With everything that Flynn did with Turkey, this is an incredibly light charge. Clearly, there's a plea deal at work here.

Quote:

Michael Flynn Charged With Lying To FBI, Set To Plead Guilty

Special Counsel Robert Mueller has charged former Trump national security adviser Michael Flynn with "willfully and knowingly" making "false, fictitious and fraudulent statements" to the FBI regarding conversations with Russia's ambassador. Flynn, in turn, is expected to plead guilty in a DC court to making false statements to FBI agents in January 2017, according to the court filing presented below. The plea hearing is set for 10:30 am ET.

COURT FILING SAYS FLYNN FALSELY STATED HE DID NOT ASK RUSSIAN AMBASSADOR TO REFRAIN FROM ESCALATING SITUATION AFTER U.S. HAD IMPOSED SANCTIONS ON RUSSIA
COURT FILING SAYS FLYNN FALSELY STATED HE DID NOT RECALL THAT RUSSIAN AMBASSADOR TOLD HIM RUSSIA HAD CHOSEN TO MODERATE ITS RESPONSE TO U.S. SANCTIONS AS A RESULT OF HIS REQUEST
COURT FILING SAYS FLYNN FALSELY STATED THAT HE DID NOT ASK RUSSIAN AMBASSADOR TO DELAY VOTE ON PENDING UN SECURITY COUNCIL RESOLUTION AND THAT AMBASSADOR NEVER DESCRIBED RUSSIA'S RESPONSE TO HIS REQUEST

Michael Flynn is now the second person involved with the Trump campaign to admit wrongdoing in Mueller’s probe into allegations of collusion between the Trump campaign and Russia; he is however the first Trump administration official charged in relation to Mueller’s probe into Russian interference in the 2016 presidential election.

Former Trump campaign chairman Paul Manafort and aide Rick Gates were charged with money laundering from alleged crimes that took place before they worked with Trump. A campaign adviser, George Papadopoulos, pleaded guilty to lying to the FBI earlier this year over contacts with officials connected to the Russian government.

After he left the administration, Flynn filed a foreign registration form showing that he hadn’t disclosed multiple contacts and payments from foreign entities while serving as a campaign adviser to Trump starting in February 2016. The company received $530,000 from a Dutch company working on behalf of Turkey’s government, to lobby the U.S. for extradition of an exiled cleric who has opposed President Recep Tayyip Erdogan of Turkey. He’s also disclosed payments from the Russian news site RT, described in an unclassified U.S. intelligence report as “the Kremlin’s principal international propaganda outlet.”

The news about Flynn comes a day after CNN reported that Jared Kushner had met earlier this month with Mueller's team as part of the investigation into Russia's meddling in the election, according to two people familiar with the meeting.

The question is whether as part of the plea Flynn will 'reveal' something about Trump, because if 6 months after the Mueller probe the best he could get out of Flynn is making a "false statement" about meeting the Russian ambassador, then Trump has nothing to be worried about.

And yet, nothing in there about why Trump is in a panic to end the Russia Inquiry:

Trump Pressed Top Republicans to End Senate Russia Inquiry

Senator Richard Burr of North Carolina, the intelligence committee chairman, replied to Mr. Trump that “when we have exhausted everybody we need to talk to, we will finish.”

Mr. Burr told other senators that Mr. Trump had stressed that it was time to “move on” from the Russia issue, using that language repeatedly, according to people who spoke with Mr. Burr over the summer. One Republican close to Mr. Burr, who spoke on condition of anonymity, said that Mr. Trump had been “very forceful.”

U.S. Attorney General Jeff Sessions refused to answer questions on Thursday during a closed congressional hearing about whether President Donald Trump ever instructed him to hinder the Justice Department’s investigation into Russian interference in the 2016 election, according to Democratic lawmakers who attended.

“I asked the attorney general whether he was ever instructed by the president to take any action that he believed would hinder the Russia investigation and he declined to answer the question,” Representative Adam Schiff told reporters after the hearing.

“There is no privileged basis to decline to answer a question like that. If the president did not instruct him to take an action that would hinder the investigation, he should say so. If the president did instruct him to hinder the investigation in any way, in my view that would be a potential criminal act,” Schiff said.

Sessions “is one of the most forgetful persons who works out of Washington, D.C., or he’s being less than candid with the American public.”

Robert Mueller now has three of Trump’s top campaign officials in his grasp
https://qz.com/1144239

With former US national security advisor Mike Flynn’s guilty plea for lying to the FBI, special prosecutor Robert Mueller now has serious leverage on three of president Donald Trump’s top 2016 campaign officials in his probe of Russian meddling in the presidential election.

In October, former campaign chairman Paul Manafort and his top aide Rick Gates were hit with 12 charges including “conspiracy against the United States.” Manafort has spent a month contemplating his thoughts under house arrest, agreeing yesterday (Nov. 30) to a $12-million bail deal with Mueller’s team. Now Flynn faces up to five years in jail and a $250,000 fine, with Mueller also probing his alleged role in a Turkish government plot to kidnap the dissident cleric Fethullah Gülen from the US.

Manafort, Flynn and Gates might have the most information about exactly what went on during Trump’s campaign. They all also have documented ties to Russia—Manafort and Gates spent years working for pro-Russian former Ukrainian president Viktor Yanukovych, while Flynn has made speaking visits to Moscow and taken money from state TV channel RT.

Cooperation from a low-level campaign official, foreign policy advisor George Papadopoulos, revealed a fascinating trove of information, including his attempts to set up a meeting between Trump and Russian president Vladimir Putin and the fact that the campaign knew of claims that the Russians had Democratic candidate Hillary Clinton’s emails as early as April 2016. There’s been speculation that Papadopoulos wore a wire to get hold of incriminating evidence since then.

Still, anything Papadopoulos may deliver likely would be tiny in comparison to someone like Flynn, one of Trump’s earliest supporters and most trusted advisors, whom the president called a “very good man” even after effectively firing him in February for misleading vice president Mike Pence.

As University of New Hampshire law professor Seth Abramson writes, the way flipping a prosecutorial target normally works—getting someone to offer incriminating information on another person higher up in the organization—would imply that bigger names are in Mueller’s sights. What’s more, if Flynn is only being prosecuted for lying to the FBI about his Russia contacts despite the questions about his Turkish connections, that could suggest whatever he’s offering is very big indeed. Anything he can give prosecutors may put Gates and Manafort under more pressure to offer up nuggets of their own.

Seth Abramson @SethAbramson
What this indicates—beyond any serious doubt—is the following: Special Counsel Bob Mueller, the former Director of the FBI, believes Mike Flynn's testimony will *incriminate* the President of the United States, the Vice President of the United States, or both of these two men.

For this reason, what's about to happen in 50 minutes is far and away the biggest development thus far in the Trump-Russia probe, and likely the biggest development in U.S. politics since President Nixon resigned from office during the Watergate scandal.

This is historic.

That sound you just heard was the other shoe dropping.

No, it is not. That is the sound of you hearing what you want to hear.

The transition team is SUPPOSED to make contact with the Russians, just as they're SUPPOSED to make contact with the British, the Canadians, and the Chinese. The contact was made AFTER the election, so there is no presumption of "collusion" because the election was already over with. The only way that you can construct any sort of "criminality" to this contact is by assuming that Flynn was there to reaffirm some sort of prearranged deal, to affirm the "quid pro quo" that you have to ASSUME was there to begin with.

Let's look at this from most to least culpable:

1) The worst-case situation (for Trump) is if he was actively colluding with Russia to "hack" the election, that there existed a "quid pro quo" - however negotiated (even under duress from Russian blackmail) - which set the terms, that Trump would back off on sanctions or follow other policies favorable to Russia if Russia would help him win the election. In order to show that, you'd have to show that (1) the Russians really DID "hack the election" and that (2) it was adjudged effective enough by the Trump team to meet their end of the bargain (3) produce the evidence to demonstrate that this kind of negotiation took place.

2) That Trump did NOT have an agreement with Russia, but saw all of this "Trump-Russian" linkage as being part of the deep state's war against him which was significantly interfering with his policy implementation, and he fought back in a politically naive but business-like manner way by firing Comey and seeking to delay or avoid the investigation which he thought was baseless and politically-motivated.

3) That Trump had a openly-stated, sincere policy of "making nice with Russia" because he honestly believed that policy would be good for the USA (not because of any business interests or blackmail) and that contacts with Russia were simply extensions of that policy direction, which was part of his campaign.

The supposition is that Flynn plead to this charge because Mueller had "wiretapped" evidence in-hand. As I said before, if there is evidence of collusion, it would be from surveillance, not investigation. But I'll bet you dollars to donuts that if surveillance evidence exists it will never be entered into testimony because it was tainted (ie illegal) to begin with, so Mueller's problem would be reconstructing a case in parallel to it.

I personally think that Flynn's problem isn't with the Russians. He committed so many other serious breaches of security with the Turks that those violations can be used as leverage against him.

9 legal experts on what Flynn's plea deal means for Trump
www.vox.com/2017/12/1/16723752/flynn-charged-fbi-mueller-trump-deal

Jens David Ohlin, law professor, Cornell University

The fact that Flynn was charged with, and is pleading guilty to, such a minor crime suggests a bombshell of a deal with prosecutors. Flynn was facing serious criminal liability for a variety of alleged missteps, including his failure to register as an agent of a foreign power. If this is the entirety of the plea deal, the best explanation for why Mueller would agree to it is that Flynn has something very valuable to offer in exchange: damaging testimony on someone else. Who? That’s not clear, but it probably is someone at the center — or close to the center — of this criminal enterprise.

Christopher Slobogin, law professor, Vanderbilt University

If the government has agreed not to prosecute Flynn on the much more serious charges his alleged connections with Russia could have triggered, then it’s probably getting something very significant in return. That something is probably evidence against someone higher up the food chain, and at this point, there aren’t too many links left in that chain.

Lisa Kern Griffin, law professor, Duke University

The nature of the charges against Michael Flynn and his guilty plea confirm that he is cooperating with the Mueller investigation. To receive a cooperation deal of this sort, he needs to be providing information about higher-value targets than himself. We can only speculate about who those targets are, but news reports indicate that Flynn’s testimony could implicate other members of the administration, including the president, in some coordination with the Russian government during the campaign.

That would fit the ordinary meaning of “collusion,” but the term itself has no legal significance. What remains to be seen is whether those contacts rise to the level of a conspiracy to violate the campaign finance laws or some quid pro quo involving sanctions relief for Russia.

At this point he doesn't need the wire tap, he has Flynn's own words.

He has Flynn's own words saying that he was instructed by a senior transition team member to "make contact" with Russia. On its face, there is nothing wrong with that: That's what transition teams are supposed to do. That's why they didn't charge him with anything more serious: because if he admitted to more, they'd have to charge him with more. Whatever it was the he actually told Mueller may never come out.

The Turk violations we know all about. Getting at what he did with, and what he knows about Russia and the connections to the WH, is what we need to find out. And what you should want to know too btw. Odd that you don't seem all that curious. - G

I'm much more concerned about what he did with Turkey, which is our farther-east NATO member, which houses (or used to house) nuclear weapons at Incirlik air base and has also supported jihadist terrorists in Syria.

OUtside of giving Russia the nuclear codes, I really can't imagine anything that could be promised the Russians that would seriously compromise our security or economy because our relations with Russia are negligible. So what if we lifted sanctions? That affects Europe far more than it affects us, and if we lifted sanctions the EU would be mightily pleased. So what if we cooperated with Russia on ridding the Mideast of terrorists ... that's a GOOD thing, right? Most of our problems are self-made, not made by Russia, so Russia can't really solve them OR make them worse. Only we can do that.

So why don't you sketch out for me what you think might be done with, or for, Russia which compromises our security or economy? Maybe I lack imagination.

One was our national security adviser to the president lying about illegal and covert contacts with the Russians. The other had a cooking show who lied about an illegal stock tip.

In the past two months, Robert Mueller III and his team have received private debriefs from two dozen current and former Trump advisers, each of whom has made the trek to the special counsel’s secure office suite. Among the topics of keen interest to investigators: how foreign government officials and their emissaries contacted Trump officials, as well as the actions and interplay of Michael Flynn and the president’s son-in-law, Jared Kushner.

And yet, nothing in there about "colluding" with Russia to "hack" the election.

Today, Trump admitted knowing Flynn had lied to the FBI when he asked Comey to back off Flynn. He is acknowledging awareness of the commission of a federal offense at the time he sought to intervene to prevent its investigation. It’s called Obstruction of Justice.

The other obstruction case, the one based on Comey's firing, is as compelling as such cases can get. Today’s tweet just adds fuel to an already raging fire. Eg, Trump/Lester Holt interview, Comey's notes/testimony, ridiculous pretext Trump gave for firing Comey relating to Hillary’s emails.

To repeat: Trump is admitting he knew Flynn lied to the FBI but still pressed Comey, the head of the FBI, to let it go.

Trump has got a new story about yesterday's tweet: My lawyer wrote that tweet, you know the tweet that says I obstructed justice by firing FBI's Comey because I knew Flynn lied to the FBI and Comey would not stop investigating the lie.

Trump says he never asked Comey to stop Flynn probe. But Comey said Trump did. And Comey said it before the Senate in June while under oath.

There is a criminal investigation by the FBI of Flynn, one of the Trump's top associations. Trump fires Flynn, but Flynn remains under under investigation. Trump brings in the FBI Director and says 'please stop your investigation.' That is a clear case of obstruction of justice. And now we know that Mueller Illegally refused to disclose exculpatory evidence which proved Flynn's Innocence.

And how surprising the number of crimes Mueller is committing. Not.
