Legal academics are divided on the new popular theory that former President Donald Trump can be removed from ballots under Section 3 of the Fourteenth Amendment.

While I respect many of the academics who view this as a credible interpretation, I have long opposed it as textually and historically flawed. In addition to some exaggerated claims of precedent, I view the theory as one of the most dangerous in my lifetime. One thing, however, we agree upon: it is time for the federal courts to rule on this theory to bring clarity to the election. That may now occur in West Virginia where Attorney General Patrick Morrisey wants a federal court to throw out a lawsuit attempting to remove Donald Trump from the ballot in the state.

What is most striking about the filing is the accusation of judge-shopping by advocates like John Anthony Castro in seeking to remove Donald Trump from the ballot in the state.

I have previously addressed the constitutional basis for this claim. It is, in my view, wildly out of sync with the purpose of the amendment, which followed an actual rebellion, the Civil War.

The 14th Amendment bars those who took the oath and then “engaged in insurrection or rebellion against the same.” It then adds that that disqualification can extend to those who have “given aid or comfort to the enemies thereof.”

The “disqualification clause” was written after the 39th Congress convened in December 1865 when many members were shocked to see Alexander Stephens, the Confederate vice president, waiting to take a seat with an array of other former Confederate senators and military officers.

Justice Edwin Reade of the North Carolina Supreme Court later explained, “[t]he idea [was] that one who had taken an oath to support the Constitution and violated it, ought to be excluded from taking it again.”

According to these experts, Jan. 6 was an “insurrection” and Trump gave “aid and comfort” to those who engaged in it by spreading election fraud claims and not immediately denouncing the violence.

Polls have shown that most of the public view Jan. 6 for what it was: a protest that became a riot. One year after the riot, CBS News mostly downplayed and ignored the result of its own poll showing that 76 percent viewed it for what it was, as a “protest gone too far.” The view that it was an actual “insurrection” was far less settled, with almost half rejecting the claim, a division breaking along partisan lines.

Nevertheless, Democrats have claimed that the 14th Amendment prevents Trump from running because he supported an “insurrection or rebellion.”

They have argued that this long dormant clause can be used to block not just Trump but 120 Republicans in Congress from running for office.

The lawsuit could offer a long needed judicial review and an avenue to the Supreme Court for a final ruling. Yet, what was most notable was this paragraph in the filing on the motives and means used by Castro:

Castro is running for the Republican presidential nomination. Recently, the Supreme Court refused to hear one of Castro’s cases.

Castro has been open about forum and judge shopping to get liberal, Democratic judges to rule against Trump. Castro tweeted:

“The fight is far from being over. We’re going to get the liberal 9th Circuit to kick Trump off the ballot in Montana, Idaho, Nevada, and Arizona. Coupled with the 1st Circuit kicking him off the Maine ballot, there’s ZERO path to 270. The Supreme Court can deny to hear the case but appellate courts cannot. I’m still pursuing decisions in the liberal appellate courts and there’s a full blown trial scheduled for October 20 in New Hampshire and a bench trial in Arizona on October 31.”

I tend to favor broad standing rules, but Castro’s open effort to secure review from liberal, Democratic judges should offend not only these jurists but most Americans. Castro received a J.D. from the University of New Mexico and LLM from Georgetown University.

Courts have universally denounced judge shopping. Most, like the federal court in northern Illinois, denounce the practice: “No one should be able to manipulate the assignment system in order to determine in advance which judge will get a case where the assignment is by lot.”

Obviously “forum shopping” does occur. Lawyers will seek to file in the most favorable jurisdiction, including prosecutors. Yet, I have never seen a lawyer openly discussing the manipulation of filings in search of liberal judges to achieve a particular result. The filing is accusing Castro of actually withdrawing lawsuits when he receives a judge who is not reliably liberal.

Castro must realize that he is insulting these liberal judges and making this already novel challenge even more difficult. However, it is an example of using cases to appeal to the court of public opinion. Castro knows that such raw political moves will thrill many in this age of rage.

For advocates of the 14th Amendment theory, Castro could not be a worse figure to move this claim into the courts. He adds a noxious means to a novel theory to bar Trump from ballots. Of course, this is all being done by advocates who claim that they are defending democracy but denying the ability of others to vote for one of the leading candidates for the presidency.



All is NOT fair in love, war, and politics. We have rules for a reason: to protect democracy from being driven into a ditch, as Dems are doing.

Republicans have to ask for help from Democrats to elect a Speaker of the House. As long as Democrats cast all their votes for their own leader — which is traditional — Republican candidates need 217 votes to win the Speaker of the House. But if Ds vote present, a Republican can win with only a majority of Republican votes. Alternatively, a "Gang of 217" Ds and Rs could get together and agree on a compromise candidate.

Until something like this happens the House is paralyzed. Without a speaker, they can't vote on anything — not budgets, not so much as a post office renaming.

He has zero chance.” I said that because I believed it. It never occurred to me. It was a joke. I was really shocked.

For at least three or four months after that election, every time I walked out of my apartment, people screamed at me. "You were wrong. You were wrong." I know, I'm sorry. Believe me, I'm sorry. I was sorry I was wrong. I was sorry what that meant that I was wrong. Truthfully, if you've only been wrong one time in your life, that was not the time to be wrong. So, no, I did not believe that there were that many people who would [vote for him].

A friend of mine right before the election said he could win. I said, "That is just absurd." She said, "You don't understand this country because you don't watch reality television." I said, "That's ridiculous." I'd heard of [Trump's] television show, but I never saw it. That's true. But I never saw any reality television. I knew that a lot of people like reality television, but I didn't know they thought it was reality. It's called reality television, not reality. Right?

As you know, New York City voted for Hillary Clinton nine to one. Even the Upper East Side voted for Hillary Clinton, even though they always vote Republican on the Upper East Side in presidential elections because no taxes on capital, but they didn't vote for Donald Trump.

Of all the horrible things about Donald Trump, one of the things that most bothers me, and perhaps you, is that people outside New York think he's a New Yorker. No one in New York thinks he's a New Yorker. It's the most insulting thing to me. I always say, “No one in New York thinks he's a New Yorker.” And no one in New York even thought he was a real estate developer. The truth is that in New York, the real real estate developers looked down on him. Can you imagine a level of moral squalor so profound that real estate agents look down on you? And they were right. I don't think so. I really don't think so. The problem, of course, is the electoral college. If it wasn't for the electoral college, there'd never be a Republican president. Twice in my life — which is long, but it's not a thousand years — twice in my life, the presidency was won by someone who lost a popular vote, both times Republicans, George W. Bush and Donald Trump.

In other democracies, the popular vote is called “the vote.” The electoral college, both times this happened, people that I know who are non-American say, "What does this mean?" When I explain it, they go, "Oh, so it doesn't work." I go, "No, it works perfectly. It does exactly what it was meant to do." It overweights the rural vote, the Southern vote and that far Western vote. Every state has two senators. Fewer than 600,000 people live in Wyoming; they have two senators. That many people live in my building. My building should have a senator.

It is absolutely not representative. These people represent acreage because when you look at these maps, Wyoming is gigantic. You can't believe it, but there's no one there. It's just empty. That's the way they can win, but otherwise they can't. They couldn't win.

In a study published in the American Journal of Health Behavior, researchers found a nuanced connection between obesity and voting behavior in the 2016 presidential election. Counties with increasing obesity rates initially showed rising support for Donald Trump until a threshold, after which support began to decline. This suggests a complex, non-linear relationship between local obesity prevalence and political voting patterns.

Obesity has become a major public health issue in the United States. The prevalence of obesity has been increasing significantly, and it is associated with various chronic diseases and substantial healthcare costs.

The condition has become a political issue with two predominant standpoints: the “personal-responsibility” perspective and the “environmental” perspective. These perspectives have different policy implications and are associated with different political parties.

While health disparities have been studied as a political outcome, the reverse relationship, i.e., how health behaviors or conditions influence political behavior, has not been extensively explored. Researchers Ruopeng An and Mengmeng Ji aimed to fill this gap in the literature.

To investigate the link between voting behavior during the 2016 presidential election and obesity rates, the researchers retrieved county-level 2016 presidential election data from the New York Times database. This data included the percentage of votes for the Republican Party presidential candidate (Donald Trump), the percentage of votes for the Democratic Party presidential candidate (Hillary Clinton), and the total number of votes in each county.

To ensure the accuracy of their election data, the researchers compared it with data from two other major election datasets maintained by The Guardian and Ballotpedia.org. They found that the state-specific percentage of votes for the Republican and Democratic candidates agreed across all three databases.

Data on county-level prevalence of adult obesity in 2013 were obtained from the U.S. Centers for Disease Control and Prevention (CDC)’s County Data Indicators (CDIs). This data was based on the Behavioral Risk Factor Surveillance System (BRFSS), an annual survey that collects information on health-related behaviors, chronic conditions, and preventive services.

To account for potential influences, they controlled a wide range of county-level sociodemographic factors, such as age groups, racial and ethnic composition, education, income, poverty rates, unemployment, metropolitan status, and total population.

The researchers used a spatial modeling approach called a spatial autoregressive regression (SAR) to examine the relationship between obesity rates and voting patterns. This approach allowed them to account for the spatial clustering of data, which is often seen in political behaviors. They analyzed information from 3,111 U.S. counties, excluding Alaska due to data limitations.

Contrary to previous studies that had suggested a linear relationship between obesity rates and votes for the Republican Party candidate, this research uncovered a non-linear, or more complex, connection.

The study found that as the obesity rate in a county increased from around 12% to approximately 34%, there was a steady rise in votes for the Republican Party presidential candidate. However, this trend plateaued when obesity rates reached about 36.1%.

Beyond this point, as obesity rates continued to rise, the vote margin for the Republican Party candidate started to decline. In simpler terms, there was a turning point – an obesity rate threshold – where further increases in obesity did not lead to more support for the Republican Party.

While this study provides valuable insights, it’s essential to recognize its limitations. The use of county-level data means that the findings don’t offer a direct link between individual obesity and voting behavior. Additionally, the data used for obesity rates was from 2013, which might not perfectly align with the 2016 election year.

The researchers cautioned against drawing causal interpretations from their findings, emphasizing the need for future research to explore the mechanisms underlying the relationship between obesity rates and voting behaviors.

“This study assessed the impact of county-level obesity prevalence on the 2016 presidential election,” the researchers concluded. “A quadratic association between county obesity rate and the vote margin for the Republican Party presidential candidate was identified. The vote margin initially increased with county obesity rate, but after reaching its peak, it started to decline as obesity rate further increased. Findings of this study indicate that disparities in obesity not only may serve as a political outcome, but also as an influence on political behavior. This study is observational and subject to measurement error, confounding, and ecological fallacy.”

“Future research is warranted to replicate the nonlinear association between county obesity rate and the vote margin for the Republican Party presidential candidate identified in this study, elucidate the mechanisms through which the obesity epidemic links to voting behaviors, and track the long-term trend for the relationship between obesity rate and the presidential election.”

Texas Republicans backing away from MAGA group that's 'infested' with Hitler fans

Ameeting between white supremacist Nick Fuentes and a prominent Republican donor has blown up into civil war among Texas conservative groups.

The Holocaust-denying Fuentes took an hours-long meeting earlier this month with GOP donor Jonathan Strickland, then-president of the ultraconservative Defend Texas Liberty PAC, and the fallout from that confab exposed growing concerns about extremism within GOP ranks, reported The Daily Beast.

“Among the concerns were a [Young Republicans of Texas] leader who ‘openly affiliates with antisemites’ online, as well as another prominent member who ‘is a public supporter of Adolf Hitler,’” reported Amanda Moore, who went undercover in the MAGA movement for a year.

The Texas Young Republican Federation (TYRF) voted in August to disassociate from the Republican Party of Texas (RPT) over alleged troll actions by RPT chair Matt Rinaldi, and some smaller groups broke away from TYRF and formed the ultra-MAGA Young Republicans of Texas (YRT).

But it’s not only the talk that’s raising alarms. We’re seeing an actual spike in acts of political violence taking place in the U.S.

A Reuters investigation from August found that attacks began to go up in 2016, after Trump first got into politics. Some of these incidents never received national media attention — like the Trump supporter in Ohio who killed his neighbor last year because he was a Democrat. Others were unavoidable. The mass shooter in Buffalo who targeted Black shoppers, leaving 10 dead in 2022. The home invasion and violent attack at Nancy Pelosi’s house in San Francisco.

What’s alarming is that, in recent weeks, Trump has cranked up the language to a new, even more incendiary level.

What this implies is that public views about crime needn’t have much to do with personal experience. They may instead be shaped by impressions people pick up from media, both news and social, and from politicians.

In other words, perceptions about crime are like perceptions about the economy — perhaps more so: They don’t necessarily bear much relationship to reality.

Now, sometimes popular impressions are more or less right. Back in the 1970s and 1980s, when Hollywood was producing vigilante thrillers like “Death Wish” and dystopian sagas like “Escape From New York,” violent crime really was surging.

However, violent crime began falling rapidly in the early 1990s, for reasons that remain unclear. Whatever the source of the good news, there were two remarkable things about this decline. First, it was truly epic; as someone who has lived in New York since 2015 but visited it many times over previous decades, I can attest that the city feels infinitely safer than it did in the bad old days. Second, most Americans didn’t notice.

Donald Trump devoted his 2017 inaugural address to the theme of “American carnage” — a supposed wave of violence sweeping our cities. At the time, actual urban violence was near a generational low point. But his rhetoric nonetheless resonated with many Americans. After all, throughout the epic decline in crime, voters kept telling pollsters that crime was rising nationally (although they were more sanguine about crime in their own areas, about which they may have had more personal knowledge):

And like views about the economy, perceptions about crime have a strong partisan element, with Republicans generally more likely to say that crime is rising, especially when a Democrat is president.

In 2020 and 2021, it briefly looked as if Trump’s dark vision might retroactively be coming true. There was in fact a surge in crime beginning in 2020, especially in murders.

Unlike the somewhat mysterious decline in crime in previous decades, this crime wave wasn’t too hard to explain. The Covid-19 pandemic led to a lot of isolation and disruption, plus a lot of psychological stress, making it plausible that some Americans became disconnected from the social bonds that usually keep most of us law-abiding.

The big question was whether the post-Covid surge in crime would, like the post-Covid surge in inflation, prove transitory. Would crime keep rising, or would it subside back to relatively low levels?

Well, the answer appears to be in, and it’s encouraging. Murders dropped significantly in 2022, and so far seem to be falling even faster this year. Take the example of New York City, which had 319 murders in 2019 — down from 2,262 in 1990! — but saw that total rise to 488 in 2021. I should acknowledge that while violent crime is clearly on the downswing, some forms of property crime are still running high. Many pharmacies in New York and other cities, concerned about theft, now keep their products locked behind glass, which isn’t scary but is annoying. Still, America is clearly getting safer again, and is much safer than it was two decades ago.

But if history is any guide, most voters won’t believe it. Politicians will run campaigns promising to defend Americans against a terrifying crime wave, even as crime is receding nationwide.

Wait, there’s more. In addition to having false beliefs about trends in crime over time, many Americans have false beliefs about the geography of crime. In particular, Republicans often treat it as an established fact that blue states, and especially cities run by Democrats, have higher crime rates than red states and cities, with New York singled out for special opprobrium. Back in April, the Republican-controlled House Judiciary Committee held a “field hearing” on “victims of violent crime in Manhattan.”

But the reality is that red states have consistently higher homicide rates than blue states. Most big cities are run by Democrats, but those run by Republicans don’t have significantly lower crime. And New York City happens to have remarkably low crime, with a murder rate around half that of Republican-run cities like Miami and Fort Worth. (My guess is that part of the reason for low crime in New York is the city’s large immigrant population — because contrary to another myth, immigrants are relatively law-abiding.) https://www.nytimes.com/2023/08/31/briefing/crime.html

Again, however, it’s doubtful whether data, or even the lived experiences of those of us who reside in places many Americans believe to be hellscapes, will change many minds.

So what’s the moral of this story? The good news is that while many feared that America was about to experience a sustained resurgence of crime, at this point we seem to be heading back to the prepandemic normal of fairly low crime. The bad news is that the politics of fear can work, even if there isn’t much basis for those fears.

For both parties, they work very much like the Electoral College in the General Election does. We the People go out and vote in the primaries, then the parties tell us that our opinion is duly noted and the delegates vote for the nomination.

Those delegates are supposed to vote for the will of the people, but if Democratic Party Chairman Raymond Buckley's tweet above is correct and "Joe Biden* wins the NH First in the Nation Primary in Janurary", they're now put in the position of putting on full display that they don't have to vote along with the will of The People at the ballot because they will go ahead and give the nomination to Joe Biden* even though he wasn't on the NH ballot.

In any event, because Joe Biden* was just itching to make South Carolina the FITN Primary over New Hampshire against all better judgement, he just shot himself in the foot. Now the Legacy Media can't make a big deal when Republicans do the exact same thing for Trump in Minnesota or any other Democrat ran shithole state that tries to take him off the Primary Ballot.


Now, you have nothing at all to gain by stripping Trump from a primary ballot and everything to lose. All that stripping Trump off a primary ballot in a state Trump was never going to win in the first place is going to do is make people in other states go out in force for Trump.


So please. Do it. Stop talking about it and do it.

Clarence Thomas never paid for his luxury motor home

In 1999 Supreme Court justice Clarence Thomas bought a luxury motor home for $267,000. It was financed by a loan from his friend Anthony Welters, a health insurance millionaire.

Yeah. I barely know anything about him, but the little I've heard I don't like at all. Sounds like somebody GWB would have approved of.

Like I said before, I don't expect him to be in that seat for very long. But TPTB threatened the GOP members that weren't going to vote for any Uniparty warmongerer that enough of the GOP members were going to vote for Hakeem Jeffries next vote if they didn't play ball and get somebody in there who would approve more funding to Ukraine and Israel immediately and raise that debt ceiling before the government shut down.

Expect Mike Johnson to be booted from that seat by sometime in January at the latest.

If you read that proposal carefully, getting past the often mealy-mouthed language, you realize that it calls for the evisceration of the U.S. social safety net — not just programs for the poor, but also policies that form the bedrock of financial stability for the American middle class.

Start with Social Security, where the budget calls for raising the retirement age — already set to rise to 67 — to 69 or 70, with possible further increases as life expectancy rises.

On the surface, this might sound plausible. Until Covid produced a huge drop, average U.S. life expectancy at age 65 was steadily rising over time. But there is a huge and growing gap between the number of years affluent Americans can expect to live and life expectancy for lower-income groups, including not just the poor but also much of the working class. So raising the retirement age would fall hard on less fortunate Americans — precisely the people who depend most on Social Security.

Then there’s Medicare, for which the budget proposes increasing the eligibility age “so it is aligned with the normal retirement age for Social Security and then indexing this age to life expectancy.” Translation: Raise the Medicare age from 65 to 70, then keep raising it.

Wait, there’s more. Most nonelderly Americans receive health insurance through their employers. But this system depends greatly on policies that the study committee proposed eliminating. You see, benefits don’t count as taxable income — but in order to maintain this tax advantage, companies (roughly speaking) must cover all their employees, as opposed to offering benefits only to highly compensated individuals.

The committee budget would eliminate this incentive for broad coverage by limiting the tax deduction for employer benefits and offering the same deduction for insurance purchased by individuals. As a result, some employers would probably just give their top earners cash, which they could use to buy expensive individual plans, while dropping coverage for the rest of their workers.

Oh, and it goes almost without saying that the budget would impose savage cuts — $3 trillion over a decade — on Medicaid, children’s health coverage and subsidies that help lower-income Americans afford insurance under the Affordable Care Act.

How many Americans would lose health insurance under these proposals? Back in 2017 the Congressional Budget Office estimated that Donald Trump’s attempt to repeal Obamacare would cause 23 million Americans to lose coverage. The Republican Study Committee’s proposals are far more draconian and far-reaching, so the losses would presumably be much bigger.

So Mike Johnson is on record advocating policies on retirement, health care and other areas I don’t have space to get into, like food stamps, that would basically end American society as we know it. We would become a vastly crueler and less secure nation, with far more sheer misery.

I think it’s safe to say that these proposals would be hugely unpopular — if voters knew about them. But will they?

Actually, I’d like to see some focus groups asking what Americans think of Johnson’s policy positions. Here’s my guess, based on previous experience: Many voters will simply refuse to believe that prominent Republicans, let alone the speaker of the House, are really advocating such terrible things.

But they are and he is.

The Speaker of the House represents a movement that is actively seeking to institutionalize the religious beliefs of evangelical Christians into law.

In interviews he has spoken of the fact that “We don’t live in a democracy” we live in a “Biblical republic.” He asserts this was because the founders sought to follow a “biblical admonition”. In the same set of remarks he described democracy derisively as “two wolves and a lamb deciding what is for dinner.”

Thomas Jefferson said he viewed with “solemn reverence that act of the whole of the American people” which established “a wall of separation between church and state.” George Washington approved a treaty that explicitly stated, “The government of the United States is not in any sense founded on the Christian religion.” The very First Amendment in America’s Bill of Rights states “Congress shall make no law respecting an establishment of religion.” The principal author of the Constitution, James Madison, in his treatise, “Memorial and Remonstrance Against Religious Assessments,” described 15 reasons why the U.S. government must avoid backing any religion.

Men like Johnson and other members of that movement, a group that includes members of the U.S. Supreme Court and important leaders in the GOP like former Secretary of State Mike Pompeo, represent one of the threats those who founded this country most feared. They had learned the lessons of centuries of suffering and horror that were imposed upon the world by theocrats who claimed to be the representatives of the Almighty on earth.
