From the article's opening lines:

I found this abominable:

I wonder if there is a similar conduct code that says activities by the school that "dishonor" students are punishable?

Obviously they should get in trouble if they're doing it during school time while they're at school. But what they do on their own time isn't the school's business especially if its a public school. Its possible that a private school could kick them out or punish them for moral turpitude, but public school has no business doing so if it was done on the kids' own time. Its them and their parents who are concerned if its not during school hours.

I find this interesting:
"One of the major issues in the case was whether the girls' pictures qualify as a substantial disruption to school operations, which would then not be protected speech. Simon's opinion said the photo shoots, conducted off school property without portraying any school insignia and not shared with the wider school community, were not such a disruption."

I guess there are limits to free speech. It's all fun and games till somebody gets hurt? What about public teachers posting legal but distasteful photos on their own time? (in the courts) What if it's a private-sector employer? (you are so fired) Man, you have to have a law degree before you do anything.

This whole thing reminds me of a parable from the Gospel of Thomas - you have become as the Pharisees, for you either love the fruit and hate the tree, or hate the fruit and love the tree.

Hello,

If I had my way, all personal-time speech would be absolutely inviolable. If a company wants to control what you say when you go home, they should be forced to pay you for every hour of your speech that they want to control.

And teachers would be able to do porno movies and attend S&M parties in their off-time as long as they did nothing objectionable WHILE AT WORK.

Unfortunately, the world does not seem to share my broader views of freedom.

Once again here we are trying to enforce our own bizarre form of Sharia Law onto kids, and it really does always come back to the same place.

And that's why I held my tongue - I knew good and damn well that Frem was going to say it so much better and more clearly than I could on this matter. And Anthony as well.


I might also bring up Anthony's reference in another thread to the idea of triage; is this really a fight the school district wants to spend its very limited funds fighting? I might be wrong, but I'm guessing that lawyers cost more than teachers; do they really want to pay teams of lawyers to keep fighting this fight, even though they've already been rebuked?
