Shoulda been restricted, no-copy courtroom evidence only, what's on that is between the parties involved and the court that decided the case.

None of ANY damn body elses business, none.

And, on conclusion of the case, should have been purged and destroyed.

But since yon prosecutor was so free in passing it out, as Six pointed out, it's likely to get wilded, and how would you like to be the girl, or her parents, and stumble across it being offered as entertainment on the net ?

All the rest, I'd let go in exchange for Wilson being freed, guilty of anything or not, he's done paid his damn debt already and if that didn't teach him, ain't nothin going to.

But passing copies of the tape out like that ?
No, that one doesn't slide, and McDade is gonna pay for it, and pay dear, he should count himself lucky if all he gets is disbarred for it.

Sure, the kid did wrong, but WTF is McDades *issue* that he took it so ludicrously far and played fast and loose with the evidence besides ?

Which is all fine and dandy, on the surface, but setting the protocol even as you prosecute it qualifies as a geniune conflict of interest and should have been taken into account on a case of this nature - which means he never should have been allowed to prosecute it in the first place.

He also had better damned well be able to account for EVERY tape and who he gave it to, and I would lay pretty good odds at this time that he cannot do so, because he sent one or more of those tapes *unsolicited*, giving lie to the FOIA request - the paperwork in question seems to indicate this was indeed the case.

He also completely overstepped his bounds with the girls mother.

From my understanding, like I said in the beginning of this thread, no one had specifically brought it to his attention till pretty late in the day - it didn't initially get the huge media attention bump it's gettin now, and wrangling stuff past the office staff of a dude so politically involved isn't very easy, cause you got any number of bitchers to deal with who may or may not have a legit gripe.

Sharpton, and his crew, have indeed been helpful, not just with the march and the media fronting perspective (and yes, ole AL is gonna do some media whoring in this, it's his nature) but also from a legal research perspective and helping with the dirt-diggin shovelwork, too.

It strikes me, that at this point he's realized his chances for any real major office are about shot, and he's starting to realise he needs us honkeys too if he's ever to get anything done so he's toned down a lot of that let's-hate-on-whitey shit he used to pull and started to get with it on a more we're-all-in-this-together front, although it's not stopped him from a bit of race baiting here and there even now.

Can't say I like the guy, cause yah, he's a self centered arrogant media whore still, but when someone waved this case under his nose, he stood up and got to work on it, and that I can respect even if I don't like him personally.

He could be the devil hisself for all I care, long as Wilson walks and he helps mop the floor with McDade's face.

I agree. I just don't want to hear about how this is a race thing and i'm an asshole for being white again. When I read the story, I didn't know the kid was black until days later. I didn't care any less about it when I found that out either. But hey, if an innocient man can finally go free after 4 years of wrongful imprisonment, what is a little more white-bashing in the media. Not like there wouldn't be a ton of it there anyways. Don't Blow It!: The Genarlow Wilson Saga

NEW YORK -- If our judicial system was truly one of equal justice under the law, you would never have heard of Genarlow Wilson.
Wilson, a 17-year old from Atlanta, was bringing in 2003 with friends at a New Year's Eve party. In the course of the evening's activities, he had consensual oral sex with a 15-year old female.

There were other kinds of sex going on that evening as well, as some of Wilson's friends had intercourse with the girl, with the whole incident videotaped.

Police arrested Wilson and the others because the girl was judged to be inebriated beyond the point of consent.

For the ones who engaged in intercourse, the charge was rape -- but because of a Georgia state statute that allows for consensual sex among teenagers, Wilson was found not guilty of rape.

He was, however, found guilty of having non-procreative sex with a minor in 2005, carrying with it a mandatory 10 year sentence and a lifetime listing as a registered sex offender.

The young woman never pressed charges against Wilson, admitted publicly that she consented to the act with the young man, but let's say it like it is -- the kid got 10 years for fellatio -- a blow job.

So for the last 28 months, Wilson, an honor roll student with a 3.2 grade point average, no criminal record and by all accounts a regular teenager, has marked time because he responded to the normal urges of sexual beings.

Because of the egregious nature of the sentencing, a groundswell to expunge the archaic law from the books has been successful, but not retroactive to Wilson's situation.

The attorney general who put Wilson in jail, Thurbert Baker, probably never received a blow job in his life -- how else could one explain the bellicose nature of such an anal-retentive translation of the law?

That the light has been turned on for young Wilson is a welcome thing -- but it again shows the roaches of reality always scurry back to hide from the real issues.

And here the real issue as I see it is two-fold: the rigidity in the translation of the law and America's puritanical views on that three letter word -- S-E-X.

Genarlow Wilson's situation is a clear case of Prosecutors Gone Wild. Georgia's ass-backwards approach to the law in this case on all levels seemed to take the power from the presiding judge to inject some common sense into the equation.

Many times judges have used good, sometimes innovative judgment in dealing suitable punishments for crimes committed. How many times have you heard of people who were caught and convicted for, say shoplifting and then because of their (lack of) a hardened criminal record, forced to wear a placard outside of the mall or Wal-Mart proclaiming they stole and are doing penance via public humiliation?

It may seem a poor example in comparison to being charged with rape, but it makes a difference when appointed judges can go beyond the cookie-cutter approach to prosecution.

In the 1970s, New York governor Nelson D. Rockefeller decided to flex his legislative muscles by introducing legislature that called for a mandatory 25 years to life sentence for possession of illegal drugs. With no judicial wiggle room, you did the same time whether you had 24 kilos of cocaine or a nickel bag of marijuana.

Many citizens had their lives ruined by this law, which has gained attention over the last decade.

The lock-step mentality by the Georgia Attorney General's office in insisting this kid do hard time because he got blown instead of screwing the girl got him screwed anyway.

Never mind that the girl in question admitted sex with Wilson was consensual and did not file charges once she was of clear mind; let's not let facts get in the way of a good story.

In all honesty, there is no way this young man won't eventually sue the AG's office and the state for every penny he can get -- and he will deserve every cent.

And whatever punitive damages he can garner will hopefully include the scalp of Thurbert Baker and similar vacuous, venal and venereal vainglorious vermin who get their rocks off on ruining people's lives while they smugly and hypocritically dive their faces into the crotch of Lady Justice behind closed doors.

It's no wonder as to why the bitch wears a blindfold -- she knows how fucked up the system really is if you're black. The poor kid did everything right and a black man handed him a 10-year sentence like he was ordering a sandwich at the deli.

But Wilson's case is not about victimization; it's about the mores of a sexually schizophrenic society.

Which brings us to that other thang -- sex. You can't even say the word without getting a rise out of someone in some kind of way. But in the case of the Georgia legislature, these archaic laws seem more designed to protect Miss Ann from those sex-starved nigras.

Fear of a Mandingo Planet

Laws have been on the books against sex with minors in every state, but in certain situations where both protagonists are minors, the one indicted can be charged as an adult. Since Wilson was charged as an adult, why wasn't the other consenting person considered to be an adult in the eyes of the court as well?

If I put myself in the place of Wilson, I'm getting blown, too, because I'm young, horny and the girl is of a consenting nature. Is she still 15? Yes -- but I'm only two years older.

But God help that kid had he gotten a blow job by a white girl. The echoes of the Emmitt Till murder still reverberate throughout the consciousness of Black folk; and Wilson would've probably been put under the jail.

This isn't like the sick shit that is encouraged by groups like NAMBLA (North American Man-Boy Love Association) advocating sex with pre-pubescent boys; which, by the way gets not-for-profit status by our government.
But anything beyond the missionary mindset, whether young or old, seems to foster derision instead of delight.

We're outraged by former President Clinton's getting his knob washed by Monica Lewinsky, but accept the blow job Lewinsky gives us when she said she was saving the cum-stained dress "just in case."

I just wish Clinton had finished the sentence after he said, "I did not have sexual relations with that woman," with "but she sucked the shit outta my dick."

And some of the same muthafuckas that called for Clinton's head were getting eventually busted for inappropriate sexual behavior with page boys.
Certain members of the Moral Majority's extended family were also snagged while playing spit-and-swallow with the family values as well, apparently turning the other cheek in a manner not recalled in the Bible.

For many serving our country in Iraq and Afghanistan, the love they offer in serving has turned into a rectal reaming, as our country's leaders offer these noble charges weapons of ass destruction -- with nary a dab of AstroLube.

But evoke any image, perceived or real of Black male power or sexuality and this society's conditioned reflex is to neuter and emasculate it. And let there be no doubt, Genarlow Wilson was a powerful young man -- college ready, with infinite academic and athletic opportunities awaiting him.
As all the trappings of potential power are sexually appealing to whites, so too are they just as appealing to Black folks.

It seems the more pious the voice, the bigger the freak they are, and, make no mistake, this is a freaky country.

And until Genarlow Wilson is a free man, y'all, better keep it in your pants; or read your respective states laws on Fornication Under Consent of the KING.

Even protect.org - to my surprise, stepped in on this one, and they'd like to see McDade doing 10 years for distro of the tape, cause it's sounding a lot like McDade gave to the tape to certain political folk, then used their possession of it as a form of blackmail to get their support.

I want Wilson out of prison, dammit, and I *will* see it done.

Great news to hear my man. I'd love to see those assholes burn on their own crosses for a while.

Mr. Ingram writes a good article, though I see he's jumping all over the race issue here too like Jesse would. Whatever it takes to get this kid justice though, I suppose, but it just pisses me off how everything needs to be a race issue. Everything else he wrote about I agree with 100%.

What I think he fails to understand is that he's almost right on the mark when he makes the statement "It's no wonder as to why the bitch [Justice] wears a blindfold -- she knows how fucked up the system really is if you're black", all he has to do is change the word "black" to "poor" there, and every instance it was used above, and that racist fallacy becomes a very true and powerful statement.

Hey... you don't gotta tell me that the Bushes, and the Rockafellers and the Hiltons and most of the rich folk running the show are whites or jews.... just don't give me and the other apartment/trailerpark dwellers that we're a part of that bullshit. We're supposed to be on the same side.

Well, he was tryin to write that from a young black dudes perspective, and he slammed it home - I don't see that one so much race baiting as "quit kickin the brothas, homie!" which is understandable, but as you say, a bit of a fallacy unless you consider the intended audience of the article.

Most of the fellow anarchists I know couldn't give a shit about race anyway, there's always been a lot of socialist-leaning movements in the black community, and it's not that long of a step from there to anarchism, so as Gus put it so very well "hey, some of us black blocs are blacker than others, just means them bitches can see us better, right ?"

I think it's downright amusing that most of the beard-waggin, knuckle-draggin, redneck lowbillies that Dave expected to jump right on this (believe me, HE has done his share of race-baiting and then some, from the other side, his own color notwithstanding...) jumped in from the OTHER side, with a little encouragement, cause of a lot of them have kids, most of whom are humpin one another in various fashion, and realise they too could find themselves where wilson is, if someone wanted to make an issue of it.

But in the end, race, religion, all the various things that divide us, are ultimately products of the establishment that wishes fervently to do so, much like prison wardens turn the gangs against one another to save themselves hassle and headache.

Done more than my share of makin folk aware of that, and such support is currently united in the belief that Dave is an asshole who did this for personal reasons having naught to do with his office - and we're not gonna let it go, black or white, the cause is Right.

Nah, the Judge actually wanted to pitch it, or at least cut down the sentance, but was straighjacketed by mandatory sentencing rules.

Heck, even the guy who WROTE the law said this was a misuse and misinterpretation of it.

And the Jury, being misinformed, and vaguely threatened, as they always are these days, felt they were risking obstruction and contempt charges to do anything but rubberstamp a guilty verdict for the prosecutor.

So it boils down to the prosecutor, who is also black, who has apparently run with this ball for personal reasons outside the scope of his office and the case in question - to the point of threatening the girl and her mother, demanding they commit perjury, and mailing unsolicited copies of the tape to politically-involved folk, and then blackmailing them into supporting his end of the case with their possession and viewing of said tape....

AND this prosecutor has a nasty history of conflict of interest, sexual misconduct and other bad habits besides that.

His name is David McDade, and he deserves to be disbarred, fired, charged and if convicted, imprisoned.

Race and religion aside, the core of this seems a personal vendetta between McDade and Wilson, and McDade misused his office, the court, and our legal system to settle it to his benefit.

I have a lot of respect for US Postal Inspectors, as their efficiency and effectiveness are what drove predators to the internet in an effort to avoid them, and if McDade shipped that material via USPS, especially AFTER being told it was illegal, he's gonna have some Postal Inspectors all up in his ass too.

As for how many of em were unsolicited, prolly no knowing that, but there's evidence of one, and one is enough - especially with him admitting he cannot account for all the copies.

McDade is, unfortunately, still employed, but at this point a laughingstock and whipping boy for all those who wish to politically distance themselves from that mess, and rather blatantly watched like a hawk for any excuse whatever that would justify his dismissal and followup lynching in the court of public opinion.

While unhappy that it took so long, I think we've got the best real-world possible set of results we're gonna, and it's a done issue for me save for poking at the parole board over Henry.
