The Supreme Court is not about happiness or pleasant thinking or negativity. The decision made it crystal clear, at least to me, that Congress botched the drafting of the law:
Quote:

(b) Congress has since broken more than a few promises to the Tribe. Nevertheless, the Creek Reservation persists today. Pp. 6-28.

(1) Once a federal reservation is established, only Congress can diminish or disestablish it. Doing so requires a clear expression of congressional intent. Pp. 6-8.

(2) Oklahoma claims that Congress ended the Creek Reservation during the so-called “allotment era”—a period when Congress sought to pressure many tribes to abandon their communal lifestyles and parcel their lands into smaller lots owned by individual tribal members. Missing from the allotment-era agreement with the Creek, see 31 Stat. 862-864, however, is any statute evincing anything like the “present and total surrender of all tribal interests” in the affected lands. And this Court has already rejected the argument that allotments automatically ended reservations. Pp. 8-13.

https://www.supremecourt.gov/opinions/19pdf/18-9526_9okb.pdf

If Congress wants Oklahoma criminal law to apply to everyone in Oklahoma, including the parts of Oklahoma in the Creek Reservation, then Congress needed to state that. But Congress failed to make it law, therefore Federal criminal law, not Oklahoma criminal law, will apply. As the Supreme Court helpfully pointed out to those idiots in Congress:
Quote:

Congress remains free to supplement its statutory directions about the lands in question at any time. Pp. 36-42.

SPOILER ALERT: It was a very bad ruling on the ability to try somebody who is American Indian who murdered or raped another for murder or rape they committed in Eastern Oklahoma. It's not as if any of the 1.8 million residents in eastern Oklahoma who aren't Indian are going to have their property seized and given to natives. This isn't South Africa. Thank God.

Among those who will not be prosecuted and/or have their cases thrown out even if already found guilty in the past because of this ruling is a man who killed his girlfriends ex husband and cut off his balls, and another man who raped a 4 year old girl on the Creek reservation.

Do Right, Be Right. :)

Can you link in the story Jack. I'm going to have to read this.

Yes. I'm trying to be extremely careful when giving any sources on this one though. Because, like everything else in 2020, almost nobody wants to report facts on either side and everything is opinion based.

Although it doesn't go into specific gory case detail of crimes, this is probably the most factual account I've found of the ruling overall:

https://www.smithsonianmag.com/smart-news/scotus-rules-much-eastern-ok
lahoma-native-reservation-180975289
/

In fact. I've learned something too by trying to find as politically neutral an account on the issue that I could when posting a link to you as well. The two Native Indian men I mentioned aren't necessisarily getting away with rape of a child and murder and mutilation. They will be re-tried in Federal court rather than state court.

And even if for some reason those crimes were to be put on trial and handled by Indian reservations, I can't imagine that there would be any reason why they wouldn't be punished harshly for what they did.

The most important bits of the article, as always, being at the bottom I will quote here:

Quote:

Kevin Gover, director of the Smithsonian’s National Museum of the American Indian, acting under secretary for museum and culture, and a citizen of the Pawnee Tribe of Oklahoma, tells Smithsonian magazine that the court’s decision is a “welcome” one because it upholds the principle that Native American treaties should be honored unless Congress explicitly revokes them. Still, he preaches caution in interpreting the ruling, pointing out that it centers on jurisdiction, not land ownership.

“The headlines are wrong,” says Gover in an emailed statement. “The Court did not give eastern Oklahoma back to the Tribes. Nobody will lose their land or their home. The decision simply means that Indians in that part of the state are subject only to the criminal jurisdiction of the Tribes and the United States, as is true on Indian reservations in many other states.”

Jimcy McGirt, a member of the Seminole Nation who in a state trial was convicted of sex crimes against a child, brought the case at the center of the ruling to the Supreme Court. Because the crime occurred on tribal land, McGirt argued that he should be re-tried in a federal court.

Per the Post, both McGirt and Patrick Murphy, a member of the Creek Nation convicted of murder in 1999 and the subject of a related case called Sharp v. Murphy, will now receive new federal hearings.

Jonodev Chaudhuri, a tribal ambassador for the Creek Nation, tells Kolby KickingWoman of Indian Country Today that the ruling is a huge win for the tribe. “Many folks are in tears,” he says. “Despite a history of many broken promises, as is true with many tribal nations, the citizens feel uplifted that for once the United States is being held to its promises.”

Summarizing the ruling’s overall significance for Vox, Ian Millhiser concludes, “The primary impact of McGirt is that Oklahoma loses much of its power to enforce certain laws against members of Native American tribes within the borders of tribal lands. But the decision will have far less impact on non-Native Americans.”

As you can clearly see though... This ruling has nothing at all to do with land ownership, or anything other than how the jurisdiction works when prosecuting criminal cases. Which is something that you couldn't be blamed for believing it was if all you read was a headline of an article by CNN or Vox.

If they actually did give land back to Natives here, it would be the first step in doing that all over the country until everybody's homes and land were confiscated by the government and redistributed as they see fit.

The anarchists, Bernie Bros, Antifa and AOC devotees would love that. But that's never going to happen.

Do Right, Be Right. :)

That is a win because the US government is well known for taking back land that was granted to the tribes by treaty.

It's been a mess Brenda. This country is supposed to be a work in progress. This is a step forward in a period that's been 3 steps backward.

"The Supreme Court today kept the United States' sacred promise to the Muscogee (Creek) Nation of a protected reservation," the tribe said in a statement.

It is NOT a “sacred promise”. There is nothing sacred. By next week, Congress could rescind the promise, assuming the Democrats in the House decide to join with Republicans in the Senate and Trump to rescind. The court's decision hinged on the question of whether the Creek reservation continued to exist after Oklahoma became a state.

"Today we are asked whether the land these treaties promised remains an Indian reservation for purposes of federal criminal law. Because Congress has not said otherwise, we hold the government to its word," Justice Neil Gorsuch wrote in the majority opinion.

Sadly, this is not a US Nunavut judicial moment. It's not as if the US government suddenly woke up and said - you know that land that we signed a treaty about, where we said it was yours forever but we took it anyway? That land really is yours.

That didn't happen.

I know that. Your government has whittled away at many a reservation down there over the years.

Still breaking treaties then remaking them to suit your use.

I do see that from what you posted. Yes, even if he was tried in a reservation court he would receive a harsh punishment.

I learned something as well. When I think of the Trail of Tears, I always think of the Cherokee. But I didn't know that the US government also moved the Seminole from Florida as well.

Which was the whole point of Oklahoma in the beginning. It was originally set up to be an Indian state. A good number of tribes were meant to be moved there to contain us. But when something useful was found or during the expansion phase that idea was dropped and the Cherokee were marched back to their original homeland. Some stayed in Oklahoma and obviously some of their other tribes did as well.

Goodbye, kind world (George Monbiot) - In common with all those generations which have contemplated catastrophe, we appear to be incapable of understanding what confronts us.

The Canadian courts did the most remarkable thing in recent history and ruled - in response to a lawsuit - that

Yanno, that treaty that Canada broke? You're right. We owe the First Nations something for our bad faith.

And created Nunavut. Check out a map sometime to see what that means.

Covid tests are needed to decide who should be in quarantine, but Trump doesn't like massive Covid-19 testing because it shows that the pandemic is growing faster and faster, which makes his reelection less and less likely. Is there a better explanation for why Trump tweeted this?

Donald J. Trump @realDonaldTrump
This is why we have so many “cases” for the media to constantly refer to!
Under @realDonaldTrump’s leadership, over 40 MILLION coronavirus tests have been conducted with nearly 730,000 tests yesterday alone.
11:10 PM · Jul 13, 2020·Twitter for iPhone
https://twitter.com/realDonaldTrump/status/1282890085483061248

Trump does not want the media to know that the number of cases is growing faster and faster. With fewer tests, the media would know less and Trump could smoothly be reelected. You should look at a chart of the number of cases, which can be found here:
https://ourworldindata.org/coronavirus/country/united-states?country=G
BR~USA

The chart makes Trump look bad. If there was less testing, the chart couldn't be drawn, which would be advantageous for Trump's campaign.

Trump wrote "For the 1/100th time" but what he meant was the 1,000th time. Somebody should ask Trump: "Would there be half as many pregnancies if there were half as many pregnancy tests available?" Give him a minute to think before he answers. If his answer is anything other than "No" he is too stupid to be President.

Do you have to try really, really, really hard to make yourself this stupid?

"Would there be half as many pregnancies if there were half as many pregnancy tests available?" would be an adequate analogy if Trump had said "Would there be half as many Covid Deaths if there were half as many Covid tests available?"
For those who can read (which obviously excludes you), this is not a new concept because 6ix has been repeating this for months and months now.
But Trump did not say this.

For Trump saying "Would there be half as many confirmed Covid cases if there were half as many Covid tests available?" then the adequate analogy would be "Would there be half as many known pregnancies if there were half as many pregnancy tests available?"

You are such an ass. As well as dumbass.

Yup. Second is a dumbass.

And yup... I have been saying that about the testing for months and months now.

Even Sigs is pretending like I haven't been right about this virus since the beginning.

She's conflating my trolling of Kiki with the legit stuff I had been saying since the beginning and the predictions I was making. She's also ignoring the fact that Kiki has ALWAYS attacked me first, and whenever I tried to be nice to her and go back to how we used to get along it only took a day or two before she'd attack me again.

Former CDC chiefs rebuke Trump for ‘undermining’ agency’s guidelines

Is eating out in restaurants the right thing to do during the pandemic? Some say no.
POLITICO logoFormer CDC chiefs rebuke Trump for ‘undermining’ agency’s guidelines

Four former heads of the Centers for Disease Control and Prevention on Tuesday implicitly rebuked President Donald Trump, arguing the “extraordinary” efforts by him and other administration officials to diminish the public health agency’s guidance was contributing to a resurgence of coronavirus cases across the United States.

Covid-19 has exposed the world’s greatest democracies, Britain and the US, as victims of prolonged self-harm; it has also demonstrated that countries with strong state capacity have been far more successful at stemming the virus’s spread and look better equipped to cope with the social and economic fallout.

South Korea rolled out testing at ‘walk-in’ booths all over the country, then used credit card records and location data from mobile phones to trace the movements of infected people – a tactic Britain has failed to master after months of effort. Other East Asian countries such as Taiwan and Singapore are also faring much better. Vietnam swiftly routed the virus. China managed to curb its spread and has since dispatched medics and medical supplies around the world.

Anglo-America’s dingy realities – deindustrialisation, low-wage work, underemployment, hyper-incarceration and enfeebled or exclusionary health systems – have long been evident. Nevertheless, the moral, political and material squalor of two of the wealthiest and most powerful societies in history still comes as a shock to some. In a widely circulated essay in the Atlantic, George Packer claimed that ‘every morning in the endless month of March, Americans woke up to find themselves citizens of a failed state.’ In fact, the state has been AWOL for decades, and the market has been entrusted with the tasks most societies reserve almost exclusively for government: healthcare, pensions, low-income housing, education, social services and incarceration.

How many times are you going to brag (see: lie) about being rich?

How many times are you going to say you won't be voting for Trump but lie that you'll be happy because of the huge tax breaks you're lying about?

How many times will you go an entire days worth of posts without a single one not having the word Trump in it?

How many times will you bring up Trump's taxes that the IRS already knows?
