Not sure about Canadian law, but that's kind of a big deal around here.

No Jack. She doesn't and opening someone else's mail is a big deal in Canada as well.

Also read the end of your piece about warning people at work that you won't be able to talk is maybe a good idea. I had to warn teachers when I had my jaws wired shut when I was in high school.

She sounds like such a bitch that she'd do it anyway. At least you got that.

I'm hoping the temps are cheap. I'm thinking if they're under 500 bucks then it's worth it, even if they're only good for 6 months. Above that though, I'm really going to have to consider eating my food through a straw and communicating like a monk for 6 months.

I barely said anything at school between 7th grade and Sophomore year. I'll just have to channel my early teenage years. :)

You have a point Jack and I don't trust her anyways.

Hope so. Been there with the straw bit. Not fun but you gotta do what you gotta do.

I wrote some when I had to talk but then I bored and tired of that so I kept trying to talk and succeeded too.

I doubt I'd be doing any talking, Brenda. If I do this it's because I have no teeth and I'd only be wearing the boxing mouth guard to have something in my mouth keeping my lips from flapping all over the place like this guy:

I don't think I'm going to be much in the mood for talking until I can get the permanents.

I was talking with my old man about it the other day and he said that I should go to the trick shop and get those wind up teeth you used to see in cartoons.

Sorry to hear about your Indian Summer. It looks like we're going to have a pretty nice one here, but I'm going to be sleeping right through it since I work every night. By the time I get off there won't be many days with the high in the 70's left and then it's just 60's and down from there.

Understood about the no talking Jack. And the mouthguard is a good idea when you do it.

Happens up here sometimes. It could still dry out and maybe for October. But I'm not sure. Will have to remember my umbrella for tomorrow.

I didn't have to kill myself at work tonight. I was really pleased with the state of things when I got back. One of the guys got fired by number 2 while I was gone, so I think that put a fire under the lazy people's asses.

Guess my new manager has been "sick" quite a few days since I was gone and they've been scrambling to cover for him. I don't get it. Maybe one of these days they'll wise up and make me an offer I can't refuse.

Until then, I let day shift manager know it was appreciated how good the place looked compared to my last 1st day, and I was able to straighten a lot of things up and make things more presentable instead of playing catch up.

Well, my landlady and her husband where just down here a bit ago and she has given me a verbal notice to leave. I have asked for a written one and for 3 months. I may get the written one but not sure about the three months.

Haven't got a clue as to what I will do.

Well, here in the states (or at least in LA) you can stall an eviction by calling code enforcement on the landlord. After all, what have you got to lose?

Good luck on the possibility of the new place Brenda, especially in light of this.

I know it's probably not what you want to hear, but as an outsider looking in I think this is the best thing for you in many ways. Your landlady is a miserable piece of work that is toxic to your life. Your living conditions are deplorable. By all rights, she should be jailed or at least heavily fined for that.

I know we don't really know each other, but you seem like a survivor to me. That being said, I know full well myself how you can continually put up with mounting crap and living with your new normal because of how scary it can be to make a change. I've done that several times in my life until I'd gotten to the point that I was broke or even in debt, and everything around me was just shit.

I believe that this is the catalyst you needed.

I know that you're probably scared right now. I'm not going to tell you that you shouldn't be, but I know that you're going to be alright.

I believe this. I believe you're a lot stronger than you think that you are.

You're going to look back on this one day and we can laugh about it. :)

On the one hand it is a relief that the hammer has dropped but you are right I am scared. I'm over 50years old and by myself.

Thanks Jack. I know I am strong as I survived a brush with death 30years ago. (brain tumour). I've lost my dad first, my mom, who I looked after through 2 bouts of cancer the second taking her. My Blair.

This is the longest I have been anywhere since looking after my mom.

Stopped on my way back to get my mail and my landlady was leaving and she said, "You are looking for housing right."

I answered yes.

And now starts the harassment that every time she sees me, she will ask me if I am moving and if I am looking for a place.

That is very tempting on my end but it will only end up in a shouting match which I don't have the energy for. She's done that three times now and with my birthday in a couple of weeks, I will be checking the mail more, so if she sees me.....

I'm sure it doesn't Brenda. I've felt that way before too, but what I've realized is that when I've gone to those dark places and had those thoughts I was just giving myself way more credit than I ever deserved.

The universe couldn't ever possibly hate me. I could die tomorrow and it would never even know that I existed. That's probably the most liberating realization I ever had in my life.

Sometimes we have good streaks. Sometimes we have bad streaks. I think in the end it all balances out though and "Luck" is what you make of it.

You've beat down far worse scenarios than this before.

Oh, I know that too. This mortal coil wouldn't miss me much.

And heaven knows I wouldn't give the universe that much satisfaction in thinking that it beat me.

That's just my frustration and being tired of the situation talking.

I mean being asked practically if I have to eat everyday, Thursday night before she verbally evicted me was just beyond the pale.

Then staring at my meds and saying that if I were to go into a care home I would be better off.

Been there/ done that too.

You're in a tough situation, but really it mostly revolves around your landlady who is a complete, I mean COMPLETE byatch and who is toxic to you every day; who seems to take a perverse pleasure in undermining you at every opportunity. I don't expect you to be pissed off because you have to DEAL with the situation and have to keep cool, but seriously ... I'm prolly pissed off enough for the both of us.

GOOD FOR YOU to demand it in writing!

She may just be shaking the tree to see if the apple (you) falls out. I suspect her snooping is to try to catch you in something she can use against you - and if not that, at least make the situation so hostile you'll leave.

Do you have low-cost legal help where you are? Are you familiar with the housing laws in your area? It seems to me something is keeping her from just tossing you out officially. Maybe there's protection in place that prevents her from doing that for anything but 'cause' - failure to pay rent, engaged in illegal activities, creating a health hazard by hoarding, or some such. Because it seems to me like she's going through a lot of effort to make you leave by 'choice'. So, I suggest you find out what your rights are. If you are going to leave, it shouldn't be under illegal circumstances. And if you have rights to keep you in place, it could take some of the pressure off you. I hope when you leave, it's under your terms.

In any case, finding a new place will for sure be a hassle. You may have to greatly expand your geographic range, keeping public transport availability in mind.

But certainly living as her target is a hostile situation that's got to be some detriment to your well-being.

We've already talked about going to the authorities about causing trouble for her. There is free legal advice around and so I am going to try that route again. And hope it works so I can get the pressure off of me.

I hope when you leave, it's under your terms.

In any case, finding a new place will for sure be a hassle. You may have to greatly expand your geographic range, keeping public transport availability in mind.

But certainly living as her target is a hostile situation that's got to be some detriment to your well-being.

Getting too stressed out could lead me to having seizures again and I will know who to blame.

If I can find the right legal avenue, I have a whole host of things about this place. So we shall see.

You know, I can't believe there isn't some minimum requirement, like providing access to heat, even if you have to pay for it. I hope you get a rep who gets so pissed off on your behalf, you get fired up, too. You have a reason to be fighting mad.

My understanding of tenancy laws up here is that landlords are suppose to provide heat. But people will try to get out of doing things. That's what this biatch's problem is.

I've got things lined up for all week, including medical stuff. So I hope I can shake something loose.

BRENDA I looked at the various BC tenancy laws, and from what I gather a landord can only end a tenancy FOR CAUSE. And even then they have to provide a 10-day (failure to pay rent), 1-month, 2-month, or 4-month WRITTEN notice. So GOOD ON YOU! for asking for a notice IN WRITING. You may have put them in a pickle by asking for notice in writing because they will (1) have to acknowledge that they were renting without a formal rental agreement and (2) come up with a proper cause for eviction.

And BTW, BC has FORMS that the landlord has to use; so I wonder if you will even see a proper written notice on the correct form.

Here are the various reasons why a tenant can be served notice

*****
Apparently, a landlord can serve a 10-day notice if you haven't paid your rent.

*****
A one-month notice if you (the tenant)
Quote:

-Caused extraordinary damage or put the landlord’s property at significant risk
-Is repeatedly late paying rent (at least three times)
-Damaged property beyond reasonable wear and tear and haven’t made repairs within a reasonable period
-Has broken a material term and, after receiving notice of the breach, has not complied with the tenancy agreement
-Seriously risked the health, safety or rights of the landlord or another occupant
-Knowingly gave false information about the rental unit or building to someone interested in renting a unit or buying the unit or building
-Significantly interfered with or unreasonably disturbed the landlord or other occupants
-Assigned or sublet the rental unit without the landlord’s consent
-Engaged in illegal activity that has adversely affected the quiet enjoyment, security, safety or physical well-being of the landlord or other occupants
-Was provided with a rental unit as a condition of their employment and the employment has ended
-Engaged in illegal activity that has caused or is likely to cause damage to the rental property, or engaged in illegal activity that has risked a lawful right or interest of the landlord or other occupant
-Hasn’t complied within 30 days of receiving an order from the Residential Tenancy Branch (RTB), or the date specified in the order, if greater than 30 days later
-Has an unreasonable number of occupants living in the unit

https://www2.gov.bc.ca/gov/content/housing-tenancy/residential-tenanci
es/ending-a-tenancy/landlord-notice/one-month-notice

*****
A landlord can serve a TWO month's notice if
Quote:

Landlord’s use of property applies when the landlord is going to:

-Move in or have a close family member live in the rental unit
-Sell the property and the new owner, or a close family member of the new owner, will live in the rental unit

If a rental property is sold, there are two ways a tenancy can be ended if, in good faith, the buyer plans to occupy the unit or use the property for another purpose:

-The buyer makes a written request to the seller to end the tenancy before they take possession of the property (this cannot be a condition of sale) – the existing landlord then must give their tenant a Two Month Notice to End Tenancy for Landlord’s Use of Property.
-Once the buyer takes possession of the property, they can serve a Two Month Notice to End Tenancy for Landlord’s Use of Property

Unless a landlord (seller or buyer) serves a proper notice to end tenancy, the tenancy continues under the terms of the original tenancy agreement.

https://www2.gov.bc.ca/gov/content/housing-tenancy/residential-tenanci
es/ending-a-tenancy/landlord-notice/two-month-notice

*****
There is a new FOUR month notice for property renovation.

*****

Nowhere did I see that a landlord can evict a tenant for no reason at all/just because. So IMHO unless you get a proper notice you can use that time to look for a new place without worry.

But definitely get some free legal advice because your situation, while I'm sure is not unique, doesn't fit into the standard rental situation. These laws are for people who rent with a signed contract. I'm not sure how the housing authorities would look on an informal rental. Would they assume that after a long period of time that this was, in fact, a rental covered by law?

Do you have receipts or at least cashed checks to demonstrate that you were paying rent? Or was this cash only?

OH BY THE WAY ... THE RIGHT TO QUIET ENJOYMENT

Quote:

Quiet Enjoyment

As part of the tenancy agreement, tenants have a right to peace, quiet and privacy in their homes – a right that comes from the common law principle of quiet enjoyment. That means every tenant has the right to:

Reasonable privacy
Freedom from unreasonable disturbance
Exclusive possession of the rental unit, subject only to the landlord's right to enter the rental unit in accordance with the laws
Use of common areas (like hallways, yards or laundry facilities) for reasonable and lawful purposes, free from significant interference

Quiet enjoyment may also include the tenant’s right to have guests, cook foods of their choice, play music at a reasonable level during acceptable hours, practice their religion, and have the use of all the services and facilities described in the tenancy agreement, maintained in good repair.

Well, it looks like summer is finally releasing its hold on SoCal ... yaaay!!! June was ridiculously hot, and most days were hotter than average AND unusually humid for the area. The mites just went to town on the avocados, tomatoes, and eggplant, and while I was able to restore the avocados back to health I never did find the magic trick for the veggies. I looked back on my very first post in this thread, and I'd say this summer was about the same.

The difference is that this year, the backyard has a lovely xeriscaped area. When people walk into the back yard they usually pause and say something like ... "it's like a park".

But, oh, the front yard! I'm still working on that! Our soil here is very find sand. When the front yard its in full bloom with pink and gold and orange and cerise CA poppies and pink and purple and white cosmos, it's a thing of beauty. But come summer, it turns into a sand-pit because even tho I planted an oak tree,

red CA buckwheat ,

a sugarbush (rhus ovata)

several shiny-leaved mahonias

and some narrowleafed CA fuchsia

plus a giant ceanothus

I haven't planted enough perennials to fill in the yard. It takes a lot more! So now that the weather's beginning to cool, and new plants have a prayer of surviving, I just planted a half-dozen rock purlsane

pheasant's tail grass

and San Bruno manzanita (groundcover)

What I'm aiming for is a beachside effect transitioning to trees/shrubs near the house (for shade). Most beachside plants are low because they're constantly being swept by the wind, so most of my plants near the curb (succulents, beachside daisies) are about 1 foot tall, and gradually rise in height (grasses, fuchsia) until you get to the house.

That's the plan, anyway. I'll get to see if I'm a successful designer or not.

No, Jack. I was trying to get something else done and that agency called the city to see if there was any paperwork on this place and there wasn't. City sent someone around and she had to cop that she had an illegal suite. City fined her and then she came down on me.

I know I will. Someone said they will do something when I move out. I don't care. I just want out.

Hey Sig,

I did sign such an agreement with her sister when I was renting off of her. But she decided to break it. It was month to month but still.

Am going to see about some free legal advice tomorrow after I do something else.

I haven't done anything to this place. It is falling apart on its own.

I started looking for a thread about rain, so guess what I found.

A thread with exactly 1000 posts.

Seems a downpour tonight. Wasn't paying any attention at work, so it was a surprise. Newly surfaced parking lot doesn't drain worth a poo. Almost flooded out my engine in the parking lot - twice. And then also 8 more times on the 4 streets I took getting home.

Anyway, I did learn something tonight, about the morons of our Government. Apparently my phone service provider allows some entity to not only put text alerts about weather on my phone ('cause when I'm mobile - and outside - I won't be able to notice if is raining), but also to keep the display lit up while you're not using the phone, until you pick up the phone later and find all of your battery power drained. This is an excellent plan for when you get stuck in flooding waters and find you have no battery power to call for help - like an EMERGENCY type situation, and these fvucktards have robbed you of your emergency resource, so you can die. These are genius-level azzholes.
Somebody should just shoot these people. Where's a psychotropic victim when you need one?
