The long-awaited federal indictment of Donald Trump for his efforts to overturn the 2020 election may be necessary to contain the threat to American democracy that he has unleashed. But it’s unlikely to be sufficient.

The germ of election denialism that Trump injected into the American political system has spread so far throughout the Republican Party that it is virtually certain to survive whatever legal accountability the former president faces.

With polls showing that most Republican voters still believe the election was stolen from Trump, that the January 6 riot was legitimate protest, and that Trump’s efforts to subvert the 2020 results did not violate the law or threaten the constitutional system, the United States faces a stark and unprecedented situation. For the first time in the nation’s modern history, the dominant faction in one of our two major parties has repeatedly demonstrated its willingness to accept antidemocratic means to advance its interests.

The most telling measure of that dynamic inside the GOP is that Trump remains the party’s central figure. Each time GOP voters and leaders have had the opportunity to move away from him—whether in the shock immediately after January 6, or the widespread disappointment over the poor performance of his handpicked candidates during the 2022 election—the party has sped past the off-ramp.

Polls now show Trump leading in the 2024 GOP presidential race by one of the biggest margins ever recorded for a primary candidate in either party. The Republican majority in the House of Representatives has been exploring ways to expunge his two impeachments and/or block the investigations he faces. Even the other candidates ostensibly running against him for the 2024 GOP nomination have almost uniformly condemned the indictments against him, rather than his underlying behavior. Prominent conservatives have argued that Trump cannot receive a fair trial in any Democratic-leaning jurisdiction.

All of these actions measure how much of the GOP is now willing to accept Trump’s repeated assaults on the basic structures of American democracy. While the key state-level Republicans rejected Trump’s direct demands to invalidate the results in their own states, most House Republicans voted to reject the election results and most Republican state attorneys general filed a lawsuit to decertify the outcome in the key swing states won by President Joe Biden. In the election’s aftermath, the majority of Republican-controlled states, inspired by Trump’s baseless claims of endemic voter fraud, passed laws on a party-line basis making it more difficult to vote, or increasing partisan control over election administration.

Sean Wilentz, a Princeton historian who specializes in American politics, told me that U.S. history has no exact precedent for a party embracing a leader so openly hostile to the core pillars of democracy. Presidents have often been accused of violating the Constitution through their policy actions, he said, but there is not another example of a president moving as systematically to “manipulate the apparatus of government or elections in order to subvert the will of the people.”

The closest parallel to Trump’s actions, Wilentz said, may be the strategies of the slaveholding South in the decades before the Civil War. Those included violent attacks on abolitionists, suppression of antislavery publications, and the promulgation of extreme legal theories such as the denial of basic rights to Black people in the Supreme Court’s 1857 Dred Scott decision, all of which were designed to protect slavery against the emerging national majority dubious of it. That decades-long “antidemocratic thrust” from the South, Wilentz noted, “finally culminated in the greatest violation of the American Constitution in our history, which was secession.”

By contrast, Wilentz added, the GOP’s continued embrace of Trump amid the evidence of his misconduct contrasts sharply with the party’s refusal to defend Richard Nixon in the final stages of Watergate. “When Richard Nixon was about to be impeached, he didn’t storm the Capitol to get rid of Barry Goldwater,” Wilentz said, referring to the conservative Republican senator who warned Nixon that he would lose a Senate vote to remove him. “He resigned.”

All of this suggests that personal accountability for Trump is unlikely to erase the tolerance for antidemocratic actions that has spread in the GOP since his emergence. Yet many experts who study the health of democracy still believe that prosecuting him remains essential.

Kristy Parker, a counsel at Protect Democracy, a bipartisan group that focuses on threats to democratic institutions, says it is crucial to show the “silent majority” of Americans who support the constitutional system that no one is above the law. “They need to see that the Department of Justice prosecutors are willing to take the risk of indicting Trump,” Parker told me. “They need to see the election workers ensuring that people get their vote counted. They need to see the police officers standing up to the rioters. They need to see people within the system working.”

Michael Waldman, the president and CEO of the Brennan Center for Justice at New York University Law School, told me that he has been ambivalent about indicting former presidents, because of the risk of precipitating a retaliatory spiral between the parties. “It is a line that we as a country have never crossed,” Waldman said shortly after the Trump indictment was disclosed last night. “One could imagine how it could be abused and become one more shattered norm.”

Waldman said that failing to indict Trump would have been far more dangerous, because such a decision would have suggested that there is no effective way to hold presidents accountable for misbehavior. Neither of Trump’s two impeachments really damaged his position in the party, Waldman noted, in part because virtually all GOP elected officials defended his behavior. But the multiple criminal indictments facing Trump, he said, show that “the criminal-justice system still is producing tangible legal consequences” that future presidents cannot brush off as easily as an impeachment.

Waldman said the trials of hundreds of January 6 rioters already demonstrate that prosecution can have some deterrent effect. Unruly crowds of supporters, Waldman noted, did not descend on courthouses in Manhattan or Florida after Trump’s earlier indictments, despite his signals that he’d like to see that happen. “The fact that this stuff is not just a bad idea but illegal and you can go to jail for it really makes a big difference,” Waldman said.

John Dean, the White House counsel whose Senate testimony helped doom Nixon during Watergate, also considers prosecution of Trump to be “essential,” he told me. President Gerald Ford’s decision to pardon Nixon and preempt a trial, Dean said, was “a historical disaster,” because it emboldened presidents to believe they would never face criminal charges for their actions. Allowing Trump to avoid consequences, Dean believes, would send an even more dangerous signal than Ford did with Nixon. “Trump’s corruption is so much more fundamental to the system than Nixon’s,” Dean said. “Nixon, he abused power, he had his enemies list, he wanted to make government work for the benefit of Republicans and not Democrats. But he wasn’t going after the foundations of government and the system like Trump.”

Trump’s effort to overturn the 2020 election required the cooperation of many other GOP officials and conservative activists and lawyers. Now a growing number of them face consequences of their own, including disbarment proceedings, ongoing state and local investigations, and the potential of further federal charges from Special Counsel Jack Smith against the six unnamed co-conspirators listed in the Trump indictment.

“I’m not sure how much additional prosecutions will deter Trump—unfortunately, he’s all-in on winning as a way to stay out of prison at this point,” says the Dartmouth College political scientist Brendan Nyhan, a co-founder of Bright Line Watch, a collaborative of political scientists studying threats to U.S. democracy. “But Republican operatives and activists may hesitate as the evidence mounts that participating in an attempted coup puts you in legal jeopardy. That’s important, because Trump can’t carry out his plots by himself.”


Some analysts have worried that the trials could strengthen Trump if die-hard supporters of his on a jury refuse to convict him regardless of the evidence. But Parker told me that cannot be allowed to dissuade prosecutors from bringing cases when there’s evidence that Trump violated the law. The problem, she said, is analogous to the challenges she faced as a Department of Justice civil-rights attorney prosecuting excessive-force cases against police officers who were likely more popular in the community than the victims they abused: “You can’t just give in and allow, effectively, a bully to force his way out of accountability, because then you’ve crushed the ideal that no one is above the law.”

Yet although all these possible sanctions create legal reasons for the GOP to resist another Trump-led attack on democracy, the party’s political incentives point in the opposite direction.

A recent national poll released by the Bright Line Watch project found that the majority of Republican voters accepted all of Trump’s key arguments about 2020 and the multiplying legal challenges accumulating against him. In that survey, only small minorities of Republicans said that he had committed crimes in any of the cases he’s facing. Most Republicans said Trump was singled out for prosecution for behavior that would not have prompted charges against other people. Six in 10 Republicans described the January 6 riot as “legitimate protest.” And although the share of Republicans who said that Biden was elected through fraud had declined somewhat from its peak of about three-fourths, nearly two-thirds of them still denied the legitimacy of his victory.

These attitudes provide an ominous backdrop to Trump’s hints that if he wins the nomination but loses the general election, he’s likely to challenge the results again. Trump might not attempt another mass physical attack on the Capitol in 2025, but such sentiments could allow him to enlist Republicans again for a more targeted legal effort to overthrow the results in a few key states or in Congress, Nyhan told me. The widespread Republican rejection of the idea that Trump violated any laws in his actions after 2020 offers reason to doubt that the party would object any more strenuously if he launched another campaign to delegitimize the results in 2024.

Nyhan said he can imagine future circumstances in which Democrats at some point challenge the legitimacy of a presidential race, such as the election coming down to a Republican-controlled state that has restricted voting rights. But he said the more immediate danger is that Republicans won’t accept any presidential race they lose. Traditionally, presidential nominees from each party, including Al Gore and John McCain, have made statements in which “the losing side specifically affirms the legitimacy of the winner,” Nyhan said. But for the GOP next year, he added, “we can no longer take that for granted whether or not Trump is the nominee, and that’s really worrisome.”

Trump may constitute a unique threat to America’s democratic traditions. But he has always connected his claims of pervasive electoral fraud to the widespread anxiety among white, Christian conservatives that they are losing control of the country to a racially diverse, secular, and LGBTQ-friendly Democratic coalition centered in the nation’s largest cities. As Trump put it during one 2020 rally before a predominantly white, rural audience in Georgia: “This is our country. And you know this, and you see it, but they are trying to take it from us through rigging, fraud, deception, and deceit.” Whether Trump is convicted for trying to overturn the 2020 election or not, voters who accept that argument will remain the most powerful force in the GOP coalition. And they will continue to demand leaders who will fight the changes that they believe threaten their position in American society.

Those other Republican leaders may not attempt to overturn an election as brazenly as Trump did with the conduct Smith catalogs in his indictment. But, as Wilentz told me, for the foreseeable future, they are likely to pursue other means “toward the same end: that majoritarian democracy cannot be tolerated under any circumstances if the outcome is not what you wanted it to be.”

Republicans fared poorly in all three elections since 2016. Just look at what happened in 2022. Republicans nominated the Trumpiest candidate they could find in the most important races — and lost because voters clearly rejected candidates defined solely by inexperience and fury. In one vital, winnable race after another, in key states including Arizona, Georgia, Pennsylvania and Michigan, reasonable Democrats beat outrageous Republicans.

In between elections, Trumpism has been a poison to Republican state parties. Loony election deniers have taken over and in some cases crippled their organizations with mismanagement; the Arizona and Michigan parties are practically bankrupt. That’s a trend Democrats are happy to see continue.

20 Million jobs were lost when the Democrats teamed up with China to unleash Covid on the world to remove Trump from office, and 20 Million people went back to work when it was over after they successfully destroyed the American voting system to keep Trump out of office.

Add that 20 Million back where it shouldn't have been taken from and subtract it where it shouldn't have been gained and Republicans created 44 Million jobs while Democrats only created 22 Million.

And that had ripple effects on everything else.





Show me the stats of the last 50 years minus the last 4 years and those numbers look insanely different than what you've just presented.

13 Readers on What Trump Voters Want

Last week, I put this question to readers: “Donald Trump is guilty of deplorable actions, under indictment for multiple crimes, and yet remains the most popular candidate with voters in the Republican Party’s presidential primary. Why do you think he is still their first choice?”

Replies have been edited for length and clarity.

1) Randall R. argues that Trump supporters earnestly desire national greatness:

The reason many support Trump (if you have the decency to listen to them) is because they want to make America great again, and there’s no one else close to matching Trump in both prominence and apparent ability to make what they’d say is the most promising and important part of America great, in the face of the internal conflicts that currently exist.

That’s an illusion spread by a politician, offering an addictive thrill that disconnects people from parts of reality. It doesn’t make America great. But making America great, recognizing how it has long been great and how it can be more great, remains important.

Listen to the Trump voters: the neglected, the deplored, the doomscrollers, the people who want to make something of themselves, those who want to raise their family in a better world. Those who vote against Trump fit these same descriptions. It’s essential, for people on opposing sides of what’s become Trump’s divide, to listen to each other with respect, so we can build our way out of America’s problems without being exploited by political operators. You or I have no shortage of illusions in our parts of the political spectrum; shouldn’t we be reexamining those illusions instead of looking down on Trump’s followers?

2) Bob puts forth a theory of populism:

Populist movements arise from widespread dissatisfaction with cultural and economic conditions and the inability of the government to deal with public concerns. This is fertile ground for charismatic and authoritarian leaders offering quick and simple solutions. Though Trump may be a person of low character, to many of his supporters, he seems like the sort of fighter that is needed—someone who does not follow the rules because the rules are believed to be the problem. James Madison would be sad and disappointed.

3) Jaleelah analyzes what she sees as the incentives of Trump supporters:

Trump’s supporters sincerely believe that he is being framed, not only because he has been priming them for his conviction for years, but because they have to believe it lest they become severely depressed. Imagine dedicating yourself to a false religion or an unfulfilling career or a bad partner. Imagine losing relationships with your lifelong friends and your adult children who strongly disagree with your choices. When you’ve committed to something at a great cost, it is hard to admit that your commitment was all for nothing.

I don’t think it is strange that so many people insist Trump is innocent. I do, of course, believe he is a fraud who is corrupt enough to have committed the crimes he is accused of. But genuine revolutionary figures get locked up on fake charges all the time. Nelson Mandela and Mahatma Gandhi were charged, convicted, and imprisoned. Most reasonable people alive today believe their imprisonments were unjust and that states are capable of fabricating evidence against popular figures who threaten the social order. Trump’s supporters are simply applying a reasonable idea in an unreasonable context.

Liberals and progressives do not seem keen to accept repentant Trump supporters. There is little benefit to switching teams. There is a very high cost. Towns that have unified behind Trump are just as keen on cancel culture as their liberal counterparts. No one wants to be confronted by a horde of their neighbors at church or accused of supporting degeneracy at the grocery store. Peer pressure is probably keeping a lot of people in line.

4) Dan argues that “most people assume that voters look at a candidate’s record and personality,” but “what really matters is whether a candidate gives a voter an identity.” He explains:

The voters are, because of their support for a candidate, a “somebody.” Trump has done this better than any candidate in 50 years. To voters whose worlds have been destroyed by elites, Trump says: You matter. Become a part of this movement and you are standing up to the elites. You can get your life back with me, and be a SOMEBODY again. Trump’s legal cases are easily rationalized as the price he has been willing to pay, personally, to represent all of the people who see him as validating their lives and giving them identities once again. To his supporters, he is sacrificing for “the cause.”

5) Christopher scolds Trump’s critics for what he sees as a failure to understand their country:

Trump supporters believe that the economic and cultural game is rigged. Trump supporters disagree with teaching little children about gender or allowing gender-reassignment care to impressionable minors and are branded with a pejorative label for it. They see branding that Florida law as “Don’t say gay”––despite the fact that a majority of would likely support the content and intent of Florida’s efforts to ensure age-appropriate instruction––is wrong. Similarly, when someone supports law enforcement or opposes affirmative action, they are labeled “racists,” even though there are principled reasons to take issue. Trump has tapped into the frustration that comes from playing a rigged game. Trump supporters see Trump as challenging the cultural and economic system that excludes them and their views.

The elites and media need to stop dismissing Trump supporters as some fringe group. Trump received more votes in 2020 than did Obama [in 2008] and came in second in 2020 only to Biden. The 2024 election is likely to be close. The issues Trump has tapped into are not fleeting.

6) Geoff describes a type of voter he has observed as a retail manager in Colorado, in a store that catered to a Trump-voting demographic:

They are white, working-class, and very knowledgeable about stuff and fixing it, but they don’t value education as it is systematized in America. They are very transgressive in their everyday language but are model citizens overall. The most notable sentiment, for me, was commonly phrased as, “Wouldn’t it be great to vote for a POTUS sitting in prison?!” They defend him out of reaction: It’s “unpopular,” and they are raging against the machine. Think if supporting Nixon was the most “punk rock” thing you could do.

7) Patricia shares how she became a Democrat and describes some Trump supporters she has observed:

I’m 90 years old, a retired hospital administrator. My late husband and I were brought up in Republican families in California and voted that way until we watched Bill Clinton’s impeachment and witnessed the mean streak and hypocrisy of the Republicans.

We have voted for Democrats ever since.

My co-grandma is currently 89. She immigrated from Argentina at the age of 22, so you’d think she’d recognize authoritarians when she smells them, but no, she likes Trump. She loved watching The Apprentice and watches Fox. And her friends email around crazy stuff they find online. She has a Ph.D. in education and taught at a university for years.

I have a 65-year-old in-law who lives in Orange County, California, and has a successful business. A smart man, but not formally educated. He is a Trump supporter because of taxes mostly.

My granddaughter and her husband recently moved to northern Idaho from the Seattle area because they don’t like the regulations in Washington State. They think Trump is not a nice man but are pretty well aligned with libertarianism—they don’t want government interfering in their freedom, so they think Trump is the only choice. Both are college graduates.

And beyond them, I’ve observed that there are people with a seemingly “genetic” trait who simply enjoy seeing a person “stick it” to others. Trump is exceptionally good at ridicule.

8) Nick thinks his experience of being young and right-leaning helped him understand support for Trump:

Pre-2016, I identified as a conservative. While in college, if I tried to offer a different opinion on topics such as immigration, I felt ridiculed and looked down upon. I decided my two options were to be met with scorn or to hold my tongue. I know I wasn’t the only one. My good friend started a club to bring liberals and conservatives together to talk about major issues. He did everything he could to get conservatives to show up but just couldn’t get it to happen. I am not surprised because I don’t think I was the only conservative who felt like they couldn’t share out of fear of being “canceled” or called a racist or bigot for not going along with the mainstream liberal line. Perhaps Republicans are rallying around Trump despite his egregious undemocratic and immoral acts because they see themselves in him, a conservative being constantly ridiculed by liberals for his beliefs, except he actually speaks up. I don’t think all conservatives are power-hungry autocrats like Trump, and I don’t think most of them share his views. But I do think that we tend to support someone when we see ourselves in them. Identity politics play in both parties; maybe we’re just seeing the conservative version.

9) T. argues that we’re witnessing a reaction to cultural change:

I’m an architect in a progressive city out west. I abhor Donald Trump, but I understand why my in-laws in Tennessee support him without reservation. What’s mystifying to me is that so many bright, liberal folks of my acquaintance don’t grasp it. Do you recall the deafening silence after the 2016 election, when Hillary lost to the worst presidential candidate in American history? There were a couple of months of serious self-examination among Democrats, but it quickly cooled, and I haven’t heard anything like it since.

I think our lack of understanding is due to the inability of most of us to put ourselves into the shoes of disadvantaged Trump voters. What you’d see coming your way is an all-consuming political, economic, and cultural wave––one that represents not only change, but also disdain for your way of life and destruction of your sense of who you are. I’m not saying that’s true, but the impression is very real. It’s cultural imperialism, which we understand very well when we talk about gentrification, but we miss completely when the encroaching force comes from our side of the fence. After all, how would we feel if confronted by a way of life that mocks our religion, siphons up our brightest young people and convinces them we’re hopelessly ignorant, sells us out to the global economy, promotes behavior that’s been taboo for thousands of years, and cancels us if we disagree? It fits with the experience of Indigenous cultures that were overrun by modern industrial society during the past 250 years. Those Tennesseans are being sold a bill of goods by a flimflam man, but we set them up for it.

They are compassionate, kind to strangers, and even have friends in people of all political stripes. We are a racially diverse bunch: Black, Hispanic, and white. And regarding his claims of election fraud, despite lack of hard evidence, they feel in their gut that he is right on some level. I doubt I could do or say anything to convince them otherwise.

Part of being a human being is wanting to belong. One way we do that is to identify with someone or something. Passionate sports fans are a good example. And once we link our identity, our sense of who we are, to those teams, we look at everything about those teams through a positive perspective. People have identified with Trump and now their well-being and self-image are tied to him. That prevents them from viewing any reality other than the one that he creates. It will take some sort of disruption to break up with him, but it doesn’t look like that will occur. When their identity is at risk, the most comfortable path is to stay with Trump and distort new data to fit their views.

I suspect that support for Trump is rooted in people’s fears of becoming a minority and suffering economic demise due to competition from immigration by humans who are unlike them.

But did Thomas violate any laws by hoovering up all these private gifts? YES! Will anyone do anything about it? NO! As near as I can tell, a Supreme Court justice could stand in the middle of Fifth Avenue and shoot somebody and then just disappear safely into his chambers and refuse to ever talk about it.

This whole story gets sleazier and harder to believe with every new revelation. Thomas makes Hunter Biden look like a piker. But apparently, nobody will do anything about it.

While former President Donald Trump and his team try to build up his air of invincibility in the GOP presidential primary, the fact remains that he would be facing a near-certain loss in the general election.

A poll from the Associated Press-NORC Center for Public Affairs Research found that 53% of people say they would definitely not support Trump in the general election, compared to 43% who say the same of President Joe Biden. The Constitution prohibits Trump from ever being president again

As students of the United States Constitution for many decades—one of us as a U.S. Court of Appeals judge, the other as a professor of constitutional law, and both as constitutional advocates, scholars, and practitioners—we long ago came to the conclusion that the Fourteenth Amendment, the amendment ratified in 1868 that represents our nation’s second founding and a new birth of freedom, contains within it a protection against the dissolution of the republic by a treasonous president.

This protection, embodied in the amendment’s often-overlooked Section 3, automatically excludes from future office and position of power in the United States government—and also from any equivalent office and position of power in the sovereign states and their subdivisions—any person who has taken an oath to support and defend our Constitution and thereafter rebels against that sacred charter, either through overt insurrection or by giving aid or comfort to the Constitution’s enemies.

The historically unprecedented federal and state indictments of former President Donald Trump have prompted many to ask whether his conviction pursuant to any or all of these indictments would be either necessary or sufficient to deny him the office of the presidency in 2024.

Having thought long and deeply about the text, history, and purpose of the Fourteenth Amendment’s disqualification clause for much of our professional careers, both of us concluded some years ago that, in fact, a conviction would be beside the point. The disqualification clause operates independently of any such criminal proceedings and, indeed, also independently of impeachment proceedings and of congressional legislation. The clause was designed to operate directly and immediately upon those who betray their oaths to the Constitution, whether by taking up arms to overturn our government or by waging war on our government by attempting to overturn a presidential election through a bloodless coup.

The former president’s efforts to overturn the 2020 presidential election, and the resulting attack on the U.S. Capitol, place him squarely within the ambit of the disqualification clause, and he is therefore ineligible to serve as president ever again. The most pressing constitutional question facing our country at this moment, then, is whether we will abide by this clear command of the Fourteenth Amendment’s disqualification clause.

We were immensely gratified to see that a richly researched article soon to be published in an academic journal has recently come to the same conclusion that we had and is attracting well-deserved attention outside a small circle of scholars—including Jeffrey Sonnenfeld and Anjani Jain of the Yale School of Management, whose encouragement inspired us to write this piece. The evidence laid out by the legal scholars William Baude and Michael Stokes Paulsen in “The Sweep and Force of Section Three,” available as a preprint, is momentous. Sooner or later, it will influence, if not determine, the course of American constitutional history—and American history itself.

Written with precision and thoroughness, the article makes the compelling case that the relevance of Section 3 did not lapse with the passing of the generation of Confederate rebels, whose treasonous designs for the country inspired the provision; that the provision was not and could not have been repealed by the Amnesty Act of 1872 or by subsequent legislative enactments; and that Section 3 has not been relegated by any judicial precedent to a mere source of potential legislative authority, but continues to this day by its own force to automatically render ineligible for future public office all “former office holders who then participate in insurrection or rebellion,” as Baude and Paulsen put it.

Among the profound conclusions that follow are that all officials who ever swore to support the Constitution—as every officer, state or federal, in every branch of government, must—and who thereafter either “engaged in insurrection or rebellion” against the Constitution or gave “aid and comfort to the enemies” of that Constitution (and not just of the United States as a sovereign nation) are automatically disqualified from holding future office and must therefore be barred from election to any office.

Regardless of partisan leaning or training in the law, all U.S. citizens should read and consider these two simple sentences from Section 3:

No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

The Fourteenth Amendment was promulgated and ratified in the context of postbellum America when, even after losing the Civil War, southern states were sending men to Congress who had held prominent roles in the Confederacy or otherwise supported acts of rebellion or insurrection against the United States.

The two of us have long believed, and Baude and Paulsen have now convincingly demonstrated, that notwithstanding its specific historical origin, Section 3 is no anachronism or relic from the past; rather, it applies with the same force and effect today as it did the day it was ratified—as does every other provision, clause, and word of the Constitution that has not been repealed or revised by amendment.

Baude and Paulsen also conclude that Section 3 requires no legislation, criminal conviction, or other judicial action in order to effectuate its command. That is, Section 3 is “self-executing.”

Why Do Democrats Get Offended When Told Basic Facts?

• Over the last fifty years, every Republican President has seen a recession, while we have had only one recession begin under a Democrat, a short six month recession under Carter.

• Over the last forty years every Republican President has created a deficit at least double the previous record. Over that same time, every Democratic President (including already Biden) has cut the deficit by half or more.

• The last three Democratic Presidents (including Biden) have all seen unemployment effectively cut in half. The last two Republicans both saw it effectively double.

• Over the last fifty years, despite holding the Presidency for only 22 years compared to Republicans holding it 28, stock market return has been just over 100% under Republicans and just shy of 1,000% under Democrats. Over 42 million jobs have been created under Democrats compared to only 24 million under Republicans. Income growth averaged 2.2% under Democrats compared to 0.6% under Republicans. GDP growth averaged 4.1% under Democrats compared to 2.7% under Republicans.

• Going back to Truman, four of the five Presidents who have seen the largest increase in domestic oil production were Democrats (with Trump scoring the number five spot and Obama placing first). Only six Presidents over that time have seen domestic oil production fall, and five of them were Republicans.

• Since 1980, The abortion rate held steady under Reagan, Bush 41 and Bush 43. It fell under both Clinton and Obama, and under Trump rose for the first time since the 1970’s.

• Since the Nixon Administration, 338 members of Presidential administrations have been indicted on criminal charges. Three of these were in Democratic administrations, 335 were in Republican administrations.

• In the last century, only two Presidents have lost jobs during their administrations, both Republicans (Hoover and Trump)

• Over the last 80 years, five of the six Presidents with the highest job creation were Democrats, with only Reagan making the list. (Current rankings are Clinton, Reagan, Biden, Obama, Johnson, and Carter, with Biden likely to move into second place before the end of his first term.)

• Ten of the eleven safest states in the Union are blue or lean blue with Utah the only red state. Fifteen of the sixteen least safe states are red, with Georgia being the only non-red state in that mix (and until recently we would have considered Georgia a red state). (Scores based on a combination of personal safety, road safety, financial safety, and emergency preparedness.)

• Four of the five states with the highest poverty rate are deep red (New Mexico being the only blue state). Four of the five states with the lowest poverty rates are-blue or lean blue, with Utah the only red state.

• The five states with the best education are all blue. Four of the five states with the worst education are deep red, with New Mexico the only blue state.

• Four of the five states with the highest incarceration rates are deep red, with Delaware the only blue state. Four of the five with the lowest incarceration rates are blue or lean blue with North Dakota the only red state.

Republican scandals: A brief refresher

Just in case anyone could use a refresher, here are the most recent six "scandals" that have preoccupied Republicans during the last two Democratic administrations:

1 Benghazi
2 IRS tea party targeting
3 Hillary's email
4 Durham investigation
5 Afghanistan withdrawal
6 Hunter Biden

And here's how they turned out:

1 Benghazi (2012-14): There was no "stand down" order and no denial of air support. Nobody lied about the cause of the enemy attack. Administration statements were generally accurate given what was known at the time they were made. The "Innocence of Muslims" video really did play a role in the attacks. Security at the consulate was sufficient, and in any case was provided mostly by the CIA, not State. There was no cover-up related to security. The attack was primarily opportunistic, not planned, and was carried out by a mixed group. There was no incompetence on the part of Hillary Clinton or the State Department.

Two years after the attack, all of this was finally acknowledged by Republicans when the House Select Intelligence Committee—controlled by Republicans—issued its final report. Their exoneration of the White House was sweeping and nearly absolute.

2 IRS (2013): Initially it looked like the IRS was targeting tea party groups over their tax-exempt status. However, that was because the initial demand from Republicans was solely for records of conservative groups. It took several years, but when a broader record search was done it turned out that there had been no partisan intent and liberal groups had actually been targeted far more than conservative groups.

3 Hillary's email (2015-16): In the end, the final FBI report showed that Hillary had done nothing seriously wrong. She used a single account hosted on a private server for both work and personal emails, which was probably a mistake in judgment but not done with any intent to withhold anything. There is no evidence that any foreign adversary hacked the server. She turned over all official emails when requested. Before she handed them over her lawyers culled out personal emails, and there's no evidence that any work emails were deleted in the process. Extensive evidence makes it all but impossible that this happened. Her personal server was eventually wiped clean, but this was part of a routine change in record retention policy that was botched by her hosting service. During her time as Secretary of State, she sent and received only three classified emails, all of them trivial. After the fact, State and CIA argued over some other emails—almost none of them initiated by Hillary—with CIA concluding that they should have been classified. Hillary did nothing wrong except for relying on State's classification in real-time. The FBI's report is an almost complete exoneration of Hillary.

4 Durham investigation (2019-23): John Durham was appointed in hopes of demonstrating that the FBI's investigation of Donald Trump's ties to Russia was unfounded and illegal. However, despite continual leaks and feverish indictments insinuating otherwise, Durham never found anything of the sort. In the end, he indicted only three people, all on trivial charges, and even so managed to lose two at trial and win only a plea deal on the third. We know now that, in fact, Trump's presidential campaign did have links to the Russian government. The FBI did have a perfectly sensible reason to open an investigation into this. Vladimir Putin did try to interfere with the election in Trump's favor. There were never any intelligence operations targeting Trump. There were no illegal actions by the Hillary Clinton campaign. And several members of Durham's team did quit because of disagreements with him over prosecutorial ethics. Every leak from Durham produced excited reports from Fox News, but by the time he was finished, he had produced nothing.

5 Afghanistan (2021): Joe Biden didn't set the date of withdrawal. It had been set by Donald Trump during the previous administration. The evacuation was chaotic for the first four hours of the first day, but proceeded efficiently for the rest of the month. The State Department worked heroically to approve visas in the face of obstacles previously put in place by Trump aides. Over 100,000 people were flown out, including all but 300 Americans. There were almost no fatalities aside from a single ISIS suicide bomber. All in all, it was an impressive operation by the Pentagon and State Department under the most difficult circumstances imaginable.

6 Hunter Biden (2020-present): Hunter's infamous laptop—mysteriously produced by Rudy Giuliani just before the 2020 election—ended up revealing nothing but some embarrassing tidbits. Joe Biden didn't try to get a Ukrainian prosecutor fired because he was investigating Burisma, Hunter's employer. It was official administration policy—and the policy of most Western countries—to pressure Ukraine to fire the prosecutor because he was corrupt. Although Hunter failed to pay his taxes for two years, he eventually settled with the IRS and paid them in full. To this day there remains no evidence that Joe Biden was involved with Hunter. In fact, there's barely any evidence that Hunter himself ever did anything illegal.

Under the circumstances, is there any good reason to think that any Republican investigation is worth believing? All of them have been characterized by a constant drip of misleading leaks and none of them have stood the test of time. On this score, Republicans should always be presumed guilty until they prove their innocence.

The 14th Amendment to the rescue

From coast to coast, Republican politicians are breathing a sigh of relief. Even though most of them won’t say it publicly, it’s no secret that, privately, many Republicans don’t really want former President Trump to be their party’s nominee in 2024. They’re just hoping he’ll somehow go away.

Why? Because they know they can’t win with him at the top of the ticket. He’s got too much baggage. As commentator Keith Boykin adds it up, that includes (so far): 91 criminal charges; 26 sexual assault allegations; six bankruptcies; five draft deferments; two impeachments; one convicted company; one fake university shut down; one fake charity shut down; a $25 million fraud settlement; a $5 million sexual abuse verdict; and a $2 million charity abuse judgment.

But for Republicans the dilemma has been, short of a prison term, how were they going to move beyond Trump without totally alienating his loyal base — or, as Florida Gov. Ron DeSantis calls them, Trump’s “listless vessels”? For months, they’ve been secretly looking for some way to dump Trump without leaving any fingerprints of their own.

Suddenly — notice the big smiles on their faces — they’ve found the answer. It’s their own “deus ex machina.” Now riding to the rescue of Republicans as the way to sideline Trump once and for all is the 14th Amendment.

Trump is ineligible for office and more people are realizing it: Yale professor

If Republicans are serious about capturing the White House next year, their best bet would be to ditch Donald Trump.

That’s according to the findings of a newly published University of Pennsylvania Law School study authored by two staunch conservatives that says Trump would be ineligible to serve because of his role in the Jan. 6 attack on the Capitol, Yale management professor Jeffrey Sonnenfeld writes for Just Security.

Sonnenfeld asserts that the study “shows with true authority that Trump has violated a fourth qualification, by providing aid and comfort to an insurrection and enemies of the U.S. Constitution.”

Trump vows massive new tariffs if elected, risking global economic war

Trump floats 10 percent tax on all foreign imports

Trump summoned his top economic advisers to his private golf club in New Jersey for a two-hour dinner last Wednesday night to map out a trade-focused economic plan for his presidential bid.

Trump and top aides, including former senior White House officials Larry Kudlow and Brooke Rollins, as well as outside advisers Stephen Moore and former House speaker Newt Gingrich, spent the dinner discussing how Trump could attack President Biden in the 2024 election on the economy, amid a recent spate of positive economic news that has buoyed Biden’s fortunes, according to three people familiar with the meeting, who spoke on the condition of anonymity to describe the private event.

Among the ideas they discussed was Trump’s plan to enact a “universal baseline tariff” on virtually all imports to the United States, the people said. This idea, which Trump has taken to describing as the creation of a “ring around the U.S. economy,” could represent a massive escalation of global economic chaos, surpassing the international trade discord that marked much of his first administration. Trump advisers have for months discussed various potential levels to set the tariff rate, and they said the plan remains a work in progress with major questions left unresolved, the people said.

On Fox Business on Thursday, the former president called for setting this tariff at 10 percent “automatically” for all countries, a move that experts warn could lead to higher prices for consumers throughout the economy and could likely lead to a global trade war.

“I think we should have a ring around the collar” of the U.S. economy, Trump said in an interview with Kudlow on Fox Business on Thursday. “When companies come in and they dump their products in the United States, they should pay, automatically, let’s say a 10 percent tax … I do like the 10 percent for everybody.”

The proposed expansion of the tariff policy, which aides said is expected to be a central 2024 campaign plank, reflects how Trump is aiming to expand the power he wielded in the White House, eyeing sweeping authoritarian measures for his second term that range from deploying the military to fight street crime to purging the federal workforce. Trump is opting not to explain this vision to voters at the first Republican presidential primary debate, being held Wednesday. Trump said he will not attend.

Economists of both parties said Trump’s tariff proposal is extremely dangerous. Adam Posen, president of the Peterson Institute for International Economics, a Washington think tank, called the idea “lunacy” and “horrifying” and said it would lead the other major economies around the world to conclude the United States cannot be trusted as a trading partner. Although aimed at bolstering domestic production, a 10 percent tariff would hurt the thousands of U.S. firms that depend on imports, while also crippling the thousands of U.S. firms that depend on foreign exports, Posen said.

The United States today imposes an average tariff on imports of just above 3 percent, according to Posen. That number is higher for some countries, with goods coming from China facing an average import duty of 19 percent. “You would be depriving American families of an enormous amount of choice, making their lives much more expensive, and putting millions of people out of work,” Posen said.

Trump could use unilateral authority to exempt whatever countries he chooses from the automatic import tariffs. It would create enormous opportunities for influence-peddling, Posen said, following four years of a Trump presidency in which Saudi Arabia and other nations sought to steer Trump by frequenting his private businesses. “It is a recipe for corruption,” Posen said. “They will decide that whoever cozies up to Trump, or whoever his commerce secretary is, will get the exception.”

Robert E. Lighthizer, who served as U.S. Trade Representative under Trump, has suggested imposing a universal tariff at 10 percent or higher, and then increasing or decreasing it as necessary, but emphasized in an interview he was not tied to any specific numbers.

“We have had people across this country, in the Midwest but elsewhere too, where you drive through and you see this blight that is the result of U.S. policy that went off the rails in the 1990s,” Lighthizer said, arguing that Trump tried to reverse that decline through his industrial policy.

Chris Clarke, an economist at Washington State University, said the tariffs that Trump imposed on imported washing machines cost American consumers roughly $800,000 for every job saved. But later studies, which took into account the impact of retaliatory tariffs as well, found that the tariffs did not save any jobs, Clarke said.

Michael Strain, an economist at American Enterprise Institute, a center-right think tank, said international trade restrictions enacted in 1930 are widely viewed as exacerbating the Great Depression. Joe under-performed the average of the three largest polling aggregators by about double the current spread they've got Joe up by right now.


And even worse news is that was just the popular vote. Only about 40,000 to 60,000 votes need to be swung the other way in some key states (combined) to win the Electoral College. An extremely easy hurdle to overcome now that Republicans and Trump himself have decided to embrace the changes in law that de-legitimatized all American Elections going forward during Covid, just like I warned you they would.

Trump was boasting about his poll numbers when Tucker Carlson suddenly cut him off.

“Can I ask you—that gets back to my original question,” he said. “If the protests didn’t work, and you got elected anyway; the impeachment didn’t work, twice; indictment is not working … If you chart it out, it’s an escalation, is what I’m saying. So what’s next, after trying to put you in prison for the rest of your life? That’s not working. Don’t they have to kill you now?”

Trump didn’t respond directly. “I think the people of our country don’t get enough credit for how smart they are,” he said. “They get it. I got indicted four times. All trivial. Nonsense. Bullshit. It’s all bullshit.” (As all Trumptards do, Trump denies any responsibility for the trouble he is in.)

It was the second time Carlson had brought up the strong likelihood, from his perspective, that they were going to try to kill Trump. Over the course of the 46-minute interview, Carlson emphasized, repeatedly, the looming danger from the left. It was an odd conversation in part because Trump didn’t seem to want to follow him down that particular path. Trump was eager to talk about the stolen election or the failures of the Democrats or Joe Biden’s senility, but he had little apparent enthusiasm for Carlson’s questions about the prospect of civil war. It was, oddly, an interview that served, unintentionally, to make Donald Trump seem reasonable.
