Ex-Trump Official Fined $1,000 and Barred from Federal Employment for Hatch Act Violation

The U.S. Office of Special Counsel (OSC) on Tuesday announced that a former Trump administration political appointee had been fined $1,000 and barred from federal service for four years as part of a settlement agreement for violating the Hatch Act—a law prohibiting federal employees from engaging in political activity in the execution of their government duties.


Lynne Patton, who was appointed as the Region II (New York and New Jersey) Administrator for the U.S. Department of Housing and Urban Development (HUD) in 2017, admitted to OSC that she violated the Hatch Act by using her official role at HUD to produce a promotional video for the 2020 Republican National Convention (RNC).

A loose collection of well-connected groups and individuals led by a pair of Orthodox Jewish organizations had striking success in winning clemency for white-collar criminals during the Trump presidency.


One hacked the computers of business rivals. One bribed doctors to win referrals for his nursing homes.

Another fled the country while he was on trial for his role in a fraud that siphoned $450 million from an insurance company, leading to its collapse. Still, another ran a Ponzi scheme that plunged a synagogue into foreclosure.

Each won clemency from President Donald J. Trump.

They also had something else in common, an investigation by The New York Times found. The efforts to seek clemency for these wealthy or well-connected people benefited from their social, political, or financial ties to a loose collection of lawyers, lobbyists, activists, and Orthodox Jewish leaders who had worked with Trump administration officials on criminal justice legislation championed by Jared Kushner.

That network revolved around a pair of influential Jewish organizations that focus on criminal justice issues — the Aleph Institute and Tzedek Association — and well-wired people working with them, including the lawyer Alan M. Dershowitz, Brett Tolman, a former U.S. attorney for Utah, and Nick Muzin, a Republican operative.

The combination of access, influence, and substantive expertise they brought to bear produced striking results.

Of the 238 total pardons and commutations granted by Mr. Trump during his term, 27 went to people supported by Aleph, Tzedek, and the lawyers and lobbyists who worked with them. At least six of those 27 went to people who had been denied clemency through the official Justice Department process during the Obama administration.

Over the years, at least four of those who received clemency or their families had donated to Aleph. Others or their allies and families had retained people like Mr. Dershowitz, who represented Mr. Trump in his first impeachment trial, Mr. Tolman, and Mr. Muzin to press their cases before the Trump administration, often working in parallel with Aleph and Tzedek, according to public records and interviews.

Roger Stone Got A Pardon From Trump, But Now The Feds Are Suing Him For $2 Million In Unpaid Taxes

Donald Trump pardoned his longtime ally Roger Stone in the final weeks of his presidency, wiping away the Republican political operative's convictions for lying to Congress, obstructing investigators, and tampering with witnesses during the Russia investigation.

But that wasn’t the end of Stone’s legal troubles. On Friday, federal tax prosecutors filed a civil lawsuit against him in Florida claiming nearly $2 million in unpaid taxes. The government is alleging that Stone and his wife, Nydia Stone, owe more than $1.5 million in federal income taxes from 2007 to 2011 — an amount that includes hundreds of thousands of dollars in late penalties and interest — plus an additional $400,000 in unpaid income taxes and penalties from 2018 alone.

Prosecutors are also accusing the Stones of placing more than $1 million into a corporate entity that their family controlled, Drake Ventures LLC, in 2018 and 2019 in order to keep it out of the hands of the IRS. The complaint alleges that the Stones used money from Drake Ventures to pay for personal expenses — “groceries, dentist bills, spas, salons, clothing and restaurant expenses,” according to the government — as well as make a down payment on a home, resolve some of their tax debt, and pay wages to relatives and other individuals without filing the required paperwork.

“Although they used funds held in Drake Ventures accounts to pay some of their taxes, the Stones’ use of Drake Ventures to hold their funds allowed them to shield their personal income from enforced collection and fund a lavish lifestyle despite owing nearly $2 million in unpaid taxes, interest and penalties,” prosecutors wrote.

If the phrase “lavish lifestyle” sounds familiar, it’s because prosecutors from former special counsel Robert Mueller’s team used the same language when they charged former Trump campaign manager Paul Manafort with hiding millions of dollars in income in overseas bank accounts to avoid paying taxes and to finance an array of luxury purchases. Manafort was found guilty of tax and bank fraud but, like Stone, received a pardon from Trump in December 2020.

The Stones made some efforts at resolving their tax debts, the government said. According to the latest complaint, they entered into an agreement with the IRS in May 2017 and began paying monthly installments of $19,485. But after Stone was charged by Mueller’s team in January 2019, the government said he and his wife arranged to purchase a condominium in Fort Lauderdale, Florida, in the name of a new trust they’d set up, the Bertran Family Revocable Trust, and used money from Drake Ventures.

Prosecutors alleged the condo purchase was “marked by numerous badges of fraud,” noting that the Stones owed so much money to the US government at that point that they were “insolvent.”

In March 2019, the Stones failed to make their monthly $19,485 payment to the IRS. That dissolved the installment agreement and opened them up to potential legal action.

Giuliani’s legal trouble is Trump’s too

You don’t need to be a lawyer to know that when federal agents knock on your door with a search warrant and seize your electronic devices, you’re in big trouble. Ever since that happened to former Donald Trump lawyer Rudy Giuliani on Wednesday, he has tried to downplay the peril he is in, saying whatever evidence is on his phones proves that “the president and I…are innocent.”

Federal prosecutors can’t obtain a search warrant based on a hunch or mere suspicion. They had to present substantial evidence to a federal judge that there is good reason to believe that a federal crime was committed and that evidence of that federal crime was located in Giuliani’s apartment and his electronic devices. It’s significant a judge was persuaded they met that standard.

Giuliani has a long legal battle ahead of him, and his best defense will likely put him at odds with his former boss. If Trump doesn’t voluntarily protect his one-time counsel, Giuliani may have no choice but to point the finger at his former client. (Their relationship was tested in January when Trump reportedly refused to pay Giuliani for his unsuccessful work trying to overturn the November election results.)

The saga of one-time Trump legal fixer Michael Cohen, who turned on his boss after he pleaded guilty for election finance violations and fraud, is instructive here. Despite Cohen’s assertion that Trump knew of the violations, the president was protected from prosecution while he was in office under Department of Justice guidelines. Now that Trump is a civilian, those guidelines do not protect him, and he has to be concerned about his own liability going forward.

The only surefire way for Trump to avoid testimony in the trial of Giuliani would be to take the Fifth, but Trump has repeatedly noted that taking the Fifth makes you look guilty. The only way for him to get out of testifying is for him to suggest that he didn’t really know what Giuliani was doing and didn’t approve of his activities. That would make him worthless for Giuliani as a witness and force Giuliani to point the finger at Trump to save himself. The five-year sentence Manafort received for conspiring to violate FARA gives Giuliani ample incentive to do so, especially since he knows Trump cannot pardon him any longer.

When a lawyer, particularly a famous former federal prosecutor like Giuliani, faces time in prison, the incentive to reduce that sentence is significant. Just like Michael Cohen, Giuliani will have every incentive to help federal prosecutors if it could potentially reduce his prison sentence. That could make the Giuliani prosecution far more consequential than it appears at first glance, given his role in everything from the defense of Trump’s impeachment to the Jan. 6 insurrection.

Donald Trump Obstruction Memo Was a Fig Leaf for Bill Barr, Judge Says, Ordering Release

U.S. District Judge Amy Berman Jackson had harsh words Monday for former Attorney General William Barr, saying the Justice Department should not have withheld a memo from a watchdog group.

In her order this week, Jackson chastised Barr for his general handling of the Mueller report, saying his "characterization of what he'd hardly had time to skim, much less, study closely, prompted an immediate reaction, as politicians and pundits took to their microphones and Twitter feeds to decry what they feared was an attempt to hide the ball."

She also noted that another judge had rebuked Barr last year for what he said were misleading public statements that spun Mueller's findings in the president's favor.

Why a federal judge calling out Bill Barr's DOJ lies matters

Importantly, Jackson’s opinion does not reveal the memo’s contents, so we still don’t know precisely what happened. While she questioned Barr’s conduct, it may very well have been technically permissible. On the other hand, the memo could suggest there was professional or even criminal misconduct.

We already know Barr’s characterization of the evidence and findings contained in the Mueller report when he spoke to the American people — and later to Congress — was deceptive. In fact, Jackson noted that Barr “hardly had time to skim, much less, study closely” Mueller’s hundreds of pages of investigative work before “summarizing” it for Congress. Meanwhile, Barr’s claim that the evidence didn’t support indicting Trump — even as he withheld the report from the public for several weeks — allowed Trump to proclaim he was fully exonerated. All of which is to say, it would be fair to presume the memo that Jackson has ordered the DOJ to disclose portrays Barr in a less than favorable light.
