NEW YORK (AP) -- A construction worker was jailed Tuesday on charges of murdering an actress who was found hanging from a shower rod in what looked at first like a suicide.



Diego Pillco, 19, confessed to the slaying of 40-year-old Adrienne Shelly, prosecutor Marit Delozier said at Pillco's arraignment.

"He said he fought with the victim, tied a sheet around her neck and dragged her to the bathroom and hung her from the shower rod," Delozier said. "This is an exceptionally egregious case." (Watch why Shelley's husband immediately rejected the suicide theory -- 1:20 )

Pillco was jailed without bail. His attorney, Thomas Klein, said he would file motions in Pillco's case later.

Pillco had been helping renovate an apartment in the Greenwich Village building where Shelly had an office. The New York Times quoted the prosecutor as saying Pillco got into an argument with the actress after she complained about construction noise.

She was found dead in her office last Wednesday. Police were hesitant to label the case a suicide, since no note was found and sneaker prints that did not match her shoes were found in the bathtub.

Shelly appeared in the 2005 movie "Factotum" with Matt Dillon. She also appeared in "The Unbelievable Truth" in 1989 and "Trust" in 1990.

She made her directorial debut with "Sudden Manhattan" in 1996. She recently wrote and directed the movie "Waitress," starring Keri Russell and Nathan Fillion.

Shelly, who took her professional surname after her late father Shelly M. Levine's given name, was married to Andrew Ostroy, the chairman and CEO of the marketing firm Belardi/Ostroy ALC. They had a daughter, Sophie, who was two years old at the time of Shelly's death. At about 5:45 p.m on November 1, 2006, Shelly's husband found her hanging by a bedsheet[13] from a shower rod in the bathtub [11] of an Abingdon Square apartment in the West Village section of Manhattan's Greenwich Village.[13] Shelly, who lived in Tribeca,[11] used the apartment as an office and sublet it as a domicile to a friend. Ostroy had dropped her off between 10 and 10:30 a.m. that day, and as the building's doorman told journalists, "He hadn't heard from her and he said it was odd not to hear from her, so he was nervous. And he asked me to go up to the apartment with him, so we went to the front door, and it was unlocked". Illegal immigrant Diego Pillco, a construction worker confessed to killing actress Adrienne Shelly last week during a noise dispute, was arraigned in Criminal Court and held without bail yesterday.

Pillco is a 19 year old illegal immigrant from Ecuador, who told the police that he had "punched Shelly and, fearing she was dead, staged a suicide scene by hanging her from a shower rod." Reported the New York Post.

The Gothamist reports "Manhattan assistant district attorney Marit DeLozier said that Shelly died from 'compression to the neck,' not the punch, meaning she was probably just unconscious when she was hanged. Pillco did not enter a plea and was placed under suicide watch when remanded."

The New York Times and New York Post both have more detailed descriptions of how the fight may have started.

The Post speculated: "The actress told Pillco - who speaks little English - to be quiet by putting a finger to her mouth and saying, "Shhhh," a source said.

Pillco yelled at her in Spanish to get out, descended from the ladder, picked up a hammer and pounded the floor with it before again ordering her to leave.

Pillco, who is at most an inch taller than the 5-foot-2 Shelly, then shoved her out of the apartment and closed the door. But Shelly reopened the door and slapped his face before heading back upstairs, sources said."

"Pillco followed Shelly upstairs into her apartment, where she yelled at him to leave, and called him a 'son of a bitch.' " Reports the Post.

Law-enforcement sources said he may have hit her several times, and that she became unconscious.

A police source told the Times, "[Pillco] to stage this thing because he is trying to make it go away." Another investigator told the Post that Shelly "didn't go easily" during the fight, leaving scratches on Pillco's face (Pillco explained the scratches to the other construction workers by saying he got into a fight with movers.)

The Daily News that Shelly's husband, Andrew Ostroy, who discovered her body was insistent that she did not commit suicide, "is still in shock. I don't know if he'll ever get over this."

Newsday reports that the contractor who hired Pillco expressed condolences to Ostroy and added about Pillco, "He just seemed to be another hard worker immigrant. We cannot comprehend how a regular working day turned into a crime scene."

Legislation. Home Secretary David Blunkett issued a new package of immigration measures on April 12, 2002, to crack down on illegal migrants and on employers who hire workers in the underground economy. The proposed Nationality, Immigration and Asylum Bill includes authority to "compel" employers who pay workers on a cash basis to cooperate. Immigration officers will also have new powers to enter businesses to search for illegal migrants and demand information to detect asylum fraud.

The bill also includes a provision increasing the maximum jail term for those convicted of harboring or trafficking migrants from six months to 14 years.

In addition, immigration officers can remove children born in the UK if their parents entered unlawfully. Children held in detention centers will not be allowed to attend mainstream schools; instead they will be taught in special classes held inside the centers, what advocates call "forced segregation" or "educational apartheid." On April 24, Blunkett caused an uproar when he said the children of immigrants were "swamping" local schools; in 1978, Margaret Thatcher, said the British were "afraid that this country might be rather swamped by people with a different culture."

According to the Office of National Statistics, Britain is 7.1 percent nonwhite, with 2.2 percent of the population categorized as black, 3.4 percent from the Asian subcontinent and 1.5 percent Chinese and "other groups." Some 82,000 foreigners were granted British citizenship in 2001.

The British National Party elected two of the 68 people it put up for city council seats in local elections. The two won in Burnley, one of four cities that suffered racial riots in 2001; there were 6,000 seats on 174 local councils at stake in May 2002 elections. The BNP ran an anti-immigrant, pro-nationalist message that stressed "rights for whites" and "pensioners before asylum seekers."

Chunnel. Some 1,000 to 2,000 migrants who are housed at the Red Cross Center in Sangatte, France continue to try to board trains bound for the UK, or walk through the Chunnel for 32 miles to England. In early April, about 80 got aboard a train, and about 25 slipped away from UK police once they got across the Chunnel.

The New York Times Magazine on April 14, 2002 reported the stories of some of the migrants staying in the center who are trying to reach England. The Chunnel, which opened in 1994, had 400 passenger and freight trains passing every day between France and Britain, and many Kosovars and Roma found it relatively easy to use the trains to get to the UK. The UK is considered a good place to apply for asylum because the British government provides shelter and food vouchers while applications are considered, and after six months, a foreigner can win the right to work. Many asylum applicants know some English.

By 1999, migrants were camping in Calais, which prompted the French government to persuade the Red Cross to open the center, which consists of tents and portable cabins inside a two-acre shed that had housed equipment used in the construction of the Chunnel. According to the Red Cross, some 50,000 migrants have passed through the center in the past three years, and 85 percent succeeded in reaching the UK.

Smugglers operate openly inside the shed, offering to help migrants get to the UK for $300 to $1,000. Eurotunnel apprehended 50,000 migrants trying to cross via the Chunnel in 2001, many were captured several times, and 2,500 were caught each month in the first part of 2002. Local residents in France and the UK largely resent the migrants, blaming them for driving off tourists.

The Eurotunnel reported in April that rail freight tonnage carried through the Channel tunnel fell by about half in the first quarter of 2002 because of the disruption to freight trains from asylum seekers. The Home Office announced on April 12, 2002 that new technology, known as Borderguard, would help detect forged papers among arrivals at Dover.

Asylum. Some 72,000 foreigners applied for asylum in the UK in 2001; the National Asylum Support Service spent L750 million on their housing and food in 2000-01.

Many asylum applicants are housed in detention centers. However, the 900-bed Yarl's Wood detention center in Bedfordshire has been forced to close because it has been unable to get adequate insurance following a February 2002 fire. The center is operated for the government by the private firm Group 4, which also runs Campsfield House in Oxfordshire and the Oakington asylum detention center in Cambridgeshire. On April 12, 2002, Group 4 said that there is a possibility that Oakington and Campsfield will close if insurance coverage is not found.

In April 2002, Group 4's insurers demanded £100m in damages from the police. Under the Riot Damages Act of 1886, companies and individuals can sue police to recoup riot damage. The chair of the Bedfordshire police said that any claim made under the act was "outrageous and will be vigorously resisted." If insurance companies refuse to insure detention centers, the government may have to take them over.

Beginning on April 8, 2002, the UK ended its voucher program for asylum applicants, making cash payments of L29.89 a week to asylum seekers aged 18 to 24 , and L37.77 a week to those over 25.

The British government had set a target of removing 30,000 failed asylum seekers by the end of March 2002. In November, 2001, Home Secretary David Blunkett admitted that the goal was unattainable and revised it to 12,000. The aim was to deport 2,500 a month, but official figures show that the rate was closer to 500 a month- a fifth of the target.

Labor. The Economic and Social Research Council released a report in May 2002 that concluded British workers are working longer hours than they did a decade ago. However, they are less productive than their counterparts in the US and Europe. About 10 percent of British women, and 33 percent of men, work more than 50 hours a week, but British manufacturing productivity is only two-thirds that of Europe, and a third that of the US. The Trades Union Congress, representing about 6.7 million workers, wants Britain to adhere to a European Union directive that limits people to a 48-hour work week.

Despite the government's effort to encourage investments in technology, the fastest-growing jobs in the 1990s were often low-wage positions. The number of hairdressers grew the fastest, 302 percent between 1992 and 2000, and stockers in stores ranked No. 8, behind nurses, housekeepers, call-center operators, welfare workers, education assistants and software engineers.

The US military investigated building a "gay bomb", which would make enemy soldiers "sexually irresistible" to each other, government papers say.

The US defence department considered various non-lethal chemicals meant to disrupt enemy discipline and morale.

The 1994 plans were for a six-year project costing $7.5m.

The US Air Force Wright Laboratory in Dayton, Ohio, sought Pentagon funding for research into what it called "harassing, annoying and 'bad guy'-identifying chemicals".

The plans were obtained under the US Freedom of Information by the Sunshine Project, a group which monitors research into chemical and biological weapons.

'Who? Me?'

The plan for a so-called "love bomb" envisaged an aphrodisiac chemical that would provoke widespread homosexual behaviour among troops, causing what the military called a "distasteful but completely non-lethal" blow to morale.

Captain Dan McSweeney of the Joint Non-Lethal Weapons Directorate at the Pentagon said the defence department receives "literally hundreds" of project ideas, but that "none of the systems described in that [1994] proposal have been developed".

He told the BBC: "It's important to point out that only those proposals which are deemed appropriate, based on stringent human effects, legal, and international treaty reviews are considered for development or acquisition."

After numerous refusals over three and a half years, the Social Security Administration (SSA) has released the first known public copy of the U.S.-Mexico Social Security Totalization Agreement. The government was forced to make the disclosure in response to lawsuits filed under the Freedom of Information Act by TREA Senior Citizens League, a 1.2 million-member nonpartisan seniors advocacy group. The Totalization Agreement could allow millions of illegal Mexican workers to draw billions of dollars from the U.S. Social Security Trust Fund. The agreement between the U.S. and Mexico was signed in June 2004, and is awaiting President Bush's signature. Once President Bush approves the agreement, which would be done without Congressional vote, either House of Congress would have 60 days to disapprove the agreement by voting to reject it. "The Social Security Administration itself warns that Social Security is within decades of bankruptcy -- yet, they seem to have no problem making agreements that hasten its demise," said Ralph McCutchen, Chairman of the TREA Senior Citizens League. For example, a worker who turns 62 after 1990 generally needs 40 calendar quarters of coverage to receive retirement benefits. Under totalization agreements, workers are allowed to combine earnings from both countries in order to qualify for benefits. The Agreement with Mexico, like other totalization agreements, would allow workers to qualify with just six quarters, or 18 months, of U.S. coverage.

I think the Atlanta Constitution-Journal had a poll that had an opinion about the government prior knowledge of 911. And the public opinion poll, after 2 days, was taken down because it was too much an embarassment to the administration, because 52% of the people responding to their polls believed that the administration had prior knowledge to this attack."

Congressman Duncan: "Well, I hadn't seen that poll. But when I was talking about how all this stuff goes back to Big money. I did a program in which I talked about prescription drugs and the high cost of medicine - why these pills cost so much. And it's the federal government.... WASHINGTON – While the military "quagmire" in Iraq was said to tip the scales of power in the U.S. midterm elections, most Americans have no idea more of their fellow citizens – men, women and children – were murdered this year by illegal aliens than the combined death toll of U.S. troops in Iraq and Afghanistan since those military campaigns began.

Though no federal statistics are kept on murders or any other crimes committed by illegal aliens, a number of groups have produced estimates based on data collected from prisons, news reports and independent research.

Twelve Americans are murdered every day by illegal aliens, according to statistics released by Rep. Steve King, R-Iowa. If those numbers are correct, it translates to 4,380 Americans murdered annually by illegal aliens. That's 21,900 since Sept. 11, 2001.

Total U.S. troop deaths in Iraq as of last week were reported at 2,863. Total U.S. troop deaths in Afghanistan, Pakistan and Uzbekistan during the five years of the Afghan campaign are currently at 289, according to the Department of Defense.

But the carnage wrought by illegal alien murderers represents only a fraction of the pool of blood spilled by American citizens as a result of an open border and un-enforced immigration laws.

While King reports 12 Americans are murdered daily by illegal aliens, he says 13 are killed by drunk illegal alien drivers – for another annual death toll of 4,745. That's 23,725 since Sept. 11, 2001.

While no one – in or out of government – tracks all U.S. accidents caused by illegal aliens, the statistical and anecdotal evidence suggests many of last year's 42,636 road deaths involved illegal aliens.

A report by the AAA Foundation for Traffic Study found 20 percent of fatal accidents involve at least one driver who lacks a valid license. In California, another study showed that those who have never held a valid license are about five times more likely to be involved in a fatal road accident than licensed drivers.

Statistically, that makes them an even greater danger on the road than drivers whose licenses have been suspended or revoked – and nearly as dangerous as drunk drivers.

King also reports eight American children are victims of sexual abuse by illegal aliens every day – a total of 2,920 annually.

Based on a one-year in-depth study, Deborah Schurman-Kauflin of the Violent Crimes Institute of Atlanta estimates there are about 240,000 illegal immigrant sex offenders in the United States who have had an average of four victims each. She analyzed 1,500 cases from January 1999 through April 2006 that included serial rapes, serial murders, sexual homicides and child molestation committed by illegal immigrants.

As the number of illegal aliens in the U.S. increases, so does the number of American victims.

According to Edwin Rubenstien, president of ESR Research Economic Consultants, in Indianapolis in 1980, federal and state correctional facilities held fewer than 9,000 criminal aliens. But at the end of 2003, approximately 267,000 illegal aliens were incarcerated in all U.S. jails and prisons.

While the federal government doesn't track illegal alien murders, illegal alien rapes or illegal alien drunk driving deaths, it has studied illegal aliens incarcerated in U.S. prisons.

In April 2005, the Government Accountability Office released a report on a study of 55,322 illegal aliens incarcerated in federal, state, and local facilities during 2003. It found the following:

The 55,322 illegal aliens studied represented a total of 459,614 arrests – some eight arrests per illegal alien;

Their arrests represented a total of about 700,000 criminal offenses – some 13 offenses per illegal alien;

36 percent had been arrested at least five times before.

At least justice will finally be served in this terribly tragic case .

In retrospect, it's still appalling at how quickly the police were willing to write-off the life of such a beautiful, happily married, successful woman by simply calling her death a suicide.

The initial press coverage was totally inexcusable, blaming the female victim by printing many sensationalist headlines like, "Actress Set Off Illegal's "KILLER" Rage by Calling Him 'S.O.B." and other similar comments--headlines laced with innuendo against the actress by printing the killer's version of the story as if it were some kind of gospel.

The press was quick to make Shelly out as an irate actress yelling profanities at a poor hard-working immigrant. These headlines set off a firestorm of comments on whether or not she had any right to call him names! Implying that her bad temper probably caused him to lose control, and even worse creating a debate among idiots that actually believed these reports because they were printed in the press. Many people were commenting on how she might have avoided these tragic events if only she hadn't yelled at him! Are people really that stupid?

Many media outlets also took it upon themselves to make Pillco, the brutal murderer, look angelic with bold headlines stating "how respectful and decent and responsible he was" and that "he was just another hardworking immigrant."

Pillco’s cousin also told The Post that the accused killer was “quiet and peaceful. He didn’t have a temper,” and was working to pay off his smuggling debt, and to support his parents and five siblings back in Ecuador."

I think we've all heard similar comments from the family and friends of serial killers. If the media is going to defend the accused with such winning personality profiles. It would be nice if they would have taken the time to do the same for the victim, shedding even a remote amount of positive light in her direction.

Bottom line is that the media should have done a much better job considering the circumstances of this case. A defendant who brutally killed the victim and then made it look like a suicide, this in itself is especially egregious, not to mention the fact that he calmly went to work at another job site afterwards.

So why would his side of the story be printed word for word as the ultimate truth?

Pillco may have been hard working as many immigrants are, but he was obviously very mentally disturbed. If he hadn't been stupid enough to leave those mysterious shoe prints on her toilet (while hanging her still breathing body), and if her loving and devoted husband hadn't been so diligent by refusing to accept her death as a suicide, this cold blooded killer would most likely still be walking the streets.
