BREAKING: Justice Department asks judge to keep Trump's search warrant affidavit sealed, citing ongoing investigation

The Justice Department on Monday asked a judge to keep sealed the sworn affidavit underpinning last week’s extraordinary FBI search of former president Donald Trump’s Florida residence, a document thought to hold key details about the government’s investigation into the potential mishandling of classified materials.

Are you actually able to manage to accomplish anything with thoughts of Trump plaguing your mind still, nearly two years after Joe Biden* took office?

My god dude. Get some help.

In the meantime, maybe cut a few hours of "news" consumption out of your days and go outside and touch some grass. You're completely dissociated from the real world at this point.

Trump voters neither understood this tweet nor did they react sanely, which proved the point:

I agree. And I was the CIA Director

Edward Luce @EdwardGLuce
I’ve covered extremism and violent ideologies around the world over my career. Have never come across a political force more nihilistic, dangerous & contemptible than today’s Republicans. Nothing close.

Stalin and Mao and Kim Il-sung never killed anyone. They were the saviors of their countries against evil forces. Just ask any true patriot of those three countries. (Funny how many died while they ruled, but not the leaders' fault. According to 6ix, nobody died of covid, so it's nobody's fault.)

Trump's Secret Service learned of a threat to Speaker Pelosi days before January 6th but failed to deliver the info until AFTER the Capitol was attacked — making their deletion of texts even more suspicious.

"The delay in notifying Capitol Police about the threat to the speaker of the House only adds to the impression that the agency failed to do its job, and leads to more questions. Why did the agency wait two days, until after the Capitol had been breached and congressional leaders were in hiding, to pass it along?"

The Secret Service was asked for all telephone texts but it just so happened that every text around January 6th was deleted by the Secret Service. Need I remind you that Trump was in charge of Secret Service? Trump didn't want the Secret Service telling Nancy Pelosi that Trumptards were coming to kill Pelosi on January 6th.

The Democratic chairs of the House Homeland Security and House Oversight committees on Tuesday threatened the Department of Homeland Security inspector general with a subpoena, accusing him of delaying responding to the committee's request for answers regarding missing Secret Service text messages on and around the Jan. 6 attack on the Capitol.

"If you continue to obstruct, we will have no choice but to consider alternate means to ensure compliance," Rep. Bennie Thompson and Rep. Carolyn Maloney, both Democrats, write to Joseph Cuffari in a letter dated Aug. 16. (Cuffari was appointed by Trump, so as expected, Cuffari is still taking orders from Trump by telephone and lying about communicating with Trump.) https://en.wikipedia.org/wiki/Joseph_Cuffari

If this story is even true, which is seriously debatable because of all of the nearly immediately debunked media lies coming out surrounding Trump right now, what makes you think anybody is going to care about this when nobody cared about what was in Hillary's 33,000 emails or what was leaked from Hunter Biden's laptop?

Nobody gives a shit.

You've got nothing. You've never had anything.

Brace yourself for Trump to announce he's running after Democrats get trounced in November.

To put it plainly: On January 6, 2021, Pence either acted to preserve the Constitution or he unlawfully seized emergency power from a sitting president. Pence does not want to explain why he used emergency power because it will implicate Trump — and doing so will make Pence unpopular with Republicans. This is the sort of self-serving use of authority that makes emergency power so dangerous.

From a parking garage under the Capitol Visitor Center, then–Vice President Mike Pence ordered the military to defend the Capitol against a violent insurrection. According to a taped deposition of General Mark Milley, the chairman of the Joint Chiefs of Staff, Pence “issued very explicit, very direct, unambiguous orders” to him and Secretary of Defense Christopher Miller: “Get the military down here. Get the Guard here. Put down this situation.”

This is a problem—one that has been overshadowed by the larger events of January 6. The constitutional authority to call out the military to defend the Capitol is vested in the president of the United States, not in the vice president. Why did Pence seize constitutional authority that wasn’t his? The country needs answers to this question, and it needs them from Pence, not from his chief of staff or his counsel.

In ordinary circumstances, Pence’s actions would be unconstitutional. Indeed, a vice president who usurped the president’s constitutional authority, and the Cabinet and military officers who followed his orders, could be committing an impeachable offense. But these were no ordinary circumstances: With Pence huddled in a secure location protected by his security detail, his actions were almost certainly justified.

Constitutional government depends on following the law, but emergency circumstances may provide for what the 17th-century political philosopher John Locke called prerogative power: power that in ordinary circumstances is unlawful, but that in extraordinary circumstances is warranted. There is a long-standing debate about whether the public should view such power as constitutional because necessary or as extra-constitutional but justified. In “Federalist No. 23,” Alexander Hamilton argued that people should see emergency power as constitutional because “the circumstances that endanger the safety of nations are infinite.” The Constitution, Hamilton insisted, must provide the lawful power for its preservation.

In contrast, Thomas Jefferson argued that people ought to recognize that emergency power is extra-constitutional but justified. As Jefferson famously wrote in a letter to John B. Colvin—the author of the early-19th-century book The Magistrate’s Guide, and Citizen’s Counsellor, who was then writing about Aaron Burr’s treason—“A strict observance of the written laws is doubtless one of the highest duties of a good citizen: but it is not the highest. The laws of necessity, of self-preservation, of saving our country when in danger, are of higher obligation.” For Jefferson, preserving the nation was more important than “a scrupulous adherence to written law.”

Yet, as Jefferson also insisted, the officer who exercises emergency power must justify his actions to “his fellow citizens generally.” For Jefferson, “the good officer” must throw “himself on the justice of his country and the rectitude of his motives.” Whether one sees emergency power from the perspective of Hamilton (constitutional because necessary) or Jefferson (extra-constitutional but justified), it is crucial that the officer who exercises emergency power justify himself to the public. The public must know what constitutional ends the officer thought he was serving and why the circumstances commanded extraordinary action. But Pence has retreated to silence, allowing some proxies to speak for him while ducking the crucial constitutional questions that surround his actions on January 6.

Did Pence think he was acting to preserve the constitutional transfer of power and save the country when it was in danger? Did Pence think that President Donald Trump was threatening the peaceful transfer of power? General Milley and those who followed Pence’s commands seem to think this. But the public should not have to guess at Pence’s motives—he has a constitutional obligation to explain why he thought the nation was in peril and how he acted to obviate that peril.

Pence has given us no justification for or explanation of why he seized constitutional authority that was not lawfully his. Article II of the Constitution provides that in the event of the president’s removal, resignation, death, or “inability to discharge the powers and duties” of the office, those powers devolve on the vice president. If Pence thought Trump was unable or unwilling to discharge the constitutional powers and duties of his office, that informs the constitutional analysis of his decision. The formal constitutional mechanism for suspending such a president is by way of the Twenty-Fifth Amendment. It provides that the vice president and a majority of the Cabinet may convey to Congress a written declaration of the president’s inability, allowing the vice president to assume those powers as acting president.

Given the circumstances, following the formal terms of the Twenty-Fifth Amendment was nearly impossible. With the Capitol under siege, Pence’s actions were probably justified. We can surmise that he sought to protect the lives of the people in Congress and to ensure that he remained at the Capitol to officially preside over the counting of electoral votes. But Pence himself should explain to America why he feared for those in Congress, why he would not leave with the Secret Service, and why the sitting president was unable to carry out his duties. The president, after all, was not incapacitated as far as we know.

Justifying Pence’s actions turns almost entirely on Trump’s state of mind both before and on January 6—something Pence is uniquely situated to speak to. We can guess much of what Pence would say. Still, his explanation will help us better understand the events that led to that day. And it will very likely require him to explain that he acted to thwart a sitting president’s unlawful attempt to stay in power.

In retreating to silence, Pence is acting to preserve his own interests, not the country’s. One assumes that he does not want to explain why he used emergency power because it will implicate Trump—and doing so will make Pence unpopular with Republicans. This is the sort of self-serving use of authority that makes emergency power so dangerous.

To put it plainly: Pence either acted extra-constitutionally to preserve the constitutional transfer of power or unlawfully seized power from a sitting president who was acting in accord with his constitutional responsibilities. Pence is trying to have the best of both options, but those two components don’t square. The January 6 committee should force his hand.

Anthony Ornato, Top Secret Service Official Sought by Investigators for Role in Jan. 6, Retires. As a private citizen, investigators won’t have testimonial subpoena authority to compel his cooperation.

Anthony Ornato, a top Secret Service official embroiled in the January 6 investigation, retired today, just two days before his planned interview with January 6 investigators. The Intercept obtained an email Ornato sent to the deputy director of the Secret Service just after 1 p.m. announcing his retirement as of the close of business on August 29.

Ornato had finally agreed to an interview with Department of Homeland Security investigators on August 31 after multiple attempts to arrange one. According to a memo sent by the Department of Homeland Security Office of Inspector General to the head of the Secret Service, DHS Secretary Alejandro Mayorkas, and DHS general counsel, the inspector general had been attempting to interview Ornato since June 29 and spent all of July and much of August following up.

For example, Ornato cited vacation as a reason he couldn’t attend an interview. “I believe my counsel spoke to you and / or your team, but I am traveling out of district on annual leave and am not available on the dates provided,” Ornato wrote in an email on August 24. “When I am back from vacation, I will circle back with you and your team.”

This is one in a string of access issues the inspector general has experienced in relation to January 6, as The Intercept reported last week.

Ornato has indicated that he still intends to attend the interview, according to an email obtained by The Intercept, but since Ornato will be a private citizen, investigators won’t have testimonial subpoena authority to compel his cooperation.

Ornato was a longtime Secret Service agent before President Donald Trump took the unprecedented action of appointing him to a White House position as deputy chief of staff for operations. Congress had also sent document preservation requests to the Secret Service.

The Intercept reported in July that the Secret Service erased text messages from January 5 and 6, 2022, after they were requested by oversight officials.

Ornato may have played a key role in the insurrection at the Capitol. On January 6, he reportedly sought to relocate Vice President Mike Pence to Joint Base Andrews in Maryland, which could have delayed the certification of the 2020 presidential election.

According to explosive testimony from Trump White House aide Cassidy Hutchinson to the House January 6 committee, Ornato told her that he was in the car with Trump when the president demanded to be driven to the Capitol, against advice, and allegedly lunged for the steering wheel.

Ornato has reportedly met with the January 6 committee twice, in January and March, as part of its investigation, discussing Trump’s knowledge of Pence’s location during the unrest on January 6.

After President Joe Biden entered the White House, Ornato was moved to the role of assistant director of the Secret Service’s Office of Training.

Former President Donald Trump said Thursday he will "very, very seriously" consider full pardons for the rioters who breached the US Capitol on January 6, 2021, if he runs for reelection and wins.

"I will tell you, I will look very, very favorably about full pardons. If I decide to run and if I win, I will be looking very, very strongly about pardons. Full pardons," Trump said on Wendy Bell Radio Thursday, adding: "We'll be looking very, very seriously at full pardons because we can't let that happen. ... And I mean full pardons with an apology to many."

The former President went on to claim Thursday that he's "financially supporting" some Capitol rioters who he referred to as "incredible."

"They were in my office actually two days ago. It's very much on my mind. It's a disgrace what they've done to them, what they've done to these people," Trump continued, not naming who he met with specifically.

Rep. Zoe Lofgren, a member of the House select committee investigating January 6, told CNN's Victor Blackwell on "CNN Tonight" Thursday night that she found Trump's pardon remarks "shocking," especially after a January 6 rioter was sentenced earlier in the day to 10 years for assaulting a police officer.

Lofgren condemned the suggestion that Trump would provide financial support to Capitol rioters, telling Blackwell, "That he (Trump) would be funding people who tried to, you know, essentially murder the vice president, overturn the election. ... And to say that that is patriotic, to say that those people should get an apology, I'm sorry. That is disgusting."

A Democratic member of the House select committee investigating the January 6, 2021, attack on the US Capitol said Sunday that he expects the panel's final report to come out "by the end of the year."

"Under House Resolution 503, that's a significant part of our responsibility, to report to the American people about how to prevent coups, insurrections, political violence and attacks on our democratic process going forward."

There is much more to say, but Trumptards have never listened since they were children because, at a certain age, they stopped comprehending what is going on around them:

How Trump Supporters Came to Hate the Police

At the Capitol riot and elsewhere, MAGA Republicans have leaped from “backing the blue” to attacking law-enforcement officials.

One way to think about January 6th is as the consummation, in real time, of a tumultuous shift between two distinct eras of conservatism. Before 2020, most conservatives celebrated law enforcement as the protectors of a system that was, on balance, reliably favorable to their interests. By the end of 2020, after the lockdowns and the election, many conservatives had come to see that system the same way that right-wing extremists did—as corrupt and tyrannical, perhaps even satanic. At the same time, so long as Trump was still in power and weaponizing law enforcement against leftists, neither conservatives nor the police were forced to confront what this meant for their alliance. That reckoning could no longer be avoided on January 6th, and it is understandable that people on both sides of the line persisted in respecting the terms of a compact that was now obsolete.

By Luke Mogelson.
September 10, 2022

In early August, after agents executed a search warrant at Mar-a-Lago, Donald Trump’s private club in Palm Beach, Florida, allies of the former President were quick to villainize the F.B.I. Although the raid had recovered more than a hundred classified documents, at least eighteen of which were labelled “Top Secret,” Republican pundits and politicians questioned its legitimacy and denounced the federal agency as a “gang of dangerous criminals,” “wolves,” the “Gestapo,” “the K.G.B.,” and “the enemy within.” Calls for retribution spread online. A forty-two-year-old Trump supporter named Ricky Shiffer wrote, “You’re a fool if you think there’s a nonviolent solution.” Shiffer then attempted to enter an F.B.I. field office in Ohio, equipped with body armor, an assault rifle, and a nail gun. After triggering an alarm, he fled the scene in his vehicle, and a high-speed pursuit ended in a shoot-out with state troopers, during which Shiffer was killed. Three weeks later, Trump gave a speech in which he called F.B.I. agents “vicious monsters.”

Given the broad support that Republicans have historically enjoyed from law enforcement, their escalating hostility toward the F.B.I. may seem paradoxical. Right-wing extremists, however, have always viewed state agents as pernicious antagonists, and so the institutionalization of that mind-set should come as no surprise as the G.O.P. embraces the ideas and attitudes of its radical flank.

In the early days of the pandemic, as Trump supporters began mobilizing against lockdowns and other public-health measures, much of their rage was directed at law enforcement. On April 30, 2020, heavily armed conservatives descended on the Michigan state capitol, in Lansing. Facing off against police outside the barred doors of the legislature, they denounced the officers as “traitors” and “filthy rats.” Some members of the mob belonged to the Michigan Liberty Militia, whose founder later told me that he had created the outfit in 2015, after “seeing what happened with the Bundys.” Cliven Bundy, an elderly rancher in Nevada, had declared war on the government when the Bureau of Land Management impounded his cattle over his refusal to pay outstanding grazing fees. After a tense standoff in which Bundy supporters surrounded law-enforcement agents and trained rifles on them from nearby hilltops, the Bureau of Land Management released the livestock and withdrew from the area.

Following the incident in Lansing, Mike Shirkey, the Republican Senate majority leader in Michigan, condemned the protesters as “a bunch of jackasses” who had used “intimidation and the threat of physical harm to stir up fear and rancor.” Shirkey seems to have quickly realized, though, that such principled nonpartisanship was no longer tenable in American politics. A couple of weeks later, at an anti-lockdown rally in Grand Rapids, I watched him publicly laud the Michigan Liberty Militia and assure its members, “We need you now more than ever.”

In the weeks that followed, resentment of law enforcement intensified sharply, with anti-lockdowners perceiving individual officers as complicit in an oppressive, tyrannical order. “They deserve to wear the Nazi emblem on their sleeves!” one retiree told me of the state police who’d served a cease-and-desist order to a barber violating the governor’s suspension of personal-care services. “People like me used to fucking back you!” a veteran shouted at police handing out citations at a gathering in Lansing. “But you are trash!”

Then, on May 25, 2020, a police officer murdered George Floyd, in Minneapolis. I left Michigan to cover the ensuing demonstrations and riots, and when I rejoined the anti-lockdowners I found that their stance toward law enforcement had undergone a dramatic reversal. That June, I attended a demonstration outside the capitol orchestrated by the Michigan Liberty Militia and a right-wing organization called the American Patriot Council. Ryan Kelley, a co-founder of the latter group, climbed the steps and pointed to several officers who were monitoring the scene. Not long ago, I had witnessed anti-lockdowners furiously berate these very same men. “We say thank you for being here,” Kelley told them now. “Thank you for standing up for our communities.”

The volte-face reflected a larger pattern of contradiction. The original Michigan Militia was created, along with a wave of other white paramilitary groups, in 1994, following the government’s botched attempt to arrest the survivalist Randy Weaver at his cabin, on Ruby Ridge, in northern Idaho. The deadly siege, less than a year later, of the Branch Davidian compound, in Waco, Texas, and the Clinton Administration’s subsequent ban on assault weapons reinforced a right-wing narrative that white Christians were under attack. After Waco, the Michigan Militia ballooned to an estimated seven thousand members. In 1995, on the second anniversary of the Waco massacre, Timothy McVeigh, a white supremacist who’d attended several Michigan Militia meetings, detonated an enormous truck bomb in Oklahoma City, killing a hundred and sixty-eight people. The leaders of the Michigan Militia decamped to Alaska, and the organization collapsed. Over the next decade and a half, right-wing militants across the U.S. remained largely dormant. Meanwhile, under President George W. Bush, the federal government enacted unprecedented infringements on personal privacy and other individual rights while the F.B.I. employed extraordinarily invasive surveillance and investigatory techniques against law-abiding citizens, largely on the basis of their religion. The reason that none of this provoked anti-government extremists was simple: the targets of the overreach were Muslims.

Similarly, after George Floyd was killed, conservatives repudiated the national uprising that demanded police reform and accountability, choosing instead to “back the blue.” As President Trump and his allies portrayed demands for racial justice as the sinister work of subversives intent on sowing chaos—much as segregationists had dismissed civil-rights activists as Communist agitators—backing the blue became analogous with opposing the left. After my stay in Michigan, I spent a month covering antifascist protests in Portland, Oregon, where demonstrations against the local police department were punctuated by clashes with Trump supporters, including members of the Proud Boys, who presented themselves as allies of law enforcement. As anti-lockdowners had shown in Michigan, however, this alliance was conditional and tended to break down whenever laws intruded on conservative priorities. Right-wingers rationalized the inconsistency by assigning the epithet “oath breaker” to any American in uniform who executed his duties in a manner they disliked.

About a month after the 2020 Presidential election, at a rally in Washington, D.C., I followed hundreds of Trump supporters as they marauded on the streets around the White House, assaulting pedestrians, vandalizing Black churches, and seeking to engage antifascists in fist fights. The Metropolitan Police, the Park Police, and the Capitol Police did their best to keep the two sides separate. Their interference enraged the Trump supporters, who called the officers “piggies,” “cunts,” and “pieces of shit.”
Some of the insults were indistinguishable from those shouted by leftists in Portland.

“Fuck your paychecks!”

“Fuck the blue!”

“Vigilante justice will be king!”

“Defund the police!”

Many of these same Trump supporters returned to D.C. on January 5, 2021, and by then it was clear that law enforcement would no longer be exempt from their belligerence. Online, Proud Boys made plain that their days of backing the blue were over. “Fuck these DC Police,” one commented. “Fuck those cock suckers up. Beat them down. You don’t get to return to your families.”

The next day, I followed thousands of people up the National Mall after Trump’s incendiary speech from the Ellipse. On the west side of the Capitol, two broad flights of granite steps descended from an outdoor terrace on the third floor. In anticipation of Joe Biden’s Presidential Inauguration, huge bleachers had been erected over the steps, with a ten-thousand-square-foot platform constructed between them; the bleachers had been wrapped in ripstop tarpaulin, creating a sort of monolith that functioned as a rampart. Trump supporters climbed the steps and began cutting through the fabric with knives. Officers blocked an opening at the bottom of the bleachers, but they were outnumbered and obviously intimidated as the mob pressed against them, screaming insults, pelting them with cans and bottles. Some people shoved and punched individual officers; others linked arms and rammed their backs into a row of riot shields, their eyes squeezed shut against blasts of pepper spray. A few Trump supporters used their own chemical agents against the police. The stone slabs underfoot were smeared with blood. “You’re a bunch of oath breakers!” a man making his way along the police line barked through a bullhorn. “You’re traitors to the country!”

Former President Donald Trump repeatedly told aides in the days following his 2020 election loss that he would remain in the White House rather than let incoming President Joe Biden take over, according to reporting provided to CNN from a forthcoming book by New York Times reporter Maggie Haberman.

"I'm just not going to leave," Trump told one aide, according to Haberman.
"We're never leaving," Trump told another. "How can you leave when you won an election?"

Trump's insistence that he would not be leaving the White House, which has not been previously reported, adds new detail to the chaotic post-election period in which Trump's refusal to accept his defeat and numerous efforts to overturn the election result led to the January 6, 2021, attack on the US Capitol by pro-Trump rioters.
