Legal experts have said the law is a radical expansion of “standing”, which is the legal concept that determines whether one person may sue another in order to get compensation for injury or harm. The new abortion law does not require injury or harm in order to have standing. Until this abortion law passed, tort law provided remedies only to people who have incurred a harm. Anti-abortion groups argue that the Texas Legislature can legitimately give anyone standing.

Legal experts have said that the concept to expand standing is part of an emerging trend in Republican-dominated state governments that find it difficult to constitutionally prohibit actions they dislike. Instead, such governments empower civilians to sue for civil remedies.

That being said, I don't agree with this either.

It's your choice as a woman to murder a baby if you want to, not the government's. We already know that if they're made illegal, girls will be doing back ally abortions and probably killing themselves too while they're at it.

That choice is between you and God if there is one. If there ends up not being one, that was a freebie.

I purposefully make less than I'd need to make to pay any Federal Income Taxes because I don't agree with how they spend any of it. I pay nothing per month for shelter in a state with hardly any property taxes, pay nothing per month for my car unless you want to count the $25 for insurance and the license plate sticker, and I buy nothing except for what I need and can afford to buy it in bulk and/or on sale. Oh yeah... and I'm typing to you over my $20 internet connection that has a phone on it that costs me under $3 per month and is paid up until long after Trump becomes your President again.

Yup. Life is super tough around here.

Meanwhile, in reality...

It's really nice finally putting up a the other half-a-house worth of baseboard and trim I snagged on clearance 2 years ago. $200 for the whole house, and that was on a credit card that gave me $250 signup bonus for spending $1000 on it in the first 90 days.

So yeah... essentially they paid me $50 to haul over $1,200 worth of wood away... and it looks great.

I do what I want to do, when I want to do it. I learn something new and useful nearly everyday without having to pay a dime for the knowledge. I fill my life with projects that fill the hole I was never able to fill with drinking. My stress levels have never been lower since before my parents divorced 37 years ago.

I live a more fulfilling life than 3/4 of the jackass wage slaves in the so-called middle class.

In my Firefly story that will never be written down, River Tam definitely believes in God, but her true God isn't your imaginary God, 6ix. River is psychic, at least according to Joss Whedon. River has connections to The All Mighty. Her God follows the Broadway playwright/financier/executive producer/director model, where everybody is an actor, there is a script, and God is expecting you to give your best dramatic performance. At the end of a performance, God gives some criticisms, maybe God modifies the script based on actors' improvisations. Then God tells everyone that the play will be performed again, tomorrow night, and thanks all the actors for appearing before erasing selective parts of the actors' memories. If the actors could remember they are only actors in the middle of a play, they won't truly be living the part, but will just be going through the motions and their performances will be hollow. God wants the best performances and he can't get those without doing a little erasing of memories to keep each performance fresh. River's psychic ability to see the future come from remembering; she is not erased. She knows the play by heart, having seen it many times. River plans on going off script in the middle of the show, just to see God, for once, not know what is going to happen next in the Play.

The wealth lobby is buying up Democrats to defeat Biden’s tax reform

Last week, Democratic senator turned anti-tax lobbyist Heidi Heitkamp, who represented North Dakota for one term before losing in 2018, appeared on CNBC to make a surprisingly emotional appeal against President Biden’s plan to close a notorious loophole for the wealthy. The loophole, called “stepped-up basis” or “the angel-of-death loophole,” allows capital gains to escape any tax at all as long as the owners pass the asset on to their heirs before they sell it.

Heitkamp’s thoughts were with the victims of this reform. She did not invoke the tax implications for the handful of extremely wealthy families that have been financing a lobbying effort to preserve their tax advantages, including the group that currently employs her as its public face. Instead, she cited the burden of an imaginary working-class man named “Sam.”

The scenario that troubled Heitkamp was that Sam, or people like him, would inherit a family-owned cabin that had become extremely valuable and now have to pay tax on the estate. “The truck driver — let’s say truck-driver Sam, who let’s say makes $100,000 a year — all of a sudden now has a tax that he owes on inheriting that property,” she complained.

In fact, the original Democratic proposal allowed for a $1 million exemption per spouse, and it allowed heirs a 15-year period to spread out the payments. So poor Sam would only have to pay tax on whatever value his cabin had over $2 million, which seems like a rather lavish spread for a working-class fellow, and he would have enjoyed a comfortable period over which to make those payments.

Even so, the pleas made by Heitkamp and other moderate Democrats on behalf of the rural petite-bourgeoisie heirs to landowning fortunes exceeding $2 million were felt. Democrats in Congress proposed to raise the exemption to $5 million per spouse. Surely, now that truck drivers inheriting cabins worth less than $10 million would be spared, Heitkamp would have softened her opposition.

But when I reached her on the phone, Heitkamp explained that these adjustments did not satisfy her. When you look at the polling, she told me, people “didn’t believe these exclusions” would really apply. The problem was public opinion. Democrats couldn’t run the risk of taxing extremely large fortunes because working-class folks like “Sam” think they would be targeted.

The fact that this belief was completely false seemed to be beside the point to Heitkamp. She likewise seemed untroubled by the possibility that the reason working-class people would get this false impression in the first place was that groups like hers would spread it. Heitkamp’s group is currently running ads making the case that Biden’s plan to tax the fortunes of the wealthy would hit regular folks. Heitkamp is arguing that even if the proposal won’t hit regular folks, the regular folks won’t believe them. Therefore, Democrats can’t take the risk of raising taxes on the wealthy people who are paying her.

It is probably true that enacting a big tax hike on the wealthy runs a political risk: The wealthy will fund a lot of television ads attacking you over it. The trade-off is that for every dollar in tax hikes Democrats give up, they have to give up a dollar in spending on popular programs like Medicare, Medicaid, and a universal child tax credit. Some of those programs serve social needs more serious than the travails of an imaginary working-class truck driver who inherits a cabin worth more than $10 million.

Americans become two separate peoples, one long-lived and one short-lived

The divergence in life expectancy is stunning. A 2015 study by the National Academy of Sciences found that life expectancy at age 50 for men born in 1960 was almost thirteen years higher for those in the highest quintile of the income distribution than for those in the lowest quintile, while for women born in 1960, it was almost fourteen years higher.

A 2021 study by Anne Case and Angus Deaton, the authors of "Deaths of Despair and the Future of Capitalism," found that the life expectancy of college-educated Americans has continued to rise over the past two decades, while that of non-college-educated Americans has been falling since 2010. This was true for the population as a whole, for both men and women, and for both Blacks and Whites.

Not so long ago, the United States was among the rich world's longevity leaders. Today, it is its longevity laggard, with a lower life expectancy at birth than any other high-income member of the Organization for Economic Cooperation and Development except Hungary, Poland, and the three Baltic States.

The most important reason for the slide in US life expectancy rankings has been the deteriorating health of the US population. The United States as of 2017 had the third-highest obesity rate in the OECD (only Mexico and Chile were higher) and the third-highest incidence of diabetes (only Mexico and Turkey were higher). As for substance abuse, the US opioid-related death rate was not only the highest in the OECD as of 2016, but was also at least double that of every other member country except Canada and Estonia.

America is usually quick to take action in response to immediate threats, as it did with Pearl Harbor. It finds it harder to act when faced with slow-motion crises which only become apparent over the course of many years. Yet such crises may be every bit as threatening to the nation's future.

Non-insane Republicans need to bite the bullet and vote D

I'm a little late to this, but George W. Bush gave a speech on 9/11:

"We have seen growing evidence that the dangers to our country can come not only across borders but from violence that gathers within ... they are children of the same foul spirit and it is our continuing duty to confront them."

This is all very fine, and I'm glad to see Bush denounce the violent Trumpist wing of the Republican Party even if he didn't actually name them. Unfortunately, this is nowhere near enough.

The actual Trumpistas themselves I can almost feel some empathy for. They are largely old, poorly educated, and feel like they have genuine grievances. They are wide open to being conned, and Trump, Fox News, and the rest of the right-wing media machine is happy to oblige them. To a large extent, these folks oppose vaccines and believe the election was stolen because that's what they're being told—over and over and over.

The people I have a real problem with are the non-insane Republicans. These are the ones who don't like Trump and understand that he's dangerous. But they aren't willing to do the only thing that might rid the party of Trumpism: vote for Democrats.

Not forever. Just temporarily until their party gets the message that it needs to purge Trump and his influence if they want to win elections.

I don't expect anyone to become a liberal. Or to like Democrats. I just want them to hold their noses and vote D for a little while on the grounds that a few years of liberal governance is better than allowing the Republican Party to permanently become a party of Trumpism. The old notion that Trumpism is bad but fundamentally harmless was never really justified, but after "Stop the Steal" and January 6 and now the season of vaccine madness, it should be obvious that it's not harmless at all. It's dangerous and will likely get more dangerous over time.

But there's no way to clean up the Republican Party by words alone. As long as they're winning elections, they'll keep doing what they're doing. So vote D. Just for a little while.

7 ways men live without working in America

Almost one-third of all working-age men in America aren’t doing diddly-squat. They don’t have a job, and they aren’t looking for one either.

As a business journalist for a good portion of those 70-plus years, I’ve looked at thousands of charts and graphs in my life, and I have to say this one is as jaw dropping as it is vexing:

Economists, sociologists, politicians, and cable news pundits each have their pet factors to explain the groundswell of non-work. But after digging down here, I’ve concluded there are many different forces at play. That’s what I want to explore today, which is: how men can live in America without working.

And speaking of charts, another striking one came to mind when I was writing this, which I put here below. It shows U.S. GDP over the same time period as the labor participation rate:

Of course, the line on this GDP chart is inversely correlated with the line on the labor participation graph. And I think there is a relationship between the two. Which is to say, the wealthier our nation has become over the decades, the less men are working. Fact is there is just a ton of money sloshing around in our country. And men seem to be able to get their hands on it, whether obtained legally, borrowed, leached off of or stolen.

It seems like working legally to provide for yourself in America is really just one option these days.

The Banality of Trump Being Bonkers

When Bob Woodward first breathlessly reported the fragile mental state of a president on his way out of office, it was a national sensation. His and Carl Bernstein’s depiction of a drunk, unhinged Richard Nixon in 1976’s The Final Days shocked the country in an age of three television networks and zero social-media platforms. In Woodward’s new book, Peril, co-authored with fellow Washington Post reporter Robert Costa, it’s no surprise that Trump is depicted as off his rocker — that’s been reported in detail almost every day for years, and regularly demonstrated by the former president’s own statements and behavior.

He was focused on issues like his displeasure with the design of the U.S.S. Gerald R. Ford aircraft carrier. In particular, according to Peril, Trump found the placement of the flight command center on the carrier’s deck to be aesthetically displeasing and would rail against it to military officials.

There are new details in Peril on the games those around Trump played as they’d tried to manage him in the aftermath of the election, like how Secretary of State Mike Pompeo got on the phone with Milley one evening to express the need for the two to act in concert to protect the country. “We’ve got to stand shoulder to shoulder,” he told the general. “We’re the last of the Mohicans.” (The next day, Pompeo was smirking to reporters about a “smooth transition to a second Trump administration.”) Mitch McConnell reportedly went so far as to set up a back channel to communicate with Joe Biden after the election to avoid a direct phone call that would raise Trump’s ire.

Throughout, Trump was an object of scorn for many in his orbit. Woodward and Costa report that Milley thought that the president was experiencing mental decline, Attorney General William Barr compared him to a deranged character from Dr. Strangelove, and McConnell was fond of telling senators a story that ended with the punchline of former secretary of State Rex Tillerson calling Trump “a fucking moron.”

In 2018, an internet jokester tweeted a fake book excerpt about Trump’s alleged love for the Gorilla Channel, a makeshift television channel created by aides that only aired videos of apes fighting. Many people believed the excerpt and story were real. That Trump might be obsessed with watching gorillas fight didn’t seem that far-fetched compared to what was appearing on the front page of the New York Times or Washington Post most days.

Then again, the idea of a president egging on a mob to lay siege to the U.S. Capitol should have been as absurd as the idea of one spending 17 hours a day watching videos of gorillas slapping each other. It is what makes any behind-the-scenes look at Trump’s White House so ultimately unsatisfying. There are ample newly reported details in Woodward and Costa’s book, but the most shocking events during Trump’s last days in office didn’t happen in closed-door meetings or private conversations — they were broadcast live on cable television.

After all, it becomes hard to reveal that the emperor has no clothes when he’s spent half a decade tweeting that he’s naked.

This is yet another example of conventional wisdom that gets repeated forever even when recent evidence tells us it's no longer true. Here is household income at age 35-44 for Boomers, Gen X, and Millennials:

Millennials at age ~40 earn quite a bit more than Boomers did at age 40. This is median income adjusted for inflation, so it doesn't include zillionaires and it's real dollars.

But wait. Household income may have gone up because there are more two-earner families than in the past. That's true, so let's look at individual income:

Averaged together, Millennial income at age 40 is about 25% higher than Boomers at the same age, but the earnings of men have been basically flat while the earnings of women have gone up 75%. In other words, individual earnings of Millennials at age 40 are quite a bit higher than Boomers at age 40, but the distribution of those earnings is quite different.

There are technical details here about age distribution within the 35-44 band and a few other things, but nothing that makes more than a small difference. And you can always cherry pick the data to show anything you want. But if you just look at straightforward income figures, Millennials earn more than comparable Gen X and Boomer workers.

So what accounts for the ongoing myth of Millennials being worse off than Boomers? My guess is that lots of people simply refuse to acknowledge what's happened in recent years. In 2012 you could make a case that Millennials were indeed a lost generation, and it quickly became received wisdom that this was true. But starting in 2015 incomes began a powerful run, increasing by nearly a quarter before dropping a bit during the pandemic year of 2020.

In other words, the Great Recession hit Millennials hard, but it was a temporary hit and Millennials enjoyed strong income gains during the recovery. They are now the highest paid generation in American history, but only if you look at data going all the way to the present instead of just chopping things off at 2012 and never looking again.

But what you don't understand is that because I live the life I do the opinions of anybody else about the way I live my life don't matter.

Give all credit to Trump. If China is rolling back capitalism and expanding state control of the economy, this is not good for the Chinese economy.

Free market capitalism may have its problems, but it delivers the goods when it comes to economic growth. China moving even further toward a state-directed economy is almost certain to be a self-destructive move.

It's a funny thing. Back during Cold War 1.0 I felt that right-wingers who hyped the Soviet threat were showing that they didn't have the courage of their economic convictions. The US practiced free market capitalism while the Soviets ran a heavily state-directed socialism. If you really believed in capitalism, you would also have believed that the US would inevitably crush the Soviets and eventually put them into bankruptcy if they tried to keep up (or pretended to).

This is why, aside from the nuclear threat, I was never much worried about the Soviet Union's global ambitions. I did believe in capitalism, and the Soviet Union seemed like a country that would fall further and further behind us until its influence in the world was all but gone.

Now we're stumbling into Cold War 2.0, and China is certainly a bigger economic competitor than the old Soviets ever were. Nevertheless, I still believe in capitalism. China is far behind us economically, and if they're actively backing away from free markets they're unlikely to ever make up the gap.

And that's not all. I'm no China expert, but I've long thought that China is likely to reach a point this decade where they start to have real challenges from both demographic decline and a difficult transition away from a low-wage economy. If they also choose this decade to strangle their economy their problems will only multiply.

I'm all in favor of keeping a gimlet eye on China. Our plan of engaging with them in hopes that they'd become a better actor on the world stage obviously didn't work, and over the last few years it's become increasingly obvious that they consider us their #1 adversary. That said, it would be wise on our part not to overestimate their capabilities or to panic every time they launch a new aircraft carrier. If the Journal is right about their economic direction, we will simply outgrow them, just as we outgrew the Soviet Union.

If you want the median American to get a bigger share than the wealthiest 1% er, that will happen only if tax laws change. The laws won't change because every GOP Senator will be opposed to change and just one Senator can stymie passage of a new law. If every GOP Senator takes turns preventing passage, nothing can possibly change, even if every Democratic Senator wants change.

All three men driving to Trenton had a keen awareness of tyranny; all were refugees from Nazi Germany; all had found safe-haven on the pristine streets of suburban Princeton. After the Anschluss, Gödel was a stateless man, and though raised Protestant he was suspect by the Nazis and forced to emigrate. Gödel, with his wife, departed Vienna by the Trans-Siberian railroad, crossed from Japan to San Francisco, and then took the remainder of his sojourn by train to Princeton. His path had been arduous and he’d earned America, so when Gödel found a paradox at the heart of the Constitution, his desire to rectify it was born from patriotic duty. At the hearing, the judge asked Gödel how it felt to become a citizen of a nation where it was impossible for the government to fall into anti-democratic tyranny. But it could, Gödel told him, and “I can prove it.” Apocryphally, Einstein kicked the logician’s chair and ended that syllogism.

Debt ceiling fight pits corporate America against Republicans

The Business Roundtable, which represents the CEOs of some of the nation’s largest companies, separately sounded the alarm that a default would saddle the federal government and private companies with significantly higher borrowing costs.

“Failure to lift the U.S. federal debt limit to meet U.S. obligations would produce an otherwise avoidable crisis and pose unacceptable risk to the nation’s economic growth, job creation and financial markets,” Business Roundtable CEO Joshua Bolten and Walmart CEO Doug McMillon wrote in a letter to congressional leaders.

Republican opposition to raising the debt limit underscores the divide between GOP lawmakers and corporate America that has only grown in recent years. Company executives can still count on Republicans to deliver tax cuts, but their influence has waned on other hot-button issues like climate change, voting rights and immigration.

No House Republicans voted for the John Lewis Voting Rights Advancement Act after more than 150 large corporations employing 4 million U.S. workers urged them to support the bill. Corporate America also failed to generate GOP support for the Equality Act, a bill that would codify discrimination protections for LGBTQ individuals, and measures to provide a pathway to citizenship for undocumented immigrants.

“The Republican Party has become a populist party, thanks largely to Donald Trump but also because of the presence of what’s now the Republican base. And for that very reason, corporate America has much less influence than it used to have,” said Geoff Kabaservice, director of political studies at the Niskanen Center, a right-leaning think tank.

“I think they’re right to be nervous,” he added, referring to major corporations worried about the potential of a default.

While many Republicans, including McConnell, have said that nobody wants the U.S. to default on its debt, GOP lawmakers have also expressed confidence that Democrats will take the blame if it happens since they control Congress and the White House.

“If the Democrats don’t do their job, I guess it will be political blowback for them,” Sen. Rick Scott (R-Fla.), head of Senate Republicans’ campaign arm, said last week.

Business groups haven’t called out Republicans in the debt limit battle, instead urging both sides to come to an agreement. Corporations are wary of angering congressional Republicans, who have vowed to take revenge on companies that denounced state-level GOP voting laws and Republican attempts to overturn the 2020 election.

Even the Chamber of Commerce, which spends millions of dollars on ads backing Republicans’ reelection campaigns, drew backlash from GOP lawmakers like Sen. Tom Cotton (Ark.) after it endorsed several House Democrats in the 2020 election.

“Corporate America talked a big game about not donating to the campaigns of Republican politicians who voted to overturn the Electoral College result, and yet most of them in the end came around because they believe Republicans will be in the majority after the 2022 elections,” Kabaservice said. “On some level they think Republicans will still support their interests, whether it be tax cuts or deregulation.”

One of the sad constants of American political debate is that, anytime the tax rate on the rich is to be either raised or lowered, Republicans will repeat a certain statistic. To wit, “The Stat” is that the highest-earning one percent of taxpayers pay 40 percent of all income taxes. Conservatives consider this fact a dispositive justification either against any proposal to increase taxes on the rich, or in favor of any plan to reduce it.

Why are Republicans starting up yet another debt ceiling battle? If we breached the debt ceiling and had to cut back spending to match incoming revenue, it would mean literally shutting down every single function of government, both domestic and defense, and whacking a trillion dollars or so from Medicare and Social Security. But it never hurt the Republicans at the polls, so they're gonna do it.

If government won't set prices, prices are set by industry, not by government. If prices are rising, blame the corporations. In the past, WWII for example, the government told corporations that prices will not be rising. The government told the corporations that if they don't like the prices then don't sell the product. That system worked fine, but industry hates it because it cuts into their profits. Recently, in Texas, electric prices went from 5 cents per kilowatt-hour to $9 per kilowatt-hour because that is upper limit the government of Texas set during a natural gas shortage. That $9 didn't encourage more generation of electricity. What was happening is that Texas let corporations gouge their customers for as long as there was a shortage of electricity. The corporations didn't have to gouge, but they could gouge, so they did gouge for as long as the governor and supplies allowed them. That's how prices really work, 6ix, which is not the way you think it works.

Are Centrist Democrats in the Thrall of Right-Wing Economic Propaganda?

Surprising, at least to me, has been the self-destructive behavior of Democratic centrists — a term I prefer to “moderates,” because it’s hard to see what’s moderate about demanding that Biden abandon highly popular policies like taxing corporations and reducing drug prices. At this point it seems all too possible that a handful of recalcitrant Democrats will blow up the whole Biden agenda — and yes, it’s the centrists who are throwing a tantrum, while the party’s progressives are acting like adults.

So what’s motivating the sabotage squad? Part of the answer, I’d argue, is that they have internalized decades of right-wing economic propaganda, that their gut reaction to any proposal to improve Americans’ lives is that it must be unworkable and unaffordable.

Of course, this isn’t the whole story. We certainly shouldn’t underrate the influence of money: Both wealthy donors and Big Pharma have been nakedly throwing their weight around. Nor should we discount the importance of simple innumeracy: $3.5 trillion sounds like a lot of money, and you shouldn’t assume politicians understand (or think constituents understand) that this is proposed spending over the course of a decade, not a single year. It would amount to little more than 1 percent of gross domestic product over that period and would still leave overall government spending far below its level in other wealthy democracies. It also ignores the fact that the true cost, after net savings and new revenue, would be much less than $3.5 trillion.

And some politicians seem to suffer from the misguided notion that only spending on “hard” infrastructure, like roads and bridges, counts as investing in the nation’s future. That is, they haven’t caught up with the growing body of evidence for high economic returns to spending on people — especially spending that lifts children out of poverty.

Still, I often find myself surprised to hear politicians and pundits who don’t consider themselves part of movement conservatism peddling economic narratives that are nothing more than right-wing propaganda but have been repeated so many times that many people who should know better accept them as established fact.

I frequently hear, for example, that runaway spending and budget deficits caused the stagflation of the 1970s. In reality, federal debt shrank as a share of G.D.P. over the course of that decade (only to soar under President Ronald Reagan). To the extent that we understand ’70s stagflation, it seems to have been caused by a combination of oil shocks and feckless monetary policy. Big government had nothing to do with it.

I also sometimes hear even centrists giving Reagan’s tax cuts credit for turning the U.S. economy around. The truth is that most Americans did worse in the decades after the Reagan tax cuts than in the corresponding previous period; the post-Reagan boom, such as it was, was limited to a small number of wealthy people.

Finally, it’s amazing how many people believe that European economies with high social spending are severely damaged by reduced incentives to work. It’s true that during the 1980s and 1990s much of the Continent seemed to suffer from “Eurosclerosis” — persistent high unemployment, even during periods of economic expansion. But that was a long time ago. These days generous welfare states often have better labor market performance than the United States.

Take the example of Denmark, which Fox Business at one point compared to Venezuela. Indeed, if there were any truth to right-wing dogma, Denmark should be an economic hellhole. It has vastly higher social spending than we do; two-thirds of its workers are union members, and those unions are so powerful that they forced McDonald’s to pay its workers $22 an hour.

But the reality is that working-age Danes are more likely than their American counterparts to have jobs. It’s true that real G.D.P. per capita is slightly lower in Denmark, but that’s mainly because Denmark, unlike the U.S., isn’t a no-vacation nation; the Danes actually do take some time off from work.

The point is that as far as I can tell, those troublesome Democratic centrists are blinded by an economic narrative that was deliberately created to block progress and justify vast inequality. So they imagine that the Biden agenda — which is a fairly modest effort to address our nation’s very real problems — is somehow irresponsible and a threat to the nation’s future.

I would urge them to reconsider their premises. Biden’s proposed spending isn’t irresponsible and wouldn’t hurt growth. On the contrary, it would be deeply irresponsible not to invest in people as well as concrete, and if you look at the evidence, rather than repeating right-wing dogma, you realize that Biden’s agenda is actually pro-growth.
