Dear Patriot,

Harry Reid is attempting to ram the "Patriot" Act through once again with little debate and no amendments - despite his promise to senators on both sides of the aisle to allow an open amendment process.

Thankfully, the liberty movement has an ally in the Senate whose determination to stand up for the American people's liberties is stronger than ever - Senator Rand Paul.

For the past seven hours, Senator Paul has been holding the Senate floor, keeping Reid and his allies from rushing this bill through the Senate without debate or amendments.

I know over the past two days I've sent you numerous requests to take action by calling your senators and demanding they oppose the unconstitutional, misnamed "Patriot" Act - and I will ask you again in just a moment.

But first, please give Senator Paul's office a call at 202-224-4343 to thank him for standing up for the American people and the Constitution!

Afterward, please give both of your senators another call through the Capitol Switchboard at 202-224-3121.

Ask them to stand with Rand Paul, the Constitution, and the fundamental liberties that made America great by opposing the rushed extension of these three provisions without debate - and unamended.

Together, we have a great opportunity to make a difference, but I need you all to remain as steadfast and committed to this fight as Senator Paul.

I hope you will stand with Senator Paul and C4L by again contacting both of your senators to oppose the extension of the so-called "Patriot" Act.

In Liberty,

John Tate
President

Oakland, the Patriot Act and Osama bin Laden : Indybay

RaiseTheFist.com

The feds claim that Osama bin Laden was involved in the catastrophe that occurred at the World Trade Center, and other locations on September 11, 2001, and further claimed that the fascist draconian legislation passed that is called the Patriot Act, would solve our problems.

That was around 10 years ago, and the war machine is still running full steam ahead on a global scale, wasting trillions of dollars on death and destruction, spilling blood all around the planet.

Then they said Osama bin Laden was killed on Monday May 2nd, 2011, and the hype has gone on non stop in the main stream press since the evening President Obama got on the air waves and publicly made the case, that Osama bin Laden was killed by an American death squad.

The White House could not keep it's story straight, and differing versions of what allegedly happened to Osama bin Laden was quickly leaked to the press, including the claim that Osama bin Laden was immediately buried at sea.

During the past three weeks, the main stream Bay Area media covered the Osama bin Laden issue like some crazed mad dog cheer leaders pushing the public over and over again to celebrate the existence of the death squad involved in the so-called killing, of Osama bin Laden.

They call this journalism.

The death squad celebrations are still being promoted by the so-called journalists and newscasters in the local news rooms of Channel 2, Channel 4, Channel 5, Channel 7, Channel 9, and Channel 11, and this madness has been broadcast as the news for the past three weeks.

Perhaps there should be some debate about the draconian Patriot Act thats to be voted on soon. A mature discussion on how it should be allowed to die, and rest in peace after ten years of wreaking havoc on the civil rights of people in America, and around the world.

There is no need to extend the Patriot Act for another four years. The Patriot Act needs to die and rest in peace, now that Osama bin Laden has allegedly been killed.

Mission Accomplished.

Public libraries are also much better sources of explosives information than the pathetic Reclaim Guide. Even CNN is happy to share a pipe bomb recipe with curious readers, apparently without legal repercussions. And there is extensive information available under "explosives" at HowStuffWorks.com, including information on the construction of nuclear weapons. Again, perfectly legal. And the Wikipedia (an online encyclopedia) gives a much better recipe for a Molotov cocktail than the Reclaim Guide version.

What distinguishes Sherman Austin's copy of the Reclaim Guide from my copy, or from material offered by Amazon.com or CNN or HowStuffWorks.com, or any good university library?

Austin's crucial mistake would seem to be allowing the explosives information to appear on the same web site as his anarchist protest rhetoric. (And the Reclaim Guide itself makes explicit reference to a IMF/World Bank meeting that was scheduled to take place in Washington, DC.) Hosting the bomb-making information on a separate web site, with no suggestion as to how it should be used, would probably have shielded him from prosecution.

See Leslie Kendrick's Virginia Law Review article on "criminally instructuctional speech", which includes discussion of the Austin case and the legality of mirrors.

Now, it’s about starting the world. JAN 24, 2007 - 5 YEARS AFTER THE FBI RAID ON RAISE THE FIST

author: repost from a listserve
written by Sherman Austin
edited, and posted by Akwala

On January 24, 2002 I was surrounded by 25 federal agents from the FBI and Secret Service Los Angeles Joint Terror Task force while I was at home asleep taking a nap.

The agents were armed with sub-machine guns, shot guns, bullet-proof vests, a battering ram, and a 25 page search and seizure warrant filled with as much "terror rhetoric" as they could think of. While asleep I was unaware that agents were
already positioned around every angle of the house, including right outside my window with loaded weapons ready for a fire fight. I was 18.

Fortunately my sister was home and woke me up to the news that "a bunch of FBI looking people" in suites and vests were all over block and up and down the streets. Every single one of them focused on the house. It had only been 2 years since I started the site Raisethefist.com which was receiving thousands of hits daily from around the world, many of those hits were also coming from the FBI, U.S Department of Defense, NSA, Secret Service, and foreign government law agencies. I
was running the site on a computer network and a residential DSL line from my home.

The news was no surprise.

I got up. Looked at the servers hosting raisethefist.com. They were off-line.

I approached the door where 2 special agents asked for my name, then grabbed my shoulder and pulled me outside. Agents armed with their loaded sub-machine guns and shot guns emerged from their hiding spots and entered the house. Just as they
walked in, "Its this way!" one of the agents said as he pointed his sub-machine gun and led others to my room where the servers were.

The 2 special agents who greeted me at the door escorted me back inside and said they had a search and seizure warrant because of my web site, Raisethefist.com. I asked them how this was legal and they said it was now legal under the USA Patriot Act.

I wasn't being accused of authoring anything on raisethefist.com. I was being accused of authoring a web site that was created by somebody else. A white kid. A web site that contained a page on how to build home-made explosives. Again, a web
site I didn't author, implement, or create in any way. The FBI insisted I did. They asked me 7 times if I was the author of the site which contained this explosives information. I said "NO".

I had a link to this web site from Raisethefist.com , as I did to many other sites.
While my room was being ransacked. The "evidence" which consisted of computers, protest signs, and political literature was loaded into boxes and placed into a big white truck waiting outside.

The FBI tried to ask me questions about raisethefist.com. The FBI told my mother they had been watching me for a very long time and my political haven't changed. I was asked if I'd like to see the president killed. I was told I had crossed over a line and as long as I got back on the other side of that line everything would be
okay. In other words if I stayed silent and did what I was told there would be no more trouble.

After approximately 6 hours the FBI agents left. We noticed a message on the answering machine from a call that came in the same day but before the raid. It was from an individual I hadn't spoken to in 2 years. He left a message asking if I wanted to "hang out". A few weeks prior he sent me an email about going to an anti-capitalist demonstration together to "smash the state". I later learned the FBI visited this individual, stood over his shoulder, and dictated the very words he sent me in the email. And as for the phone call, this was also a setup. He was
an informant. The FBI forgot to black this out in the 1000+ pages of case discovery.

But that wasn't the only thing they forgot to black out.

The white kid who I mentioned earlier. The one who authored the site on how to build home-made explosives. He was visited by the FBI as well. What did the agents do? Arrest him? No. They confirmed he authored, implemented, and created the web site on how to build Molotov cocktails, pipe bombs, and other recipes, then they
left. What happened next? The FBI fabricated statements saying I admitted to authoring, implementing, and creating the web site on how to build explosives.

2 weeks later federal prosecutors call my public defender and say the FBI didn't find anything illegal on the computers they seized but didn't want to let me off the hook. Basically they wanted me to sign a plea admitting guilt to something I
didn't do.This only happened after spending 2 weeks in a 24-hour lock-down maximum security federal prison cell where I was only allowed out for legal visits, and my closest neighbors on the cell block being those convicted for the U.S.S Cole bombings and the bombings of the US Embassy in Kenya. I was called "terror boy".

Then of course I was released after 2 weeks when prosecutors decided not to indict me on anything until they had gone through all of the computers. A 6 month period of death threats, wire taps, harassment, government threats, being followed and
surveilled by undercover agents, sheriffs and local police continued..

I still continued to organized and refused to remain silent. The feds didn't like that.

"18 U.S.C. 842 (p)(2)(A): distribution of information relating to explosives, destructive devices, and weapons of mass destruction with the intent that such information be used in furtherance of a federal crime of violence."
This was the statue written and sponsored by Senator Dianne Feinstein and passed under Clinton's 1997 anti-terror law. It was never before enforced. Not until August 4, 2003 when I was sentenced to a year in federal prison and 3 years "supervised release". I was threatened with over 20 years in prison under the terrorism enhancement. I was never indicted.

What happened to the white kid who actually wrote the explosives information and put it on-line with the intent that it be used at an upcoming protest against the International Monetary Fund in New York? Nothing.

The FBI walked out of the court room with smiles. My mom, family and friends were in tears.

And of course It was only standard routine for the U.S injustice system. Another young black male, railroaded by the system. Convicted and sentenced for a crime he didn't commit.

I went in when I was 20 and got released in 2004 when I was 21. I lived with my mom for the first few months when I got out. 2 undercover agents moved into an apartment complex directly across the street. They kept the blinds on the windows
closed 24/7. We later learned they worked at the Westwood Federal Building. That's the same federal building that the FBI on the case worked out of. Sometimes they made the mistake of not taking off their security badges whenever they came and
left the apartment. It was a bad job of being undercover...

As was the entire case. A bad messy job. Fabricated evidence filled with contradictions and obvious lies and allegations created by the feds. Yet the obviousness of the truth wasn't enough. The blatant fraud, a blatant setup wasn't enough to stop the judge from handing down a year prison sentence.

This case had nothing to do with information related to explosives being made available to the public on the internet. If it did then I wouldn't be on the one writing this right now with my pencil and paper as the stipulations of my probation state I still can't touch a computer.

I would say to those who believe this is too far fetched to be true, just go look at the case discovery and see for yourself. The obvious lies are supported by the contradicting articles FBI agents forgot to black out. The truth is right there.

But recently we've learned that the entire case was SEALED by the feds.

Not even a lawyer can get access to the case files now.

However, a copy of the entire case discovery was obtained before this happened. And that copy hasn't been sealed.

.What are these so-called "controversial" changes to the post-9/11 act -- which expanded governmental search powers -- that Paul wants?

"Controversial" things like requiring the government seek a judge's approval before conducting a search of someone's credit cards, emails, library books, bank statements, and business records or conducting a "roving wiretap," and requiring the government to actually come up with probable cause before searching such records or executing such wiretaps.

.Where did Paul get the notion for these "controversial" demands? The Fourth Amendment of the U.S. Constitution.

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Actually, I was asking because I didn't know, and I was expecting a scam, like I expect from all politicians.

...The 4th amendment already exists. Those protections should already exist. The Patriot Act apparently violates the fourth amendment, otherwise it wouldn't necessitate the addition. We don't need repetition in law like chronic echolalia in order to uphold any ideals we live by, we just need to stop passing the laws that violate them.

My point still stands that it would just be easier to uphold the constitution and Bill of Rights amendments if they just dropped the Patriot Act. So why don't they?

Almost sounds to me like the language of the proposed amendment is to make getting warrants easier, and allow judges to issue warrants for more in-depth investigations of more frivolous suspicions. If a judge issues a warrant immediately without affadivits mentioned or implied (the "oath" mentioned in the fourth amendment) in the wording of the Patriot Act, then law enforcement can make up charges without fear of perjury.

I don't support passing draconian bullcrap with some mouth service claiming the government is looking out for our best interests. I'll only accept repealing it or expiring it.

Reid Preempts Paul, Slips Patriot Act in Small Business Bill

Kurt Nimmo

May 25, 2011

Senate Majority Leader Harry Reid has circumvented a call by the newly elected senator from Kentucky, Rand Paul, to debate the Patriot Act.

In order to prevent a filibuster, Reid performed “some procedural gymnastics,” according to Fox News, and slipped Patriot Act language into a House small business bill that is considered filibuster-proof.

In doing so, Reid has skirted objections to the bill led by Paul and has moved closer to extending the Patriot Act without debate. Democrats have applauded this effort to rush the extension into law without debate.

“The suggestion that the extension should be debated fueled considerable opposition, particularly from Sen. Dianne Feinstein (D – CA), who insisted it would be a ‘huge mistake’ to debate the bill and might threaten national security,” writes Jason Ditz.

On Monday, Paul went on the floor of the Senate and argued against the extension. He introduced the Leahy-Paul amendment which would have National Security Letters expire on December 31, 2013. It also requires the Justice Department inspector general to audit the issuance of NSL letters and expands public reporting on the use of such letters under the Foreign Intelligence Surveillance Act.

The National Security Letter provision of the Patriot Act directly assaults the Fourth Amendment. It expands the FBI’s authority to demand personal customer records from Internet Service Providers, financial institutions and credit companies without prior court approval.

Actually, it's even easier than that, or at least it should be: Challenge that shit, all the way up to the Supreme Court. If they strike it down (and they seriously should), then the Patriot Act goes away as being in material violation of the Fourth Amendment.

Quote:

Almost sounds to me like the language of the proposed amendment is to make getting warrants easier, and allow judges to issue warrants for more in-depth investigations of more frivolous suspicions. If a judge issues a warrant immediately without affadivits mentioned or implied (the "oath" mentioned in the fourth amendment) in the wording of the Patriot Act, then law enforcement can make up charges without fear of perjury.

I don't support passing draconian bullcrap with some mouth service claiming the government is looking out for our best interests. I'll only accept repealing it or expiring it.

No kidding. With this SCOTUS already saying that cops don't need any kind of warrant beyond their nose and ears ("I heard a toilet flush, and smelled what I thought was marijuana, so I knew they were destroying evidence in that apartment I had no business even listening in on, so I kicked the door in!"), we really DON'T need to make it EASIER for them to get warrants on even flimsier "evidence"!

Quit adding onto the fucking Patriot Act; let it die, or challenge it and get it tossed out. (Only I'm not sure it WOULD get thrown out. )

The supreme court could take years to see the case. The Patriot Act has to be renewed every two years or it'll expire. Easier to make it expire than to rely on the good will of life-time appointed tyrants.

Good point, Byte, but I'd still like to see BOTH approaches tried. Yes, let it expire, but also keep pushing through courts.

Well, I'm always for contingency plans and back up strategies. Though I'm cautious here because if the supreme court were to backfire on us in striking down the Patriot Act, it would give it... legitimacy. *shudder*

Yeah, that's the real danger. And they've given their legitimacy to some really frightening shit recently.

The downside is, if it's never challenged, it's still going to be seen as "legitimate". The Constitution says lots of really great, really neat things, including such proclamations as the ones that begin, "Congress shall make NO LAW..." - and then some boneheaded state government goes right ahead and does it anyway, or CONGRESS does it anyway, and once a bill is passed and signed into law, it IS the law, until such time as it's challenged and overturned.

So even if the Patriot Act were allowed to expire, the precedent is still sitting there, festering on the shelf, stinking up the books. I hate that. I want it gone, I want it not only expired, but terminated, with extreme prejudice.

But as you point out, this Court may not be in any rush to do that. We may all be boned. :(

Your argument about stinking up the books is both logically and visually convincing. Some effort to kill it with fire and leave it on Dick Cheney's porch is required.

Meanwhile, Rand Paul shows us just how much of an ANTI-patriot he truly is, by advocating stamping out the First Amendment protections of free speech and freedom of assembly and the Due Process protections as well!

Quote:

Rand Paul, avowed fascist cocksucker, said:

I'm not for profiling people on the color of their skin, or on their religion, but I would take into account where they've been traveling and perhaps, you might have to indirectly take into account whether or not they've been going to radical political speeches by religious leaders. It wouldn't be that they are Islamic. But if someone is attending speeches from someone who is promoting the violent overthrow of our government, that's really an offense that we should be going after -- they should be deported or put in prison.

Now, by his own words, he's saying that Sharron Angle, for instance, should be deported or put in prison. And so should everyone who ever attended one of her rallies where she spoke of "Second Amendment remedies" and said that she needed to "take out" Harry Reid.

I can only assume that he's never attended a gun show or a Ted Nugent concert. If he had, he's arrest and/or deport everybody there!

Did he really say this? If so, my God.

I guess my vacation plans to visit Persepolis should be scrapped. Or attending a public reading of the Declaration of Independence.

Yup, CTS, he really, really said it.

This is the hero of the so-called "libertarian" tea party.

Now you see him and them for the fascists they truly are.

Of course he MEANS it to apply to people like Anwar Al-Alakih (sp?), the radical Muslim cleric and American-born American citizen who has had a death warrant placed on him by the U.S. government, no trial needed.

But it applies just as easily, and just as equally, to attendees of speeches and performances by Angle, Nugent, and a host of others.

What if you see a radical speech in a movie? Does that count? You paid to listen to it, after all.

If you ever said "Support the Troops!", you are a socialist. You've taken money from me, by force and at gunpoint, and you've given it to people who are on a mission I don't support, and are murdering others in my name, and I am given no choice in the matter.

I'm not sure if this should go in 'The End of Constitutional America' or here

but it seems there are some Americans on the ground and they may have picked the other side or at least some kind of neutral position. One of them Gonzalo Lira López, an American novelist and film director, he seems to have Imdb credits but I'm not sure which Gonzalo Lo[pez he is, maybe the guy who was making podcasts and film show with Sargon of Akkad? He shows film saying he is in Ukraine now

All bullshit politics forgotten, its the ordinary person of Ukraine that will die and it's the citizens that will suffer.
