I watched as Ted Cruz appeared on Colbert's Late Show. Here's what I saw and heard:

Cruz went on a tirade about how the Supreme Court is ruining this country with their decision on the Same-Sex marriage. How they are unlawful and illegally issued a law that is unconstitutional.

What?

He said, and I quote: How can 5 attorneys have the right to tell 320 million Americans what to do? They are not elected, but appointed, and shouldn't have that much power or authority over the states. Here's his quote:

“The 10th Amendment states that if the Constitution doesn’t mention it (sic: marriage), it’s a question for the states … I don’t think we should entrust governing our society to five unelected lawyers in Washington,”

Funny thing, I found out that Ted Cruz was once a law clerk working for the (wait for it) Supreme Court. Is he delusional? He's gotta know that the Supreme Court has 9 judges, and not 5 lawyers. They are selected by the president and voted upon by Congress, elected officials, who then confirm their appointment. So they are "elected" into office by the American people via Congress, who are their representatives. But he had to know that, he once worked there. Plus, he should know because it's in the Constitution. Which he claims to adhere to.

He wants the Same-sex Marriage ruling to be overturned based on his wild assumptions (he's purposefully misleading the public and pandering to his base) and wrong-headed notion that the states have the final authority and not the Supreme Court. Well, if we follow that logic then SCOTUS has no legal authority in the Hobby Lobby case. Then that ruling should be rescinded. Nes pa'?

All those who first applauded Colbert's comment about marriage not being in the Constitution should feel like jackasses when Cruz correctly pointed out that ,in such cases, the STATES should decide.

37 states or 74% of states had Legal Same-Sex Marriage prior to the June 26, 2015 Supreme Court Ruling. That was enough consensus for the Supreme Court despite the fact that a Constitutional amendment needs 75% of the States (38 of 50 States). The Supreme Court has made many, many, many decisions in the last 216 years without an amendment even though that kind of legal activism makes Ted Cruz angry, but Ted is always angry about something.

Then who are these 5 attorneys that he's speaking about? You know, the ones he says made the decision that 320 million Americans should not listen to.

Cruz is distorting the 10th Amendment to address the right's penchant for state powers over that of the Federal government. There are certain national laws that the states have no control over, and there are state laws that are specifically the state's jurisdiction. So does the FBI take orders from state & local police? You want to change that? Let's do so all the way down the line.

No more USA; instead the ISA, or Individual States of America. No more Federal taxes, each state can collect their own taxes.

Let's take that further......NY's 20 million people will keep their tax money for NY infrastructure; plus we can charge visitors double when they cross the bridge into NY. Actually, NY for New Yorkers......permit no one that wasn't born and raised here to move in and take jobs away from natural born New Yorkers. If they do want to live and work here they have to pay double the tax natural born NYers pay.

That's 9 judges, not 5 "attorneys." I must have counted wrong, because Ted Cruz is a genius. The SCOTUS is a joke, because they got it all wrong. Including Hobby Lobby. Just for that, we should not pay them any mind, besides, what do they know.
Cruz is a brilliant, genius Congressman and they are only a bunch of lunatic "attorneys."

What our resident geniuses fail to recognize is that Cruz, and others like him, are a bunch of hypocrites. They rail against SCOTUS, POTUS and the Constitution so much that they forget how they got there; by the very document they insist is being used for nefarious reasons.

They are a part of the 3 branches of government, all described, in detail (somewhat) in the Constitution. SCOTUS is an integral part of the checks and balances that govern our American way of life. It's what makes us uniquely American and in a class all our own. Cruz is out to destroy the very core of our way of life. He, and others like him, interpret the document to suit their agendas and unseat the true power of our democracy.....the people.

They are voted in by the people as representatives, who, in turn, vote to confirm the justices that are selected by the POTUS, who also was voted on by the people.
So, ergo, the SCOTUS is democratically voted on by the people because their representatives agreed upon and voted for SCOTUS. That's how democracy works.

My guess is that our brilliant participants are scratching their heads right about now. Democracy........what a concept! Or would you prefer Republic!?

My question to our brilliant contributors is this: Who do you think has more in the brain department: Ted Cruz or Justice Roberts? Think please, before you answer.

I meant that strictly in the pejorative sense. Ted Cruz is a wannabe butt weasel who thinks that he actually has a snowball's chance. He was quietly brown-nosing Trump to try and ride his coattails to the White House. Little does he know that the Real Americans out there totally reject his notion of America's make up. Colbert was right, marriage is never mentioned in the Constitution. So basically it is a moral issue, with a side order of religion thrown in for good measure. There are people out there that want to live FREE, what difference does it make if they are straight or gay? Exhibit A: Bruce Jenner.

"No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice and family," Kennedy wrote. "In forming a marital union, two people become something greater than they once were."

Chief Justice Roberts states that the Constitution has nothing to do with it.

"If you are among the many Americans—of whatever sexual orientation—who favor expanding same-sex marriage, by all means celebrate today's decision. Celebrate the achievement of a desired goal," he wrote. "Celebrate the opportunity for a new expression of commitment to a partner. Celebrate the availability of new benefits. But do not celebrate the Constitution. It had nothing to do with it."

I beg to differ with the Chief Justice, it has everything to do with it. We the People decide, that's how it is written; to

"secure the Blessings of Liberty to ourselves and our Posterity." In broad terms the securing of liberty is a function of the whole Constitution, for the Constitution makes possible the establishment of a government of laws, and liberty without law is meaningless." My question is: Who made this up about marriage being between one man and one woman? Religion, yes. Well then, religion is given specific mention in the Grand document, but were it not for the religious persecution of King George, this would be a moot point. It was addressed for a specific reason. But I have yet another argument, what of the Bible? Aren't moral conservatives transfixed by the Word of God.

Genesis 16:1-4

"Now Sarai Abram's wife bare him no children: and she had an handmaid, an Egyptian, whose name was Hagar. And Sarai said unto Abram, Behold now, the LORD hath restrained me from bearing: I pray thee, go in unto my maid; it may be that I may obtain children by her. And Abram hearkened to the voice of Sarai. And Sarai ... gave her to her husband Abram to be his wife. And he went in unto Hagar, and she conceived."

It was once considered a part of the culture to have more than one wife. Times have indeed changed, and now we have gay couples wishing to marry in the eyes of society and laws of the land. Still though the Chief Justice says that the Constitution has nothing to do with it. I am not versed in the legal entrails of the Constitution, but I do know that this country was born out of a need to be free, free from tyranny. Imagine if good ol' King George did not terrorize the countryside with his strict rules on worshiping. Right now we would be knee deep in religious persecution and public shaming of those who believe. Imagine if the Constitution had banned altogether Freedom of Religion. Nobody in this country can worship as they please or go to church; or worse, they make everyone go to one church, one relgion.

No, the right to marry, or not, belongs to everyone. That's embedded deep in the heart of the Constitution (with apologies to June Hershey).

Shunned by his colleagues, the tea party champion and presidential candidate launched into an hour long stem-winder accusing Republican leaders of “an unprecedented procedural trick,” acting “in the dark of night,” and siding with wealthy donors who “actively despise" the GOP base as “hicks and rubes.”

He also called out Republican Whip John Cornyn — a first in the progressively frosty relationship between the two Texas senators — noting that he was among those who had “voted loudly no” against his gambit risking a government shutdown.

“A voice vote is still a vote,” Cruz noted pointedly. “Even though it’s not a recorded vote.”

If any record was needed to prove Cruz’s growing isolation in the Senate, the exchange Monday evening provided ample evidence. It echoed an earlier floor fight this summer when the first-term senator caused an uproar by calling Republican Leader Mitch McConnell a liar.
