The Supreme Court is not about happiness or pleasant thinking or negativity. The decision made it crystal clear, at least to me, that Congress botched the drafting of the law:

If Congress wants Oklahoma criminal law to apply to everyone in Oklahoma, including the parts of Oklahoma in the Creek Reservation, then Congress needed to state that. But Congress failed to make it law, therefore Federal criminal law, not Oklahoma criminal law, will apply. As the Supreme Court helpfully pointed out to those idiots in Congress:

Yes. I'm trying to be extremely careful when giving any sources on this one though. Because, like everything else in 2020, almost nobody wants to report facts on either side and everything is opinion based.

Although it doesn't go into specific gory case detail of crimes, this is probably the most factual account I've found of the ruling overall:

In fact. I've learned something too by trying to find as politically neutral an account on the issue that I could when posting a link to you as well. The two Native Indian men I mentioned aren't necessisarily getting away with rape of a child and murder and mutilation. They will be re-tried in Federal court rather than state court.

And even if for some reason those crimes were to be put on trial and handled by Indian reservations, I can't imagine that there would be any reason why they wouldn't be punished harshly for what they did.

As you can clearly see though... This ruling has nothing at all to do with land ownership, or anything other than how the jurisdiction works when prosecuting criminal cases. Which is something that you couldn't be blamed for believing it was if all you read was a headline of an article by CNN or Vox.

If they actually did give land back to Natives here, it would be the first step in doing that all over the country until everybody's homes and land were confiscated by the government and redistributed as they see fit.

The anarchists, Bernie Bros, Antifa and AOC devotees would love that. But that's never going to happen.

"Today we are asked whether the land these treaties promised remains an Indian reservation for purposes of federal criminal law. Because Congress has not said otherwise, we hold the government to its word," Justice Neil Gorsuch wrote in the majority opinion.

Sadly, this is not a US Nunavut judicial moment. It's not as if the US government suddenly woke up and said - you know that land that we signed a treaty about, where we said it was yours forever but we took it anyway? That land really is yours.

I do see that from what you posted. Yes, even if he was tried in a reservation court he would receive a harsh punishment.

I learned something as well. When I think of the Trail of Tears, I always think of the Cherokee. But I didn't know that the US government also moved the Seminole from Florida as well.

Which was the whole point of Oklahoma in the beginning. It was originally set up to be an Indian state. A good number of tribes were meant to be moved there to contain us. But when something useful was found or during the expansion phase that idea was dropped and the Cherokee were marched back to their original homeland. Some stayed in Oklahoma and obviously some of their other tribes did as well.
