Hello,

I would like to see a countersuit, possibly a class action suit including everyone who was forced to pay 'gratuity.' I have never enjoyed the policy of forced gratuities. If you are going to mandate the charge, don't dare tell me it is a tip or gratuity or any such nonsense. I have a personal guideline I follow for tipping. 10% for bad service, 15% for good service, and 20% for exceptional service. Mandatory gratuities rob me of my freedom to tip what was earned, and they infuriate me.

Moreover, the establishment should have been mortified that the customer was so unsatisfied with the service that they wanted to exclude the tip. That should be telling them something, giving them a clue about a problem that needs to be addressed. If they are willing to pay for food and tax but not the tip, they are trying to convey a message. By calling the police, the establishment has proved that the message was warranted.

The forced tip has been around a long time. I consider it in bad form, but it is a legal part of the cost of the meal. I will grudgingly pay it and then never return to that resturant again.

I am surprised at the poor service. The last place I went to with this policy had excellent service. Actually to a fault. I would take a swallow of my water to have some rush up and refill my glass. There was always someone nearby to anticipate any need. It made me feel like big brother standing over me.

Restaurants with "mandatory tips" usually steal those tips from the servers.

Hence, unmotivated servers and shitty service.

Most restaurants seem to steal from their employees. Gotta fuel those bizjets.

Yep, shorting the service staff tips (which they wind up paying tax on, yet not getting) is old restaurant dirty biz, and still continues to this day.

I don't dine out much, save for business, but every restaurant within thirty miles of here has a sort of running joke with me - I always look at the menu, but always order the same damn thing, and they ALL know it - when I start lookin at the menu, they're *already* setting up a cheeseburger, fries and cola.

And since it's usually talking biz at off hours, they stand clear unless discretely signaled.

They get the full measure of the tip, in cash, handed directly to them - cause they earn it, not once have I had poor service from any of em.

Houston, grrr, different story.
