This brings up the eternal question: Is Trump lying or is he so stupid he believes this? I mean, who does he think collects tariffs?*

From whom?**

Does he think we send the bill to Xi Jinping, who then sends us a check?***

This is not one of those things where liberal and conservative economists disagree. It's just a boring bit of accounting. But Trump doesn't know this.

* Answer: Customs and Border Protection.

** Answer: Whoever is importing the goods. Eventually, consumers pay most or all of it in the form of higher prices.

*** Answer: No, that's not how it works.

Yet you're going to argue we should keep taxing Social Security.

Or that $15 Minimum Wage didn't raise the price of McDonald's meals to the point that it's a luxury item.

6ix, what is your understanding of wages at Mcdonalds? The Federal minimum wage is still $7.25/hour in Texas but Mcdonald's pays more because there aren't enough fools who will accept $7.25. How much does a Mcdonalds Crew make in Texas? As of Aug 10, 2024, the average hourly pay for a Mcdonalds Crew in Texas is $11.42 an hour. While ZipRecruiter is seeing salaries as high as $16.35 and as low as $7.61, the majority of Mcdonalds Crew salaries currently range between $10.77 (25th percentile) to $14.09 (75th percentile) in Texas.
https://www.ziprecruiter.com/Salaries/Mcdonalds-Crew-Salary--in-Texas

6ixStringJack, since you know next to nothing about Mcdonald's wages you'll know even less about taxes but here is why taxes need to be collected at the present percent rather than reduced.

Donald Trump says he wants to eliminate income taxes on Social Security benefits. These taxes are currently deposited into the Social Security and Medicare trust funds, something that was put in place under Ronald Reagan in order to help Medicare and Social Security finances.

So what happens to Social Security and Medicare if this tax goes away? Here's an estimate from the Committee for a Responsible Federal Budget:

Under Trump's proposal, the Social Security Trust Fund becomes insolvent a year earlier and the Medicare Trust Fund becomes insolvent six years earlier. Now you know that Trump is a giant fuck up.

The US national debt problem really is simple

This is a simplified version of a chart from the Center for American Progress:

See the original Figure 3 at
https://www.americanprogress.org/article/tax-cuts-are-primarily-respon
sible-for-the-increasing-debt-ratio
/

If it weren't for Republican tax cuts, the national debt would be at 60% of GDP, a very non-scary level.

Our deficit problem is simple. General spending hasn't increased, so it's not to blame. Social Security and Medicare spending have increased, but there's not much to be done about that. It's demographics, and both programs are far too popular to be meaningfully cut. Likewise, the social safety net can be cut in only small ways.

There's only one way to rein in the deficit: higher taxes. But Republicans won't allow it—and until that changes there's nothing we can do. Ignore anyone who tries to tell you it's any more complicated than that.

.For more than 100 years, the FBI has been collecting crime data from local police departments across the country through the Uniform Crime Reporting Program, which has been the gold standard of national crime statistics.

By 2020, almost every law enforcement agency was included in the FBI’s database. Some agencies reported topline numbers, such as the total number of murders or car thefts, through the Summary Reporting System. Others reported granular incident data with details about each reported crime through the newer National Incident-Based Reporting System (NIBRS).
Crime Data Gap

Then it all changed in 2021. In an effort to fully modernize the system, the FBI stopped taking data from the old summary system and only accepted data through the new system.Thousands of police agencies fell through the cracks because they didn’t catch up with the changes on time.

6ix, all the Trumptards who I have gotten a chance to see how much they pay are cheating on their income taxes. See the most famous example, Trump, who paid only $750 in 2015 and 2016.

6ix, I gave you the proof that Republican Presidents/Congressmen, when they alter the income tax code, caused the National Debt to increase mightily, which is to be expected when a political party is made up of income tax cheaters.

Unpacking the right's plot to wreck democracy — and why it might work

By Andrew O'Hehir | August 16, 2024 9:00AM (EDT)

If the title of Daley's new book, "Antidemocratic: Inside the Far Right's 50-Year Plot to Control American Elections," suggests that it makes large claims, it definitely does. But it's not a tale of a secret, sinister conspiracy, and the chaotic events of Jan. 6, 2021, are only mentioned in passing.

Donald Trump was not the architect of the long-term antidemocratic strategy Daley outlines in this book, and was probably barely aware of it before he became its accidental beneficiary. The precarious and damaged condition of U.S. democracy — corrupted from top to bottom by corporate money, large-scale gerrymandering, aggressive voter suppression and the far-right conquest of the federal courts — did not happen by accident or result from a series of ad hoc political decisions. As Daley writes, it's "the product of a deliberate, long-term and extraordinarily patient strategy, some of it behind closed doors though much of it in plain sight."

Most of the major landmarks of this history are visible; engaged liberals and progressives largely understand the pernicious effects of the Supreme Court's decisions in the Citizens United and Shelby County cases, which opened the doors, respectively, to unlimited tides of dark money (now defined as free speech) and increasingly imaginative, if nominally colorblind, forms of racial disenfranchisement or vote suppression. But those court cases didn't emerge from nowhere, and it wasn't simply bad luck that they came before a court with an entrenched majority of Republican-appointed, Federalist Society-endorsed justices.

"Antidemocratic" is less the story of the damaging consequences of those decisions (among others) than the story of how and why they happened — and that story has never been told this thoroughly in a single volume. To boil the narrative down to its essentials, Daley demonstrates that leading conservatives of the 1970s, alienated and scandalized by the increasingly liberal tenure of political and legal reasoning in America, eventually realized they had to build an entire alternative system.

Arguing for their cherished culture-war positions on racial, sexual and religious issues piece by piece, before liberal judges or Democratic state legislatures, led only to defeat. What a few impressively farsighted right-wing thinkers conceived and then created — and it took liberals far too long to notice this — was a new intellectual and political apparatus that would produce well-trained, highly capable lawyers and judges devoted to reframing constitutional law around "originalism" and (as they saw it) redeeming the promise of a white-dominated, overtly Christian nation from the dangerous moral drift of cultural relativism and increasing diversity.

Founding fathers of that movement, like future Supreme Court Justice Lewis Powell and disgruntled ex-liberal lawyer Michael Horowitz, didn't have the word "woke" to rail against. But they were anti-woke before it was cool. Along with many of their ideological followers and fellow travelers, they created our current moment of American crisis, when getting the most votes on Election Day is only part of the story and the pathways to overturning or denying the people's verdict are legion. My former boss joined me recently to talk about some of the hair-raising possibilities raised by his new book.

This transcript has been edited for clarity and length.

Q: “Antidemocratic” is perfectly timed for this contentious election. I have a decent sense of where you fall on the ideological spectrum, and I would assume you agree with the premise that Kamala Harris and Tim Walz have changed the dynamics of this election. But have they changed it enough to address the issues you talk about in this book?

A: I think that is the $100,000 question as we head into this election season. This is going to be a very tight and very close election. And as we know, the Electoral College is really what matters. In 2020, we're talking about essentially 45,000 votes in three very competitive states that made the difference. Even though Joe Biden won the popular vote by 7 million, it was those 45,000 votes that made the difference. And the kinds of litigation that we saw after 2020 was a clown show. It was Rudy Giuliani in front of Four Seasons Landscaping. It was Cleta Mitchell and a bit of a pile up.

That's not going to be the case this time. I think they're better prepared. I think there's better lawyers working on this. Lara Trump at the RNC has already said that there's about 75 to 90 cases that the RNC is involved in, either as a litigant or filing amicus briefs in about 24 states.

These involve some of the big white-shoe conservative law firms, Consovoy McCarthy and others in D.C. Rudy Giuliani is not involved. So what I worry about is another replay of Bush v. Gore in 2000. If the margin is anywhere near as close as it was in 2000, where we're talking about maybe 550 votes in one state, we are going to see a six-week period, I would imagine, no matter what, between Election Day and the meeting of the Electoral College in mid-December, that is going to be like a second election period.

Except that 180 million of us will vote on Election Day. If this winds up before the Supreme Court the same way Bush v. Gore does — and there's a million different scenarios you could conjure up that get it there — you will have nine people making that decision. Six of whom have essentially been appointed or trained or are in the pocket of Leonard Leo and the Federalist Society, and three (Supreme Court Justices) also worked (for Bush) on Bush v. Gore as lawyers.

Those are John Roberts, Justice Kavanaugh and Justice Barrett, who essentially proved their conservative bona fides in that moment, and were fast-tracked to be trusted by the conservative legal movement for these incredibly important spots on the court. Bush v. Gore, in many ways, was the proof of concept for controlling the court and controlling American elections.

How Project 2025 turned into the GOP’s biggest political loser

https://www.notus.org/2024-election/how-project-2025-turned-into-the-g
ops-biggest-political-loser

There’s a good reason Donald Trump and his campaign are so desperate to distance themselves from the classified-sounding “Project 2025”: The Heritage Foundation’s blueprint for a second Trump administration is politically radioactive.

A Democratic operative who has seen private polling on how a number of issues could move the 2024 presidential election — like health care, the economy and immigration — told NOTUS that, improbably, no issue was benefiting Democrats more than Project 2025. And, predictably, Democrats are capitalizing on the unpopular plan.

Democratic lawmakers and campaign operatives are trying to attach Trump and Republicans to Project 2025 at every opportunity, which, it turns out, hasn’t been too hard. According to Rep. Jared Huffman, the founder of the “Stop Project 2025 Task Force,” one of the reasons they’ve had such success connecting Trump to Heritage’s plan is because voters intuitively believe the former president would institute many of these proposals if he gets another chance in the White House.

“There’s no believability gap here,” Huffman told NOTUS. “People have seen enough of Donald Trump in his first presidency and of JD Vance and all of these extremists to know that they’re not kidding. This is not some hypothetical think tank document; this is actually their blueprint. It’s just not hard to convince people that’s the case.”

Huffman also said he’d seen polling on how effective the Democratic attacks on Project 2025 have been — and he suggested there was a simple reason the attacks were landing. “The heart of why Project 2025 is having such a profound impact is that it’s true. It’s just true,” he said.

The asymmetry of what Democrats have had to do to connect Republicans to Project 2025 — which isn’t much — compared to the lengths Trump and other GOP lawmakers have had to go to distance themselves from it is one of the reasons this has been such a political winner for Democrats.

Project 2025 Co-Author Lays Out "Radical Agenda" for Next Trump Term in Undercover Video

As Donald Trump tries to distance his campaign from Project 2025, those behind the right-wing policy blueprint to remake the U.S. government continue to brag in private about their close ties to the Republican presidential nominee and how they intend to push a radical right-wing agenda in a second Trump administration.

In July, Project 2025 co-author Russell Vought met with two people he believed to be relatives of a wealthy conservative donor interested in funding the effort. In fact, he was meeting with two reporters with the U.K.-based Centre for Climate Reporting as part of an undercover sting captured on video. Over the course of two hours, Vought described Trump's disavowal of Project 2025 as mere theater and laid out plans for mass deportations, restricting abortion, gutting independent government bureaucracies, using the military against racial justice protesters and more.

The secret plans are "designed to ensure that this kind of radical agenda that the conservative movement has in the U.S. can be implemented from day one," says Lawrence Carter, founder and director of the Centre for Climate Reporting and one of the reporters who spoke with Vought. "They want to make sure that the mistakes from the first Trump administration, as they see them, where not much got done, are avoided this time around."

OK school teacher want to be. Israel is not spelled Isreal. Also, your sentence structure here is incorrect. "I don't care about your What If? scenarios." The what and if should not be capitalized. And, you are not asking a question you are making a statement, so you should not use a question mark. Lastly, if scenarios is starting a new sentence as it does the way you use it, then it should be capitalized. You use a period after it. It cannot stand alone as a sentence.

I should have put quotes around "What If?", since it was a reference to the Marvel Comics.

I think it probably was introversion when I was younger and I cared far more about what other people thought of me than anybody ever should.

I just don't have the energy or desire to care too much about other people's opinions about anything more often than not. I think dumping that project is going to help open up some of those stores a bit. Although, during the handoff I mentioned just a few days ago I've unfortunately found one part in particular I cared about more than any other that I'm not going to be able to handoff immediately. And now I've done what I didn't want to do and I've gotten back in over my head trying to get it "perfect" before the hand off. It's the same as it ever was, the more I get done the more I find needs to be done.

So instead of mowing the lawn like I wanted to today, I've been sitting in front of my computer slaving away for the fifth out of five straight days in what might be the fifth of the next fifty days on something that really would be better to be working on during the winter when it's too cold to do anything else, or would have been better to be working on when it was oppressively hot and humid out rather than at the end of summer when it's going to start cooling down and I could be doing things that are more beneficial to my real-world self.

I just always have too many things to do and to think about to ever really be present in relationships, whether it be stuff like this project, or the million and one things I need to do to get this house into a proper home.

And that's on my good days when I'm super active. Can't forget about the times where I just waste weeks or months at a time doing practically nothing.

My buddy is always trying to get me to micro-dose on mushrooms. He thinks I need a "reset" and that it could be the cure for what ails me here. I dunno. It's super expensive, but he's offered to pay for it all for me. You know I don't like lab-created behavioral modification crap, but I'm pretty much on the fence about stuff like this too no matter how many times people like Joe Rogan say it's a good idea.

I did mushrooms twice in my mid 20's and tripped balls on them and neither time was a pleasant experience that I look back on fondly. Quite the opposite, actually. But my buddy says micro-dosing is nothing like that and if I even felt anything at all it would be pleasant.

A reset does sound nice though. Wouldn't it be nice to just wave a magic wand and all of the sudden have all the things that should be priority come into focus while being able to just let all the stuff that doesn't really matter go completely?

It would be sad thinking about what that might mean regarding my time spent here in the future. As many hours as I've wasted doing various inconsequential things in my life, I'm sure I've wasted a few thousands of hours on FFF.net over the last 18 years. If magic mushrooms "fixed" me, I might never feel the need to come here anymore other than saying my goodbyes to you and Brenda and Jaynez. Even to JSF too.

Hell... I'd even say goodbye to Wetware and Ted-Bot, although that would be like saying goodbye to my air-fryer and my microwave before I go out to run some errands.

At least my dad is coming over tomorrow. That was a spur of the moment decision at the end of our phone call today. He seemed like he could use it as much as I probably do, so I asked if he wanted to come over this week and he said tomorrow works for him. I probably still won't mow the lawn tomorrow but at least that will be a little break from my project and all the online bullshit. Maybe if I'm really lucky my buddy won't have a super busy day at work and we can hang out tomorrow night after dad leaves. A whole freakin' month has flown by since the 4th of July and I haven't seen my friends since then. Had plenty of opportunity to so while I was deep in my funk, but once I crawled out of it everyone seems to be so busy and doesn't have time to hang out.

Search unearths more massacre remains

By Ken Miller
Associated Press

OKLAHOMA CITY — The latest search for the remains of 1921 Tulsa Race Massacre victims has ended with three more sets containing gunshot wounds, investigators said. https://www.tulsahistory.org/exhibit/1921-tulsa-race-massacre/

The three are among 11 sets of remains exhumed during the latest excavation in Oaklawn Cemetery, state archaeologist Kary Stackelbeck said Friday.

“Two of those gunshot victims display evidence of munitions from two different weapons,” Stackelbeck said. “The third individual who is a gunshot victim also displays evidence of burning.”

Forensic anthropologist Phoebe Stubblefield, who will remains on site to examine the remains, said one victim suffered bullet and shotgun wounds while the second was shot with two different caliber bullets.

The exhumed remains will be sent to Intermountain Forensics in Salt Lake City for DNA and genealogical testing in an effort to identify them.

The search ends just over a month after the first identification of remains previously exhumed during the search for massacre victims were identified as World War I veteran C.L. Daniel from Georgia.

The search is the fourth since Tulsa Mayor G.T. Bynum launched the project in 2018, and 47 remains have now been exhumed.

Bynum, who is not seeking reelection, said he hopes to see the search for victims continue.

“My hope is, regardless of who the next mayor is, that they see how important it is to see this investigation through,” Bynum said. “It’s all part of that sequence that is necessary for us to ultimately find people who were murdered and hidden over a century ago.”

Oklahoma, where the race-motivated massacre took place, was, is, and will always be Trumptard Country.

It is not a surprise that Trump left Unpaid Invoices in Arizona

People flock to Trump venues where he stiffs the municipalities and leaves unpaid invoices. And this is OK for his followers?

Unpaid invoices could keep Trump rallies at smaller Arizona venues

By Camaron Stevenson, Copper Courier

After the Harris-Walz presidential campaign’s stadium-filled rally in Glendale, Arizona, last week, Trump supporters in the state may wonder when they’ll see a similar event for their candidate.

Problem is . . . that may not be possible.

Republican presidential candidate Donald Trump has had massive rallies in Arizona during previous campaigns—15,000 people filled the Veterans Memorial Coliseum in 2020 and again at the Country Thunder Festival Grounds in 2022—but his financial circumstances have changed considerably in the time since, and a large-scale event may not be on the table for the former president and convicted felon.

Venues left unpaid

The Trump campaign hasn’t directly paid for a rally in Arizona since January 2020 and has left a trail of unpaid invoices in cities across the state. Initially, Trump wasn’t billed for his use of venues and city services like on-site law enforcement until after his rally. As a result, his campaign left unpaid invoices from 2016 and 2018 totaling roughly $150,000.

To this date, those bills are still unpaid.

“Arizonans expect and deserve leaders who honor their commitments, not someone who leaves them to pick up the tab,” said Arizona Democratic Party Chair Yolanda Bejarano.

“This is a reminder that Trump has always been about himself, not the hardworking people of our state.”

In a statement, the city of Mesa made it clear that, while Trump is personally under no legal obligation to reimburse the city, the additional cost was an unfortunate burden to saddle taxpayers with.

“The City of Mesa has never billed this White House nor any previous administration for costs associated with providing security for the president of the United States. We embrace that obligation,” the statement said.

“We believe the Trump 2020 campaign should reimburse our City for those taxpayer dollars, and we have invoiced the campaign accordingly.”

The next rally after he refused to pay Mesa was held at the Veterans Memorial Coliseum, where the Arizona Exposition and State Fair Board demanded the $27,000 be paid upfront. The campaign agreed, and that was the last time a Trump rally in Arizona was held—and paid for—by the campaign itself.

The problem, SIX, is that Trump is not his best advocate. He speaks off the cuff scattershot, makes random promises to toss out the the crowd. WYSIWYG. He's working against the entire establishment... the deep state, the DNC, the establishment media. Look at how they memory-holed the attempted assassination. What he needs to be is focused and incisive. But that's not what he is, thanks to galloping ADHD.

Kamala, if she was unscripted, would look worse than Trump. I heard her once, unscripted, saying how she felt about a judge being nominated for the Supreme Court, IIRC, and she used a word like "marvelous" or "amazing" or something like that, four or five times in one answer. Sounding, BTW, completely inauthentic.

I was horrified that someone so intellectually impoverished would be VP. Wish I could find that video again!

But YOU WILL NOT FIND HER IN A SINGLE UNSCRIPTED MOMENT.

And if you did, Trump unscripted is almost as bad as Kamala unscripted.

So it gets down to a person's record, and what we can glean from it of their plans for the USA.

HARDLY ANYBODY LOOKS THAT DEEP.

I favor Trump/ Vance bc the deep state globalists are so dead set against him. (I wish Vance was running TBH.) Plus, I know what Trump did and what he tried to do as President. (My big beef with him is on Israel and Iran.)

Trump, BTW, needs to shut up for a while. IMHO.

But I have great faith in our "interagency" and corrupt media to engineer an election win for Kamala*, who will be just another meat puppet. Look how far they kept Biden* fiction going. Hell, nobody is even asking NOW who's running the country!

If change is gonna come to the USA, it's going to need someone a lot more savvy than Trump. Someone like JFK or RFK, but with better security.

And if change doesn't come from within, it'll be imposed from without, and we're not going to like it. My guess is that'll start to be imposed some time in the next five years. So maybe it's better if Kamala* gets hit with a shit storm.

4 more years of Democrats running things will be terrible for the economy and America in general. In one way that's a great thing because it makes everybody lean further and further socially to the right and back away from the Alt-Left. We've already seen a LOT of pushback against the worst Left policies that came out of 2020 and 2021 reset back to the middle in the last 4 years.

But unlike Democrats I don't wish for pain upon people to get taught a lesson. The amount of underprivileged that will suffer greatly before white college "educated" liberals feel real pain is not worth the tradeoff.

You Trumptards are all the same, which makes it no surprise that you all suffer about the same fates. Your weird beliefs that the economy has been destroyed are true, for you. You think it has been destroyed because you destroyed your little quarter acre of it by setting your life on fire. In the last 4 years I have seen many Trumptards make every mistake possible. And they create a disaster for themselves. Good! I hope in the next 10 years the Trumptards further impoverish themselves with their horrifyingly stupid financial decisions. See Trump for examples of stupid financial decisions, lost court cases, fines, etc.

The election is extremely close
Harris is winning — but her strategy still seems a little complacent

By Matthew Yglesias | Aug 19, 2024

https://www.slowboring.com/p/the-election-is-extremely-close

Kamala Harris has pulled off a virtuosic political performance this summer. In the immediate aftermath of Joe Biden’s debate fiasco, the Democratic Party was paralyzed by two conflicting convictions: One was that if Biden was not the nominee it had to be Harris, and the other was that Harris would be a terrible candidate.

I wrote last December that Harris would plausibly be a stronger choice than Biden and in July that she was clearly the stronger candidate. Still, relative to my expectations, she has over-performed. In a matter of weeks, she’s managed to:

• Wrap up intra-party support with striking speed (not so surprising, this is the political skill she’s always shown)

• Neutralize an emerging Donald Trump financial advantage, which is consistent with her past record, but still impressive

• Immediately address her most glaring potential weaknesses

• Launch several strong biographical ads

• Not only dig out of Biden’s post-debate polling hole (easy though still important), but break out a polling lead

Going back to before the debate, Democrats spent the winter of 2023-2024 in a weird amount of denial about the fact that Biden was on track to lose the election.

Under Harris, that is no longer true. If you were asked to bet on who would win the election if it were held tomorrow, Harris is clearly the right choice. People who are, in fact, gambling on the outcome in November are betting that Harris will probably win. Nate Silver’s state-by-state rundown of the transformation is stunning. Before the swap, Trump was more likely to win Virginia than to lose Florida, while Harris is now more likely to win Texas than to lose Minnesota.

Still, heading into the convention, I think it’s important to be realistic about these odds. As impressive as the turnaround has been, we’re talking about a situation in which Silver thinks she has a 57 percent chance of winning the election. On Polymarket she’s a bit weaker at 54 percent. On PredictIt, she’s a bit stronger at 58 percent.

These are good numbers (above fifty percent!) but not great numbers like the ones Biden was putting up during the summer of 2020. She could still easily lose the race, and there are a lot of known potential pitfalls. The 2020 DNC was strange primarily because of Covid, but I also thought it was full of odd programming decisions — a little complacent, self-indulgent, and self-congratulatory from a party that knew it was on track for victory and lost discipline. I’m hoping we see a convention that is laser-focused on persuadable voters — on retaining Romney-Biden voters and regaining Obama-Trump voters — rather than on placating intra-party dissent. Trump is really bad, and I’d really like to see him lose, ideally quite badly, in a way that helps us turn the page on this era of American politics.

There's nothing about price controls here, and not even much suggestion of anti-gouging action outside of natural disasters (and even then, only if it's gratuitous gouging, not price hikes due to higher wholesale costs). This may or may not be a good idea, but it's surprisingly modest given the ruckus it produced in the press.

So I checked in on our old friend from the New York Fed, the Global Supply Chain Pressure Index. Here it is through July:

It's right at zero, just as normal as can be.

At a fundamental level, you don't know what "idiotic" means, 6ix. Democrats versus Trumptards is not a philosophical difference of opinions. You Trumptards have lost the meaning of everything and, not surprising, it shows in how difficult life is for Trumptards compared to other Americans. Trump's talk about a destroyed American economy is not true for ordinary Americans, but is true for Trumptards who don't understand the economy. Trumptards misunderstand everything. Trumptards are deeply confused about simple things, which is one reason why 6ix has written "Fuck Ukraine" and "Nobody cares" many times. 6ix, you are a lost soul if you can't even understand which side is evil in that war.

A historic example would be the Confederates. They demonstrated the same quirky and deranged mental processes as today's Trumptards. The Confederates could not see anything wrong with slavery, but they did see abolitionists as evil. The Confederates didn't see anything wrong with overthrowing the government, but they did see Lincoln and the Union Army as evil for stopping their treason. The Confederates did not see their evil lives as evil, but they saw good lives as evil. The Confederates misunderstood everything.

It is a historic fact that once the Union stopped the Confederates from their most blatantly evil ways, the ex-Confederates lived in poverty compared to normal Americans for a hundred years because the ex-Confederates didn't know how to behave in a way that fits the country they live in. Their minds remained quirky and deranged in most things that were even slightly complicated, including farming, running a business decently or raising children who aren't crazy like Mommy and Daddy. Trumptards, including Trump, don't know how to behave decently, same as the ex-Confederates. That's why Trump has to lie and cheat on his taxes to get ahead because he does not know how to behave. That's why 6ixStringJack had to withdraw from society and live in relative poverty compared to normal Americans. He does not know how to behave and does not want to learn.

Defining Corruption Down

by Barry Goldman | Aug 20, 2024 5:00AM

https://3quarksdaily.com/3quarksdaily/2024/08/defining-corruption-down
.html

Robert McDonnell was the Governor of Virginia in 2014 when the federal government indicted him and his wife on bribery charges. A Virginia businessman named Jonnie Williams provided the McDonnells with over $175,000 in “loans, gifts and other benefits.” In exchange, the Governor “arranged meetings, hosted events, and contacted other government officials” in an effort to advance the fortunes of Anatabloc, a nutritional supplement manufactured by Williams’ company.

Mr. and Mrs. McDonnell were convicted and sentenced to prison terms of two years and one year respectively. McDonnell appealed, and the Court of Appeals affirmed. He petitioned the Supreme Court, they granted certiorari, and we have the case of United States v. McDonnell.

I don’t want to be accused of spinning the facts here, so I’ll take my language directly from the Court’s decision. Here are two examples of the conduct at issue:

Governor McDonnell’s wife, Maureen McDonnell, offered to seat Williams next to the Governor at a political rally. Shortly before the event, Williams took Mrs. McDonnell on a shopping trip and bought her $20,000 worth of designer clothing. The McDonnells later had Williams over for dinner at the Governor’s Mansion, where they discussed research studies on Anatabloc.

At a subsequent meeting at the Governor’s Mansion, Mrs. McDonnell admired Williams’s Rolex and mentioned that she wanted to get one for Governor McDonnell. Williams asked if Mrs. McDonnell wanted him to purchase a Rolex for the Governor, and Mrs. McDonnell responded, “Yes, that would be nice.” Williams did so, and Mrs. McDonnell later gave the Rolex to Governor McDonnell as a Christmas present.

There is no dispute that McDonnell “arranged meetings, hosted events, and contacted other government officials” on behalf of Williams and Anatabloc. The question the court addressed was whether those were “official acts.” Here is more from the Court’s opinion:

[T]he federal bribery statute… makes it a crime for “a public official or person selected to be a public official, directly or indirectly, corruptly” to demand, seek, receive, accept, or agree “to receive or accept anything of value” in return for being “influenced in the performance of any official act.” An “official act” is defined as “any decision or action on any question, matter, cause, suit, proceeding or controversy, which may at any time be pending, or which may by law be brought before any public official, in such official’s official capacity, or in such official’s place of trust or profit.”

So let’s review. Williams wants to see universities in Virginia conduct trials of Anatabloc so he can get FDA approval to market it as a drug. He takes the Governor’s wife out and buys her $20,000 worth of clothes and a Rolex. The Governor invites him to the Mansion and also invites top health officials from his administration and executives from Virginia universities involved in drug research. What do you think is happening?

Exactly. Textbook public corruption is happening. And that’s what the District Court and the Court of Appeals thought too. But the Supreme Court found otherwise. According to the court, arranging meetings, hosting events, and contacting other government officials is just what public officials do. Without more, the court said, those are not “official acts.”

The decision contains a lot of what purports to be textual analysis and there is the invocation of the Latin maxim noscitor a sociius to establish that introducing people at a dinner at the Governor’s Mansion is not “any decision or action on any question, matter, cause, suit, proceeding or controversy, which may at any time be pending” because, um, reasons. Then there is this:

[C]onscientious public officials arrange meetings for constituents, contact other officials on their behalf, and include them in events all the time. The basic compact underlying representative government assumes that public officials will hear from their constituents and act appropriately on their concerns – whether it is the union official worried about a plant closing or the homeowners who wonder why it took five days to restore power to their neighborhood after a storm. The Government’s position could cast a pall of potential prosecution over these relationships if the union had given a campaign contribution in the past or the homeowners invited the official to join them on their annual outing to the ballgame. Officials might wonder whether they could respond to even the most commonplace requests for assistance, and citizens with legitimate concerns might shrink from participating in democratic discourse.

Oh please.

Anyway, McDonnell’s conviction was reversed and we were left with a dramatically narrowed definition of “official act.” (At least until Trump v. United States where the court needed a very broad definition of official acts so it could find Trump immune from prosecution for the crimes he committed in office. But that’s a different essay.)

That was a few years ago. This year we got Snyder v. United States. James Snyder was the mayor of Portage, Indiana. He “steered” a contract for over $1 million to a local truck dealership who subsequently wrote him a check for $13,000. A jury convicted Snyder of bribery, and once again the case made its way to the Supreme Court.

The law in question (Section 666 of Title 18) makes it a crime to:

“corruptly” solicit, accept or agree to accept “anything of value from any person intending to be influenced or rewarded” for an official act.

The Court did more of its highly sophisticated textual analysis and discovered that the conduct prohibited by the statute included only bribes, not gratuities. Bribes, you see, are paid to a corrupt public official before he performs the desired official act. Gratuities are paid afterward. You might think the language in the statute that says it’s unlawful if the public official was “intending to be influenced or rewarded” meant it covered both, but you would be wrong. “Rewarded” does not mean rewarded. It’s complicated.

But the policy reasons for this finding are not complicated. I am not making this up. Here is language from the decision:

Is a $100 Dunkin’ Donuts gift card for a trash collector wrongful? What about a $200 Nike gift card for a county commissioner who voted to fund new school athletic facilities? Could students take their college professor out to Chipotle for an end-of-term celebration? And if so, would it somehow become criminal to take the professor for a steak dinner? Or treat her to a Hoosiers game?

Under the Government’s approach, families, students, constituents, and other members of the public would be forced to guess whether they could even offer (much less actually give) thank you gift cards, steak dinners, or Fever tickets to their garbage collectors, professors, or school board members, for example.

This is complete horseshit, of course. But there it is. The court ruled 6 to 3 along the predictable lines that Section 666 does not prohibit gratuities. The question is why. Why is the court systematically dismantling the law of public corruption?

The obvious answer is that the members of the court benefit from public corruption. Justice Thomas, for example, appears to be a world-class schnorrer. And the Federalist Society that gave us the current court majority also gave us Citizens United and the idea that corporations are people and money is speech. What used to be considered egregious corruption is now the ordinary course of business.

But there is also another answer. I’m thinking here of Daniel Patrick Moynihan’s famous essay Defining Deviancy Down. In it, Moynihan cited Emile Durkheim for the idea that, “the number of deviant offenders a community can afford to recognize is likely to remain stable over time.” He proffered the thesis that:

[O]ver the past generation… the amount of deviant behavior in American society has increased beyond the levels the community can “afford to recognize” and that, accordingly, we have been redefining deviancy so as to exempt much conduct previously stigmatized, and also quietly raising the “normal” level in categories where behavior is now abnormal by any earlier standard. (This description fits the behavior of typical Trumptards, including Trump the tax cheater, rapist, and all-time liar champion. )

If this idea is correct, society seeks a state of equilibrium with regard to what is considered normal, what is considered deviant, what is criminal and what is tolerable. If public corruption is de-stigmatized, it creates room in the system to criminalize something else, say, abortion or homelessness.

I don’t know if this is happening because of Moynihan’s principle. I note only that it is happening. So, what comes next ? After public corruption has been thoroughly normalized, where else might we expect to see similar reconfiguration?

The separation of church and state is a promising area. We have seen that the court is sympathetic to doctors who oppose reproductive healthcare on religious grounds, bakers and web designers who oppose same sex marriage, and coaches who like to lead prayers at public high school football games. If nothing is done about the direction of the court we are likely to see far more.

Then it is easy to imagine the court coming after free speech and free association where they conflict with the court’s policy preferences. The supermajority on the Supreme Court was engineered by the same radical conservative ecosystem that created Project 2025. Ideas that were “abnormal by any earlier standard” are now in play.

House Concludes Biden "Actively Participated" In Impeachable Offenses - Except It's Too Late To Impeach Him
Monday, Aug 19, 2024 - 12:02 PM

The GOP-led House committees who have been investigating the Biden family shook their fist at the sky on Monday, announcing in a 291-page report that the president engaged in impeachable conduct by helping to enrich his family with millions of dollars through various business schemes to trade on the family name - and then defrauded voters by lying to cover it up, Just the News reports.

The House Oversight, Ways and Means and Judiciary Committees said they believe the evidence from their nine-month investigation establishes that Biden abused his office and violated his oaths under the Constitution, according to the 291-page report reviewed by Just the News.

Obviously this would have been infinitely more helpful even a few months ago when there was time for the GOP-controlled House to take action (particularly before the DOJ concluded that Biden is too senile to prosecute), but hey - better late than never

...

Beyond Biden’s conduct as vice president, the report argued the Justice Department during his presidency deviated from normal practices in order to provide favorable treatment to Hunter Biden, throwing up roadblocks in the investigation and preventing attorneys from pursuing certain avenues of inquiry, as two IRS whistleblowers testified to the House Ways and Means Committee. -Just the News.

Says much about Biden* corruption. And Repub and DOJ [and FBI] corruption too.

We'd be better off if DC, Langley, and the Pentagon took a 50-year hiatus. Since they can't do the job of running and defending the country decently they should give someone else a chance.

Signym, the topic is always the same: Signym, 6ixStringJack, Trumptards, and Trump himself are lunatics who cannot adjust to America as it is. Instead, they want their insane asylum behavior to rule over America. Look at your signature, Signym, and make a persuasive argument you are NOT crazy. By the way, Kissinger never said what your signature claims, he said the exact opposite, and "second" can actually do what Signym thinks is impossible. It is easy for people who aren't overly articulate dumbbells like Signym.

Signym, you ignorant ****. They found no evidence stupid. And if you would like me to prove that here respond to this post by saying so. Because if you want proof I can post video after video of the Democrats pleading with the Republicans to impeach going back forever. Again because, the whole thing was a hoax too fool stupid ignorant people. Of course that would mean you. Do me a favor. Dare me to post a dozen videos of the Democrats saying if you have anything impeach or let's end this hoax.

There's plenty of evidence, it was ignored or buried, and memory-holed.

Republicans probably have their own nefarious reasons for not pursuing this. I imagine they, too, were in on the grift, possibly on the MIC side.

I'm going to make a sweeping statement based only on my experience with a few thousand Trumptards in Texas: Trumptards have difficult personal lives because they have defective personalities. They deserve their troubles and suffering. But Trumptards think they don't. See how they responded to Trump's conviction for how Trumptards deny their leader Trump is as highly defective as they are:

Trump felony conviction talking points from the GOP – an incomplete list

1 The judge was corrupt and the trial was rigged.
Americans will lose faith in the rule of law! At least, if we have anything to say about it!

2 If they can do it to Trump, they can do it to anyone.
Who among us has not falsified business records in an attempt to influence the outcome of an election? You might as well criminalized breathing!

3 What about Unrelated Things.
I've heard that other crimes are frequently committed in the city of New York! Why isn't the DA investigating that?

4 No laws were broken.
If arranging a complicated hush money scheme through a fixer in order to win the presidency is wrong I don't want to be right!

5 Joe Biden orchestrated everything.
He is senile and incompetent and also the secret mastermind manipulating the levers of power to persecute Donald Trump!

6 This will set a dangerous precedent.
What will happen to this country if it becomes normal to demand your political rivals get locked up? I shudder to even think of it!

7 This is good, actually.
The jurors have just guaranteed that Donald Trump will be the next president! Nothing provides a political boost like 34 felony convictions!

8 Revenge is a dish best served at any temperature.
There will be riots! And bloodshed! Our enemies will suffer a terrible retribution! Because of our great respect for the rule of law!
