Why did ABC News roll over for Donald Trump?

This isn't hard, ABC News made a campaign contribution to Donald Trump. It is that simple.

The topic here is a defamation suit Donald Trump filed against ABC News last March. It's one of the zillions that Trump files regularly and loses just as regularly. But for some reason, only a few days before Trump would have been forced to sit through a damaging deposition, ABC caved and agreed to pay Trump $15 million plus $1 million in legal fees.

This might make sense if ABC had a disastrously weak case and just needed to pull the plug. But they didn't. Trump had sued over an interview George Stephanopoulos did with Rep. Nancy Mace where he repeatedly asked how she could support a man who had been found "liable for rape" in the E. Jean Carroll case. Trump protested that the jury found him liable only for sexual abuse, but the judge later clarified this:

Forcible, unconsented-to penetration of the vagina or of other bodily orifices by fingers, other body parts, or other articles or materials is not called “rape” under the New York Penal Law. The finding that Ms. Carroll failed to prove that she was “raped” within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump “raped” her as many people commonly understand the word “rape.” Indeed, as the evidence at trial recounted below makes clear, the jury found that Mr. Trump in fact did exactly that.... The proof convincingly established, and the jury implicitly found, that Mr. Trump deliberately and forcibly penetrated Ms. Carroll’s vagina with his fingers, causing immediate pain and long lasting emotional and psychological harm.

Sorry for the long excerpt, but I wanted to provide judge's full context. In short: Trump was not liable for rape under New York's stringent legal requirements, but he did rape Carroll as the term is commonly understood in modern usage.

It doesn't matter if the judge was right about this. It's what he wrote in an "official public proceeding," which means it's privileged and can be freely quoted as long as the source is noted. Stephanopoulos would have argued he did exactly that when he explicitly said, "the judge affirmed that it was rape."

Would he have prevailed? That's impossible to say, but he sure seems to have a strong case. The jury found that Trump had jammed his fingers into Carroll's vagina; a judge said that met the common definition of rape; and Stephanopoulos then cited the judge.

So why did ABC roll over with barely an effort to defend itself? It's a good question. It might have to do with the fact that ABC is owned by Disney, which recently fought with Florida Gov. Ron DeSantis for over a year and eventually paid a stiff price. Maybe they weren't up for another mud wrestling bout with the MAGA crowd.

But one way or the other, their decision seems to have been based on fear, not legal weakness. They were afraid of the retribution Trump might be able to mete out as president. And in this they aren't alone. Trump's revenge-based MO has proven remarkably effective. It's not clear what it will get him in the long run, but in the short run it's already earned him groveling fealty from politicians, foreign leaders, corporate CEOs, and now a major media outlet. This is unique—and uniquely chilling—in American presidential history.

And anyway, how big a deal is a $15 million contribution settlement? For Disney—net profit in 2024: $7.6 billion—it's barely noticeable. Best to just stay safe and write the check.

In some areas, the election looked like a red wave; compared with four years ago, the presidential vote swung to the right by about 10 points in some of the most populous blue states, such as New York, California, and New Jersey. But down-ballot races offer a solid case for Democratic optimism. The party label appeared to be far less of an albatross for Democratic congressional candidates than it was in strong Republican years such as 2010 and 2014. In the Senate this year, although Republicans flipped four seats, Democratic candidates prevailed in four battleground states that Kamala Harris lost to Trump. And according to the Cook Political Report’s David Wasserman, Democrats could have retaken the House majority with only 7,309 more votes across three congressional districts.

Democrats also held their own in state-legislative races. They made gains in Wisconsin and broke a Republican supermajority in North Carolina, although they lost ground elsewhere. Overall, the party retains significantly more power in state capitols than it did when Trump first took office in 2017. “There could have been a red wave in the states, and there wasn’t,” Heather Williams, the president of the Democratic Legislative Campaign Committee, told me. “I genuinely see this election as defying odds.”

What really happened in 2024?

Here's the vote for president in California for 2020 and 2024:


It's easy to see what happened here. Donald Trump gained no traction at all, but two million Democratic voters from 2020 didn't bother to show up and vote for Kamala Harris. Why? There are two obvious theories:

• They didn't like Kamala much.

• They knew she’d win the state easily so they just didn't bother.

For what it's worth, in final polling before the election Trump gained a couple of points compared to 2020, which turned into a 1% increase in his vote. Harris lost a couple of points, which turned into a 17% drop in her vote. This points in the direction of laziness/strategic voting.

Was this a problem with Harris in particular or with Democrats in general? Here's the House vote over the past couple of decades:


The Democratic share of the vote was down this year, so maybe it really is a D problem. But there's evidence this is mostly strategic. Here's the number of seats Democrats have won:


It was up! Democrats voted where they needed to but skipped out where a seat was uncompetitive. In the end, the Democratic share of the California delegation reached an all-time record aside from the blowout year of 2018.

I don't have a big axe to grind here. I just want to know: Was there a specific problem with Kamala Harris this year or is there a widespread problem with the Democratic brand in general? Honestly, I see evidence both ways. You really can't ignore the fact that every single state (in fact, every single county) shifted red. On the other hand, Harris lost by only 1.5% of the vote nationwide, while House Democrats gained 0.6% of the national vote compared to 2022 and picked up two seats. It's the same dynamic that played out in the deep-blue state of California.

It's just a genuine mystery. Trump really did pick up support compared to 2016, but then again, so did Harris by a little bit. Trump mainly picked up support from the third-party vote, not from Democrats.

I'm still not sure what to think, and it's going to be months before we have more reliable data to dive unto. Until then, we're fumbling around in the dark. But if I had to pick a story right now, it would be this:

1. Overall, Democrats ran about even compared to 2022. There's little sign that the party's brand is in serious trouble.

2. However, the Trump/Harris race clearly exposed dissatisfaction with the Biden/Harris administration. That needs to be investigated.

3. One way or another, the answer is mostly going to lie with Hispanics, who deserted Harris in droves.

4. We are still, basically, a 50-50 nation.

The fact that it now seeks an exemption after paying the taxes for 52 years suggests that preexisting law does not favor the church’s position — and that the church’s lawyers now think they can win, after Trump is President and orders his handpicked Supreme Court justices to vote the way he wants. Trump doesn't give a damn what the law says, and his Trumptard justices hold the law in only slightly less contempt than Trump does.

I had previously read the Trump tweet below and thought that this is why Trump is so popular. That says a lot about me and my reading comprehension at high speed. I misunderstood Trump. I should have read that tweet a lot slower and considered the implications of what Trump wrote. But at first glance Trump is brilliant:

The idea that the BRICS Countries are trying to move away from the Dollar while we stand by and watch is OVER. They can go find another "sucker!" There is no chance that the BRICS will replace the U.S. Dollar in International Trade, and any Country that tries should wave goodbye to America.


There’s a lot that’s foolish about that rant, starting with the idea that foreign governments can simply replace the dollar by decree (although others, like Vladimir Putin, share the same misconception.) I’ll write a future post about why that’s not at all how it works.

There are also delusions of grandeur: Trump clearly imagines that America holds all the cards when it comes to a possible trade war, and I fear that he and the rest of us will soon get an object lesson in the limits of U.S. trade leverage.

But what’s really bizarre about Trump’s rant is that given his views about trade, he should want to see the dollar lose its special role.

Howard Lutnick, Trump’s choice for Commerce secretary, has close ties to Tether, the company that is at the heart of the scheme the UK just uncovered and is rumored to play a large role in money laundering in general.

We’ll see what happens. But what Musk and Andreesen are demanding could be seen as a call for the U.S. government to intervene to make life easier for criminals. And if you think such a thing would be inconceivable under the second Trump administration, you haven’t been paying attention.

The news of the moment is the looming prospect that the federal government will shut down over the weekend. (All credit for the shutdown will go to Trumptards such as Elon Musk, if the shutdown happens.)

We’ll have to see how much damage this does, but it’s already clear that assuming the worst happens — and it’s hard to see how it won’t — this will be the dumbest shutdown ever. I’d say that the incoming Musk administration (so far Musk, not Trump, appears to be calling the shots) is trying to hold itself up for ransom, but it doesn’t even rise to that level. This isn’t like 1995, when Newt Gingrich shut down the government in an attempt to extract cuts in Medicare and Medicaid — a move that seemed (and was) a foolish act of petulance, but at least had a ghost of motivation.

No, Musk is demanding — apparently successfully — that Republicans in Congress renege on a deal they had already agreed to, a continuing resolution that would keep the federal government going for the next few months. Why? Because, Musk says, of the outrageous provisions in that CR.

Except none of the items Musk is complaining about are actually in the bill. No, Congress isn’t giving itself a 40 percent raise. No, the bill doesn’t fund a $3 billion stadium in Washington. No, it doesn’t block future investigations into the Jan. 6 committee. No, it doesn’t fund bioweapons labs.

In a barrage of posts on X Musk pushed misinformation about a more or less routine, place-holding bill that was basically a way to keep the ship of state afloat until Trump takes charge. Maybe this was in part a power play, an attempt to make Republicans in Congress show fealty to a man who clearly imagines that he’s the real president — and Trump, by meekly endorsing Musk’s position, did in fact convey the impression that Musk is leading the guy who is supposed to be in charge by the nose. But this political theater will have real consequences, for America, for Trump, and for Musk himself.

Musk has asserted that shutting the government down for a month would do no harm. And it’s true that Social Security, Medicare and Medicaid funding — which is where the bulk of the money goes — will continue. But many services people rely on will be disrupted, especially if the shutdown goes on for more than a month, which seems all too likely given Republicans’ razor-thin House majority and the dominance of misinformation in many members’ thinking.

Maybe Musk himself doesn’t expect to experience any hardship, but put it this way: I’m glad that I won’t need to renew my passport any time soon, that I don’t expect to be trying to get through airport security for a while, and especially glad that I don’t rely either on food stamps or on small business loans. For all of these things have been disrupted in past government shutdowns.

Do Musk and Trump know any of this? Almost surely not.

One benefit of the rise of streaming is that you can get through holiday season watching movies at home other than endless reruns of “It’s a wonderful life.” If you do find yourself viewing the old chestnut, however, you should be aware that it’s an unrealistic fantasy.

I’m not talking about an angel getting its wings every time a bell rings and all that. True, I haven’t seen any evidence for that claim, but then I haven’t seen any evidence against it either.

No, I’m talking about the bank run at the heart of the plot, which could not have happened at the time the movie was set. For the events in “It’s a wonderful life” take place just after World War II, and by then deposits at thrift institutions like Jimmy Stewart’s bank were covered by the Federal Savings and Loan Insurance Corporation, so his customers would not have been worried about losing their life savings. FSLIC itself went bankrupt in the 1980s — more about that later — but depositors’ money was protected from the savings and loan crisis, and it was folded into the Federal Deposit Insurance Corporation, which covers commercial banks.

Now, however, the incoming Trump administration reportedly wants to abolish the FDIC and weaken bank regulation in general. And that could eventually lead to very bad things.

Bank runs were quite common before the creation of FSLIC and the FDIC — audiences when the movie came out in 1946 still had vivid memories of the huge bank runs of the 1930s. And this was far from the first time bank runs had a devastating effect on the real economy.

In particular, we know that Donald Trump has a thing about the 1890s, when men were men, tariffs were high, businesses were free to pollute the air and water, and nobody knew what went on in meatpacking plants. But you can bet your Bitcoin that he’s never heard of the Panic of 1893, a huge wave of contagious bank runs that was catastrophic for industrial production and employment:

Economists actually understand bank runs pretty well. When the 2008 financial crisis struck after generations without such crises (in the United States), monetary economists could be found wandering the halls muttering “Diamond-Dybvig, Diamond-Dybvig,” after a classic 1983 analysis by Douglas Diamond and Philip Dybvig, who pointed out that banks offer their depositors immediate access to their cash while investing most of the money in “illiquid” assets like loans that can’t be quickly sold, or at least only at fire-sale prices. (Diamond and Dybvig eventually won a Nobel Prize for their work.)

Normally the illiquidity of most bank assets isn’t a problem, because on any given day only some of a bank’s customers want cash, while others are making deposits, so it’s OK to hold limited amounts of ready cash.

But if for whatever reason depositors fear that a bank may be about to fail, they will rush to pull out their money — and their fears can turn into a self-fulfilling prophecy, because a bank trying to raise money in a hurry can go bankrupt even if it would have been solvent if it had had time to sell at a more deliberate pace. And since the collapse of one bank can cause fears about other banks, bank runs can be contagious.

Deposit insurance made old-fashioned bank runs a thing of the past; I’ll talk about recent crises in a minute. But from the beginning it was obvious that protection for depositors had to come with strings. Otherwise banks could play heads I win, tails taxpayers lose: attract funds by offering attractive interest rates, then invest in potentially high-yielding ventures that could also easily go bad. Depositors wouldn’t worry, because they were protected; bank owners would get rich if they were lucky, just walk away if they weren’t.

So deposit insurance had to be accompanied by things like capital requirements that forced bank owners to put their own money at risk and restrictions on the kinds of investments they were allowed to make.

Concerns that unregulated banks would gamble with depositors’ funds weren’t purely hypothetical. The interaction between deposit insurance and deregulation of savings banks in the 1980s turned a modest-sized problem into a huge mess that eventually cost taxpayers around $130 billion — adjusting for inflation and economic growth since then, that’s the equivalent of around $650 billion today.

Still, thanks to deposit insurance we went from the 1930s to 2008 without major banking crises. What happened in 2008?


The answer, which most economists, myself included, unfortunately didn’t recognize until after the fact, was that by 2008 much of the financial system had been taken over by “shadow banking” that functioned a lot like ordinary banking but lacked both guarantees and effective regulation. For example, firms like Lehman Brothers were in effect using overnight borrowing to finance purchases of mortgage-backed securities, creating the conditions for something that was the functional equivalent of a Diamond-Dybvig bank run even though it didn’t involve bank deposits.

And when the runs came, the results were a lot like those of 19th-century “panics.” We managed to avoid a full replay of the Great Depression thanks to a combination of bailouts and fiscal support, but it was still ugly, and the crisis was followed, appropriately, by tightened regulation of finance in general.

But now the incoming Trump administration seems eager to deregulate the financial industry. We’re hearing about the possibility of abolishing the FDIC. Deposit insurance would supposedly remain, although it would be absorbed into the Treasury Department. But the FDIC has a lot of institutional experience in bank regulation, which would presumably be lost. And this comes amid a general push to loosen financial regulation, indeed regulation of all types.

I have no idea how far this stuff will go, although Wall Street types are clearly eager to start taking dangerous risks again.

But it does seem like a reasonable guess that panics, along with pollution and polio, are well-positioned to make a comeback.

Trump waited 36 days before signing a bill. During the wait, the government was shutdown. All Trump had to do to end the shutdown was pick up a pen and sign the paper that was on his desk. The shutdown was all Trump's fault.

Dave Wasserman, the well-regarded number cruncher for the Cook Political Report, noted, “the 2024 election was decided by 229,766 votes across Michigan, Pennsylvania and Wisconsin out of about 155.2 million cast nationally.”

If the Harris campaign had mobilized more base voters in those states—rather than squandering precious time on Republican-outreach events with Liz Cheney—they might well have made up the difference. Or, if they could have developed strategies to get just 114,884 working-class Wisconsin, Michigan, and Pennsylvania voters to shift from Trump to Harris, the Democrat would have prevailed.

That’s roughly the number of people that a pair of Taylor Swift shows drew in Philadelphia this year. In Wisconsin, historically the most closely contested of the battleground states, a shift of less than 15,000 votes would have given the state to Harris.

It’s not uncommon for presidents to boast that they have more support than is actually the case, and it’s certainly not Trump’s first time doing so. Countless presidents have peddled a fantasy of broad popularity in order to gain an advantage in the wrangling over Cabinet picks and policy initiatives.

But the voters did not hand Trump a massive mandate.

Rather, they produced a result so close that, with just a slight shift of votes, the Electoral College would have made a Democrat the 47th president of the United States.

United States President-elect Donald Trump has threatened to demand control of the Panama Canal after accusing Panama of charging excessive rates on US ships passing through one of the busiest waterways in the world.

“Our Navy and Commerce have been treated in a very unfair and injudicious way. The fees being charged by Panama are ridiculous,” Trump posted on his Truth Social platform on Saturday.

The US largely built the canal in 1914 and administrated territory surrounding the passage for decades. But Washington fully handed control of the canal to Panama in 1999 after a period of joint administration.

Trump also hinted at China’s growing influence around the canal, which connects the Atlantic to the Pacific oceans.

“It was solely for Panama to manage, not China, or anyone else,” he said. “We would and will NEVER let it fall into the wrong hands!”

The post was an exceedingly rare example of a US leader saying he could push a sovereign country to hand over territory.

“It was not given for the benefit of others, but merely as a token of cooperation with us and Panama. If the moral and legal principles of this magnanimous gesture of giving are not followed, then we will demand that the Panama Canal be returned to us, in full, and without question,” Trump said.

Last month, Trump said he would impose tariffs on Mexican and Canadian imports on day one of his administration and that the measures would remain until the “invasion” of undocumented migrants and drugs came to an end.

“Both Mexico and Canada have the absolute right and power to easily solve this long-simmering problem. We hereby demand that they use this power, and until such time that they do, it is time for them to pay a very big price!” he posted on his Truth Social platform.

The cost of raising a child has risen, and there are far fewer resources for the elderly, so many Gen Xers are feeling this “sandwich” squeeze of caring for both their children and their parents. However, Gen X was told we could not depend on larger institutions to help us. Much of the popular culture we grew up with reinforced the message that institutions fail us and can’t be depended upon. These institutions that benefited their parents have completely eroded for our generation. In that light, it seems understandable that some might vote for the bomb thrower over a problem solver — at least I’ll get a tax cut, the thinking goes. But I doubt finishing the destructive job started during the Reagan era will solve the many problems our generation or younger cohorts face. Political nihilism rarely works for those who vote for it, only deepening the crisis . . .
