More than a quarter of Republicans approve of the January 6 Capitol attack, according to a new poll. More than half think the deadly riot was a form of legitimate political discourse.

The Economist and YouGov survey said 27% of Republicans either strongly or somewhat approved of the riot on 6 January 2021, which Donald Trump incited in an attempt to overturn his election defeat by Joe Biden.

Nine deaths, including law enforcement suicides, have been linked to the attack. More than 1,000 people have been arrested and hundreds convicted.

The longest sentence yet handed down is 10 years in prison, to a former New York police officer who assaulted Capitol officers. The statutory maximum sentence for seditious conspiracy, the most serious convictions yet secured, is 20 years.

Trump was impeached for inciting an insurrection, but acquitted. The House January 6 committee made four criminal referrals regarding Trump to the Department of Justice. The federal investigation continues.

Similar to other so-called “militia” groups tied to January 6, no one brought weapons to the Capitol that day; no one was charged with assaulting police officers or lawmakers. A key piece of evidence that prosecutors claimed was a road map for the “attack” on the Capitol wasn’t produced by any Proud Boy but by a former intelligence asset who himself sent the plan to Tarrio through a third party.

The document represented just one more instance of how a government agent helped shape the government’s narrative that the Proud Boys plotted in advance to carry out an “insurrection” on January 6. In fact, much like the FBI-engineered plan to “kidnap” Michigan Governor Gretchen Whitmer in 2020, court proceedings confirm that FBI assets might outnumber criminal defendants.

At least 10 and possibly up to 15 FBI informants were embedded in the group months before and continuing after the events of January 6. Informants participated in numerous group chats, cozied up to leadership, and even accompanied the Proud Boys to Washington.

One known informant, according to a September 2021 New York Times report, was involved in the first breach of Capitol grounds and entered the building that afternoon.

But prosecutors and Judge Timothy Kelly have tried their best to prevent the public from learning the full scope of the FBI’s involvement. The docket is littered with sealed hearings and filings; prosecutors presented to the defense team heavily redacted reports related to FBI informants just before the trial began.

“Everything has been done under cover,” one defense attorney recently complained in court. A consortium of major news corporations also knocked Kelly this week for holding “sealed hearings and exclud[ing] the press and public from attending proceedings in this high-profile case.”


Kelly also took the highly unusual and prejudicial step of requiring the defense to “pre-clear” questions with prosecutors before asking a witness about the use of informants— but information is slowly trickling as the defense finally gets their turn.

For the second time this month, Kelly suspended the trial on Wednesday after prosecutors confessed that a key witness for the defense, who was scheduled to testify on Thursday, had worked as an FBI informant during the entire investigation. Although prosecutors have known for months that the defense might call this person as a witness, they waited until the last minute to tell defense attorneys, who were blindsided by the news.

Former top national security officials have testified to a federal grand jury that they repeatedly told former President Donald Trump and his allies that the government didn’t have the authority to seize voting machines after the 2020 election, CNN has learned.

Chad Wolf, the former acting Homeland Security secretary, and his former deputy Ken Cuccinelli were asked about discussions inside the administration around DHS seizing voting machines when they appeared before the grand jury earlier this year, according to three people familiar with the proceedings. Cuccinelli testified that he “made clear at all times” that DHS did not have the authority to take such a step, one of the sources said.

Trump’s former national security adviser Robert O’Brien, in a closed-door interview with federal prosecutors earlier this year, also recounted conversations about seizing voting machines after the 2020 election, including during a heated Oval Office meeting that Trump participated in, according to a source familiar with the matter.

Details about the secret grand jury testimony and O’Brien’s interview, neither of which have been previously reported, illustrate how special counsel Jack Smith and his prosecutors are looking at the various ways Trump tried to overturn his electoral loss despite some of his top officials advising him against the ideas.

Now some of those same officials, including Wolf, Cuccinelli and O’Brien, as well as others who have so far refused to testify, may have to return to the grand jury in Washington, DC, to provide additional testimony after a series of pivotal court rulings that were revealed in recent weeks rejected Trump’s claims of executive privilege.

Cuccinelli was spotted going back into the grand jury on Tuesday, April 4.

Without that privilege shield, former officials must answer questions about their interactions and conversations with the former president, including what he was told about the lack of evidence for election fraud and the legal remedies he could pursue.

Trump's indictment accidentally overshadowed a major MAGA development in Michigan.

Tuesday’s indictment of former President Donald Trump for conspiring to overturn the 2020 election overshadowed the announcement of a related indictment that same day in Michigan. Both cases are incredibly important, and Michigan case’s under-the-radar significance should not be overlooked.

A grand jury there charged Matthew DePerno, the November 2022 Republican candidate for state attorney general, with four criminal charges: undue possession of and willfully damaging a voting machine, both five-year felonies, and conspiracy to commit undue possession of a voting machine and false pretenses. In September 2021, Trump endorsed DePerno for attorney general, the state’s top law enforcement position.

The grand jury in Michigan also charged Daire Rendon, a former Republican state representative, with “conspiracy to unlawfully possess a voting machine and using false pretenses ... in unlawfully acquiring one of the machines.”

(Both DePerno and Rendon are of course innocent until proven guilty. DePerno’s attorney told the Detroit News his client “categorically denies any wrongdoing and firmly asserts that these charges are unfounded and lack merit.”)

But this prosecution has implications far beyond Michigan, for three primary reasons.

First, DePerno and Rendon, both vocal 2020 “election deniers,” are alleged to have illegally obtained a voting machine in a wildly ill-advised attempt to prove election fraud that, despite Trump and his allies’ pronouncements, did not exist. A nation that holds secure elections cannot allow self-deputized vigilantes improperly seizing possession of voting machines under false pretenses.

How General Mark Milley protected the Constitution from Donald Trump

That summer, Milley visited Chiarelli in Washington State and, over breakfast, described what he thought was coming next. “It was unbelievable. This is August 2, 2020, and he laid out in specific detail what his concerns were between August and Inauguration Day. He identified one of his biggest concerns as January 6,” the day the Senate was to meet to certify the election. “It was almost like a crystal ball.”

Chiarelli said that Milley told him it was possible, based on his observations of the president and his advisers, that they would not accept an Election Day loss. Specifically, Milley worried that Trump would trigger a war—an “October surprise”­—to create chaotic conditions in the lead-up to the election. Chiarelli mentioned the continuous skirmishes inside the White House between those who were seeking to attack Iran, ostensibly over its nuclear program, and those, like Milley, who could not justify a large-scale preemptive strike.

In the crucial period after his road-to-Damascus conversion, Milley set several goals for himself: keep the U.S. out of reckless, unnecessary wars overseas; maintain the military’s integrity, and his own; and prevent the administration from using the military against the American people. He told uniformed and civilian officials that the military would play no part in any attempt by Trump to illegally remain in office.

The desire on the part of Trump and his loyalists to utilize the Insurrection Act was unabating. Stephen Miller, the Trump adviser whom Milley is said to have called “Rasputin,” was vociferous on this point. Less than a week after George Floyd was murdered, Miller told Trump in an Oval Office meeting, “Mr. President, they are burning America down. Antifa, Black Lives Matter—they’re burning it down. You have an insurrection on your hands. Barbarians are at the gate.”

According to Woodward and Costa in Peril, Milley responded, “Shut the fuck up, Steve.” Then he turned to Trump. “Mr. President, they are not burning it down.”

As Judge Sarah Wallace puts it in her 102-page decision: “The court finds that . . .Trump engaged in an insurrection on January 6, 2021 through incitement, and that the First Amendment does not protect Trump’s speech.”

Thus, the Colorado court has both affirmed the commitment to truth that animates the justice system under the rule of law and set another marker of Trump’s deviation from constitutional governance. The court’s decision makes a record for history.




We now have arguably the most important 14th Amendment ruling about Donald Trump to date. Friday’s decision from Colorado isn't entirely convincing, but its most useful feature may be that it lays the groundwork for the U.S. Supreme Court to weigh in.

Colorado District Judge Sarah Wallace found in her lengthy opinion that Trump engaged in insurrection. That might lead one to think that Trump is therefore barred from the presidency under the Constitution’s insurrection clause. But Wallace also said the president isn’t an “officer” under the provision in question, so, according to the Colorado state judge, Trump isn’t banned from the presidency despite his otherwise unconstitutional behavior. My colleague Hayes Brown explained why it’s a dubious distinction on Wallace’s part.

But the state trial judge won’t have the last word. Importantly, unlike other courts that have punted on the subject recently, Wallace issued an actual ruling, based on facts and evidence, even if her conclusion is wanting. On that note, the Colorado challengers are attacking the “officer” distinction on appeal to the state’s Supreme Court. If they’re successful in doing so — leading to a ruling that Trump is ineligible — then the U.S. Supreme Court will more likely step in to make a definitive, nationwide ruling.

The U.S. justices have discretion over their docket, but they’ll be more likely to review a decision that keeps Trump off the ballot; if a lower federal court or state high court says he can stay on the ballot, then the justices can maintain the status quo by simply rejecting any appeals of such decisions and declining to get involved.

But if the Colorado Supreme Court endorses her insurrection finding yet disagrees with her “officer” rationale on legal grounds, then Wallace’s decision may have been the first step in the issue’s judicial resolution.



Since you’re stupid I’ll explain it to you. The judge, by declaring Trump was an insurrectionist based on the evidence presented in court, did that part of the Supreme Courts’ job. So, all they will have to do is conclude that Trump was a federal “officer” because of his serving as president.
