Quote: "One hundred forty years ago, the Royal Society in England warned against the railroads, claiming that at speeds over 30 miles per hour, the air supply to the passenger compartment would be cut off and people would die from asphyxiation. And the college of physicians in Munich, for its part, warned that at 30 mph, travelers would suffer headaches, vertigo and possible lose their sight because of a blurring effect. Over 30 mph great catastrophies were predicted, because everyone knew that even a twig would shatter the wheels." -Jules Burgman, ABC News, NASA Langley Research Center, The Impact of Science on Society, NASA SP-482, NASA Scientific and Technical Information Branch, National Aeronautics and Space Administration, 1985 http://history.nasa.gov/sp482.pdf "This will be 'saturation' weekend for THP. They think that sending 10 cars up here to cover 11 miles is something that the general public sees as very cool, and not a waste of taxpayers money. I hardly agree. The Gov of TN has decided to make war with tourists in this area. We are under a police state on the TN side of the mountain." - www.DealsGap.com, Saturday, August 4, 2007 "As of noon, there are 14 THP troopers and 4 Blount County Sheriffs in the Gap." -DealsGap.com, Saturday August 11, 2007 "NEW TENNESSEE MOTTO ... YOU'ALL DON'T COME BACK NOW. NEWEST TENNESSEE TOLL ROAD - US 129. TENNESSEE GOVERNOR SAYS RIDE NORTH CAROLINA. TENNESSEE'S NEW SAFETY PLAN - KEEP TOURISTS OUT. TENNESSEE HIGHWAY PATROL HAS VIRTUALLY SHUT DOWN ELEVEN MILES OF A FEDERAL HIGHWAY WITH 14 OR MORE TROOPERS HARASSING ALL TRAVELERS. WHERE ARE THE FEDS WHEN YOU NEED THEM?" - www.TailOfTheDragon.com, TENNESSEE SHUT-DOWN OF US 129, August 2007 "THP nabs one of the 'lawless' on Saturday. I was ticketed for holding a video camera while driving my car. Trooper Martin stated it is a television or similar device even though the video display was closed and there is no viewfinder to look through. According to the trooper cellphones, IPODS, Whoppers and drinks are legal to hold while driving, but video cameras are not. We go to court on November 1 ... we can't wait. The stop is fully documented on two video cameras and ready for presentation to the judge. Looks like THP doesn't like their pictures taken. As a photo journalist covering the news on the Dragon I resent this attack on my personal freedom. IT IS JUST MORE HARASSMENT BY THP. We are looking into filing a civil rights violation against Trooper Martin, THP and the state." -Ron Johnson, TailOfTheDragon.com, BULLETIN AUGUST 26, 2007 www.familyrightsassociation.com/info/law/title42sec1983/ How to Win in TN Traffic Court with or without a blowjob www.DealsGapDragon.com Police Evidence Video Stung by the Dragon http://video.google.com/videoplay?docid=9061594534302727021&hl=en www.killboy.com/EVIDENCE.HTML www.killboy.com/ANALYSIS.HTML

And no, this isn't a joke. Here's the new rule: Kill a biker, get a highway named after you. As a tourist who has spent a lot of family vacation dollars in Sen. Clabough's district, if those signs go up, you'll never see another penny of mine in Knox or Blount counties." -Greg Harrison, Vice President of Communications for American Motorcyclist Association, American Motorcyclist magazine, "A Monumental Mistake", June 1999 “Please read the enclosure that presents the facts by someone involved in the investigation of this tragic accident. I grew up knowing Sen. Koella for the last 30 years. The bill has been passed and signed. There is NOTHING you can do to change that, and if you choose not to come to Tennessee, we will be better off without you.” -Senator Bill Clabough, American Motorcyclist Association, American Motorcyclist magazine, Greg Harrison Column: Contemptible, September 1999 www.ama-cycle.org/terrybarnard/index.html www.geocities.com/american_motorcycle_association/koella.html

Section 1983 class actions are in the works, with Affidavits of Probable Cause for Criminal Complaints against cops. Traffic tickets are FUN! Especially when suing them against copsters. Bet you can't cite a single successful case...but me, I do at least 5 or 6 a week and several of those go to trial and I win...EVERY time. Unless the officer does not show up. Then I win a little less. The rules are simple. If you speed you might get caught, if you get caught your likely to be found guilty. You can't sue the police for doing their job and in every community their job includes traffic enforcement. I don't know about Tennessee, but in Ohio the speed itself is not dispositive of the issue (except on highways). The question is if the speed travelling was "unsafe for the road conditions". You can be going over the posted speed limit and prevail (yes, its rare) in this issue or going under it and lose all depending on the conditions you find. In other words the State of Ohio expects drivers to BE CAREFUL. I suspect Tennessee is of a similar mindset. H
Quote: "Congress cannot pass laws that are contrary to the Constitution, and it is the role of the Federal courts to interpret what the Constitution permits. It is also not entirely unworthy of observation, that in declaring what shall be the supreme law of the land, the constitution itself is first mentioned; and not the laws of the United States generally, but those only which shall be made in pursuance of the constitution, have that rank. Thus, the particular phraseology of the constitution of the United States confirms and strengthens the principle, supposed to be essential to all written constitutions, that a law repugnant to the constitution is void, and that courts, as well as other departments, are bound by that instrument." -US Supreme Court, Marbury v. Madison, 5 U.S. (1 Cranch) 137 (1803) http://caselaw.lp.findlaw.com/scripts/getcase.pl?navby=CASE&court=US&vol=5&page=137 http://en.wikipedia.org/wiki/Marbury_v._Madison

That in committing the acts alleged herein, Defendants, acting in concert, committed the act of civil conspiracy, under state law and 42 U.S.C. § 1985, by agreeing to act together to harm the Plaintiff, and other members of the public, each acting for the purpose of promoting or facilitating the commission of harm against Plaintiff, agreeing that one or more will engage in these acts. SULLIVAN, and UNKNOWN, Defendants; Case No.: 3:06cv400; UNITED STATES DISTRICT COURT, FOR THE EASTERN DISTRICT OF TENNESSEE, AT KNOXVILLE, filed October 16, 2006 www.dbhamilton.com/amendedcomplaint.jsp www.piratenews.org/kill-robocops.html "On February 3, 1999, the district court found that the conduct of the FDIC and the U.S. Attorney's Office had been vexatious and granted the Hollands' motion for attorney's fees and costs pursuant to the Hyde Amendment. The United States appeals from the district court's denial of its motion for reconsideration of the district court's decision to award attorney's fees and costs to a criminal defendant under the Hyde Amendment, a federal statute that permits courts to award attorney's fees and costs to individuals who were subjected to a vexatious prosecution. For the reasons that follow, we affirm the district court's denial of the United States' motion for reconsideration. Because we conclude that the Hyde Amendment proceedings are civil in nature, we do not address the question whether, in the criminal context, an appeal from a motion for reconsideration always raises the underlying order for appellate review. Two other Court of Appeals have addressed this issue. See United States v. Robbins, 179 F.3d 1268, 1270 (10th Cir. 1999) (holding, without explanation, that the Federal Rules of Criminal Procedure apply to Hyde Amendment proceedings); United States v. Truesdale, F.3d , 2000 WL 554543 (5th Cir. May 5, 2000) (holding that an appeal from the denial of fees under the Hyde Amendment is subject to the appeal period applicable in civil cases)." -Judge Moon, UNITED STATES COURT OF APPEALS FOR THE FOURTH CIRCUIT, US v HOLLAND, 2000 http://laws.findlaw.com/4th/996823p.html US DISTRICT COURT BILL OF COSTS HANDBOOK www.cacd.uscourts.gov/CACD/FilingProc.nsf/f886c79ce9bf9384882567c500805718/f530515c88ba023c882567c500805ef0?OpenDocument US DISTRICT COURT BILL OF COSTS FORM www.uscourts.gov/forms/AO133.pdf

Quote: "The path between straight-line motion and free equilibrium turn requires an initial steering motion OPPOSITE that of the steady turn. Motorcycle riders in these accidents showed significant collision avoidance problems. Most riders would over brake and skid the rear wheel, and under brake the front when greatly reducing collision avoidance deceleration. The ability to COUNTER STEER and swerve was essentially absent." -Dr. Harry Hurt, US DOT, NHTSA, "Motorcyccle Accident Cause Factors and Identification of Countermeasures", 1981 www.motorbyte.com/mmm/pages/safety/safety37.htm www.geocities.com/american_motorcycle_association/crashcures.html

He wanted me to plead it and take 2 YEARS in min-security... like hell, for what, self defense ? All of the witnesses being drunk, none of the stories matched, one couldn't even positively identify any of the principals, and the two cops who came in the door at the end of it couldn't get their stories straight in SPITE of having rehearsed them together (goddamn if you wanted to root out police corruption quick, just bug the damn locker room), and directly contradicted each other more than once - grilling them seperately while the other was sequestered was a nice touch. Prosecutor was pissed as hell, threw his little briefcase into the wall and stormed out in a rage when the judge tossed the case, as it had become apparent there WAS no case - although the Judge did stoop to delivering some quiet, extremely vicious off-the-record threats when he had me walk up there so he could sign off on the whole mess.

Quote:Originally posted by Hero: Quote:Originally posted by Fremdfirma: folks have started pushin me, and many plan a write-in Yeah, the only folks pushin you are the ones in your head. And PN. Crazytalk. You and PN are off the deep end. Make no mistake, I've prosecuted folk like you before. Happens once or twice a year. We get a Freeman or other "know my rights" type who comes in to defend themself. Thats fine. They generally argue as much nonsense as they can, for as long as they can, and then lose. They like to pick and choose the laws they want to agree with. For example, one fellow wanted to ignore the Traffic Rules and substitute the Uniform Commercial Code to justify street racing in a school zone. Another fella wanted to use the fact that he had car dealor tags to justify making up his own license plates for a van he had illegally parked in his front yard. And they all argue the Constitution while ignoring filing deadlines, court appearances, or any of the other basic rules established for the orderly running of the Court system. As for Public Defenders...I've know a number of them. The last one we had was REALLY good. The one we have now is ok. Generally they have been ok but we've had some REALLY bad ones, especially when they send the interns from the lawschool. The problem PDs face is that the overwhelming majority of their clients are guilty. How can they argue a theft when I've got video from Best Buy (who has great video) of their client stuffing DVDs down their pants? Monday the PD's client for a DUI case showed up drunk...for the third time (he blew a .271). I don't envy their job because they deal with the worst clients for VERY little money. H

Quote: Judge Sentences Nifong to 1 Day in Jail (08/31/07 -- DURHAM) - A judge has sentenced disgraced prosecutor Mike Nifong to one day in jail for lying to a judge while pursuing the Duke lacrosse rape case. Nifong will serve his time beginning 9 a.m. September 7 and will end 9 a.m. September 8. Nifong, who was disbarred for his actions in prosecuting the discredited case, was initially asked to recount his career history, his personal policy of turning over evidence to defense attorneys in cases he prosecuted, and how he became involved in the lacrosse case after noticing an affidavit on an office copy machine. Defense attorneys have asked Superior Court Judge W. Osmond Smith III to punish Nifong for telling the court he disclosed all DNA testing results in the lacrosse case, when he in fact knew, and failed to reveal, the presence of the unidentified genetic material to defense attorneys. If held in contempt, Nifong faces up to 30 days in jail and a fine of up to $500. Nifong ultimately recused himself from the case after being charged with ethics violations, and state prosecutors who took over the case dropped all charges against the three men and declared them innocent victims of a "tragic rush to accuse." Nifong was disbarred in June for more than two dozen violations of the state's rules of professional conduct during his prosecution of the lacrosse case. He resigned a month later as district attorney. http://abclocal.go.com/wtvd/story?section=triangle&id=5621847
