If there’s one thing this entertainingly salacious tragicomedy about the rise of Donald Trump (Sebastian Stan) teaches us, it’s that Trump was going to find a way to sue it. And so it’s proved, with the ex-President’s campaign team taking exception to a scene that depicts him raping his then-wife Ivana (a long-rumoured but unproven incident).

Filmmaker Ali Abbasi, of course, will have seen this coming. After all, ‘always file a lawsuit’ is the key lesson Trump learnt from his attack dog of a mentor, Roy Cohn (Jeremy Strong), and The Apprentice charts that master-pupil dynamic in forensic detail – complete with bribery, blackmail and mobster connections.

The result is either an inspiring Secret of My Success tale of bromance, entrepreneurship and reinvention or a gruesome origin story for a capitalist goblin who sheds his few human qualities in pursuit of the mighty dollar, depending on who’s watching. A cinematic Rorschach test, it’s more likely to reaffirm your views on the man than challenge them.

Have you heard of Robert Durst? He is a contemporary of Trump, but he died in prison. Durst was in courtrooms frequently, same as Trump, and he avoided prison for decades until a TV show investigated him, forcing/embarrassing prosecutors to finally do their jobs, rather than give up quickly after each time Durst committed a new crime.

The Durst TV series, The Jinx Part Two, would have been far stronger if it had taken up the theme of communal complicity earlier on, been less monolithic in its focus on Robert Durst and more thoughtful about a society that creates and enables many more like him. (He is, after all, not the only son of a New York real estate mogul to evade prosecution for major crimes.)

My consolation prize when Trump wins is money. Trump will see that I get a multi-million-dollar tax cut. My preferred outcome is Trump goes to jail and the rich finally start paying their fair share, which they have not done since Ronald Reagan lowered the long-term capital gains tax.

Reagan's 1981 cut in the top regular tax rate on unearned income reduced the maximum capital gains rate to only 20% — its lowest level since the Hoover administration (1929 –1933). The tax rate is 0% for inherited stocks. Zero tax. You read that right but it is the wrongest thing in the tax code and very much a Republican feature that Trump would protect with the power of the Presidency.

Schwarzman names immigration as one of the key reasons he supports Trump — yet Trump is now the cause of the crisis, because Trump torpedoed the bi-partisan bill both the Senate and House were ready to pass and Biden, to sign, that would have provided the resources and policy changes needed to solve the crisis.

Could Steve really believe the Big Lie that Trump won in 2020? Could he consider corporate taxation a more important issue than climate or reproductive rights or competence or honesty or Trump’s authoritarianism and eagerness to curry Putin’s favor?

The NYTimes article was brought to my attention by a college friend of long standing.

He writes:

There is absolutely no surprise here. I’ve known Schwarzman since he was fifteen years old. Trump and Schwarzman are the quintessential, unapologetic transactionalists. Whatever pads the bottom line. Whatever most expediently preserves power and wealth. However best to grease the respective palm. For both men, no moral compass or ethical convictions impact the calculus, despite lip service to both. The difference is that Schwarzman knows better. He knows who Trump is. He knows exactly what is going on. He is fully aware of the danger Trump poses to the republic, but this awareness is subordinate to his undeviating pursuit of his own interests and the rapacious accumulation of personal wealth. The fact that Schwarzman’s intelligence compared to Trump’s is like the sun to a candle flame starkly demonstrates the boundlessness and ruthlessness of his cynicism. He will die a very, very rich man, far richer than Trump could ever imagine on even the best of his self-deluded days. But the country’s best interests and the preservation of its democratic institutions will be damaged in Schwarzman’s wake. No matter; he will die with the ever-present self-satisfied smirk on his face.

I hesitated to share that, but too much is at stake not to offer his point of view.

The Stench of Climate Change Denial

This may sound a bit weird, but when I think about my adolescent years, I sometimes associate them with the faint smell of sewage.

You see, when I was in high school, my family lived on the South Shore of Long Island, where few homes had sewer connections. Most had septic tanks, and there always seemed to be an overflowing tank somewhere upwind.

Most of Nassau County eventually got sewers. But many American homes, especially in the Southeast, aren’t connected to sewer lines, and more and more septic tanks are overflowing, on a scale vastly greater than what I remember from my vaguely smelly hometown — which is both disgusting and a threat to public health.

The cause? Climate change. Along the Gulf and South Atlantic coasts, The Washington Post reported last week, “sea levels have risen at least six inches since 2010.” This may not sound like much, but it leads to rising groundwater and elevated risks of overflowing tanks.

The emerging sewage crisis is only one of many disasters we can expect as the planet continues to warm, and nowhere near the top of the list. But it seems to me to offer an especially graphic illustration of two points. First, the damage from climate change is likely to be more severe than even pessimists have tended to believe. Second, mitigation and adjustment — which are going to be necessary, because we’d still be headed for major effects of climate change even if we took immediate action to greatly reduce greenhouse gas emissions — will probably be far more difficult, as a political matter, than it should be.

On the first point: Estimating the costs of climate change and, relatedly, the costs polluters impose every time they emit another ton of carbon dioxide requires fusing results from two disciplines. On one side, we need physical scientists to figure out how much greenhouse gas emissions will warm the planet, how this will change weather patterns and so on. On the other, we need economists to estimate how these physical changes will affect productivity, health care costs and more.

Actually, there’s a third dimension: social and geopolitical risk. How, for example, will we deal with millions or tens of millions of climate refugees? But I don’t think anyone knows how to quantify those risks.

Anyway, the physical side of this endeavor looks very solid. There has, of course, been a decades-long campaign aiming to discredit climate research and, in some instances, defame individual climate scientists. But if you step back from the smears, you realize that climatology has been one of history’s great analytical triumphs. Climate scientists correctly predicted, decades in advance, an unprecedented rise in global temperatures. They even appear to have gotten the magnitude more or less right.

The economic side of the effort looks flakier. That’s not because economists haven’t tried. Indeed, in 2018, William Nordhaus received a Nobel largely for his work on “integrated assessment models” that try to put the climate science and the economic analysis together.

Yet with all due respect — Nordhaus happens to have been my first mentor in economics! — I’ve long been worried that these models understate the economic costs of climate change, because so many things you weren’t thinking of can go wrong. The prospect of part of America awash in sewage certainly wasn’t on my list.

There has been a trend in recent studies to mark up estimates of the damage from climate change. The uncertainty remains huge, but it’s a good guess that things will be even worse than you thought.

So what are we going to do about it? Even if we were to take drastic steps to reduce emissions right now, many of the consequences of past emissions, including much bigger increases in sea level than we’ve seen so far, are already, as it were, baked in. So we’re going to have to take a wide range of steps to mitigate the damage — including expanding sewer systems to limit the rising tide of, um, sludge.

But will we take those steps? Climate denial was originally all about fossil fuel interests, and to some extent it still is. But it has also become a front in the culture war, with politicians like Ron DeSantis of Florida — who happens to be the governor of one of the states at greatest immediate risk — apparently deciding that even mentioning climate change is woke.

Now imagine the collision between that kind of politics and the urgent need for substantial public spending, on everything from sea walls to sewer systems, to limit climate damage. Spending on that scale will almost surely require new tax revenue. How quickly do you think right-wing culture warriors will agree to that?


So I’m very worried about the climate future. We probably won’t do enough to limit emissions; President Biden has done far more than any of his predecessors, but it’s still not enough, and Donald Trump has promised oil executives that if he wins, he will reverse much of what Biden has done. Beyond that, we’re unlikely to do enough to limit the damage.

In short, it’s not hard to see some terrible outcomes in the not-too-distant future, even before full global catastrophe arrives. Bad stuff is coming, and we’re already starting to smell it.

If Trump Is Convicted, It’s Democrats’ Job to Make Sure America Cares

Here we are. Verdict week. Or are we? That’s the big question. The betting seems to be that if we’re going to get a conviction, it’s going to happen fast. The jury shouldn’t have to deliberate more than a couple days, maybe even more than a few hours, to find Donald Trump guilty in the Stormy Daniels hush-money case. Los Angeles Times legal affairs columnist Harry Litman is putting his shilling on a guilty verdict on Friday afternoon.

Better still, of course, would be Wednesday morning. Or Tuesday evening! That would be the optimal political outcome—a unanimous guilty verdict in about three or so hours. It would send a great message to the country that, while Trump may have successfully stalled the other three cases, the law finally caught up with him and the outcome was unequivocal.

But the longer the deliberations go, the more we ought to worry. If we head into next week without a verdict, it may mean that there are one or two holdouts on the jury, and it’s 11-1 or 10-2 for conviction, but those one or two just won’t budge. Or, they could just acquit. Juries do unpredictable things. O.J. Simpson was acquitted in four hours. I don’t even want to think about that outcome for Trump, and you don’t need me to tell you how depressing it would be.

Let’s cross that bridge if and when we have to. For now, let’s focus on the consequences of a guilty verdict.

The Senate has subpoenaed Leonard Leo over his lavish gifts to Republican Supreme Court justices. So far, he hasn’t complied since the gifts are bribes. If he testifies to the Senate, rather than take the 5th amendment, the next step is the DOJ indicting Leo and the Republican Justices for bribery. That will make the Trumptards go berserk!

Leonard Leo, the architect of the conservative Supreme Court and principal puppeteer of right-wing legal affairs, is currently about a month and a half into defying an April 11 Senate subpoena. The Senate Judiciary Committee seeks his testimony under oath about gifts, including luxury trips, he has helped to arrange for multiple Supreme Court justices and their families. But Leo’s flouting of the Senate subpoena, underscoring his decades of contempt for legal ethics and democratic oversight, reflects his determination to execute his corrupting agenda without accountability.

Leo is an astoundingly powerful political figure who controls billions of dollars and an array of political front groups. Most importantly, he is the co-chairman of the board of the Federalist Society, the highly influential right-wing legal network. In the Trump administration, Leo played a primary role in picking justices for the Supreme Court—Brett Kavanaugh, Neil Gorsuch, and Amy Coney Barrett—as well as almost every other federal judge appointed to lower benches. As ProPublica reported, “Once Trump took office, he gave control over judicial picks to Leo, White House legal counsel Donald McGahn,” and their allies. It’s no mistake that of the Trump appointees to the circuit courts and the Supreme Court, “86 percent were former or current Federalist Society members.”

The Senate has subpoenaed Leo to learn the facts about the lavish travel, lodging, and transportation gifts he arranged for Supreme Court justices, most notably Clarence Thomas and his wife Ginni, and Samuel Alito. In 2008, for example, Leo organized a trip to Alaska that included a private jet flight for Alito, paid for by Paul Singer, a hedge fund billionaire and Leo donor with interests before the court.

A duly authorized Senate subpoena is not “lawless.” Nor is the Senate committee a “dark money effort.” On the contrary, it is Leo who operates a dark money empire whose influence-peddling with the highest court in the land the committee rightly wants to discover. It’s not the first time he’s projected so strongly: Ironically, Leo named one of his dark money groups for shielding the identities of wealthy donors who seek to undemocratically pack the courts and influence judges the Rule of Law Trust.

Leo fears congressional oversight because his methods of elite influence depend on secrecy and obfuscation that are antithetical to a functioning democracy. In particular, Leo seeks to obscure his gifts to Ginni Thomas, which raise crucial issues about the proper boundary between the judicial branch and partisan politics. Thomas’ activism exploits her personal ties to inject her extremist politics into the judiciary, and Leo has played an instrumental political and financial role in enabling her agenda. Thomas launched her lobbying firm, Liberty Consulting, in 2010. Her firm’s website promoted her work by quoting a client affirming that she is able to “give access to any door in Washington” — which occurs in part thanks to the right-wing network including Leo and his money.

I get that the Journal has to pretend that this is some kind of live issue, but surely they know better? Republicans have been passing unpaid-for tax cuts since Reagan took office, and the only offsets they've ever been interested in are spending cuts on the poor. That's it. There's nothing more.

The president’s ability to grant pardons and commute sentences is a dramatic but generally quiet power. Presidential grants of clemency generally go through a complex bureaucratic process. They are not usually announced in advance, let alone deployed as part of a campaign to win votes.

But, as with many other things, Donald Trump is changing all that. He has made promising pardons an important part of his 2024 campaign.

This is a bad development in our scheme of constitutional government, a tactic that taints one of the most awesome of presidential prerogatives. Trump is turning clemency from a solemn responsibility to just another tool in his transactional political repertoire.

On Saturday, in an appearance at the Libertarian Party Convention, Trump gave us another example of the lengths to which he will go just to win a few votes. There he offered a clemency quid pro quo.

“If you vote for me,” he promised, “on Day 1, I will commute the sentence of Ross Ulbricht to a sentence of time served. He’s already served 11 years. We’re going to get him home.”

Trump knew exactly what he was doing when he made that promise, since many in his audience were waving “Free Ross” signs. And, as Politico reports, “Ulbricht’s case was one of the top issues that libertarians asked Trump to address before the convention—and it won Trump his biggest applause of the night.”

Hearing of the loud booing and catcalls being thrust at Trump as he spoke to the Libertarian convention in Washington D.C. last weekend, I looked to tune in hoping to enjoy the experience. It wasn’t fun. Yes, there were many who were yelling out against him as he spoke, but make no mistake, there were others who cheered him.

What came across most clearly was just how completely vile this man Trump is. Under the pressure of a yelling and screaming crowd, Trump’s reptilian demeanor came to the forefront. His entire speech, which was actually quite long and read verbatim off of a teleprompter, was delivered with a gravelly, hostile tone, almost as if a menacing hiss lay behind every word. There were plenty of gratuitous name-calling and egregious lies saturating the remarks, but it was the tone, the angry, raspy hating tone that defined it. No one could cheer such remarks who was not him or herself sharing their nasty, seething temper inside their own heads, or otherwise was too fearful of them to oppose them.

The experience made the news of Nicky Haley’s endorsement of Trump seem so especially and brazenly foul. How could this seemingly civil person throw in her lot with such a foul forked-tongue demon? It is breathtaking to contemplate.

But lest we totally despair, on the other side last weekend was also the occasion for the remarks at the Brandeis University’s commencement by filmmaker historian Ken Burns. He told the graduates the following:

“Listen, I am in the business of history. It is not always a happy subject on college campuses these days, particularly when forces seem determined to eliminate or water down difficult parts of our past,” he said.

“For nearly 50 years now, I have diligently practiced and rigorously tried to maintain a conscious neutrality in my work, avoiding advocacy if I could, trying to speak to all of my fellow citizens,” he continued. “Over those many decades I’ve come to understand a significant fact, that we are not condemned to repeat, as the saying goes, what we don’t remember. That is a beautiful, even poetic phrase, but not true. Nor are there cycles of history as the academic community periodically promotes.

“…If I have learned anything over those years, it’s that there’s only us. There is no them. And whenever someone suggests to you, whomever it may be in your life, that there’s a them, run away. ‘Othering’ is the simplistic binary way to make and identify enemies, but it is also the surest way to your own self imprisonment, which brings me to a moment I’ve dreaded and forces me to suspend my longstanding attempt at neutrality.

“There is no real choice this November. There is only the perpetuation, however flawed and feeble you might perceive it, of our fragile 249-year-old experiment, or the entropy that will engulf and destroy us if we take the other route, when, as Mercy Otis Warren would say, ‘The checks of conscience are thrown aside and a deformed picture of the soul is revealed.’ The presumptive Republican nominee is the opioid of all opioids, an easy cure for what some believe is the solution to our myriad pains and problems… when in fact with him, you end up re-enslaved with an even bigger problem, a worse affliction and addiction, ‘a bigger delusion,’ James Baldwin would say, the author and finisher of our national existence, our national suicide as Mr. Lincoln prophesied. Do not be seduced by easy equalization. There is nothing equal about this equation. We are at an existential crossroads in our political and civic lives. This is a choice that could not be clearer.

“…Choose honor over hypocrisy, virtue over vulgarity, discipline over dissipation, character over cleverness, sacrifice over self-indulgence. Do not lose your enthusiasm, in its Greek etymology the word enthusiasm means simply, ‘god in us’. Serve your country. Insist that we fight the right wars. Denounce oppression everywhere.

The former president's latest courthouse complaint has a huge problem.

Donald Trump on Wednesday complained that “key witnesses” were never called to testify at his criminal trial in the Stormy Daniels hush money case.

But his critics were quick to point out one key detail: His own attorneys could have called those “witnesses,” but didn’t.

The former president claimed there were “five or six” people who could have backed his version of events.

“Why didn’t they call those witnesses?” Trump asked. “They didn’t call them because they would’ve been on our side. And it’s a shame.”

Critics of the former president pointed out that his team could have called any witnesses they wanted and that Trump had insisted he would “absolutely” testify himself, but ultimately didn’t.

This is ridiculous. Trump could’ve called the witnesses he’s now complaining were not called by the prosecutors. He’s counting on his audience to be ignorant about basic courtroom procedures.

There’s a very real possibility that if Trump wins in November it’ll be the last real national election America holds for a very long time. And while there’s room for disagreement here, if you consider that statement to be outrageous hyperbole, you haven’t been paying attention to Republicans.

Yes, we can and should examine the candidates’ policy platforms and potential effects, just as if this were a normal presidential election. But this isn’t a normal election; democracy itself is on the ballot. And it would be incredibly unwise not to take that into account.

Start here: Trump refused to accept the results of the 2020 presidential election, making evidence-free claims of fraud in his effort to overturn it. In the past couple of years, various polls have shown that somewhere around two-thirds of the Republican Party has co-signed his election denialism. And several leading party members have refused to say that they’ll accept the election results this year. Why imagine that they’ll become any more respectful toward future elections?

You might say that American institutions would constrain the ability of Trump and whoever follows him to impose permanent one-party rule, which they did — barely — after the 2020 election. But institutions ultimately consist of people, and at this point many Republicans, up to and including Supreme Court justices, are showing about as much strength in supporting democracy and the rule of law as a wet paper towel.

So a Trump victory might well bring down the curtain on politics as we know it — he has already floated the idea of a third term, something that’s barred, of course, by the 22nd Amendment. But in any case, among his followers, at least, he has mainstreamed the idea that any presidential election won by Democrats is illegitimate.

It will be successfully appealed, likely after he's voted in as President, but maybe before. At that point the felony charge will be illegitimate and he won't even need to have it expunged.

I completely forgot to mention it to either my aunt or my friend while talking to them on the phone it means so little. RCP is barely even mentioning that it happened. And a hell of a lot more than 74 Million people are voting for Trump this time around, regardless.

Once again, you proved my point by not understanding what Trump did wrong.

Trump would not have been in court if he had written one check out of his personal bank account rather than dozens of checks out of the corporate account, but Trump being a cheat, had to cheat on his corporate taxes.

On top of that, it was an illegal campaign contribution for his corporation to do that, besides cheating on NY corporate taxes.

Stupidly, after being caught, Trump lied about not having sex with that woman, lied about why the checks were written, lied about everything, which irritated the hell out of the jury because Trump's constant lying was wasting weeks and weeks of the jurors' time as the prosecutors meticulously proved Trump lied about all facts in this case. (Trump's clever retort? "Believe me! I'm telling the truth. You're the liar!")

To prove beyond a doubt that Trump was lying, Trump and his lawyers kept on lying during the trial, excluding his lying before the trial, which was a further waste of time for everybody involved. If Trump had testified, as he promised, there would be a new trial for Trump's perjury if he repeated under oath the same lies he was speaking to reporters when he wasn't in the courtroom.

What Trump and other elected Republicans are doing is not merely claiming that the jury was wrong, or that the prosecution’s arguments were bad. They argued that the conviction was illegitimate: the product of a Biden administration conspiracy to send its political opponents to prison, akin to a Soviet show trial.

In his statement, Sen. J.D. Vance made it clear that this amounts to a conspiracy theory: “Dems invented a felony to ‘get Trump,’ with the help of a Soros funded prosecutor and a Biden donor Judge, who rigged the entire case to get this outcome.” But there’s no evidence the judge “rigged” the case, and Vance doesn’t try providing any fake "evidence".

But the evidence isn’t the point. The conspiratorial vibe is — ensuring that, in whatever way possible, Republican voters get the message that anything bad that ever happens to Donald Trump is the fault of the Democrat-controlled system.

It’s a level of paranoia that makes Richard Nixon look grounded, yet there’s every reason to believe that it’s widely shared in the GOP base. An NPR poll released this morning, asking Americans if the Trump trial would affect their vote, found that 90 percent of Republicans either would be unaffected or more likely to vote for Trump after a guilty verdict.

Texas Republicans want rural voters to count more than city slickers

GOP platform changes election rules, promotes Bible study, and promotes Confederate traitors.

Texas Republicans have a clever idea to guarantee they remain in power, even if their candidates can’t win the popular vote in statewide elections.

Delegates to the state party convention have ratified a new platform that would change how statewide officials, from governor to land commissioner, are chosen. To take office, a candidate would have to win the popular vote in a majority of Texas’s 254 counties.

The proposal, akin to the federal Electoral College, would give voters in Loving County, population 64, as much power as those in Harris County, where 4.7 million people live. King County, with 265 people, would wield a vote equivalent to Bexar, with 2 million.

Does this sound like a political party that has confidence in its electoral future?

Texas Republicans see plenty of precedent for their anti-democratic proposal. Why not elect statewide officials based on the number of counties they win?

Many readers will scoff at the idea that such a radical change has a chance of becoming law, and I hope they are correct. But as a longtime observer of Texas politics, I remember when a near-complete abortion ban and the permit-less carrying of pistols in public spaces seemed absurd.

Outrageous ideas can become law, especially in places where a single party controls all the levers of power for decades. The Republican Party of Texas’s 50-page platform supplies plenty of fodder for dystopian fiction writers looking for inspiration.
