I think he rather misses the entire point of "cruel and unusual punishment" being unconstitutional. As such, no warrants could apply.

Did you miss the memo?

Alan Dershowitz was the man who suggested the policy of torture in the first place. Cheney and Co. sent a letter out to America's "top legal experts" asking how much the US could get away with in interrogation, and how to do it. ç responded "I think we can get away with torture, and I think think it's a good idea." He then told him the basics of how, but the technical details were drawn up by Bybee and Yoo.

I read Dimwitz letter at the time, I don't have a link, but I'm sure it's out there.
