6ix, as a reminder of the real reason why the GOP stands with Kavanaugh's nomination:

Groups like the US Chamber of Commerce are still backing Brett Kavanaugh. Big business knows that Kavanaugh could be a boon to their bottom line.

One of the biggest questions facing the American judiciary is whether the Constitution allows elected representatives to meaningfully regulate the national economy.

Kavanaugh clearly believes it does NOT. He has called the existence of independent regulatory agencies — notably including the Consumer Financial Protection Bureau but potentially the entire alphabet soup of FCC, FTC, CFTC, SEC, FEC, etc. — a “threat to individual liberty.”

But rather than debate this squarely, we are instead faced with grifters like Kavanaugh’s former boss Ken Starr insisting in the pages of the Washington Post that Kavanaugh stands for nothing more than a simple “pro-democracy, let-the-people-govern-themselves vision.”

The truth is quite the opposite — Kavanaugh’s vision, which he shares with Starr and the bulk of the conservative legal academy, is one in which the courts should stand as staunch allies of capital and block any effort at control of big business.

claims that he wasn't there - wherever there was. So, why not have the FBI
investigate and clear his name once and for all. Nobody can lie to the FBI or

back his friend's play? You know, to support his best bud. But no, he's

One more: Why don't the senators in the Judicial Committee request that the
FBI investigate the allegations brought on by these women? What do they have to hide? What are they afraid of? Don't they want to clear his name?

No matter. Once the Dems take over after the mid-terms they will push for
an investigation and testimony from the women. If the charges have merit,
they will push for impeachment of Kavanaugh.

In the Judge Thomas case, Bush called for an investigation to clear his name
and it took 4 days. There were 20 people called to testify, and that included
people in support of Clarence Thomas. And as you know, Thomas found his way
to the Supreme Court.

Something is off.

They don't because they CAN'T. I posted that already: The Senate isn't the FBI's "boss". The directive can only come from the DOJ or the President. They CAN request that the President or the DOJ direct the FBI but they don't have direct control.

Is it possible that she read a description of what somebody said they were told, and then took her (fragmentary) memories and tried fitting those puzzle-pieces to that picture? Did she read the emails first and "reconstruct" her memory afterwards? Or were those independent recollections?

Right now, it's a three-ring circus.

What one has to keep firmly in mind is that an allegation- no matter how shocking and heinous- is just that: an accusation without proof.

As far as the first two allegations are concerned, I think that I have REASONABLE doubts about their accuracy, and that these REASONABLE doubts need to be answered before a conclusion can be reached. Other statements are coming forward about the other allegations, and those need to be sorted out as well.

A poll from Morning Consult/Politico released Wednesday shows that only 49 percent of GOP women support Kavanaugh’s confirmation, and 15 percent oppose it. That’s a drop of 18 points in support from Republican women since last week. And overall, 37 percent of Americans oppose his confirmation; just 34 percent think it’s a good idea.

That’s the point to remember. The allegations against Kavanaugh — and the recriminations they have elicited from Republicans who see him as unfairly maligned — may not affect his confirmation. But they will affect how his jurisprudence as a member of the Supreme Court is seen.

Republicans may think that’s unfair. But if they want Americans to have confidence in the Supreme Court, they should take more care, in the future, to make sure that Americans can have confidence in their nominees.

I heard an interesting segment on NPR a couple of weeks ago, and one of the interviewees said that the Democrats have never focused on the importance of the Supreme Court like the Republicans have.

I have to agree. Just look at what happened since Trump was elected ... it's been RUSSIA!! RUSSIA!! RUSSIA!! 24/7 in their neocon/neoliberal/neo-McCarthyite campaign to get rid of Trump. Now, SUDDENLY, they realize that they face a real crisis (and not just a phony made-up one) with the Supreme Court.

I'm not a fan of the Federalist Society, I hate most of the conservative rulings that they favor, and I just wish that the Dems had made a more adult effort to win their elections instead of playing identity politics.

And BTW they're STILL playing identity politics. Well, they get what they deserve. Too bad we "get" what they deserve too.

There is still hope for Dems, tho. IF they can manage to win enough seats in Congress they can pass legislation which the Supreme Court would have to respond to. One of the reasons why the Supreme Court has so much influence is because Congress has abdicated its power to both the President and the SC by allowing one branch to "enforce" laws which it has not written (for example, immigration reform) and allowing the other branch to "interpret" laws which it has not made explicit. If Congress were to write clear, explicit, comprehensive, proactive legislation ... oh, and btw take back it's duty to declare war ... then the President and SC wouldn't be so influential.

I had to chuckle at that video, KIKI. That pretty much sums up our current political atmosphere. And the Dems? They're more interested in "playing politics" than in governing ... which means "solving real problems".

I actually like a lot of Garland's history, from the short amount that I've read of him before replying here.

The 11 Republicans you speak of would have denied anybody that Obama put up, so I can't say that it was anything personal against Garland himself, other than just being Obama's pick.

Maybe my brain still has some cobwebs since I just woke up, but could somebody explain this little blurb about his stance on the 2nd ammendment:

Emotion aside, was any new evidence presented that bolstered Dr Ford's case? Because aside from her "demeanor" I'm under the impression that we pretty much stand in the same place as before; except that I heard about the calendar (or diary) that Kananaugh kept. (Was in the car so listening to the radio)

I admit I didn't listen much to the hearings except here and there since I was pretty busy. So if something popped up I'd be interested in knowing about it.

He was referring to the judge’s wildly emotional performance, in which he alternated between shouting, as he blamed the Clintons and the Democrats for conspiring to torpedo his nomination to the Supreme Court, and weeping, as he spoke about the pain that he and his family have experienced in the weeks since accusations of sexual assault against him became public. Kavanaugh choked up and sobbed as he described his father’s detailed calendars, which apparently inspired his own calendar-keeping practice; he seemed unable to gain control over himself, gasping and taking frequent sips of water. The initial impression was of naked emotional vulnerability, but Kavanaugh was setting a tone. Embedded in the histrionics were the unmistakable notes of fury and bullying. Kavanaugh shouted over Dianne Feinstein to complain about the “outrage” of not being allowed to testify earlier; when asked about his drinking, by Sheldon Whitehouse, he replied, “I like beer. You like beer? What do you like to drink, Senator?” with a note of aggressive petulance that is hard to square with his preferred self-image of judicious impartiality and pious Sunday churchgoing. When Kavanaugh is not crying or shouting, he uses a distinctly adolescent tone that might best be described as “talking back.” He does not respond to senators. He negs them. His response, when he is asked about his drinking, is to flip the question and ask the senators how they like their alcohol; his refusal to say whether he would coöperate with an F.B.I. investigation brings to mind a teen-ager stonewalling his parents. Since when does the accused get to have a say in whether the FBI investigates? The accused is Kavanaugh and he did not enthusiastically want the FBI to help him get confirmed. He couldn't ask the FBI to question his high school friends about his drinking and sex life. The friends have already answered, but when the FBI asks a question, rather than a reporter, it is a crime to lie to the FBI. Not a crime to lie to a reporter.

Christine Blasey Ford finished testifying, and judging by Twitter and cable, the widespread consensus among neutral observers and even some Republicans has been that she was entirely credible. Ford was endearingly convincing in declaring that her only true motive in coming forward was to help the assembled senators — and the country.

Ford was cautious when navigating the perils of memory, and struck an oddly compelling balance by airing her own emotions while explaining them in the clinical language of a psychology professor.

Republicans avoided going hard at Ford in a way that might have alienated millions of suburban and college-educated white women who will decide the midterms. But what they did not count on was that Ford’s performance might have a force all its own, independent of whatever Republicans did or did not do to frame the day’s events.

I don’t know if the force of Ford’s performance will be enough to get two Republicans to oppose Kavanaugh’s confirmation. But if they do confirm him after Ford’s showing, it seems even clearer today that Republicans will indeed pay a big political price with suburban and college-educated white women.

I'm not gullible. I've made no illusions to anyone here that I was a Republican. I've never been a Republican.

When the people on the side I agree with less in 2018 constantly call you names though, it's really easy to find yourself on the opposing side.

Second must have finally read How to Win Friends and Influence People over the weekend. Either that, or he is possibly starting to see himself that the tactics the Democrats have taken the last two years are ineffectual at best, and catastrophic for the party at worst.

I'm open for a debate about things that doesn't involve somebody calling me an idiot or a Nazi, or as is often in Second's case an underhanded remark that stupid people wouldn't even realize was an insult.


Second did none of those things here, so I see no reason not to at least hear him out. It's not as if I'm a huge fan of any Republican politicians out there. Chances are I wouldn't be a fan of his choice if I really knew a lot about him either, but TBH I have seen far worse. I could name a few that are on the Supreme Court right now that I'd rather see be replaced with Garland.



TO SECOND:

I won't hold my breath that you'll continue this type of conversation in the future, but I have to say that it is appreciated. I'm more than willing to continue civil discourse in the future if you are.

That old adage “When the facts are on your side, pound the facts. When the law is on your side, pound the law. When neither is on you side, pound the table,” arguably needs updating for the Trump era; perhaps "When neither is on your side, call it fake news, a witch hunt, and a partisan political conspiracy."

The Senate vote will be held on Monday, I believe.

Tribalism, Kavanaugh came out waving the flag of tribalism. He even said the Clintons' were somehow behind what was happening. I felt bad for him because his problems were alcohol based dating back to his teens, and he apparently got a handle on that. He did work hard and became quite the success. Only to see his past catch up to him on the eve of his coronation onto the Supreme Court, his dream come true.

However it can't be stated enough, he was asked 19 times to let the FBI take a few days to look into this and that's when his credibility vanished. He dodged the question each and every time and became belligerent. He is a judge who was denying and blocking due process. That's a head scratcher. This investigation could have taken place in as little as three days. Nope, he and the republicans want no part of that.

Another problem for Kavanaugh and the republicans, is that after the November elections if the democrats take back the house they will have subpoena power. Then the investigation will take place. The democrats have already said so. If that investigation shows the republicans knowingly put a sex offender on the Supreme Court the consequences could be disastrous. Think of the reaction of women if that happens.

In the real world, I've got to be careful not to destroy somebody. But here, I can use a shotgun from three feet away without worry of splattering myself with their blood. The thing about a shotgun is that it is too easy, but even with a fatal blast, nobody here notices, nobody falls down dead. I will go back to what I do best, rifle at 150 yards, 1 shot to the heart.

Here is my 1 shot: all that talk yesterday made no difference. The vote is scheduled for 1:30PM ET today where it will be 11 Republicans vs 10 Democrats on the committee. I'm pretty sure I know how they will vote, already.

In the full Senate, Republicans do not currently have the votes to confirm Kavanaugh, multiple senior aides and senators tell CNN. But GOP leaders see a path to 50 votes -- meaning they could lose one Republican and have Vice President Mike Pence break a potential tie -- so they're going to gamble with a damaged nominee who is viscerally opposed by Democrats.
