His legal arguments for overturning the election were frivolous and rightly dismissed by every court that heard them. The rule of law is in Republican hands now. If they choose the course they took during the election challenge, history will remember them — and not Manhattan’s district attorney — as the instruments of American destruction. Responsible leaders urge peace. Responsible leaders respect the legal process. We know what Trump has said. DeSantis has already signaled he’ll defy the law. Who in the G.O.P. will have the courage to check the rage of the Trumpist mob?

Former Maryland Gov. Larry Hogan’s one-time chief of staff Roy McGrath has died after a nationwide manhunt for him ended Monday in a confrontation with the FBI in Knoxville, Tennessee.

McGrath, who served as the top aide to Hogan, a Republican, for a few months during the summer of 2020, faced charges related to an alleged scheme to bilk Maryland out of more than $276,000.

McGrath was indicted by a federal grand jury in October 2021 on charges that he defrauded the Maryland Environmental Service of a $233,647.23 severance payment. He also defrauded Maryland to pay for a tuition expense of more than $14,000 and falsified time sheets during two vacations.

An arrest warrant had been issued for him in March after he failed to appear for his scheduled trial in Baltimore.

Donald Trump insisted on turning his Tuesday arraignment into a spectacle, and he’s going to get his wish.

A law enforcement official tells Rolling Stone that the former president was offered a chance to surrender quietly and be arraigned over Zoom. Instead, Trump opted for a midday, high-profile booking at the Manhattan courthouse, the official says.

“He wanted a perp walk, he wanted daylight hours,” says the law enforcement official, who’s involved in aspects of the security planning. “He wants to get out of the vehicle and walk up the stairs. This is a nightmare for Secret Service, but they can only strongly suggest — not order — that Trump enter through the secure tunnels,” the official says. “Trump wants to greet the crowd. This should be a surprise to no one — especially not his detail.”

Secret Service had argued in favor of holding the proceedings outside of court business hours, at night with minimal cameras and less risk. But Trump, a source close to his legal team says, wants to create the type of scene that he believes will galvanize his supporters.

“It’s kind of a Jesus Christ thing. He is saying ‘I’m absorbing all this pain from all around from everywhere so you don’t have to,’ ” says the source. Describing the message Trump hopes to send his supporters, the source says: “ ‘If they can do this to me they can do this to you,’ and that’s a powerful message.”

Don't underestimate the strengths of Alvin Bragg's case against Donald Trump
Opinion by Harry Litman

Manhattan Dist. Atty. Alvin Bragg’s indictment of former President Trump takes an open-ended approach to the charges that some critics of the unprecedented prosecution see as a weakness. What the detractors have overlooked are the substantial and unanticipated legal and factual strengths in the case Bragg outlined.

A key question in advance of Tuesday’s unsealing of the indictment concerned how Bragg would augment the easily proven misdemeanor charges of falsifying business records. Under New York law, those offenses become felonies only if they're in furtherance of another crime. Many theories were circulating as to what second crime Bragg would allege, and most of the possibilities had noteworthy shortcomings.

Bragg’s answer was essentially “I’ll tell you later.” He took advantage of the wording of the state law, which requires only that the misdemeanor be done in service of “a crime,” to buy himself maximum time and flexibility.

Bragg may have to pick his crime down the line, perhaps in answer to an expected defense motion for a “bill of particulars” — that is, a fleshing out of the Delphic indictment to enable Trump’s team to prepare an appropriate defense.

On the other hand, the prosecutor may not have to specify a second crime. The jury instructions on falsification of business records say it’s a felony if the defendant acted “with intent to defraud that included an intent to commit another crime or to aid or conceal the commission thereof.” It's therefore not clear that they require the jury even to agree on what the augmenting crime is.

But Bragg this week also added a potent possible second crime beyond what many observers expected. It emerges from the fact that in making his lawyer Michael Cohen “whole” for the hush money he paid to Stormy Daniels, Trump included enough to compensate Cohen for the taxes he would have to pay on the “income” — that is, on the phony legal retainer that camouflaged the hush money.

It’s not clear whether Cohen in fact declared and paid taxes on the reimbursement or whether the Trump Organization declared it as a business expense. The Bragg team’s insight is that it doesn’t matter: The language that elevates business record falsification to a felony only requires “an intent to commit another crime or to aid or conceal the commission thereof.”


That purposely encompasses what lawyers call “inchoate” crimes. The law would plainly be satisfied by the inclusion of money intended to commit or conceal another crime — namely, a false tax filing — whether or not that crime occurred.

Importantly, this theory could be a way around the legal questions inherent in alleging that the second crime was a state or federal campaign finance violation.

Alleging a campaign finance violation would also raise a factual dispute over whether the hush money was really paid to buoy Trump’s electoral prospects. Team Trump continues to suggest that the actual purpose of the payout was “to prevent something coming out [that was] false but embarrassing to himself, his family, his young son," as Trump lawyer Joe Tacopina put it.

That is a far-fetched theory to be sure: The idea that Trump may not be a loyal spouse wouldn't come as a shock to most people, let alone those who know him best. But in a setting in which the prosecution must prove its case beyond a reasonable doubt, the claim that he was trying to protect his family’s feelings can’t be totally disregarded.

Here is where it’s important that Bragg alleged an entire course of conduct — not just the Daniels payout but also a broader “scheme to boost [Trump’s] election prospects” by squelching other potentially damaging stories. Bragg pointedly emphasized that much in his spare public statements this week, suggesting that David Pecker, the former chief executive of the National Enquirer’s parent company, will be a critical witness.

Bragg’s “statement of facts” supplied a nugget of new information that blows the Trump team’s alternative explanation of the payment out of the water. It notes Trump told Cohen that “if they could delay the payment [to Daniels] until after the election, they could avoid paying altogether, because at that point it would not matter if the story became public.”

If the jury credits that statement, it will demolish the argument that Trump only sought to conceal the tawdry facts from Melania. In fact, it proves that Trump was fine with broadcasting the affair to his family and the rest of the world once his election was secured.

So even as Bragg hedged his bets with a skeletal indictment, his statement of facts and public comments reveal a clear path to a felony conviction: showing that Trump’s falsification of business records was meant to aid and conceal a tax offense (whether or not it occurred) and to prevent a revelation that would damage his campaign on the eve of the election.

He was also a hypocrite of the highest order, described by his own family as a “self-hating Jew,” a gay man who persecuted accused homosexuals by McCarthy’s side.

But it’s in his role as friend and advisor to a future President Trump that Cohn has re-entered the news. He served as an attorney for Trump and his father when they were were sued by the Justice Department for discriminating against black rental applicants in their buildings, and it’s Cohn who came up with the idea of countersuing the government for $100 million. Though Cohn died in 1986, his legacy lingers—when in a fit of rage at then-Attorney General Jeff Sessions’s insufficient venality, Trump reportedly demanded,“Where’s my Roy Cohn?”

Eight alleged fake Trump electors in Georgia accept immunity deals in grand jury probe

Eight of the alleged fake electors involved in the 2020 presidential election in Georgia were offered immunity by the prosecution in an ongoing grand jury probe, a new court document shows.

The electors, referenced only by letters A through J, had interviews with the prosecution April 11 through 14, with the exception of one who was out of the country. All of them accepted immunity deals, the document says.

GOP Georgia chair: Trump's lawyers advised me to stand as fake elector

David Shafer, the chairman of the Georgia Republican Party, now claims that his plot to stand as a fake elector should not be criminally charged because he was acting on the advice of former President Donald Trump's legal team, reported CNN on Monday.

"Specifically, Shafer’s attorneys say their client was relying on 'repeated and detailed advice of legal counsel' when he organized a group of 'contingent' electors from Georgia and served as one himself, thus 'eliminating any possibility of criminal intent or liability,' according to a copy of the May 5 letter," reported Zachary Cohen and Sara Murray. "The letter, which was first reported by the Atlanta Journal-Constitution, comes as Willis and her team of prosecutors investigating efforts to overturn the 2020 election results in Georgia are planning to make an announcement on possible charges against Trump or his allies later this summer."

The Special Counsel Who Indicted Trump Is No Democrat. They Never Are.

Also, no Democrat has ever headed the FBI.

Democrats seem to be barred from several key roles in the U.S. justice system, even under Democratic presidents. The Federal Bureau of Investigation was established in 1935 and has had eight directors in the subsequent 88 years. Literally, none of them has been a Democrat.

Similarly, no Democrat has been named as a special counsel (or special prosecutor or independent counsel, the names for similar earlier positions) for a significant investigation for 50 years.

Democrats of recent generations desperately yearn for Republicans to accept that a “fair” system can find Republicans guilty, so they never appoint a Democrat. Meanwhile, Republicans couldn’t care less what Democrats think, so they also never appoint a Democrat.


During the Clinton administration, the inquiry into the Whitewater affair was first run by Robert Fiske, a Republican. He concluded that White House aide Vince Foster had indeed committed suicide, rather than being taken out by one of the many assassins on Bill and Hillary’s payroll. Republicans believed this raised “questions about Fiske,” so he was replaced by Kenneth Starr. Starr, a Republican, somehow investigated Whitewater by digging into Clinton’s relationship with Monica Lewinsky, which led to Clinton’s impeachment. The Whitewater assignment was wrapped up in 2003 by Robert Ray, a Republican.

Another independent counsel was appointed during the Clinton administration to look into the FBI’s siege of Waco, Texas. The man chosen for the job (by Clinton’s attorney general) was John Danforth, a Republican.

Shockingly, the streak of Republicans was broken during the George W. Bush administration when Patrick Fitzgerald was appointed in 2003 to look into the Valerie Plame affair. Fitzgerald was a self-declared independent.

Then it was back to Republicans. Robert Mueller, who was picked to head the investigation into any intersection between the 2016 Trump campaign and Russia, is a Republican. John Durham, appointed by Trump’s Attorney General William Barr to look at the origins of the FBI’s investigation into Trump and Russia, is a Republican. Robert Hur, chosen by Biden’s Attorney General Merrick Garland to investigate Biden’s handling of classified documents, is a Republican.
