.

The police exhonorated me of all blame and now I have the hassle of trying to get reparations for my damage from an unlicensed/unregistered and uninsured rider..

We only bought the car a week ago..

We were wearing seatbelts and didnt really feel a huge impact. Just like you would expect from an encounter between a 4WD and a motorbike.

It was just a psychologically traumatic event for me and my son.

HARDWARE

If the rider is under 18 you always have the option of pursuing his parents for reimbursement. However, if you have an aftermarket bull bar I can't imagine that you have much damage. I have insurance against uninsured drivers because the world is full of idiots.

I'm glad you and your son are both okay though.

The more I get to know people the more I like my dogs.

Thanks for the kind words guys.

The damage to my car is minimal however I can imagine straightening the bullbar and replacing the plastic trims at front will probably end up costing me some hundreds, just aint right that I should end up out of pocket because of this kamakaze fool..

Anyways it could have been much worse so I should probably count my blessings.

If it's any comfort, the guy won't do again any time soon. A broken femur is no picnic, and the fun of wearing that cast will stay with him for a long time.

In the U.S., your insurance company would pay for the damages and then seek reimbursement from his insurance carrier. Don't know if that's the system wherever you are, though.

Course, if you'd drive on the RIGHT side of the road like civilized people . . . :>)

Here in Australia the regs are much the same. My insurance carrier will do the repairs and pursue him personally for the money but I am still out of pocket 500$ for the insurance excess. I estimate the damage is probably 500$ so either way I lose out..

Trying to sleep last night was difficult, the last few micro seconds before impact kept playing in my mind. I remember hearing the rider scream in terror and seeing his eyeballs turn into huge saucers just before he hit me.

Wow...

Firstly, I am so glad that you and your son are okay. That is the main thing.

Second, that's the worst thing about driving, you cannot control other people.

Third, it does suck that you're now out of pocket. Can you pursue the cost in the civil courts? Considering the police have exonerated you, it shouldn't be too hard.

Insurance companies are made to make life difficult. RACV did something similar to me, too, when my car was stolen. Sure, they paid some, but I got penalised for it and now I have higher premiums, because I've made a claim. Even though it wasn't my fault.

Last, it's no real surprise that you're a little traumatised. You really do need to talk to someone about it, just get it out there.

You were put in a situation where you were responsible for another person's life, not only that but the safety of your son and yourself. It has to be hard.

Wish you well in getting through this.

My youngster and I had been looking forward to getting a 4WD and going some fun places for a while. Its lost its appeal big time for both of us now. My son said to me last night "I dont want to go into the bush anymore daddy" to which I replied "me either mate". Maybe in time.

Frustrating part is I know couldnt possible have driven any safer, it was completely unavoidable for me. I think thats where the real anxiety comes from. If you know you did something wrong then you know how not to repeat the mistake. When you are just at the wrong place at the wrong time it definitely makes you anxious driving again.
