Gun owners have the constitutional right to bear arms, but do they have a right to confidentiality?

The state of Illinois is currently weighing this question. On Monday, state Attorney General Lisa Madigan’s office issued a ruling that declared the names of gun permit holders to be public information that must be disclosed. But the agency overseeing such permits — the Illinois State Police — may challenge the ruling in court once it becomes binding.

The Chicago Tribune notes that state police officials have long believed that releasing such information about firearm permit holders would an unwarranted invasion of privacy and ultimately endanger the lives of gun owners of those who don’t have firearms. But the attorney general disagrees, claiming the public has a “legitimate interest” in knowing who owns a gun.

Is it anyone's business who has an abortion?



Frankly, I'd be more worried for the safety of those who DON'T own guns or have permits for them. After all, if the list of who has a permit is public information, then by default you also have a list of who DOESN'T own a gun. And those WITH the guns will have an easy time robbing from those without, since they have a pretty darned good idea where the guns AREN'T.


But really, do you have more of a "right" to privacy when it comes to your gun ownership status than you do when it comes to your pregnancy status, or than you do with your telecommunications, your banking info, your library history, your travel itinerary?

Its a public record. As long as the real confidential stuff is redacted (like SSN numbers) then its open to the public.

I don't think that who has had abortions should be in the public records either. Maybe we should figure out exactly what "public records" means. Does it mean that any Joe Someone can go down to the government office or go online and look up whether has neighbor owns a gun and has had an abortion? Or does it mean that the police can look up in their fancy data system and figure out if someone owns a gun and has had an abortion. On crime shows it looks like the police already have access to all that stuff and I guess I don't care so much since its already that way, well maybe I care a little. But the impression I've always had is that Jo Someone can't just look up those stats on his next door neighbor. Anyone know the answers?

Riona, the problem is, IMHO, even HAVING such databases in the first place...

Cause no matter what the original purpose is, no matter how noble the intentions were, it always, always comes back to the same place, doesn't it ?

What I find kind of ironic is that in their somewhat justified whinging about this, the gunbunnies somehow missed a 48-8 vote in Wyoming, followed by no attempt to veto - and now it is legal to carry concealed in Wyoming without needing a CCW permit whatever, although I would still reccommend a MINIMUM of training for anyone who intends to carry, whether it's required or not.

One "issue" we have in MI, and have in PA as well, is that the cops insist on "inspecting" your firearm before handing over your CCW - and during said "inspection" they write down the serial, model and production numbers, along with your CCW info and file it in a database somewhere... which is, no matter what they wanna call it, registration, which is EXPLICITLY illegal under PA law, and debateably so under MI law - current legal brawls goin on about that, of course.

But as I say, if you do not COLLECT and then STORE, that information (often the initial collection and storage is done illegally and/or under false pretenses, and then retroactively justified by bullshit like the patriot act) in the first fucking place, this never becomes a problem.

Ergo, the police departments that did not collect this info legally, or did so under a false pretense, ought to be facing charges for misusing it in any fashion beyond that which it was initially collected for.

AND it ought to be legal for a citizen to demand a purge - not that I think that'll have any realistic effect since you know the fuckers will keep a copy and put it right back, but as a legal precedent to start SOME respect of privacy back in the other direction.

QQ, please be aware that not all liberals are as anti-gun as you think. I consider myself to be an independent libertarian, but I am sure you would classify me as liberal, certainly much more liberal than you.

I have never owned a gun, never intend to, since I am a pacifist and was a conscientious objector (non-combatant medic in the Army). I fully support other people's Second Amendment rights to own firearms and think it should not be on the public record of who owns a gun or who does not. I do think it prudent to keep records of those who have a concealed weapon permit though, and it should be mandatory that they have training in order to obtain such permit.
