Herman Cain accuser stands by complaint, won't go public

The lawyer for one of the woman who received a financial settlement after alleging sexual harassment by Republican presidential candidate Herman Cain when he was head of the National Restaurant Association in the 1990s said Friday that the woman stands by her allegations but is choosing not to discuss them publicly.

The woman "sees no value in revisiting" the complaint, attorney Joel Bennett said, saying the woman and her husband feel it would be "extremely painful to do so."

"My client stands by the complaint that she made," said Bennett, adding that "she would disagree with the statement's [Cain has] made concerning her complaint."

"She made a complaint in good faith about a series of inappropriate behaviors and unwanted advances from the CEO," he said.Bennett did not provide details of the allegations but did say that multiple incidents took place "over a period of time at least a month or two."

Cain has flatly denied all allegations of sexual misconduct and complained of a "witch hunt" against him. In response to the statement, Cain spokesman J.D. Gordon said, "We look forward to focusing our attention on the real issues impacting this country -- like fixing this broken economy and putting Americans back to work through our 9-9-9 Plan, as well as strengthening national security."

Bennett said the woman is not interested in "exposing herself personally...she prefers her privacy and not to be a public figure." He said she appreciates the media and public respecting her privacy.

Bennett represents one of two woman who settled with Cain over alleged sexual misconduct; the Associated Press reported that a third woman has also accused him of improper conduct. According to a report by the New York Times, Bennett's client received settlement of $35,000, though Bennett is not discussing the amount other than to say "it was a monetary settlement.

Cain has given conflicting accounts of his knowledge of the accusations and the settlements, which he first said he was unaware of before discussing them specifically.

Bennett told CBS News earlier that Cain did not sign the initial settlement agreement, and that it's conceivable that Cain didn't even know about it. He repeated that assertion Friday afternoon.

Still, he said "Mr. Cain knows the incidents that were alleged," saying they involved "very specific instances."

"If he chooses not to remember or not acknowledge those, that's his issue," he said. Bennett said the woman was married at the time of the incident, and remains married today.

The National Restaurant Association said in a statement released as Bennett was speaking that it "can confirm that more than a decade ago, in July 1999, Mr. Bennett's client filed a formal internal complaint, in accordance with the Association's existing policies prohibiting discrimination and harassment. Mr. Herman Cain disputed the allegations in the complaint. The Association and Mr. Bennett's client subsequently entered into an agreement to resolve the matter, without any admission of liability. Mr. Cain was not a party to that agreement. The agreement contains mutual confidentiality obligations."

The statement went on to say that the restaurant association had agreed to waive the confidentiality provisions if the woman wanted to discuss the allegations. Bennett said he and his client "have not asked them to lift it beyond making this statement." He also expressed concern about violating "confidentiality and non-disparagement" provisions in the agreement.

Meanwhile, Cain keeps "remembering" details of things he says never happened, and keeps trying to parse words ("We had an *agreement*, but I didn't know it was a *settlement*"; "If she got anything, it wasn't much."; "She got a standard severance package... of two or three months salary." - turns out one woman got a full year's salary - hardly a "standard" severance package for a staffer)

Hey, it sounds like Cain is just really bad at picking up women, and thinks that if you just grab a woman's head and pull it towards your crotch, she'll get an idea what you want.

Haley Barbour says that this whole thing "smells like Clarence Thomas" - whatever that's supposed to mean. Seems to me, with the number of women involved now, and the FACT that there was definitely a decent amount of cash paid out to at least one of them, this is starting to smell more and more like Bill Clinton. Or at least like one of his cigars.

And let's just think about the irony: Cain has "no memory" of lawsuits and accusations and untoward behavior and settlements or any of that...But as soon as the accusing woman's name becomes public, he's all ready to go with a document containing her whole personal financial and legal history. Hmm.

BTW, he disclosed all this sexual harassment "stuff" in private conversations with his handlers-of-the-moment in 2003. Just in case it might come up. But in 2011 he has no idea. So that's what he's trying to sell us. (And sadly, that's what some demented little people are buying, because they need something chewy to go along with their kool-aid.)

My eyes are rolling right out of my head right now.

Wait, I might be confused again - is this story about Perry or Cain? Or Santorum? Gingrich? Bachman? Sarah P? Or--my god--is W. back? They're all so uniformly nuts that I can't tell which is which...

On the up side, I kind'a like Buddy. He's done good things, not the least of which was on Colbert last night. Brilliant.

Someday I may have to live in a world with no Stewart and no Colbert. That will be a very sad day. Unlike a day with no Cain/Bachman/Palin/Santorum/Perry/Romney... I'll survive that one, but only because there will all be those juicy internet video clips to remind me of the GOTP fun.

I also note that Cain's campaign claims that this latest accuser has had cases filed against her claiming medical fraud, and they act like that alone is "proof". What they miss is that, by their own standard of "proof" - or their implication that since she's had allegations made against her, there MUST be something there - Cain is confirming what all his accusers have said. Hey, there's a settlement, so that settles it, right? There were complaints filed, so he MUST be a serial harasser, right?

Meanwhile Cain, who says he doesn't really believe there's racism anymore, has made references to "lynching", claimed that it's because he's black, blamed "brainwashed" blacks and "the Democrat plantation", and is now crying about some secretive vast left-wing conspiracy being carried out by "The Machine". The more Cain denies that whatever happened didn't...

The more pissed the women that it happened TO will be. The slow drip-drip-drip of ongoing revelations from these angry women, who will refuse to see their sisters taken down individually, will torpedo Cain.

This really IS like Clarence Thomas, but the outcome will be different. Women of that time (that's me) remember Anita Hill being pilloried by the right for daring to speak the embarrassing truth. But people then- black and white- were so caught up with racial politics they couldn't see that Clarence Thomas was a buffoon. Thomas himself has taught many people (blacks included) to look beyond race. Heh.

Good point, Sig, about the other women. That may have been at least partly behind this "fourth woman" coming forward, so there may be more to come. Hopefully; if he gets buried under enough of them, and enough verifiable FACTS...oh, no, wait, I don't WANT the ultra-righties to give up on him, I want him NOMINATED! That would be SO much fun, what with his ignorance, ego and stumble-ability.

Seriously, tho', this is pretty disgusting. Apparently the name of the second woman who got a settlement is known by the media now, so HER life will probably become hell. That's a shame--Anita Hill went through quite enough, and now other women's lives will be affected. Damn these bastards. I would say something along the lines of "MEN!", but I know they don't represent you guys. It's just that once some men get a bit of power, it seems like the first thing their "brains" turn to is how to use it to get sex! And all too often, they succeed.

I hope they bring him down big time. That smirk makes me sick; thank gawd he's not running that ad here, so it only pops up in clips from pundits. I just got to see this creepy sleazebag in person, complete with kinda subduded pimp-daddy threads, at a local diner populated by low browed, slack jawed, rightwingnuts who'd make our own Rappy feel at home - seriously, I felt the desperate need to take a goddamn BATH upon my return just from being that close to them, and the whole thing put me of a mind of one of them sleazy religious revivals run by some shyster with that cult of personality goin on, yeah, he has charisma up close and in person - but it's the kind where once you get some time, distance and space you kinda feel the urge to puke, there's a really, REALLY heavy "sleaze factor" which comes along with it - not that any of the (entirely white, mind you) adoring crowd of hate-radio koolaid chuggers seemed to notice or care but what do they ever care for reality anyway, right ?

I give him about two points over even me on the personal charisma thing since mine is certainly more understated, minus a couple on fashion sense, and then it goes into negative numbers quickly on policy and morality - stupidass ripoff tax plan aside, you do NOT want this guy in office - imagine a right-wingnut version of Clinton with suppressed race issues going on underneath the surface cause at one point he was kinda grinding his teeth upon noting ZERO people in the crowd who weren't righty-whitey wingnuts, all the more laughable to me being that he isn't, and they don't seem to REALLY care, so much as mindless obediance to "the cause" in a fashion straight out of the late 1930's.

He's a charlatan, a fraud, a smooth talking slime with a hefty heap on personal charisma and charm who has essentially nothing behind it but the iron fist of the same despotic fuckers behind Bush and Cheney - so essentially a right wing Clinton, only without Clintons intellect or ability.

I'm kinda surprised you stuck around as long a you did, Frem! Did you catch his referring to himself with regard to the Koch brothers as "the brother from another mother"? He doesn't see any problem with that...what's that tell you?

NOW he's in trouble for calling Pelosi "Princess Pelosi" (not for the first time, according to reports). He finds nothing wrong in this; when asked why he's apologizing for saying it, his response was "So you guys will stop asking me about it". The man is, among many other things, totally clueless.

I don't think about him much and wish the news would shut up about him. He's ONLY in it, like Palin, to sell books and speaking tours, and that will become obvious soon enough.

What's truly sad is how the audience boooed even the QUESTION at the debate, and then cheered lustily at his "I'm a victim" answer. Something is truly wrong with the mentality of the right these days, and it's incredibly sad to see.

But there’s also something else. The GOP’s relationship with Cain is more psychologically important than its relationship with any other candidate because Cain is that special thing: the party’s cool new Black friend. You ever see white people in the beginning stage of latching on to a new Black friend? They’re more excited because it’s something new and cool, a font of new thoughts and experiences. This isn’t simply racial: its the thrill of making a connection with someone unlike you who opens you up to new things, like a woman with a new gay friend.


Cain has to survive his still metastasizing sex harassment scandal and his many gaffes and his clear lack of competence, experience and serious intellect because the GOP is so excited about him that they are refusing to really kick the tires (or admit to themselves that when they kick the tires they prove flat). Because they know they need him. See, Cain feeds the myth that racism is over.

Some Obama critics feel they have been wrongly painted as racist for the crime of opposing Obama. Some of their critique has been racist, some has been reasonable, some has been unreasonable but what would be leveled at any Democrat. Either way, Cain offers absolution and liberation from feeling like a racist. For how can the party be racist if there’s a Black frontrunner? I think many in the party genuinely like him and are won over by his chutzpah and respect his journey from Morehouse to CEO. Fair enough. But the ascension of Cain does not prove that racism is over. Just because the party has a cool, new Black friend it’s excited about, doesn’t erase decades of condescending opinions and harmful policies toward Blacks.


Alas Cain, in particular, is not the best person on which to hang your proof that your party isn’t racist. A Black man who denies that racism has an impact on today’s world gives great comfort to people who wish for the race conversation, as opposed to racism, to be over. A Black man who thinks if you don’t have a job, it’s your fault gives comfort to those on one side of the class war. A Black man who wraps himself in minstrelish tropes, like wanting the Secret Service to call him Cornbread and breaking into song at campaign events, surely gives comfort to those who are still not comfortable seeing Blacks as Alpha men. A Black man who can lead in the polls for weeks without seriously convincing anyone that he’s going to win is like having your chocolate and not getting fat. Or getting the walk-on-the-wild-side thrill of dating a Black guy without worrying that you’ll ever be pressured to marry him.

Even if he’s not the nominee, Cain has already proven himself a psychologically transformative candidate for the GOP because the confidence that comes from having “dated” him is like a shield off of which all accusations will bounce. Mostly I wanted to see him up close personally since the opportunity was right there and I had homefield advantage, just like I did with McCain, only he pales even in comparison to McCains self-damning stupidity in lauding Nuclear Power to folks who were still pissed off about Fermi - twas only that the masters ordered it that got him any crowd at all around here.

Except that it's a lie. There's a guy with the same last name, but he's not related to her. And he doesn't work at Politico.

What kind of evil parallel plain are we living in, that THESE are the people running for President??? Did the damned rift open up again and I missed it??? They're certainly not from THIS planet!

Did find amusing that, once his brain thawed, he yattered on and on about how HE would have evaluated the decision and decided what to do, which just happened to be exactly what Obama must have done. I mean like DUHHHHH!!

It's astonishing to me what's happened here, culturally. We're used to politicians bullshitting their way through interviews, forever evading question after question. It makes us mad, but it doesn't make us think, "This guy is a sad, incompetent fool." Being a good bullshitter can even be construed as part of a politician's stock in trade.

But this? This isn't even bullshitting. This is simply failure. It's anxiety and confusion and humiliation. Watching him shift in his seat, move his water bottle around as he tries to come up with SOMETHING to say is painful.

How did we get here? People have already spent a ton of money on getting this man elected, and will surely be spending several tons more before he's done. What were THEY thinking? Has the right's blanket disrespect for government *per se* blinded them to the need for their candidate to have the slightest clue what the hell is going on in the world? Or have they become so comfortable with the corruption of our system that they don't even worry about their candidate's putative electability--only his willingness to do their will?

Put it this way: If I ever walked out of a job interview after a performance like that, I'd drive away *KNOWING* there was no way in hell I was getting the job, and I'd be downright scared and embarrassed if I *did* get the offer after such a horrific performance.

He went into this knowing he was going to be asked questions. He has claimed repeatedly that if he didn't know something, he was just going to come out with it and say, "I don't know" and move on.

I actually felt kind of bad for the guy, because that was just plain uncomfortable.

We really are humped. None of the Repubs are any good at this and so none of them have a chance. Obama will win again, even though most people agree he isn't good at being the president and most people would prefer someone else.

But you've got a great point - we NEED better Republican candidates. The "establishment" Republicans won't have anything to do with Ron Paul or Jon Huntsman, because they say crazy-loopy things like "We have to work with the Democrats to find solutions."

They say that compromise is an agreement that leaves no one happy, and if that's the case, then Romney will be the nominee.

Oh, Jim's up and around--he went to work. Two skinned knees, two skinned hands and a huge cut on the bridge of his nose...little things like that will never stop him! He's one of "those"... yeah, it'll take a while to heal, he's got so many scrapes and cuts--he said it doesn't really hurt, he's just stiff all over. No surprise there! I'm pretty used to this; he tends to come home with road rash on a fairly regular basis, whether he trips himself running in the hills or falls off his bicycle...I've long since given up trying to dissuade him, but I KNEW running with them up on the Divide on leash pretty much guaranteed disaster. Told him so, too, when he decided to do it, but, well, you know..."MEN!"

Tashi ended up damaging BOTH of us in less than 24 hours. Choey and I took the dogs out to the reclamation ponds...they're great for sulkying, gravel path winding in and out of them, good workout for the dogs. I carry water, and the water bag was empty. So I'm standing at the open door filling it, bent over, making sure to block the dogs, and damned if he didn't JUMP OVER ME! This is a dog who doesn't push himself, only jumps for dinner, and at that just once or twice in excitement, and let's poor Kochak, at ten pounds lighter, do the majority of the pulling on the sulky.

The ponds are next to a cow pasture. Yup, there he went, like a bat out of hell, after the cows. I had to scramble over a fence after him, which was stupid because there's no way I can catch him and he won't come back until he's tired, hot, thirsty and/or bored, but I did it anyway. Scraped myself going over and (when he was either tired, hot, thirsty and/or bored) bringing him back, so I've got my own "war wounds". AND hurt my back...

Not only that, but one of them stole an ENTIRE CAKE last night (!!). It was one of those sale "day-old" cakes, and I thought I'd put it where they couldn't get to it. Silly me. Found the plastic container on the dog bed in the Outback; Kochak has dabbled at her last two meals and Tashi has diahhrea, so they both had their share. I never got a bite.

I keep trying to remember why I wanted huskies...

Yup. On the other hand, they're not nearly as SCARY as Bush or McCain, who actually had a chance and who were and would have been a disaster if they got elected. What we've got now I'm thoroughly enjoying, it's the best comedy I've seen in ages, and the late-night guys, and Stewart and Colbert, should send in donations, they've given them so much material! I saw a clip of a SNL skit supposedly lampooning Cain's Libya idiocy...but it wasn't nearly as funny as when Cain himself did it. Some things you just can't improve on!

I say let'em come, give 'em every possible chance to talk; I don't have to listen, but they'll really help us defeat them next year!

It's a damned good thing nobody's paying attention to Huntsman. The more I hear from him, the more I respect him...as nominee I think he might actually scare me. But he'll never get nominated, thank gawd; to start, he's part of that Mormon "cult", and then he actually (gasp!) believes in science! Those are both death knells, thank goodness.

Maybe, MAYBE, as his last term, Obama will find that guy he said he was, or believed he was, or WAS, and get some shit done before he leaves office! I think what it is, is that the ACTUAL candidates are biding their time to 2016. I mean, anyone with half a brain doesn't want to be up on stage with those fruit baskets!

The dangers of chocolate for dogs tend to be greatly exaggerated. A full-sized dog like a Husky would have to eat something like one of those 16-oz giant-sized dark chocolate bars to be in any real danger. A little bit once in a great while isn't going to do any harm to them.


While I wouldn't necessarily *support* Huntsman, he's probably the Republican candidate most likely to get me to stay home on Election Day. I've got no real enthusiasm for Obama, and would only vote for him as a vote *against* any of the others. As far as Huntsman is concerned, I figure, "Meh - we could do a lot worse..."

Ron Paul? I'd actually vote for that crazy bastard.

Yup, Mike, that's pretty much how I feel about Huntsman. Tho' I wouldn't stay home; the party BEHIND him is capable of so much harm, it would be them I'd be voting against.

Riona, Mike's right...we had a Springer Spaniel (not by choice!!!) who ate an entire huge chocolate heart. Called the vet, he said she'd be fine, but wired to the gills before it passed through her system. And she was. All friggin' night! Picture an already-hyper dog on a severe cafeine high!

It wasn't chocolate anyway, it was Dulce de Leche. I love the ice cream, so thought since it was cheap I'd try the cake. Wonder how it tasted? Turns out it was both of them...Kochak wasn't interested in breakfast the next day or dinner last night, and Tashi's got the runs (serves him right!). Friggin' huskies...
