Here's a quick recap of what's going on lately with border security:

1. Republicans are opposing an immigration plan that tightens up the border considerably without much in return for Democrats.

2. The House is moving ahead with an impeachment vote against DHS Secretary Alejandro Mayorkas for literally no particular reason and with no chance of success.

3. Texas is defying the federal government and cordoning off pieces of the border completely from the Border Patrol.

4. Republican Speaker Mike Johnson is saying that he won't accept any border proposal "that ALLOWS even one illegal crossing."

The purpose of these things is:

1. Making Joe Biden look like he's helpless to do anything about the border.

2. Giving Republicans a big stage to rehearse their border gripes on national TV.

3. Hoping that Biden will overreact, producing lots of video of federal officers tearing down border barriers.

4. Making it clear that nothing will happen as long as Biden is president.

It's all just a show to them. They could hardly make it any clearer.

But neither side ever does anything about it, and now New York is letting them vote in elections and kicking kids out of school to house them and California is using taxpayer dollars to give them health insurance.

The only laws against hiring aliens can only be Federal laws which happen to not be enforced because there is no money to enforce them. I wonder who controls that money? Oh, I remember! Congress, not the President! Employers can shrug off in court after there is one of those extremely infrequent raids on their businesses whatever laws exist by claiming they did not know who was an alien. If E-verification became a legal requirement before anybody was hired, and employers get arrested for failure to E-verify, it would be a very different situation at the border.

Texas "handles" the problem by purchasing bus tickets to score points with people like you. The real law, the Federal law requires that illegal aliens get a day in court to make their case, but when the Immigration Court Backlog tops 3 Million and each Judge is assigned 4,500 cases that means Congress needs to fix this rather than Biden buying 3 million bus tickets or ordering 3 million bullets fired into the heads of aliens. Since tickets are expensive and bullets are cheap, Biden is left with one choice: bullets, at least until Congress provides the money for bus tickets. Bullets aren't really cheap because Biden would have to bury the Aliens, which means Congress has to pay even more than for bus tickets.

The impeachment articles that the House Homeland Security Committee approved accuse Mr. Mayorkas of flouting several provisions of the Immigration and Nationality Act that say deportable migrants “shall be detained” until they can be removed from the country. They charge that the secretary pursued a “catch and release” scheme to allow inadmissible migrants into the United States, knowing that it would be difficult or even impossible to ensure they would later appear in immigration court for removal proceedings.

What the charges do not take into account, however, is that Mr. Mayorkas also has the legal authority to determine which migrants to prioritize for detention, given limited bed space and long backlogs in the immigration courts.

“Congress loves passing laws that are impossible to execute,” said Aaron Reichlin-Melnick, the policy director at the American Immigration Council, adding that enforcing detention mandates is often “a question of resources.”

The United States has not had enough detention beds to accommodate the number of migrants awaiting removal proceedings for several years, well before President Biden took office. Even the Trump administration released migrants into the country, because the maximum detention capacity — about 55,000 in 2019 — was not enough to accommodate the number of arrivals seeking entry. Mr. Trump’s Remain in Mexico policy requiring some migrants to wait for their immigration court dates outside the United States, which Republicans want to reinstitute, did not apply to all migrants making claims at the border.

One of the impeachment articles says Mr. Mayorkas “paroled aliens en masse in order to release them from mandatory detention,” again with the intent of undermining the law.

But the immigration act gives the executive branch parole power to let migrants temporarily live and work in the United States for humanitarian reasons, or if their admission would be to the public’s benefit. Decisions about whom to parole are to be made on a case-by-case basis, and there is no restriction as to what criteria the secretary can consider when determining who qualifies. There is also no statutory cap on how many migrants can be allowed into the country under the authority.

Several past administrations, including those of former Presidents Trump, Barack Obama and George W. Bush, have relied on parole authority to bring members of certain vulnerable migrant groups into the United States.

The Biden administration has built on pre-existing programs allowing nationals of certain economically ravaged Central and South American countries with sponsors already in the United States to seek parole. It has also inaugurated similar pathways for Afghans and Ukrainians fleeing war, and introduced a mobile app known as C.B.P. One to streamline migrants through ports of entry.

House Republicans have sought to close down those avenues, passing legislation last year that would shutter nearly all of them.

Disney has lost a round in its fight with Ron DeSantis:

In a legal victory for Florida Gov. Ron DeSantis, a federal judge in Tallahassee dismissed on Wednesday a lawsuit filed by the Walt Disney Co. over the state’s dismantling of the entertainment giant’s special taxing district.

....Judge Allen Winsor of the U.S. District Court for Northern Florida ruled that Disney “lacks standing to sue the governor” and that the law it was suing over was constitutional.

And what do we know about Judge Winsor? He was, no surprise, nominated by Donald Trump. He is, naturally, a longtime member of the Federalist Society. The Leadership Conference on Civil and Human Rights doesn't think much of him:

Mr. Winsor is a young, conservative ideologue who has attempted to restrict voting rights, LGBT equality, reproductive freedom, environmental protection, criminal defendants’ rights, and gun safety. He does not possess the neutrality and fair-mindedness necessary to serve in a lifetime position as a federal judge.

In other words, Winsor is just your basic modern conservative judge, and that's about all you need to know. Of course he ruled in favor of DeSantis.

POSTSCRIPT: For what it's worth, Winsor agrees that Disney has suffered a general injury by no longer having a tax board it controls. His ruling denying standing to sue DeSantis is twofold. First, DeSantis's actions to stack the board with his lackeys is in the past. Nothing can be done about it now. Second, maybe DeSantis effectively controls the board, maybe he doesn't. But the board hasn't done anything bad yet, so who cares?

This strikes me as a bit of "heads I win tails you lose." Disney can't sue over past action, and future action is just speculative. But if that's the case, what would give Disney standing?

Winsor also inexplicably says that the law creating a new tax district is OK because it doesn't single out "a specific group." IANAL, but the record sure seems to show that, in fact, it does single out Disney and it was retaliatory. I'm not sure how much more explicit a law could be on those grounds.

As a tax professor, I love taxes: the theory, the policy, even the politics. But I have a confession to make. I hate doing them. My taxes are not complicated. Yet, every year, I spend hour upon hour gathering documents, paying for tax preparation software, entering in my income, and puzzling through the instructions as I try to figure out whether I am eligible for this or that deduction or credit. Every year, I think to myself: There has got to be a better way!

And there could be, so long as politicians got out of the way and let the IRS work directly with the American people. By that, I’m referring to a 2024 pilot program that would allow a large number of taxpayers to file directly with the IRS. It’s a huge deal! But like most things associated with taxes, it is complicated.

I've been saying for a decade this should be done, as long as its free for simple taxes. The free file program with 3rd party outfits is a pain in the ass at best, and a data harvesting nightmare with the great potential of a database leak of everyone's most sensitive information at worst.

But the IRS was in charge of it, so I would advise everyone to let somebody else be the guinea pigs for the first few years before they work out the bugs.

As the folks who bought a coal burning car in the last 2 years will tell you, never be an early adopter.

Why Men Are Drifting to the Far Right
Many men are falling behind. They need meaning and belonging.

Last week, a widely-circulated analysis in the Financial Times confirmed what many researchers had long suspected: The ideological gap between men and women is growing.

Over the past fifteen years, men across the globe have voted for radical right-wing parties at much higher rates. Spain’s far-right, populist, and conspiracy-minded Vox party polls roughly twice as well among men compared with women. While men and women voted for Poland’s anti-democratic Law and Justice Party at similar rates last year, men voted for the even more extreme Konfederacja nearly three times as much as women. Data from a 2009 study of European parties that leaned authoritarian or populist found that men were generally around twice as likely as women to vote for them—and up to five times more likely in the case of the nationalist-populist Swedish Democrats.

It’s not just Europe: Brazil’s Jair Bolsonaro performed 10 points better among men than women in the 2018 election which brought him to power. Roughly the same gender difference pushed Argentina’s new populist libertarian leader, Javier Milei, over the top last November.

In some countries, gender aligns very closely with other social or demographic variables like class, education, and employment—but in a number of places, being male makes a big difference, independent of other factors.

The United States is no exception. As women moved strongly to the left, men have moved to the right, creating a gap between male and female voting that was greater for Trump in 2016 than in a half century of exit polling. While much has been written on the role of race in recent elections, gender is playing a crucial and different role. White men formed Trump’s core support in 2016, but by 2020, Trump polled 12 points better with black men than black women, winning 18% of the black male vote.

People who care about democracy could read these numbers and conclude that they should simply double down on getting women to vote. But giving up on half of one’s country is not good civics—nor is it smart electoral math.

The problem is not that men are natural crusaders for authoritarian populists. In fact, American men are much more likely to be politically apathetic, and most young men are better characterized as confused and drifting. The problem is that anti-democratic and violent forces are trying to weaponize that aimlessness. Politics is coming into most men’s lives subtly. They look for belonging, purpose, and advice, and find a mix of grifters, political hacks, and violent extremists who lead them down an ugly road. And few people are fighting back.

Popular culture focuses on Elon Musk, Davos CEOs, and the other men flourishing at the top of society’s heap. But that’s not where the majority of men exist. Men with only a high school diploma typically earned $1,017 a week in today’s dollars in 1979; now they earn $881. More than one in ten men in their prime aren’t working at all.

It’s not just about money, but about status and life satisfaction. Women are out-graduating men from high school and vastly out-competing them in college. These women aren’t so interested in men who are less educated and earn poorly, so men without college degrees are marrying less. Over 1.5 million men aged 20 to 24 aren’t in school, training, or work, and these men are having a lot less sex than past generations and their more productive peers.

Unsurprisingly, young men without college degrees report that they have the least optimism and purpose in life among all the groups of men surveyed by Equimundo. Many have lost a reliable way to earn a living. They also claim to have the least social support and are uncertain how to have basic relationships—with friends, let alone romantic partners. They feel their low status acutely, but because popular culture aggregates their lives with the men at the nosebleed top, they are told by much of the left that they are privileged and should take a back seat.

Many men turn these feelings inward, with the result that nearly three in every four deaths of despair—largely from opioids and suicide—are male. These deaths became so common that they were causing a decline in life expectancy for American men even prior to COVID-19. That is a tragedy for these individuals, their families, and their communities.

But some men seek someone else to blame. That has become a tragedy for our democracy.

For the two-thirds of young men who were willing to admit to researchers that “no one really knows me well,” a sense of community might mean a lot. It might mean even more to men who report having no social activities at all—as one in six of all men with a high school education or less claim. That leaves a lot of time for websurfing and gaming.

And that’s where Steve Bannon found them. Bannon told journalist Joshua Green that he first noticed the “monster power” of “these rootless white males” when he bought a gaming company long before he entered politics. In 2012, when he took over the Breitbart News Network, he hired the provocateur Milo Yiannopoulos to “activate that army.” Yiannopoulos declared that feminist bullies were tearing the video game industry apart and poured fuel on what became the Gamergate controversy, which catalyzed a harassment campaign against women game developers. As Bannon explained, “They come in through Gamergate or whatever and then get turned onto politics and Trump.”

Bannon was hardly alone in noticing a pool of possible recruits. Gavin McInnes, the founder of the violent Proud Boys movement of male Western chauvinists, focused more than half the videos that launched his movement on male victimhood. “Feminism,” he claimed, “isn’t about equality anymore. It’s about taking masculinity away from men.” He offered violence as a way for men who felt their manhood had been threatened to demonstrate their strength and virility. Like martial artists, men can move through four degrees to gain status in the Proud Boys hierarchy—first by submitting to violence from other members of the group (for example, getting punched in the stomach until you can name five breakfast cereals, ostensibly to demonstrate “adrenaline control”), and in the end, carrying out political violence against others in American society.

McInnes follows a long tradition. Globally, violent extremists often look to give men who feel disenfranchised or emasculated in other parts of their lives a way to feel powerful. White supremacists have been recruiting young men on gaming platforms for years, and they are getting more prevalent—the frequency of exposure more than doubled after 2021, with nearly one in five people on gaming platforms reporting that they had seen white supremacist content in 2022.

But more and more often, men are being recruited into extremist politics and violence not via far-right ideology or racism, but simply by trying to figure out how to be a man in a world where gender roles have changed precipitously. Go online and start looking for typical questions that a man might ask in the absence of any friends or role models—like how to find a date, or how to build muscle. Before long, the algorithms pull these unsuspecting guys into the “manosphere”—a world of online men’s support communities that begins with many appealing on-ramps for someone trying to figure out how to live, but ends in a swamp of men endorsing misogyny, hate, and violence.

Nearly half of young men aged 18 to 25 told Equimundo that they trust one or more of the “men’s rights,” anti-feminist, or pro-violence manosphere influencers such as Andrew Tate, a self-described misogynist and MAGA supporter. The manosphere takes the very real problems that men face and blames them on women, cultivating a zero-sum world where men lose if women gain.

Americans spent decades building a path for empowered women and girls, without any accompanying effort to craft a broader and more secure sense of masculinity for the men who needed to stand alongside them. Now we are reaping the backlash.

Some of the answer undoubtedly lies in concrete policies that will help men feel more secure—such as higher wages for blue-collar, traditionally male jobs, and paths to success that hinge on skilled manual labor rather than college degrees.

But it takes a political storyteller to turn material vulnerability into political anger. In addition to improving men’s situations materially, we need to consider how men can have a sense of purpose and status alongside empowered women. Years of cultural tropes have depicted strong, able women and bumbling men who “fail to launch.” We need to depict both men and women as competent adults. Women have been leaning in to mentoring young women for decades—men need to do the same to build real relationships that counteract online manosphere influencers taking over the roles of dads and big brothers.

Authoritarian forces have always supported patriarchal gender roles. Pro-democracy efforts to help men need to understand the power of that siren song.

Psychologists have a saying: “Hurt people hurt people.” Many men in our society are feeling lost, hopeless, and helpless at being unable to articulate their problems in the face of a society focused elsewhere. It’s hurting them, hurting women, and hurting our democracy, too. We must advance, whole, together.

Killing shows Trump losing control of fans triggered by violent rhetoric: analysis

Donald Trump is losing control over the unstable MAGA base as his violent rhetoric pushes past the brink of sanity, and the proof is a decapitated federal worker’s head, a new analysis contends.

Salon’s Amanda Marcotte Thursday took a hard look at the disturbing news to come out of Pennsylvania Tuesday night when Justin Mohn, 33, posted YouTube video demanding violence against the government with his dead father’s head in full view.

Marcotte acknowledges Mohn’s mental health problems, but argues there’s a bigger issue to blame.

“The people who spread hateful and violent rhetoric, starting with Donald Trump, know full well that unstable people are listening and will take this rhetoric as an excuse to act,” writes Marcotte. “In many cases, the loudmouths are counting on it.”

This tactic nearly served Trump’s purposes well on Jan. 6, 2021, when his supporters stormed the U.S. Capitol in hopes of disrupting the peaceful transfer of power to reinstate their leader.

Subsequent investigations have found mental health problems were rife among the hordes, which Marcotte argues makes them valuable for a very specific reason.

“Trump knows full well that a lot of his biggest fans are unwell or in crisis, which makes them vulnerable to conspiracy theories and false promises that MAGA (or QAnon) will give them community and purpose,” Marcotte writes.

“That's also likely why Trump saw the Capitol rioters as especially disposable.”

Trump’s “just jokes” defense may protect him in the short term, but as the presidential race gains speed and he amps up his tactics, he’s finding himself unable to control what “the little guys” behind him will do, Marcotte argues.

“They're lashing out in a chaotic manner close to home,” Marcotte writes, “instead of in strategic ways to advance the MAGA agenda.”

Trump would probably like to see his base organize another mass political disruption but without the power of the White House behind him, he can’t solve the problem they face, Marcotte writes.

“Trump followers have been scared away from more organized violence,” Marcotte writes. “In truth, they just don’t want to get arrested…and are using conspiracy theories to justify their own cold feet.”

But as Trump blasts his followers with violent rhetoric and the main base comes up with strange excuses, it’s the mentally unwell people on the fringes who are pushed far enough to take action, Marcotte concludes.

“All that hate and anger is going to go somewhere,” she writes, “and often the target is close to home.”

I like work. But then I'm an engineer. What happens to workers with no college degree, such as 6ix? This happened:

Men with only a high school diploma have seen their incomes slide and then slide some more. There were brief exceptions during the expansions of the late '90s and aughts, but they didn't last. Right now, men with no college earn 6% less than they did 30 years ago. The college kids, who were already making more, have opened up ever bigger leads over time.

On the other hand, this started as far back as Nixon, long before neoliberals took over the party. Every time this comes up, I refresh myself on the evidence and end up coming back to the same thing: the two drivers of Democratic losses are race and culture. Race is obvious: the white South has switched pretty much completely from Democratic to Republican and it was quite obviously due to the Civil Rights Act and other racial turnabouts of the '60s and beyond. Today, the Republican Party is almost entirely white. In Congress, there are currently four Black Republican House members out of 222 and one Black senator out of 49. That's less than 2%.

Culture is also fairly obvious because we've talked it to death over the past couple of decades. Working class discontent with liberals has been driven by an underlying long-term trend starting in the counterculture '60s and then supercharged by Fox News starting in the late '90s. Fox may tell their audience that Democrats are bad for the economy, but they spend ten times as much time obsessing over the latest cultural outrage from liberals. You could pretty much write a political history of the right just by listing the most common subjects covered by Fox News over the years since 2001. It's gone from Muslims to voter fraud to the tea party to Critical Race Theory to whatever they decide to focus on this year.

Research suggests that Fox News generates about 3% more votes for Republicans than they'd otherwise get. In a 50-50 electorate, that's a lot. And it doesn't help that Democrats make themselves so easy to attack. From "Defund the Police" to extreme softness on the border to defending trans girls competing in high school sports, liberals have been pushing the boundaries of social conventions pretty hard. That scares ordinary people and costs votes.

There's probably not a lot we can do about race. Some people are racists and that's that. We just have to fight them. But we could probably tone down the cultural leftism and adopt moderately more populist economic policies. It wouldn't take a lot. But it might make enough of a difference to sink the Republicans for the coming decade.

Republicans and Democrats consider each other immoral – even when treated fairly and kindly by the opposition

Why it matters

Our experiments illustrate the magnitude of current political polarization in the United States, which has been increasing for at least the last four decades.

Americans with different political opinions could once cooperate and maintain friendships with one another. But as political attitudes begin to coincide with moral convictions, partisans increasingly view each other as immoral.

My colleagues and I are particularly interested in this topic, as we worry about the potential for political polarization based on moral convictions to descend into political violence.

Psychology researcher Eli Finkel and his colleagues have suggested that moral judgment plays a major role in political polarization in the United States. My research team wondered if acts demonstrating good moral character could counteract partisan animosity. In other words, would you think more highly of someone who treated you well – regardless of their political leanings?

We decided to conduct an experiment based on game theory and turned to the Ultimatum Game, which researchers developed to study the role of fairness in cooperation. Psychology researcher Hanah Chapman and her colleagues have demonstrated that unfairness in the Ultimatum Game elicits moral disgust, making it a good tool for us to use to study moral judgment in real-time.

The Ultimatum Game allowed us to experimentally manipulate whether partisans were treated unfairly, fairly or even kindly by political opponents. Participants had no knowledge about the person they were playing with beyond party affiliation and how they played the game.

So, who is Mayorkas and what did he allegedly do?

Mayorkas is a former federal prosecutor who held high-level immigration-related roles in the Obama administration before being appointed to his current job by Joe Biden. The articles of impeachment drafted against him by Republicans on the Homeland Security committee say he has “repeatedly violated laws enacted by Congress regarding immigration and border security.” They claim that Mayorkas should be holding every undocumented migrant encountered by border agents in detention while their cases are being processed and that he is violating the law by releasing some of them into the country while they await a ruling on their status.

Is that a fair charge?

People besides Republicans on the Homeland Security committee—including prominent conservative legal commentators and the editorial board of the Wall Street Journal—generally agree that it is not. In recent years, starting during the Trump administration, the U.S. has seen an unprecedented surge of attempted migration. There are vastly more people trying to enter the country over its southwest border than there are federal facilities to hold them in, and there are not enough federal officials to handle the many claims of eligibility for asylum that these individuals submit. The backlog of cases in immigration court is yearslong, and both the Biden and Trump administrations have responded to the overload by releasing some migrants while they await adjudication of their status.

Could Mayorkas and Biden simply turn people away without taking their asylum claims?

No — or, at least, a federal court already ruled that this was illegal when Trump tried it in 2018, which is why a bipartisan group in the Senate is reportedly negotiating legislation that would give the president more authority to do so. The bill would also reportedly appropriate money to hire more asylum officers and immigration judges. Speaker of the House Mike Johnson, however, says the lower chamber will reject this bill, again on the grounds that Biden and Mayorkas could be doing more under current law.

David Bier of the libertarian Cato Institute noticed that two of the court cases that Republicans cite to argue that Mayorkas has certain existing authorities were actually reversed on appeal . . .

New reporting about the inner workings of the White House during the Trump administration sheds even more light on the ex-president’s corrupting power and influence over the people around him and the type of toxic environment he created and enabled while in office. From Rolling Stone:

In an attempt to better understand the Trump White House pharmacy scandal, I recently spoke with Dr. Justin Frank. He is a former clinical professor of psychiatry at the George Washington University Medical Center and the author of "Trump on the Couch: Inside the Mind of the President."

In this conversation, Dr. Frank shares his professional insights about the Trump White House pharmacy and why it was so dangerous. He also discusses the specific drugs and narcotics that were apparently being given out there with few or any controls of limits and how they could impact people’s behavior and moods – which includes the possibility of fatal outcomes.

Dr. Frank also continues to warn about Trump’s extremely dangerous mind and overall pattern of behavior and why as seen with the second E.
