New Mexico already held a Gay Pride celebration this year, but it needs to hold another one. Proponents of marriage equality who are in official positions have pushed the envelope and started allowing same sex marriages in two counties last week. Republican legislators aside, there’s a mounting sense of jubilation in New Mexico. Not only are the state’s residents applying for marriage licenses in droves, but couples continue to pour in from Texas. Dona Ana Chief Deputy Clerk Mario Jimenez, who has so far granted 90 same-gender licenses, says: "They are traveling to change their lives. And more are coming."

It's fascinating to watch. When Dona Ana County Clerk, Lynn Ellins, planned to begin issuing same-sex marriage licenses, there were couples ready and waiting when the office opened for business on Wednesday. As word got out, others began streaming into Las Cruces from different parts of the state and from Texas, which borders the county. By the end of the day, 40 licenses had been issued to same-gender couples.

New Mexico Attorney General Gary King held a news conference on Wednesday to say that not only does he believe state law doesn’t prohibit same-gender marriages, but also that he won’t challenge any other county clerk who decides to issue licenses to these couples.

Late on the very next day, Thursday, a state judge weighed in on the issue, opening up the process in a second county. District Judge Sarah Singleton issued an order requiring Santa Fe County Clerk Geraldine Salazar to start giving licenses to gay and lesbian couples. The order was the result of a lawsuit that two Santa Fe men filed. It stated that:

… reading a sex or sexual orientation requirement into the laws of New Mexico violates the state constitution, which mandates that ‘equality of rights under law shall not be denied on account of the sex of any person’.
County Clerk Salazar was only too happy to comply. In April, the Santa Fe City Council passed a resolution recognizing same-gender marriage as legal — but Salazar works for the county, not the city.

After the Judge's ruling, on Friday, Salazar kept her office open into the evening to accommodate those who wanted to get married over the weekend. She also sent one of her employees to a local hospital so that a woman who is dying of brain cancer could marry her partner.

Go New Mexico!!! That's so damned simple: "reading a sex or sexual orientation requirement into the laws of New Mexico violates the state constitution, which mandates that ‘equality of rights under law shall not be denied on account of the sex of any person’".

Officials of the Roman Catholic Church, Republican legislators, and the rest of the hard-core right are, of course, having shit-fits and planning "legislation" to stop it. sigh....

And, of course, the right-wing clergy is right there at the forefront, screaming bloody murder (and I do mean "bloody murder"). Anti-gay ‘Christian’ chaplain Gordon Klingenschmitt is livid. The extreme conservative threw yet another temper tantrum over an August ruling by the New Mexico Supreme Court that a photography studio violated the state’s anti-discrimination law when it refused to photograph same-sex weddings.

Citing religious freedom and freedom of the press, Klingenschmitt urged religious wedding photographers to stamp ‘worthy of death’ on all photos taken of same-sex weddings, and claimed on his Pray In Jesus Name internet program that such a ruling amounts to persecuting Christians for exercising their religious beliefs:

Well, this is not the first place and it may not be, sadly, the last place that Christians are punished by law for exercising their religious conscience objections,” the ex-Navy chaplain said. “We do see a demonic spirit of tyranny and persecution — and anti-Christian persecution, which violates our ability to obey God.”



Gotta love that "Christian" spirit!

Maybe on the next page? I've been following it with threads, put up a couple, but they've disappeared down the list. I'm just fascinated by it because it appears to be the ONLY state doing it this way, just accepting that there shouldn't be discrimination because of sex, and curious to see how it turns out.

Meanwhile, now that he's threadjacked us nicely, there's news: One more county has joined the story:

LOS ALAMOS – Los Alamos County Clerk Sharon Stover issued a marriage license to a same-sex couple shortly after a District Court judge ruled she must during a court hearing Wednesday.

Stover, who had denied the couple a marriage license when they applied for one last week, said she based that decision on language contained in state statutes.

But focusing primarily on the law that addresses marriage licenses, Judge Sheri Raphaelson interpreted the language differently. Raphaelson noted that the statute refers only to “the couple” and makes no distinction between male or female.

“There’s nothing that makes a gender distinction in that language,” she said, acknowledging that the marriage application forms issued by the state do ask for the names of the male and female applicant.

The judge also noted that the statute uses the word “shall” in directing county clerks to issue licenses to those who qualify.

“The clerk is required that if any couple asks for a license, then the clerk has no discretion,” she said.

Raphaelson said the statute trumps the form. “If the statute is clear, I don’t need to look any further,” she said.

With the ruling, Los Alamos became the eighth New Mexico county to begin issuing marriage licenses to same-sex couples.

After the hearing, Janet Newton and Maria Thibodeau met Stover at the County Clerk’s Office for a marriage license. They have not set a wedding date.

Although the couple could have gone to another county that already was issuing licenses, Newton said they wanted to do it in Los Alamos, her hometown.

“For me, it was very important for it to be a Los Alamos County license,” she said. “It has a lot of power for anybody who is connected to the community that your community recognizes that it is important to view you as equal.”

The hearing was held a day after Raphaelson ordered Stover to begin issuing marriage licenses to same-sex couples or appear before the court to explain why she wouldn’t.

In refusing to issue the licenses, Los Alamos became the first New Mexico county to defy a court order on same-sex marriage.

Los Alamos County Attorney Rebecca Ehler, who represented Stover at the hearing, first asked the judge for a stay in the matter, citing another case in Bernalillo County that addresses the same issue.

“Whatever is decided here would not resolve the many issues regarding the gay marriage issue,” she said. “The Bernalillo case does.”

Santa Fe attorney Brian Egolf, representing Newton and Thibodeau, argued that staying the case would call for speculation that the New Mexico Supreme Court would soon rule on the matter.

“To ask for a stay on the grounds the Supreme Court may act is not fair,” he said. “Issuing licenses in Los Alamos County would be adding to the list of those (counties) who already have and brings no harm to anyone.” http://www.abqjournal.com/258003/news/clerk-issues-license-for-samesex

Yeah, and as I posted above, there's the CHAPLAIN who said they should now "stamp ‘worthy of death’ on all photos taken of same-sex weddings". Lovely "christian" sentiment (dammit, I said leave the "c" UN-capitalized!).

But yes, if their ruling on that is any indication, it may be a good thing.
