7 legal experts on how Kavanaugh views executive power — and what it could mean for Mueller

What happens if a sitting president happens to be the subject of a criminal investigation? It’s an issue involving executive power that could rise all the way to the Supreme Court, and one that Brett Kavanaugh, President Donald Trump’s justice pick, could weigh in on if he’s confirmed.

And on that issue (and others), Kavanaugh, a judge on the DC Circuit Court of Appeals, has a paper trail — opinions and other writings that offer insights into how he might make decisions on the highest court. The Supreme Court may hear some element of the Russia investigation — the subpoena of a sitting president, or (less likely) the indictment of one. And Kavanaugh could be one of the justices to decide on such matters. And he has made it all too clear how he will decide, even before there is a case to be decided.

He got fired from his last job as president of Fox News for his role in orchestrating a massive, multi-year cover-up of widespread sexual harassment and sexual assault of employees. The White House didn’t note this in the press release.

His wife, Darla, meanwhile, has a habit of tweeting inaccurate anti-vaccination memes and a ton of racist stuff, but leading conservative commentators take the view that, since she is nice to her friends, quoting her accurately amounts to a liberal smear campaign.

Then there’s White House staff secretary Rob Porter, who was eventually forced out once it came to light that he’d beaten up a couple of his wives but the White House could never quite get its story straight on exactly what happened, seemingly because Chief of Staff John Kelly had known the facts and tried to cover them up. About a month later, Trump decided he missed Porter and wanted him back, which didn’t happen, but Kelly obviously wasn’t punished for the coverup.

Jim Jordan, a leading House conservative, stands accused by a half-dozen former Ohio State University wrestlers of turning a blind eye to routine sexual abuse of young athletes. And both President Trump and his colleagues are rallying behind Jordan with the preposterous theory that it’s all a conspiracy cooked up by the “deep state”.

What is really striking thing about the current state of Republican Party politics is not the handful of crooks and spouse abusers who’ve been forced out of their jobs, but the petulant and foot-dragging manner in which they’ve been cashiered, the continued tolerance for so many apparent malefactors, and the evident lack of desire to even attempt anything resembling a proper house-cleaning.

Trump’s administration is full of kooks and crooks because it’s led by Donald Trump. Nothing can realistically be done about it because there’s no way to hold your team to any kind of normal standard of conduct when Donald Trump is captain of the ship.

Corruption is not exactly new to American politics. But never before in American history has the president of the United States been a person whose entire career has been devoted to enriching himself. Donald Trump is first and foremost a greedy person, and despite his campaign season promises to set avarice aside and “be greedy for the United States,” he has, in practice, relentlessly monetized the presidency. He has refused to divest from his business, refused to engage in any meaningful financial disclosure, and clearly encourages business and others with interest in the policy process to cut him in on a piece of the action by holding events at his clubs and hotels. The only presidential democracy with a long history of constitutional continuity is the United States. The constitutions of Finland and France are hybrids rather than true presidential systems, and in the case of the French Fifth Republic, the jury is still out. Aside from the United States, only Chile has managed a century and a half of relatively undisturbed constitutional continuity under presidential government, but Chilean democracy broke down in the 1970s.

The superior historical performance of parliamentary democracies is no accident. A careful comparison of parliamentarism as such with presidenlialism as such leads to the conclusion that, on balance, the former is more conducive to stable democracy than the latter. This conclusion applies especially to nations with deep political cleavages and numerous political parties; for such countries, parliamentarism generally offers a better hope of preserving democracy.

You are focusing on the wrong end of gun. Sure, Trump looks to be a foolish hunter, an Elmer Fudd spraying shotgun pellets randomly, but he actually keeps hitting the target: making the rich ever richer. I found a story where, just this week, Trump made another excellent move, before he flew to Europe and continued to distract attention from what he is actually doing, making the rich richer:

The real debate in the American judiciary is whether the Constitution allows the people’s elected representatives to meaningfully regulate the national economy.

Soon to be Supreme Court Justice Kavanaugh clearly believes it does not: He has called the existence of independent regulatory agencies — notably including the Consumer Financial Protection Bureau but potentially the entire alphabet soup of FCC, FTC, CFTC, SEC, FEC, etc. — a “threat to individual liberty.”

But rather than debate this squarely, we are instead faced with grifters like Kavanaugh’s former boss Ken Starr insisting that Kavanaugh stands for nothing more than a simple “pro-democracy, let-the-people-govern-themselves vision.” The truth is quite the opposite — Kavanaugh’s vision, which he shares with Starr and the bulk of the conservative legal academy, is one in which the courts should stand as staunch allies of capital and block any effort at democratic control of big business.

The business world moves fast to try to exploit profit-making opportunities. At the same time, passing laws is clunky and difficult. Between bicameralism, the presidential veto, the committee system, and the filibuster, it’s just very hard to get new legislation enacted. So if you want to regulate business effectively, you can’t play legislative whack-a-mole and spot abuses in real time. What reformers do instead is try to create regulatory agencies that are given broad mandates to police areas of conduct. But the GOP wants to kill the agencies.

A classic example is the Clean Air Act, which charges the Environmental Protection Agency with identifying forms of harmful air pollution and promulgating rules to cost-effectively reduce it, rather than counting on Congress to pass new laws every time science or business practice changes. To make this system work, judges need to show deference to the regulatory agencies and acknowledge that the congressional reformers who created them wanted the agencies to have some flexibility and discretion. Kavanaugh, as Starr correctly observers, does not believe that this deference should be granted. This is a crucial aspect of his judicial philosophy, and Starr is right to call attention to it.

But Kavanaugh’s doctrine is not about the promotion of self-government or even about deference, it’s about viewing discretion as a one-way street that is always biased against regulation. How does he do it now and how will he continue once on the Supreme Court?

The Reconstruction-era Congress passed the 14th Amendment to try to establish black people’s civil rights, only to see Gilded Age courts rule that the 14th Amendment’s reference to “due process” prohibited all kinds of economic regulations — including civil rights laws! That only changed when those old judges died, but Kavanaugh and many young and conservative intellectuals are now trying to rehabilitate the same old Gilded Age idea that the Constitution should be read primarily as a property owners’ charter, whose purpose is to stymie economic regulation.

Kavanaugh and the conservative legal mainstream use it as a tool to protect business owners from majority rule. If one is a sufficiently unprincipled liar — which Brett Kavanaugh certainly is, as we saw in his remarks after Trump introduced him to the nation — one can dress this up in the language of democracy or originalism or whatever else.

In my head, the story was finished years ago and was inspired by Indistinguishable From Magic www.fireflyfans.net/bluesun.aspx?bid=5185

At that point I bought a book "Time Machines, Time Travel in Physics, Metaphysics, and Science Fiction". I discovered there was too much magic and not enough real physics in the original story. Rather than travel to the past, River will send a telepathic message to the past, to herself. The complications that ensue to send that message have amused me and that is what's important to me. I pretty much agree. What the Republican voters, the Russian trolls, the empty-headed 6ixStringJack, etc. post about demonstrates that the entire way their dingy little minds work, even with the smartest of them, seems to be extreme helplessness and fearfulness. I can see why these people have lots of problems: they have almost no problem solving skills in the real world and they are afraid of everything.

This is why I'm not good writer: I always forget the example. What made you Trump voters think that he could improve your lives? He spent his entire career lying to people to get their money, then when they discovered he would not keep his promises, going to court and counter-suing the people he cheated. All those Trump voters disbelieved the true stories about Trump's past and preferred his make-believe stories.

Thursday morning at the Economic Club of Washington, House Speaker Paul Ryan had three clear messages on trade. He thinks the Trump administration’s trade wars are misguided, he doesn’t intend to do anything about it, and he is committed to pretending that there’s nothing he can do about it.

Here’s the reality of what he can do. Back in September of 2016, the Obama administration vetoed a bill that was supported by large bipartisan majorities in both houses of Congress. Congress voted to override his veto. (Obama vetoed legislation that would allow 9/11 victims’ families to sue the Saudi Arabian government over its support for the terrorists who carried out the attacks.)

Veto overrides are rare because they require two-thirds support in both houses of Congress and because it’s very unusual for a president to take an action that gets denounced by his own party’s leader, for example, Ryan denounced Trump on trade.

If Paul Ryan and other congressional Republicans who’ve long supported free trade wanted to write legislation curtailing Trump’s ability to invoke spurious national security claims to raise taxes on imported goods, it seems certain that they would be able to get the votes to do so.

The question would be whether Democrats would bail Trump out by upholding his veto. Given that there is no real strategy behind Trump’s trade approach, it seems unlikely to me that any Democrats will support Trump.

But Ryan is voluntarily surrendering to Trump without a shot, all while pretending that he has no choice.

I'm not in semi-poverty, btw. I'm one of a very small percentage of people in the country who own their house free and clear and don't have a mortgage or need to pay rent. Because of this, though my yearly income falls below poverty thresholds, my lack of financial obligations puts me in the same boat that a single person making more than double my yearly income is in.

The only reason things are as tight for me as they are now is because even though I have access to a ton of credit, unlike the guy making $30-35k per year with a mortgage, I refuse to put anything on credit that I can't pay off at the end of the month.

At the end of the day my financial situation, no matter how good or bad one could argue it is, has no bearing on how ridiculous you sound every time you post here.

The poorer the state, the more likely the mortgage has been paid-off. There is a strong connection between being a Trump voter with a low income and having primitive ideas about money, credit cards, and mortgages. 6ixStringJack, I haven't got the time or interest to straighten out your hillbilly/white-trash ideas. Michael McFaul: No, I’m not in that camp. We engage with autocrats and adversaries all the time. We did this during the Cold War under very perilous times. So generally I’m not against holding summits, even with people like Putin. But in this particular instance, it just doesn’t feel like there’s an agenda to advance.

When I was in the Obama administration, that was the way we approached all summits with Russian leaders. The first question we asked was, “What set of objectives are we going to advance by having this meeting?” And we canceled a summit with Russia that was scheduled in 2013 because there was no concrete agenda to advance and because Putin had granted asylum to Edward Snowden.

We decided that was too much of an affront for us to move forward with the meeting. What Putin has done in the last couple of years, however, is completely outrageous compared to what he did in 2013.

Sean Illing: There doesn’t seem to be any downside for Putin to have this meeting. People worry that Trump might agree to something foolish in a meeting like this, but he’s already helping to advance Putin’s foreign policy, so it’s not clear to me why anything said here will really matter.

Michael McFaul: That’s correct. In terms of his other behavior, Trump is definitely advancing policy outcomes that Putin favors. What he did in Brussels last week, for example, was absolutely in Putin’s interest. But it’s important to remember that there is a danger simply in having the meeting if there’s nothing to be gained from it.

Trump’s instinct is going to be to forget about the past, to forget about Russia’s annexation of Crimea, to forget about Russia’s war in Ukraine, to skim over Putin’s support for one of the worst dictators in the world, Syrian President Bashar al-Assad, and to say next to nothing about Russia violating our sovereignty in the 2016 election. Because his impulse to get along is so strong, he’s going to forge ahead and forget about all these issues.

And of course, there’s also the possibility that Trump will give something away or agree to a deal that helps Putin and does nothing to advance American interests.

The man who co-wrote “The Art of the Deal” said Sunday he believes President Trump’s faculties are diminishing — and that he feels obligated to sound the alarm.

“We are in a true emergency,” Tony Schwartz said on CNN Sunday. “And the accelerated rate at which his breakdown or decompensation is occurring is cause for us, and certainly for me, to come onto TV more often, to tweet more often.”

Schwartz told CNN’s Brian Stelter that he felt comfortable making that assessment because he had “spent an enormous time with [Trump] over a period of 18 months.”

He also said he was a 25-year student of psychology and had spent “an enormous amount of time” with shrinks who were trying to get to the bottom of Trump.

Schwartz said he felt bad for journalists covering the president because they couldn’t go far enough.

“I believe the republic is in enormous risk that goes far beyond what most journalists are comfortable saying and what the general public, therefore — it doesn’t really fully understand,” he said.

What Putin has on Trump

It’s hard to know what to say after a week like the one we’ve just experienced. On one hand, none of it should’ve come as a surprise. The full frontal assault on our closest allies in the EU and NATO, like the assault on the free press and the pointless flattery of Vladimir Putin, stretch back two years to the 2016 campaign. Donald Trump has spent this past week doing exactly what he said he would do before his election, and doubling down on the denials that anything but his own genius helped him win that election. And yet, no matter how many times we’ve heard “NO COLLUSION!,” there’s something about watching it unfold in real time that stuns in a way that — like catching a cheating partner after months of suspicion or seeing a loved one die after a terminal illness — no amount of intellectual knowing, understanding, or expecting can prepare you for.

After Trump and Putin met in Helsinki, many pundits and politicians struggled to understand what it is they saw, to rationalize it, to explain it away, to speculate on what kinds of kompromat the Russians could have on Trump, when the answer — like infidelity or death — was staring them, us, in the face. Yes, Putin has something on Trump: He helped him win. That’s the kompromat.

Facing the press after his meeting with Trump, Putin admitted — openly, arrogantly — that yes, he had wanted Trump to win in 2016. But we had known that as early as…2016. His state-run media didn’t do much to hide their boss’s preference: anyone but Hillary Clinton. I remember constantly explaining that summer why Putin preferred Trump to Clinton. Through the spring of 2016, Kremlin TV was clear that it wasn’t that Putin wanted Trump to win, it was that he wanted Clinton to lose. The propaganda machine — and, as we now know, the covert influence machine — got behind Bernie Sanders, Donald Trump, Jill Stein — anyone who wasn’t Clinton.

There’s a reason presidents aren’t supposed to talk about monetary policy, and that’s the 1972 election. Back then, as we now know from his tapes, President Nixon was able to pressure then-Fed Chair Arthur Burns into cutting rates when he really shouldn’t have in the run-up to his reelection. The result was not only faster growth that helped Nixon secure a second term, but also what would eventually be much higher inflation that would take over a decade to wring out of the economy. And it’s something we still have to worry about today. That’s because lower rates are always good for a president’s short-term prospects, but aren’t always for the economy’s long-term ones. The only way to solve this problem, then, is to avoid it by keeping politicians out of monetary policy to begin with.

It’s something Trump might learn the hard way.

How the Right Wing Convinces Itself That Liberals Are Evil

Since the 1950s, the conservative movement has justified its bad behavior by persuading itself that the left is worse.

If you spend any time consuming right-wing media in America, you quickly learn the following: Liberals are responsible for racism, slavery, and the Ku Klux Klan. They admire Mussolini and Hitler, and modern liberalism is little different from fascism or, even worse, communism. The mainstream media and academia cannot be trusted because of the pervasive, totalitarian nature of liberal culture.

So-called Never Trump conservatives lament that the Republican Party and, indeed, the conservative movement have ceased to be about ideas beyond slavish devotion to Trump’s cult of personality. But this critique ignores the centrality of the idea of liberal nefariousness even in the self-consciously intellectual corners of the conservative movement. Jonah Goldberg, who has been affiliated with National Review for twenty years, has called for a revived conservative intellectual vigor to tackle the policy challenges of the twenty-first century. He was also the author, in 2008, of the book Liberal Fascism, which—until a last-minute change by Goldberg—bore the subtitle The Totalitarian Temptation from Mussolini to Hillary Clinton.

The idea that the left is depraved, corrupt, and ruthless has been an important strain of American conservatism since the movement began. But it has metastasized. Right-wing policy ideas have been so thoroughly discredited — does anyone even argue anymore that trickle-down economics will ensure mass prosperity? — that the only apparent reason for conservatism’s existence is to fight back against evil liberals. This is, of course, not the sign of a healthy political movement. But has it ever been healthy?

In 1961, what did the right-wing say about Medicare for the elderly? The American Medical Association produced an LP in which an actor opened a broadside against the proposed Medicare program by attributing to Norman Thomas, a six-time Socialist Party candidate for president, a made-up quote that “under the name of liberalism the American people will adopt every fragment of the socialist program.” Because these ideologies were so interchangeable in the imaginations of many conservatives — and were covertly collaborating to enact their nefarious agenda — this meant that it was both important and necessary to fight back through equally underhanded means, e.g. Medicare = Communist slavery of doctors.

The title of that LP? Ronald Reagan Speaks Out Against Socialized Medicine. It’s a reminder that the future president lied freely and constantly in his attempt to stop Medicare. Now he is a Republican Saint.

Pity Rick Perry. His boss demands not only his loyalty but his soul. Trump’s plan will take $16.7 billion a year from consumers and redistribute it to Trump’s coal and nuclear industry allies, according to The Brattle Group, the energy industry’s foremost consultants.

The former Texas governor built his political career on the slogan “Texas, open for business.” His conservative philosophy was simple: Wipe away regulations, lower taxes and promote free enterprise.

Then he accepted President Donald Trump’s offer to serve as secretary of energy.

Perry is struggling to find a plausible excuse to reward Trump’s coal-industry donors and supporters by blowing up the nation’s competitive electricity markets, which have made U.S. electricity bills the envy of the world.

The fact that Perry oversaw the groundbreaking privatization of the Texas electricity market makes his recent work especially galling. One might expect our former governor to cite his experience, defend free enterprise, encourage private-sector solutions and denounce government interference. Not this time.

Trump promised to save and grow the coal and nuclear power industries even though neither is competitive in the age of cheap natural gas and renewable energy. So he’s ordered Perry to devise a scheme to force private electric companies to buy expensive electricity from privately owned nuclear and coal-fired power plants.

For over a year, Perry has floundered in justifying this unprecedented government intervention. In April 2017, he asked experts at the Department of Energy to assess whether increased reliance on gas and renewables would endanger the power supply. They concluded no, it doesn’t.

Last fall, he proposed a rule to the Federal Energy Regulatory Commission requiring the use of coal-fired and nuclear power to guarantee resilience. The Republican majority rejected his reasoning, siding instead with the 95 percent of electric companies and grid operators who said it was unnecessary.

According to a memo obtained last month by Bloomberg News, Perry’s new plan is to declare a national emergency under the Federal Power Act and the Defense Production Act. He says we can’t rely on natural gas power plants because pipelines are too vulnerable to cyberattack.

Therefore, subsidies for nuclear and coal-fired power plants are necessary because they keep weeks of fuel on site, Perry argued. His hyperbole fails even basic analysis.

Whether it’s snowstorms, heat waves, hurricanes or cyberattacks, the most vulnerable links in the power grids are transmission lines. Yet, the Energy Department has not declared an emergency to fortify them.

When confronted with his faulty reasoning, Perry falls back on the last refuge of scoundrels: patriotism.

“You cannot put a dollar figure on the cost to keep America free, to keep the lights on,” Perry told the World Gas Conference.

Trump-appointed FERC Chairman Kevin McIntyre is not buying it. “There is no immediate calamity or threat of the ongoing ability of the bulk power system to operate and serve needs,” he said.

Perry needs FERC commissioners to sign off on this plan because it picks financial winners and losers. There is no precedent or evidence to support Perry’s plan.
